garner can secure a new attorney. he was arrested last year for allegedly abusing a 13-year-old relative. in 012, he was convicted of know lessing two girls at his home but the conviction was later overturned. garner was once the chairman of the democratic committee in falls church. i'm richard jordan at the live desk. the truck driver involved in a terrible crash out near los angeles with a commuter train has now been released from jail. we just got the video in from overnight. he's not facing any charges yet. prosecutors say they want to wait until the investigation is complete before they present any charges against him. that driver saying he accidentally made a wrong turn, got stuck on the tracks and then ran for his life when he couldn't move his vehicle. police later caught up with him and arrested him. there have been six septembers at that same crossing in just the past seven year, but some time some 30 people were injured when the train cars flipped on to their side. 4:35.

volkswagen passat. court documents reveal a half dozen incidents where the driver tried to pull over other vehicles. police are investigating whether there are other instances of this crime. no charges have been filed. virginia governor manage call live is praising state lawmakers for approving a budget. the deal includes raises for teachers employees and college faculty. it restores $30 million for local governments. it does not raise taxes and does not expand medicaid like the democrats wanted. virginia's even come is beating projections, so the state has hormonemore more money to work with. the met proceed board decided not to raise fares on trains or buses. they also say they will not make substantial cuts to services. metro says it will focus on other ways to balance the budget. you won't be able to use the greenbelt metro station this weekend. it will be closed. buses will replace trains between college park and greenbelt on saturday and sunday

15 before the hour. once again, it is a last minute scramble on capitol hill. congress has to make some kind of deal on funding for homeland security today. nous house house republicans are sighing a short term fix. tracie potts is live for us. walk us through the house gop plan. >> reporter: it's pretty simple three weeks, that's all the money homeland security would get while the house and senate try to sit up to together in a conference and work out something more permanent that may or may not deal with the sticking point which has been rolling back the president's immigration order that allows undocumented immigrants to stay here. so a three week temporary fix while they try to work that out. but it's not clear if senate democrats will participate in that conference. they have a separate vote set

today that would fully fund homeland security, doesn't deal with immigration at all, but there is a separate vote in the senate on immigration. so two completely different plans coming up for a vote just hours before this deadline. >> let's look more at that first option. if you take us forward from there, if congress can only pass a short term solution are we right back where we started in a couple weeks? >> reporter: we may be because they have yet to deal with the issue of immigration that con receiver difference republicans are pushing. at some point they have to degree here on capitol hill whether or not to deal with that as part of the overall funding for homeland security. so if the temporary fix gets passed, it means the coast guard, tsa agents border control, they will get paid for a few more weeks. but jayeh johnson says it really just creates a lot more anxiety for the 230,000 people who work for him. >> tracie potts on the hill for

first district of maryland would much rather have his attention on their issues. congressional republicans had threatened to arrest d.c. leaders if they allowed the law to take effect. you may not be able to smoke marijuana everywhere you thought you could. landlords will not be required to allow marijuana use on their properties. so if you rent your apartment, it is up to whomever owns the building whether or not to allow smoking. land lords can also include anti-smoking clause in lease agreements. if you own your own home you city still may not be in the clear if there is a condo board or homeowner's soergs. they could also create rules against allowing marijuana. toys of course are getting high tech but these newls could be vulnerable to hackers. the toys that use siri-like technology they listen and respond having full conversations with your
