police are also investigating whether the shooting was gang related. 23red rick high school has two more basketball games tonight and right now those games will still go on as scheduled. students at west frederick middle school also go back to today. defense lawyers for jesse matthew will ask that his trial be accused. he's accused in a 2005 sex assault and also abduction of hannah graham. lawyers are expected to ask that the trial be delayeded until the summer. police say an incident happened last weekend at uva and was reported yesterday. police say the alleged attack happened inside a dorm on campus. this comes as state lawmakers are considering legislation to mandate the reporting of campus sex assaults. last late-year, "rolling stone" published an article about a sex assault that was later

retracted. a d.c. elementary teacher won't be in class today after being arrested for sexual assault. 33-year-old leroy damian ware teaches at miner elementary. he was arrested misdemeanor sex abuse of a child. we're working to find out whether the child is a student at miner. a woman is on life support after being tased by deputies at the fair taxfax county detention center. he was preparing to be transferred but she resisted the deputies instructions. they used a taser gun to control her. she suffered a significant medical emergency. a developing story right now, health officials in new jersey are looking into the first suspected case of measles in that state. it involves a 1-year-old baby in jersey city who has not yet been vaccinated. in the meantime, health

officials in chicago have not yet identified the source of a measles infection at a daycare center. 5 infants were diagnosed with measles, ten more children exposed. there have been more than 100 other measles cases reported this year including one in d.c.. most of the cases are related to an outbreak at disneyland. a little bit of extra shut eye could cost big bucks for fairfax county. megan mcgrath has a break down of some of the numbers p. >> reporter: it's a $2.6 billion budget. and it funds things like later start times for high schools and pay increases. however, the chairman of the fairfax county school board says that the budget does not fund all of the school system's needs. now, since 2008 21 another positions have been cut, and there has been $435 million in

spending cuts. the board chairman says this manner of b is not sustainable and eventually will affects the quality of education for our students. taking a closer look at the budget it funds full day mondays in lamtelementary schools and later start times for high schools. there a 1% market scale adjustment for all employees and step increase for eligible employees. it also includes a request for an additional $70 million from the board of supervisors. the budget has been approved by the school board, but it still needs to be approved by the county. megan mcgrath, news 4. fairfax county is not the only one setting its budget. the priorities being laid out by alexandria public schools coming up at 6:30. it is one of those stories that will stun you and then make you angry. a family behind bars after trying to teach a 6-year-old boy a lesson about being too nice to

6:15 now. today the driver of an suv that was hit by a commuter train will be laid to rest. services for 49-year-old ellen brody will be held in westchester county just north of new york city. witnesses say brody drove on to the tracks on tuesday after her car was hit by a crossing gate in the new york city suburb. the collision with the train sparked a major fire five people on the train were also killed. and this morning the ntsb's investigators are learning more about what was happening in the momecrash. black boxes say everything was operating normally and the train was traveling below its 60-mile-an-hour speed limit. investigators also talked to the

train engineer steven smalls. they say he did hit the train's emergency brake, but it takes about 30 seconds to stop the train once that happens. right now they are still trying to figure out why brody's car wound up on those tracks. d.c. emergency workers say there is still major concerns about radio communication after metro's underground emergency. >> you asked me should you be concerned in going down in the tunnel. and using a radio. i'm going to tell you this. you'll do better using your cell phone. that is kenneth lyons head of the union that represents d.c. fire and ems workers. he told d.c. council members yesterday that radios still aren't working well in metro tunnels. the hearing focused on the radio issues connected to last month's smoke incident which left one woman dead and 80 others hurt. i'm molette green at the live desk. just two minutes after takeoff, both engines lost power, key moments before the crash laid out this morning at a news conference in taiwan.

a flight data recorder shows the plane's right engine triggered an alarm 37 seconds after takeoff and it event with idletit went idle. the pilot then shut down the other engine to attempt restarting both. they are still looking into why the engines failed. eight people still unaccounted for after wednesday's crash. 35 are dead. some victims' families have receive received compensation. back to you. it's now 6:17. a woman hit by a car on the bw parkway this past weekend is talking from her hospital bed about a 911 call that has so many people upset. jill pearce and rick warrick were changing a flat tire when they were hit by a car. warrick was killed. his teenage daughter was in the back seat and called 911 for help. anne arundel county dispatcher told the teen to, quote, stop whining so he could get their location. pierce significant said the it is patcher's comments just matt the situation worse. she was also upset that no good

police say the boy's mother his grand mother his aunt and a 23-year-old man planned the fake kidnapping to teach him a lesson. they thought the boy was too nice to people. police say the man lured the little boy into his pickup truck on monday after school he tied the boy up covered his head with a jacket and told him he'd never see his family again. >> in 11 years i've been in law enforcement, i've never seen anything like that, when it is okay to terrorize a child, to they will them that they would die. >> just unimaginable. police say the little boy told his teacher about the entire ordeal. that child is now staying with another relative. jayson werth will spend his final weekend in jail on reckless driving charges. werth will report today for his final three days. last july he was stopped after going 105 miles per hour on the beltway. werth is being allowed to serve jail time on the weekends so he

can continue to rehab his shoulder from surgery. brace yourself, a 5% hike in tuition may become a reality at the university of maryland. larry hoe xwrangan says unless there is more federal help there is no other choice. the university currently has a $47 million budget hole. a firing freeze will continue there and it seems layoffs may be likely too. key initiatives could also be scaled back. you will not be able to enjoy the reflecting pool this weekend at the national mall as it will be empty. the park service started to drain it yesterday for annual cleaning and maintenance. the work will take between 30 and 60 days. it just gives you an idea of how much water is in there. they have to drain it, clean up all the stuff that is left over and l it. >> wonder if could have frozen it was so cold overnight. right now we're at 19 degrees outside our studios. you need all the scarf, the whole nine yards. >> earlier we said like a

murders of two others. severance is currently receiving a mental evaluation to see if he's competent to stand trial. jordan says air strikes are just the beginning. a video this week showed isis burning their pilot alive. air strikes were carried out yesterday. jordan says it won't stop attacking until isis is destroyed. here at home president obama is preparing to ask congress for authorization to continue targeting isis. he wants to step up air strikes in iraq and syria. right now there is no request for boots on the ground. tracie potts is live on capitol hill with how some in congress say troops deploying is inevitable. >> reporter: good morning. and those who think that we're eventually going to have combat troops on the ground there want the president to prepare the public for that the public in polls that we've done has been very reluctant to get involved in another long term conflict.

welcome back. a developing story right now. health officials in new jersey are looking in in to the first suspected case of measles in the state. it involves a 1-year-old baby in jersey city who has not yet been vaccinated. p we're told the baby has since recovered. the incubation period for possible exposure in this case ends tomorrow. this comes after at least five babies at a chicago area daycare have been diagnosed with measles. haley jackson joins us live with more on the situation there. >> reporter: good morning. and interesting here because the five children at this daycare also under 12 months also too young for the vaccine. just like that case in new jersey. two of the children here have had lab testing to confirm the diagnosis. the other three have apepidemiological link it's believed that they do have the

disease. it's incredibly contagious which is why health officials are warning this cluster could get worse before it gets better. as many as ten other children may have been exposed to the virus. they're being asked to stay home to stay away from people for the next three weeks during this exposure or this encould you baseincubation period. coming up on the "today" show, we'll have more information and advice about what to do about your own daycare. >> haley jackson, thank you. we know a lot of parents are worried about the situation. the full report will be on the "today" show. today defense lawyers for jesse matthew will ask that his trial in fairfax county be delayed. matthew is accused in a 2005 sex assault. he's also charged with abducting university of virginia student than made graham. the hannah graham. today lawyers are expected to ask th trial be delayed until the summer so they can have more time to prepare.

and class leaders have taken to social media. they're urging their classmates to wear black and gold today. the school colors. they're also asking people to turn out in large numbers to the varsity basketball game tonight. two frederick county school students were shot outside the gym during a jv basketball game on wednesday night here at frederick high. police are looking into reports from students that a group of four or five males dressed in big coats with their hands in their pockets walked into the gym during the game and walked out shortly before the shots were fired. police are also looking at a range of possible motives including gang violence or the possibility that this stems from some sort of rivalry between the two schools playing during the game. at this point, though police have not identified any suspects. and no arrests have been made. reporting live from frederick high school megan mcgrath, news 4. 6:48 right now. a d.c. elementary schoolteacher
