northbound and south bond also looking quite good. more on this new accident on 270 coming up. we have a few school dras sdelays to pass along. >> if you live in spotsylvania county two hour delay. fredericksburg city schools also starting two hours late. and king george county schools are delayed two hours, as well. later this morning, we expect to learn more about a lawsuit being filed in connection with monday's metro accident on the yellow line. a d.c. firm has been hired by several victim one of them is expected to be at today's announcement. megan mcgrath is live with more on this this morning. >> reporter: one person died and more than 80 people went to the hospital. and in recent day, we've heard some pretty chilling accounts of what it was like for people on board that smoke filled train. now we're learning of the very first lawsuit being filed against metro. a group of victims have hired the firm of cohen and cohen, the

same firm that represented some of the victims in the deadly 2009 metro crash. a press conference is scheduled for later on today. we're expecting to hear from a man who was on board in athat train. we'll also learn more about the lawsuit itself. the lawsuit will be filed officially in court on friday. reporting live from the plan fant plaza metro station, megan mcgrath, news 4. and one of the passengers on board that smoke filled train showed how long it took for help to arrive. jonathan rogers says he took this picture a few minutes after the smoke started entering the train. his iphone time tamped the photo at 3:20. rogers says this photo was taken when evacuations began at 4:01. and at 4:20 an hour after his first photo, rogers took a photo of the first firefighter that he saw and then finally about ten minutes later, you see rogers is in that tunnel and walk to go safety. bob mcdonnell has a second

appeal in court over the ruling that he must report to prison next month. he appealed his two year sentence earlier this week. we told you a judge denied his request to say out of prison while he tried to get his sentence reduced. mcdonnell was convicted of corruption for taking more than $150,000 in gifts in exchange for political influence. tomorrow a man will be in court accused of planning an attack on the capitol. the fbi charged christopher lee cornell with trying to kill federal employee after he bought two assault style rifles in ohio. they say he planned to set off pipe bombs in the capitol and shoot people as they ran outside. if you work on the hill, the fbi says you were never in any danger because they were monitoring cornell for months. the pope will be in philadelphia this september and we've learned that he could also be coming to d.c.. tom sherwood says plans are under way for pope francis to address congress. he would also host an event at the basilica of the national shrine of the immaculate

applications to the university of virginia are declining. the number of applications, that is. is this the fir time the univer has seen a drop in numbers since 2002. the university just received more than 31,000 applications during the current admissions cycle, down a few hundred from the previous cycle. of course the numbers come just a few months after the rolling" armticle describing a brutal rape. governor mcauliffe proposed a statewide sexual misconduct policy for public universities. he also talked about funding for schools. that is why my budget

a developing story in france. police arrested two people after they drove a car into a police woman guarding the french presidential palace. the car was going the wrong way on a one way street. france is on high alert after violence that left almost two dozen dead. police say last night's incident is not connected to those attacks. france is getting more involved in the international fight against terrorism. the president there is sending an aircraft carrier in the middle east to join american trips fighting isis. france is are already carrying out air strikes. meanwhile the justice ministry has ordered a crackdown on hate speech. 54 people have been arrested

since last week's attack for anti-semitism and glorifying tim. one week after that shooting massacre at "charlie hebdo," it is releasing a new issue. the cover shows an image of the prophet muhammad. muslim communities have could not condemned it. al qaeda has claimed responsibility for the attacks at the magazine. meanwhile some in congress are criticizing the move to release five more men from pr yemen being held at guantanamo bay. lawmakers are questioning the timing of the release considering the new threat there al qaeda in that region. the five prisoners were captured in pakistan. they had been in guantanamo for 13 years. the men thousand will resettle in estonia and oman. the fire marshal is he it was an accident when a jewelry store exploded.

on the same day in 1982 of smoke inhalation. the families of two young women killed when a csx train derailed have reached a settlement with the company. according to the baltimore sun, that settlement was reached in november. two 19-year-old college students were buried by coal when the train derailed in the summer of 2012. rose and elizabeth were sitting on a railroad bridge when 21 cars went off the rail. a fractured rail caused the crash. the amou in the settlement is confidential. this morning we're working to learn more about two people who were shot in the district. one man was killed and a team age girl was hurt in that shooting last night. this happened at mlk jr. avenue and randle street southeast. it happened near a metrobus, so police are looking through the bus' surveillance video to see if it caught anything. after the shooting, a large crowd started gathering with officers. police were able tocalm everyone

16 before the hour. terror concerns here at home. right now a man from ohio is in jail because the fbi says he was planning to attack the u.s. capitol. tracie potts joining us live now from capitol hill with more on this story. tracie good morning. >> reporter: what led them arrest christopher lee cornell turns out it was his tweeting with an undercover person working with the fbi. he was tweeting about isis, pro isis messages, they had been following him for about a year.
