two children. >> reporter: this man heard that shot and called 911 for help. >> we were working close, and we heard a bang and called the police and they came and told us to evacuate. >> reporter: cops with long guns at the ready. large armored vehicles moved into position. for some time today a portion of brookville road in silver spring looked like a war zone. the scene of the standoff a gigantic mountain of mulch at a landscape company. witnesses say that an employee here came to work and that hs ang and that he aked on it. >> this who was an employ of the business arrived to work seemed upset and agitated. at one point, he left the business went to his vehicle, and retrieved a shotgun. he pointed it at one employee and then shot a round into into a mulch pile nearby. >> reporter: the standoff between that man and the cops went on and on. it went on for nearly four

hours. they say police made attempts to talk to the man. but in the end, they say he turned that gun on himself. the man who died here was a mechanic for the landscape company. a few minutes ago i talked to a woman who saw him just about every day. her reaction to what happened here coming up at 6:00. live in montgomery county, pat . federal investigators are back at the site where a small plane crashed near takeoff at tipton airport sunday. it went down shortly after takeoff landing on its roof just a few hundred yards from the airport. barnett and his passenger, thomas kline, were hurt. barnett is chief of transportation and community programs in charles county. download the nbc washington app and we'll let you know as soon the faa determines what went wrong. the number two official at the secret service is losing his

job, but he's taking another position with homeland security. a.t. smith stepped down as deputy director of the secret service today. some members of congress had previously been critical of the fact that he had not resigned in the wake of the recent white house security breaches. no confirmation yet on who is going to be replacing him. smith will take an unspecified job with homeland security. closing arguments are going to begin tomorrow in that whistle-blower case against the d.c. police. it led to chief cathy lanier being called to the witness stand for a second day. >> you'll recall this case involves police escorts for actor charlie sheen and other celebrities and whether a high-ranking officer was demoted for talking about it. news4's kristin wright joins us live from d.c. superior court with details of the chief's testimony today. kristin? >> reporter: chief lanier spent the entire day on the stand. at issue right now is whether lanier demoted a commander for his performance or because he blew the whistle.

d.c. police chief cathy lanier back on the stand for a second day. today lanier testified for several hours in the whistle-blower case filed by a former commander of the department. captain hillard burton said he was demoted in retaliation after he contradicted chief lanier in testimony he gave to district counsel concerning the use of police escorts for celebrities. in court today chief lanier maintained that burton was demoted for several other reasons including the handling of a barricade situation in 2011 and pushback against a supervisor. in cross-examination, burton's attorney questioned lanier on an interdepartment memo written the day after actor charlie sheen tweeted about his escort. the memo asks for a police department policy on celebrity escorts. closing arguments begin tomorrow morning. live at superior court, kristin wright news4. one of the best cancer treatment facilities in the world is going to be coming to

forging documents that are related to a sex he allegedly had with a 17-year-old employee at hiss law office. he got a plea deal in that case for which he's serving a six-month sentence. he's been going to legislative sessions during the day on work release. his trial on these new charges is set to start at the end of april. in just a matter of weeks we could have legal marijuana in the nation's capital. it is shaping up to be quite a showdown between the d.c. government and congress. news4's tom sherwood has more on how the city is moving ahead with its p. >> reporter: the d.c. council chairs sat nearly an hour after a hearing was spoeed to start on how the city will regulate and tax marijuana. that's when and now if it becomes legal la mon after a routine 30-day congressional review. a last-minute letter from d.c. attorney general carl racine warned the hearing might violate congressional laws barring any

action by the city on the marijuana measure. the council went ahead with the hearing but just legally didn't call it that. >> the district will explore every option to get its law legalizing marijuana enforced. >> reporter: it's all part of a showdown with the republican-led congress. congre passed a measure last year saying this city couldn't enact its legal marijuana bill. but the city contends the voters had already enacted it and the city is just carrying out the law unless congress takes new action to block it. >> i do think that self-governance is intrinsic to the american way of life and here in district of columbia we dot enjoy the full rights that the other 50 states in the country enjoy. >> reporter: d.c. council chairman phil mendson warned it could result in an odd situation, legal marijuana with no enforcement from the city because it would have to spend money. >> the apph that congress took to limit our ability to spend money creates a real

cutting millions in state aid too education. montgomery county schools has been polling parents on their website. >> got about 1,200 e-mails and about a third of those people were not in favor of changing bell times and about two-thirds were in favor of them. our staff overall through surveys done by our employees association are not in favor of changing bell times. >> reporter: now, the montgomery coun board of education will hold a public hearing tomorrow morning followed by a vote. now coming up on news4 at 6:00 we will hear what montgomery county's 12,000 teachers have to say about a later start to the school day. we'll hear what they have to say as soon as you can hear anything over all this shouting here at the school board. that's the latest live in montgome ne >> we got the message. a local art museum facing nearly a half million dollars in taxes. that has forced montgomery county to change the way it deals with new cultural institutions. the county last week changed the law after a private art museum

was charged the hefty bill. "the washington po" reports the revised law reduces the burden on art institutions such glenstone museum currently under construction. after the change the building's owner was responsible for $72,000. a lot of drivers have figured out the way to park at the metro parking lots and not pay for it. the transit agency says people are parking for a full day and they wait till just after midnight when the gates open and they drive away without paying. metro says this is such a problem that it may extend the hours at night so kit keep those gates down even longer. a suspected drunk drive who caught fire during his arrest has just been charged tonight. this happened down in the richmond area. the drivel condition according to police. his clothes apparently went up in flames when police used a taser on him early saturday. he allegedly led police on a chase in chesterfield virginia. firefighters had to save him after he crashed his car.

prince georg the district down through charles county too, all seeing that rain right along 301. this is all rain right now. back towards the west you notice the rain in through frederick county virginia towards clark county loudoun county seeing that rain up towards the panhandle of west virginia and down towards front royal. also seeing almost all rain. the only exception some of the higher elevations here. that's where we could see some of the freezing rain. around mt. airy though notice this area of pink. most likely sleet beginning to make its way down to the south as the cold air moves on in here. so howard county right now seeing a mixture of rain and sleet. that cold air is making its way down from the north. you can see, watch here looks like rain and look at the snow start to develop down to the south as te colder air starts to move south. that cold air will be here throughout the night tonight and we'll only get colder. that's why we have that winter weather ad in effect h tomorrow morning. now, for most of the area to the west of i-95 this is until 3:00 a.m. so panhandle of west virginia western loudoun, western montgomery coun and frederick county but areas east of i-95 including howard county

i'm pat lawson muse at the live desk. we've learned at the past hour the white house will formally ask for permission to use military force against isis. congressional aides say the president is working on language for the request and they expect it to make it to capitoll by wednesday. the current air campaign against isis was launched back in august. at the time president oba said he didn't need congressional approval to build the coalition and to launch the attacks based on precedent set by former president george w. bush. aides say lawmakers are hoping this request clarifies the u.s. strategy in the fight against isis, especially isyri it could take weeks or months for lawmakers to approve authorization with use of ground troops expected to be a major sticking point. at the live desk i'm pat lawson muse. back to you. major oscar buzz won't impact the decisions made in a high-profile murder case.

tonight a lot of people in arlington are dealing with damage and loss because there was a rash of break-ins in vehicles. >> the most recent cases are from ear saturday and sunday mornings. >> northern virginia bureay is outside one of the places that was targeted by these crooks. jules? >> reporter: well, this is one of the two parking garages in the rockland area that's been hit so far this month. both residential and public parking garage so today residents are getting notices frting them to what hpe over the weekend. arlington police say around 2:30 saturday morning at least 14 vehicles were broken into in this garage at the corner of clarendon boulevard and pier street. then early sunday morning about five cars in a nearby neighborhood had their passenger windows smashed out. at the beginning of the month in this parking garage on lind street some 17 vehicles were damaged. >> the other similarity is the

and he didn't know if she would wake up. a restaurant in woodbridge is getting an unexpected makeover for its dining room. a taxicab smashed into the hard times cafe here yesterday, take a look. no customers were inside at the time. hard times posted a picture on their facebook page saying drive-throughs are for fast food. the restaurant is still open. most of the dining room is closed while repairs are being made. higher than expected revenues in virginia means there will be pay raises for teachers and other employees. state lawmakers in richmond released their budget proposals on sunday. this proposed wage hike will be ranging from 1.5% to 3% and it would go to school teachers state police and college faculty across the commonwealth. la virginia are also set to vote on a bill that involves cannabis oil for medical use. it's a bill that would make cannabis oil more accessible. news4 brought you the emotional story of a teenager who's from fair and accurate who suffering from daily seizures.

jennifer collins' family has been lobbying for this cannabis bill. if passed the virginia senate -- or did pass the virginia senate and vote in the house is expected later today. doctors in maryland are making a preemptive strike tonight against the measles outb urning all parents to vaccinate their kids in the baltimore area. now, the city hasn't seen any measles infections in the past decade. nationally there have been 121 cases of measles confirmed since the beginning of the year. only one in our area in d.c. a majority of the cases are linked to outbreak that began at disney theme parks in california last year. cell phone video from inside the frederick high school could be the key to cracking that school shooting. police are asking for video to help identify four men who entered the gym. two teenagers were wounded last week. one of them is still in the hospital. accord the frederick news post the boys are 14 and 15 years of age. they did not go to the school. police believe this was gang

related. the jv basketball team was playing crosstown rival governor thomas johnson high school. the shooting happened outside of the gym. an alert shopper getting credit tonight for helping fairfax county police break up a gift card scam. police arrested this man, nathaniel henry, on saturday at a mt. vernon shopping center. they tell us he was sitting in a car with a computer and a credit card decoder -- encoder rather and stack of credit cards. police charged henry with forgery and trespassing. detectives determined he and another man uploaded fake credit card information onto blank gift cards and planned to go shopping. tonight, you have a chance to weigh in on a road project that's designed to ease congestion on a busy interchange. vdot is widening an inner loop ramp. this project will take traffic from rolling road to the fairfax county parkway in west springfield. crews will create a two-lane ramp.

i'm meteorologist doug kammerer. we hav a little storm making its way through the area not a big storm, but the temperatures drop below freezing we could see big issues. storm team 4 radar picking it up pretty well. we have an area of rain back to the west but you can see it changing to snow just to the north of hagerstown. in and around the d.c. metro area not much, but you've seen areas of rain thh portions of southern maryland through the

district. some in prince george's county calvert county anne arundel county right around the bay bridge but the bulk of the precipitation is back to the west and this is almost all rain right now. but there have been some little areas, you can see the pink just to the north of baltimore, where the colder air is starting to move on in here. let's hoe you the temperatures now. 34 in gaithersburg 34 in bowie, 32 at camp springs, 33 in huntingtown. that colder air make its way down from the no. d it will be cold enough over the next few hours to produce some of this sleet, some of this freezing rain maybe even snow toward the north. that's why we have the winter weather advi in effect. it include all the counties in west virginia panhandle, washington county maryland right on toward the south. only half montgomercounty the northern half same thing with loudoun county the western half. these are areas that are a little higher in elevation around mt. airy and damascus in through portions of northern loudoun county. but notice that also includes anne arundel couy a prince county. this goes till 5:00 a.m. these only until 3:00 a.m. we will see more of this rain and sleet and snow down to the

is det. >> reporter: kelly mack is one of the most upbeat people you'll ever meet. >> i'm pretty easy going, pretty laid back and, you know, i have a pretty sunny disposition. >> reporter: but there's one thing that really gets her down. >> excuse me. a lot e i have to make my presence known, ask for space, say excuse me. >> reporter: battling rheumatoid s since she was 2 years old, she uses a wheelchair to get around. >> everyone is stressed they're rushing to commute, and i think a lot of people haven't give an thought about how difficult it might be for people with disabilities to actually use metro. >> reporte kelly contacted the news4 i-team to help her show you what she and many others like her go through every day. we hooked her chair up with cameras and folls she navigated a maze of elevators. >> sometimes i hear people grumble when i'm getting on fist and they feel like they've been waiting and i say this is the only way i can take metro.

i don't have a choice. i cannot use the escalator. >> reporter: at the woodley park metro station, we watched as she tried to get to the front of the line. only to be cut off by a stroller. >> i think it would be easier if i went first. >> reporter: sometimes she says people won't even let her on, won't look her as they leave her behind. as she caught in these pictures she tarted taking on her daily commute. >> that elevator was designed and put there for people with disabilities. >> rep dara baldwin with the national disables network says it's okay too use the elevator if you have a stroller or luggage, but if you see someone with a disability who cannot use the escalator, you need to let them board first. >> the fact you have used equipment that was specifically made for them to get around and you're taking it first before they are taking it, that is what yodoing. you're taking away that person's civil, human, and a.d.a. rights by doing that for. >> >> reporter: which is why when you get on a metro

elevator. >> please give priority to senior sit sens and personals with disabilities. >> rep and see signs telling people to let people wis and seniors board first. kelly says she needs to go in fist to maneuver her chair so it will fit into metro'elevators. metro just launched a new campaign reminding riders to give priority to the disabled and pregnant rid because many disabilities are not visible it's important you don'e the person asking to go fist in line or sit in that priority seat. >> there are times when the train is so crowded i can't get on. there are times when it's very difficult for me to find the right spot to get on the train. excuse me. >> reporter: and while there are days people hop off to let her in most days she says she feels like a piece of furniture. >> i've had people lean on my chair or rest their bag on me or my chair, and it's kind of uncomfortable to have to say

responded to a craigslist ad. that man accused in the murder just pled guilty. this came after a new witness came forward. gregory lewis is accused of luring a man to an anne arundel coun parking lot in october of 2013. police said he put up a fake internet ad advertising a car for sale. rene arkita was shot to death after responding to that ad. lewis will spend 60 years in prison. if you had problems voting in the most recent election here in the district you're not alone pap new audit found that more than 20 polling locations in d.c. were understaffed in november. nearly 40 prints were not fully accessible to people with disabilities. and nearly 60 had technical glitches. there also issues at the reeve center which requires i.d. and i.d. to enter the building. d.c.'s board of elections tells "the washington po it reviewing this audit to make the necessary changes. and same-sex couples are getting married today across

humbled and amayed. >> reporter: there's a new twist happening outside the podcast. his lawyers will have new trial. andy levy an attorney and professor at the university of maryland tells me postconviction appeals aren't granted often. >> the court of special appeals said we will hear your case. we will review your case on the merits and that is something that very very few cases ever accomplish. >> reporter: the defense will have to convince a panel of three judges that sayed's trial lawyer was ineffective. >> you have show the lawyer was incompetent or did something wrong, that there was no tactical explanation for, and you have to show that that mistake by the lawyer caused you prejudice, that there would have been a different result if the lawyer had done what the lawyer should have done. >> reporter: thousands of listeners of the serial podcast will now have to stay tuned to the courts to learn his fate.

the west along i 81 back through 66 at faulkier county look at loudoun county now starting to see some pretty good rain coming down there. this will move into prince george's county right into montgomery county rather then into prince george's later throughout the evening hours. the bulk of this rain changing over the sleet and even some snow. notice to the north of the mason/dixon line, that's what we're seeing rain changing to snow. that will be the case as we move on through the rest of the evening hours. as i mentioned, that's why we had that winter weather advisory in effect. it includes loudoun county and they just updated this it now includes all of loudoun county all of montgomery county and now prince george'sy as well. we will continue to watch these arias through the night tonight and through the early morning hour tomorrow. rush hour tomorrow could be a little bit of a problem, but it may not be in the advisory area. we'll talk about that coming up at 6:15. >> thanks doug. news4 today will be tracking the latest road conditi
