good afternoon, everybody. first at 4:00 today, a buoy state university student is suing his fraternity claiming he was beaten and bruised during a hazeing incident. >> we have the details about the $3 million lawsuit. >> reporter: i'm darnelly spence are where a student has filed a $3 million civil lawsuit. he claims that he was hazed while joining a fraternity on campus there last year. now, monday allegations in this lawsuits as the student was allegedly beaten he was body slammed. he also said he was spanked with a wooden paddle and that these incidents happened night after night after night. his attorney says the abuse continued even after his mother came to the university to complain about the abuse. >> he was body slammed. he was punched.

he was beaten with a paddle. he was slapped. he was beaten with the hands on a nightly basis from five to eight hours a night. >> reporter: coming up at 5:00 you'll hear from the student who filed this lawsuit. he'll describe the abuse that he says he endured and why he did not quit the fraternity. in upper marlboro darcy spencer, news 4. >> bowie state says it has a strengthen hazing policy. this statement reads in part -- bowie state university is aware of the lawsuit filed today alleging an incidence of hazing by a fraternity on campus. we understand that the university is not named as a party in the suit and we are not able to comment about any allegations cited in the suit. breaking news right now in the district. d.c. police are investigating a shooting near the intersection of nanny hell is not borough's avenue and division avenue in northeast. all police are saying right now is a man is in grave condition. we have a crew there and will

bring you an update as soon as it comes? we have learned new information about a deadly accident on the beltway. a tow truck driver is dead after being hit on the outer loop. you heard us break this news on the twitter account, on her account this morning. it happened around 10:00 near route 7. he was standing on the shoulder near an unattended vehicle and was hit by a box truck. the driver of the truck was not injure but has been charged with req his driving and was cited with using his cell phone behind the wheel. traffic was diverted for several hours, but is now back to normal. new information about the murder of a cheer leading coach and teacher, lily morris' body was found on her front lawn in frederick county maryland last week. police took her granddaughter into custody after finding blood on her armies. harris told police she saw a masked man running from the house, according to just released court documents, but

police say her story doesn't add up. harris said she got blood on herself while kneeling next to morris' body on the lawn but witnesses told police they never saw her leave the house. harris is being held without bond today and is facing murder charges. trash haulers are now in the fourth day of their strike. the two counties of scrambling to make sure that trash is collected anyway but the timing of the strike is creating more challenges. >> reporter: this is chris gordon at the shady grove processing facilities and transfer station in duralwood, maryland. this is where trucks come to dump trash and recycled materials after they leave your neighborhood. >> what do we want? [ chanting ] >> they demonstrated in laurel maryland this morning. they've been on strike since last friday. the union says that negotiations over their first contract have stalled. meanwhile, replacement workers on the unity trucks making

minutes. that v.j. thank you. now to the latest inniece authorities just asked the u.s. for help after a full-day search failed to turn up anything conclusive. wendy rieger has the latest. >> the state department says it's just received that request for help. u.s. officials are reviewing it. right now we know that flight was supposed to be a two-hour jog across the java sea. the pilot asked for permission to climb above some bad weather, but the air traffic controlleders had to say no because the airspace was too crowded at the time. airasia flight 8501 gone from the radar. today the head of indonesian search and rescue agency said the plane is probably in his words at the bottom of the sea. at least seven aircraft 15 ships, and 4 helicopters will resume their search at daybreak. this incident caps an exceedingly tragic year for air

travel in southeast asia. malaysian airlines flight 370 disappears in march with 239 people on board, still hasn't been found. in july malaysian airlines flight 17 was shot down over ukraine, killing 300 people. now airasia, which is also based in malaysia. back to you. new details in a deadly double shooting in the district. police ideyied the victims as a father and son. they found preston johnson sr. and his son preston johnson jr. during their routine patrol last night. both hug shot a short distance from united medical center. in just a few moments police will provide an up date on their investigation. we'll have more on news 4 at 5:00. right now first at 4:00 the washington monument is open again. the national park service had to shut it down for a short time because of a leak above the screening area. that affected the x-ray machine

and could have compromised security. it's still not clear where the leak generated. two weeks ago an elevator outage forced crews to close the monument for an entire day. first at 4:00 police want been to be careful when you answer the phone. montgomery county police tell us there's been a rise in phone scams within the past week. officers say someo has randomly dialing numbers, saying that a family member or friend of yours is in jail in an accident even kidnapped. the scammer then asks you to send money via a wire transfer or prepaid card. if you get a call like this don't give away any of your personal information, just ask if you can call them back. a presidential mix-up the mistake that had president obama apologizing to a couple of newlyweds. not so fast a flight full of american passengers forced to turn around. the scary moments that have so many people holding their breath. a young life cut short. the tragedy on the thank you cable.

we are learning more about a teen killed in a violent crash over the weekend. 17-year-old steve carbahal was a senior at lee high school riding in the passenger seat when the car he was riding in swerved to miss a deer in fran konya early sunday. the car slid and hit a telephone pole. he died at the hospital. derrick ward spoke with the teen's family and neighbors about the crash. we'll have a live report on news 4 at 5:00. flights are back in service at england's gatwick airport. the virgin atlantic flight was on its way to las vegas at the time when it got over the ocean it a problem with the landon gear. the pilot circled for several hours before going back to the

airport. emergency crews were standing by. everyone on board was able to get out withg hurt. the ordeal delayed several flights in and out of gatwick airport. a lot of your families and friends are liking this story. mo than $70,000 has been donated for a window washer who fell down 11 stories last month. pedro perez hit a moving car when he fell off a bank building in downtown san francisco. he fractured his pelvic broke an arm, ruptured an artery and sustained severe brain trauma. perez has since been moved out of the hospital and into a rehabilitation facility. his family remains hopeful that he will walk again one day. the tv weatherman who was shot two weeks ago is out of the hospital. patrick crawford is the morning meteorologist at the ne waco texas. he was walking to his car after work december 17th when a gunman shot him three times. crawford says he doesn't know

tempers flared outside the police station in texas city texas, two days after a man was shot and killed by police. supporters of the officer clashed with community activists over the shooting of carlton wayne smith. last week officers shot him five times after he was seen firing a gun into a crowd outside a club. demonstrators are demanding the nightclub release video surveillance to the public. they're also asking for a grand jury probe. new evidence today of the high tensions between the new york city mayor and the nypd following those two murders of police officers. >> nbc's chris po lone shows us how the mayor's greeted at a

. new developments at this hour on the deadly fire near greece. the number dead is up to ten. >> more than 400 are safe. the rescue took more than 24 hours keir simmons reports. >> reporter: a terrifying rescues operation, a ferry on fire hundreds of passengers on the top deck. they are airlifted one by one while two jets of water are visible pouring from another ship to control the flames beneath those still treaded 148 people were reportedly still on board. some were winched to safety in groups. here a mother and two children

and apparently very young child in her arm wrapped in blue. she miles. we're okay. the ferry was headed from greece to italy. most of the 478 on board were greek. it's thought the fire broke out on the car deck before spreading. here a burst of flames. one person has died jumping from the ship. now cold is causen hypothermia. 329 are safe. some left from a container ship this morning it would reached the ferry to help before rough seas high winds and the intense fire made rescue by sea impossible. there wa no alarm, nothing, this man says everything was blocked. it was freezing cold. no help. the ferry had passed a technical inspection according to its owners but one passenger cad his wife from on board and told her they had been left to burn. meanwhile, the weather continues to see rough seas rain even
