expecting someone to be home it might take them a little longer. look at the rain and this is a line of showers and thunderstorms. there are some thunderstorms embedded in this. one of them right down towards i-95 right along prince william/stafford county line. we'll do a couple of zooms here and shown you the rain up towards gaithersburg. look at this storm in and around the city of fairfax, very heavy rain right along 66 right along 50 and then this is heading right in towards arlington and right into the d.c. metro area. so downtown d.c. will most likely see this in the next 20 to 30 minutes. look down towards springfield, down towards mt. vernon and oxenon hill hill. this is the lightning right around quantico. they heavy rain along i-95. this is an area that alwayses has problems in the afternoon. stafford county yeninundated with rain. all of this continues to move off towards the east and will continue to move off towards the east as we move through the rest

of the evening. a few more showers and even a couple more thunderstorms as we continue through the rest of the night. we will continue to track them for you on storm team 4 radar. plus i'm tracking another system. could be a tropical system that moves up the coast just in time for your weekend. back to our breaking news now in charlottesville, virginia. our david culver in court with jesse matthew when the announcement was made in front of the parents of both girls. david? >> reporter: vance, this is a significant change in this case. jesse matthew now facing an additional charge. he's now charged with capital murder during an abduction. this has to do with the death of hannah graham who's from fairfax county a second year at the university of virginia. now, we say an additional charge because he still faces first-degree murder and abduction with aintend to defile. the prosecutor says if this goes to trial, she will seek the death penalty. we also heard from the prosecutor as to why they came

with this additional charge. she said it had to do with new forensic evidence. >> these are never easy decisions. if i didn't believe that this case were worthy of a capital charge if i didn't believe that mr. matthew or someone that would be appropriate for this ultimate penalty, then we wouldn't be standing here having this conversation. >> reporter: it's been an emotional eight months to get to this point for the grahams. it started back on september 13th the last time hannah was seen alive walking on a popular downtown mall. five weeks from the day she went missing, police found her remains. surveillance video and witnesses led police to jesse matthew. after a nationwide manhunt that ended in texas, police took matthew into custody. in february they charged him with hannah's murder. just a short time before the court started, we did see jill harrington the mother of morgan harrington walking into the court house. you remember her daughter's case still has no formal suspect. jesse matthew has been linked to

it but he hasn't been charged. >> i think that it is an obligation of mine to be here and to watch what happens. i want to learn. i want to see what happens when evil intersects with justice. and i will pray fervently that justice, whatever that may be eventually will prevail. that is my hope. >> reporter: and i can tell you that hannah's parents, john and sue graham from fairfax county were escorted privately into the courtroom. they sat stoic as that additional charge was announced. as far as jesse matthew was concerned, he will head from charlottesville here back up to fairfax county. his trial for a 2005 attempted murder and sex assault begins june 8th. back to you. >> thank you. on to presidential politics now. now there are six form. former arkansas governor mike huckabee is the latest to join the race for president. he announced his second presidential bid from his hometown of hope arkansas

today. he'll travel to iowa and south carolina next on his factories, farms and freedom tour. huckabee lost the gop nomination to john mccain back in 2008. the head of the district's 'em battled 911 call center is out of her job after a series of failed emergency responses. mark segraves broke the story on twitter. new at 6:00 hear what the director herself said that may have been the last straw. >> reporter: jennifer green had risen through the ranks of the d.c. police department before being named director of the officer of unified communications. yesterday mayor muriel bowser asked her to resign. >> we've had several months to evaluate the operation there and we really need a new beginning. >> reporter: bowser would not elaborate on why green was forced out, but multiple sources say a series of failed and delayed 911 responses, including a recent incident where the closest paramedic was not sent to a child who was choking on a

grape. that child later died. and the problematic rollout of the new computer tablets used in ambulances and fire trucks which also led to delayed response times were all factors. >> i'm very glad to see that the mayor is looking at some of these agencies and cleaning them out, because we need to use her in some of these agencies. >> reporter: sources say green's testimony last week that her call center cannot meet the national standard of dispatching help within 90 seconds of getting a call was the last straw. >> we need to look at it. we've been talking about it for probably over the course of the year that we need to change or update our current policies to reflect the national standard. and so that we have something that's realistic to shoot for. we shoot for that one minute and 30 seconds but we don't make it. >> people rely on that. that has to be perfect because that's the last call somebody may make. so we need to do whatever we need to do and it includes

changing the leadership. >> now, mayor bowser wants to find a new director who can integrate new technology at the call center. greene's departure comes on the same day as new fire chief begins his job. bowser will look to the fire chief for advice on hiring a director for the call center. tonight members of a d.c. church congregation are standing by their founding pastor as he faces new charges. darrell best that pastor is also a police officer. investigators say they found pictures on his phone that constitute child pornography. best led the god of a second chance ministry church on southern avenue. he's been in jail since he was arrested in march on accusations that he had assaulted teenage girls. prosecutors say one attack happened at his church the other at police med quarterheadquarters. best is in jail until a court appearance next month. we are hearing more from a man accused of abusing his elderly mother just months after

he ran for montgomery county council. our pat collins has our report. >> reporter: james kirkland is 57 years old. he's charged with abusing his 87-year-old mother. i tried to talk to him about that today. >> james. james kirkland, tell me about your mother. >> i don't think i have a comment, pat, sorry. >> did you abuse your mother? >> no. bye. i did the best i could, pat. >> i'm a libertarian style republican. the reason i'm running is to support truck owners car enthusiasts, single people, millennials and the night life community. >> reporter: james kirkland was a one-time candidate for the council in montgomery county. police say he lived with his mother in this house in bethesda. this is where they say the abuse took place. >> there were severe wounds on her backside and her legs and they were not maintained

properly by the defendant. >> and there were compression socks she had on as well? >> correct. they were on so long they were fused to her feet and had to be removed by doctors at the hospital. >> reporter: kirkland admitted to being his mother's primary caregiver. he would feed her bread and soup and at times they would split a can of fruit. >> did he say where she slept when she was in the house? >> he did. he said she slept in a plastic chair in front of the television. he stated that was very comfortable. >> reporter: james kirkland is out on bond. we were here when he left the house. last year kirkland ran for the montgomery county council az a republican but the republican party dropped him after the disclosure of an e-mail he wrote containing anti-semitic statements. police say james kirkland's mother is in the hospital. they say her condition is described as serious. in bethesda, pat collins, news

4. one of the police officers charged in the death of freddie gray in baltimore filed a court motion today. he claims that gray's arrest was legal because of the type of knife he was carrying. also today we are learning about a plan by the city of baltimore to spend $50,000 to train police on how to legally stop people. according to "the baltimore sun" the training was already planned before gray died. and businesses that felt the impact of the riots last week in baltimore are getting a break. they have been given a two-week extension to file their april sales tax returns and payments. the definition of assault on a police officer could be change changechange change -- changing in d.c. a bill was introduced that would narrow the definition. somebody impeding and opposing an officer is considered

assaulting. if someone resists arrest they can only be charged with assault on an officer. the police union agrees a change is necessary but do not support everything in the bill. the councilwoman says it's only a starting point. you can expect extra traffic delays around the watergate complex as crews work on the big garage collapse there. at least one lane on virginia avenue northwest is still closed. workers are shoring up the garage so they can do a more extensive search in there. three levels of the parking garage pancaked on top of one another last friday. a cadaver dog indicated a possible hit but nobody has been reported missing. a development in the shooting in texas that his leaders here in washington concerned. we'll tell you in a first for the u.s. and a terro group, isis. it's a story you saw first on news 4. what's next for the area outside the white house after a series of high-profile security breaches. also some concerns that

soon we should learn more about the plans to stop people from jumping over the fence at the white house. our scott mcfarland broke this story on twitter earlier. federal officials tell him the secret service and the national park service will reveal a timeline and plan for changes on thursday. the fence is expected to feature steel spikes bolted on top until a new permanent fence can be installed. there are some new homeland security concerns that won't be fixed with a higher fence. for the first time isis is claiming responsibility for a strike on american soil. that failed attack on a controversial art show in texas. but the administration is not necessarily buying it. jay gray is in garland, texas, now with the latest on this. jay? >> reporter: hey, good evening, jim. garland police investigators along with the fbi poring over evidence from the scene right now. federal agents also coordinating efforts in phoenix to learn more

about the suspects who lived there before the attack. not that long after remnants of the failed attack were cleared away isis called the men responsible soldiers and brothers. the terror group for the first time ever claiming responsibility for action on u.s. soil praising roommates elton simpson and nadir soofi as soldiers for the caliphate during a radio broadcast and threatening larger more brazen attacks on america. >> we know there are extremists around the globe, including some who are affiliated with isil who are trying to capitalize on the opportunity that's presented by social media, to try to communicate with individuals around the world, including inside the united states. >> reporter: to this point the group has not offered any evidence of involvement, leading some to believe it could be an opportunistic claim to grab attention. while the attention of federal agents and investigators has turned to phoenix now and the apartment the men shared. >> s.w.a.t. was all over the place. they told me to expect maybe some possible booms in the apartment because they might be

detonating stuff in it. so that was pretty unnerving. >> reporter: neighbors say the agents also searched a car and apparently found books on islam inside. part of an evidence trail and investigation that now stretches between arizona and texas. again, we know of no concrete evidence at this point that this isis was directed -- this plot was directed by isis. it may have inspired the men to do it. one counterterrorism expert telling nbc news it's clear the attackers were not trained by isis. that's the latest live here in garland. i'm jay gray. jim. >> thanks jay. hurricane season doesn't begin until june 1st but there's a subtropical depression that might be forming down in the atlantic. it's a storm system that's already bringing rough surf clouds and wind to south florida. rip currents and flooding possible along the east coast through the weekend if that storm tracks inland. meanwhile, we're getting

some rain in parts of our area doug. >> yeah and that rain right now coming down fairly heavily. of course we are tracking that system off the coast. look outside our studios, the rain starting to come through northwest d.c. and it is going to be fairly heavy. a little thunder, a little lightning. nothing strong nothing severe. you can see the radar right behind us. you notice all the reds and oranges, those are the heavy showers. we'll show you exactly what's going on. there's the rain on storm team 4 radar. you can see it right along i-95 just south of baltimore through the d.c. metro area, all the way down towards fredericksburg and charlottesville. a lot of rain with this coming through right now. let's do a couple of zooms for you. you notice from gaithersburg all the way out towards laurel right along 29 over towards columbia maryland and howard county and right down towards the south, look at this shower that just popped up. a very intense shower right along 50 and 4 i95. that is exit 19-a. that takes you towards the bay bridge and ocean city. look around bethesda right on

down through fairfax, let's zoom on this on this region because that's the region about to get hammered. downtown not much going on. you've got some wind down there but look at the rain coming at you. this is all in through virginia towards alexandria right down towards mt. vernon. some very heavy rain moving off towards the east. this storm not moving very fast. so maybe back towards northeast you might be hitting some of that. down to the south, quantico woodbridge fredericksburg all seeing the rain. it is heavy rain but again notice not a lot of lightning or thunder with this. you may hear a little bit but we're not expecting much. a few showers through the rest of the evening. the first round moves out. we may see another round around 10:00, 11:00, although most of us should remain dry. the nationals are supposed to play tonight. i do think their game may be delayed but i don't think it will be postponed. tomorrow morning maybe some

areas of fog and tomorrow afternoon we see more scattered showers developing. mostly down to the south and west of the area but this is something we will continue to watch during the day tomorrow. satellite and radar showing we had clear skies earlier and then clouds moved on in. with those storms that came in through here, it is a ryanline. this is associated with a stronger system just to the north, big-time frontal boundary and a lot of rain back to the west. but then we turn our attention down to the south. this is what jim was talking about, this subtropical storm down towards florida. this will make its way up the coast and sit here a couple of days and then it could move inland. if it does it may have a little impact on our weekend. we have changed that weekend forecast just a little bit. tomorrow still warm. 77 d.c. 80 in washington 82 down towards fredericksburg and 80 back towards leesburg. we'll see a chance for maybe a thunderstorm during the afternoon, just like today. 50% chance of that happening with a temperature around 80. 79 on thursday 83 on friday.

the man from ohio who is accused of plotting to attack the capitol will be allowed to see the evidence against him and he'll be allowed to look at it by himself. his name is christopher cornell. he'll get to privately review the video and the audio files in the case against him. he'll have five days to look it over on the condition that he has no access to the internet or outgoing mail during that time. cornell was arrested back in january. he pleaded not guilty to charges

of attempted murder for planning to attack the capitol with pipe bombs and shooting government officials. there was a labor rally on the steps of the wilson building today. the d.c. council passed a resolution standing with the united farm workers. union members have been in a dispute with geruwan farming for years. the council is calling on the company to come into compliance with california and u.s. laws. calm turned to panic late last month on the beltway near i-66. a multi-vehicle accident one car on fire but fortunately all the drivers were okay. then something unbelievable happened. one of the drivers jumped into his burning vehicle, forcing the first fairfax county officer on the scene to make a life-or-death decision. northern virginia bureau chief, julie carey, reports. >> reporter: this is all that's left of the car that was at the center of a dramatic rescue on the beltway. it was friday april 24th.

>> there's a vehicle on fire. >> reporter: here's what officer ramirez could see as he pulled up the camry in frames after striking two other vehicles and the jersey wall. good news at first, everybody was out of the cars and okay. but suddenly what you'd never expect. the camry's driver jumped back into the fiery car and locked the doors. >> that's when i made the decision to break out the driver's side window. and upon doing that the flames started coming out of the driver's citedside window so i wasn't able to make my approach that way. >> reporter: ramirez didn't give up. you see, he was a long island firefighter before he became a fairfax county police officer. he broke out another window still no luck. but then the man climbed out the broken window and just as quickly tried to get back in. ramirez grabbed him. >> you could tell he was still on fire. as i pulled him, that's when i burned my hand. but i was kind of determined not

to let him go back in that vehicle. >> reporter: two other officers and a firefighter arrived to help and finally they subdued the man. he and ramirez were taken to the hospital to be treated for burns, but the officer's hand healed quickly. only a few tiny blisters visible today. >> i would do the same thing all over again. >> reporter: a life saved, even as police across the nation are taking a lot of heat. ramirez says he won't let it distract him. >> public service, you never know what it is that you're going to get. it's one of those things that when you put the uniform on and you go to work you don't know you're going to have you just know that you have to be ready for it. >> reporter: in fairfax county julie carey, news 4. next jesse matthew charged with capital murder. what we're learning right now from inside the courtroom. thousands of gallons of sewage leaking into a neighborhood for days. what it will take to clean up the mess. plus new at 6:00 planes flying so low you can see the passengers inside. why noisy

well at 6:30 new details on a bizarre case. the case of a former fbi special agent accused of trying to crash the gate at the cia. >> she's also accused of making violent threats against the security officers when she got there. she was supposed to appear in court today, but that didn't go according to plan. scott mcfarland broke this story on the nbc washington app last night and was there for today's hearings. >> reporter: in just the past

hour prosecutors filed this paperwork specifying the charges against this former fbi special agent. in this very bizarre case, the charge is a misdemeanor. the court documents charge her with forcibly assaulting resisting, opposing impeding and intimidating cia security protective officers at the agency's mclean headquarters. at a court hearing late today davis did not answer the many questions about her case. she didn't show up at all. the judge said davis was not kwaup rating cooperating, that there was significant difficulty getting her out of u.s. marshals' custody and into her chair in the courtroom and that significant force might have been needed. the judge said the charges are serious and ordered an evaluation. tunisia davis was an fbi special agent from 2004 to 2010 according to a cia investigator. in an incident first revealed by news 4 last night, that cia investigator said davis drove

last thursday to the entrance of the nsa in maryland. was turned away and then tried to enter the front gate of the cia in virginia. court records say an officer had to physically stand in front of her car before she stopped. they say she reached towards an officer's gun belt and later threatened to shoot police. her facebook page includes many videos she recorded of herself. in some she is deeply critical of the federal government and at times vulgar. that facebook page was taken down after news 4 broke the story last night. at her apartment complex, friends say davis was a kind woman but often protested police conduct and the federal government. her landlord tells news 4 he was surprised in mid-april when davis notified him she was ending her lease april 30th. april 30th is the same day davis allegedly tried to enter the cia gate. and the judge has ordered tunisia davis undergo a mental health evaluation likely in the next day or two. at federal court in alexandria, scott mcfarland news 4.

new reaction tonight to a big sewage spill in our area. a sewer main is leaking thousands of gallons of waist water along huron drive in oxon hill. tracee wilkins just talked to the person who discovered this problem. >> reporter: i know that people here are really happy that this rain is washing away some of that smell, hopefully. it was the smell that helped this neighbor discover the problem. >> you could smell it. >> reporter: doug waller says he was cutting grass on wednesday when -- >> it smelled like sewage. >> reporter: that's when you noticed something bubbling from underground. >> it's been going on i don't know how long. but that's what i first noticed it friday. >> reporter: wssc spokesman says the crack in the 14-inch sewer line has spilled 10,000 gallons of sewage. workers are laying 7,000 feet of temporary pipe. that work could take days. and then the work to repair the actual line could take several

weeks. >> it probably is a lot of damage but i don't know how long it's been leaking. >> reporter: the leak is located behind homes on huron drive off of a field near forest heights elementary. some of the sewage has gone into oxon run creek where we watched children playing today. there are about 20 signs posted at the site of the leak and a lot of caution tape urging folks to stay away. >> something that we've got to deal with. >> reporter: wssc spokesmen are saying this will not impact drinking water. they are concerned about this getting into the creek and are monitoring that very closely. jim, back to you in the studio. a woman from northern virginia could face life in prison for running down her ex-husband's fiancee with a car. the woman's name is margaret henry. she pleaded guilty to all three of the charges against her. back in january, she drove past her ex-husband's home saw him

in the yard with his fiancee. she went back and drove her car across the lawn and hit the fiancee, pinned her against a parked trailer. the woman's injuries were so severe that her lower leg was amputated. henry is going to be sentenced in july. a big night in alexandria as long-time mayor bill eulle faces a challenge within his own party. he has been mayor since 2003. he's a democrat and for the first time he's facing a primary fight. former mayor, kerry donnelly and the council vice mayor, allison silverberg are hoping to unseat him. the primary will be held on june 9th. hundreds of law enforcement officers gathered in downtown washington today for the annual blue mass. a service at st. patrick cathedral honors local, state and federal officers who died in

his nickname is fighting joe and today president obama nominated him to become the next chairman of the joint chiefs of staff. marine general joseph doneford jr. is expected to be easily confirmed in congress. he earned the fighting nick and a quarter during the war in iraq in 2003.

the president also named general paul silva to serve as vice chairman. he was is a top officer in the air force. tougher new restrictions are now being considered in california where voluntary efforts to save water have fallen short. state regulators say water usage fell only 4% when compared to the same time two years ago. they also say local officials were not at all aggressive in cracking down on waste. the state water board is now considering regulations that would make cuts of more than a third and those cuts would be mandatory. some local water department officials say that proposal is unrealistic and unfair. one of the largest charities in the city is moving. according to "the washington post" martha's table is getting ready to break ground on a $20 million headquarters in anacostia. they currently operate out of a

was with michael brown when he was shot and killed in ferguson missouri is filing a lawsuit. suing the city of ferguson officer darren wilson and the city's former police chief. johnson's lawsuit said wilson initiated the confrontation that ended in brown's death last august. it says wilson used excessive force and acted with deliberate indifference or reckless disregard for his rights. wilson was not charged with any crime in the case and he has

trees in that area. at the live desk i'm erika gonzalez. ching those showers moving across our area. a lot of you will need the umbrella tonight. doug is tracking it from the weather center. >> yeah we've seen these in and out of northern virginia over the last couple of hours now moving in towards southern maryland just crossing through the district and i-95. we'll show you what's happening down towards nats park. they have delayed the game. i put this out a little earlier thinking we might see a delay here but i still think they'll get the game in. most of the rain now gone out here towards nats park. as we look toward the other vantage point from national harbor looking up towards the north, you can see some clearing and that is good news for you nats fans. i think we will get the game in. you can see the rain coming to an end back towards northern virginia, moving in towards portions of the maryland right now. prince george's county getting hit hard charles county getting hit hard. it's really right over 301. more showers and a few thunderstorms back along i-81 from just south of martinsburg down towards parts of shenandoah

county. here's the heaviest rain from i-95 right down towards 50 in bowie. let's go ahead and zoom in around the bowie/crofton area. somebody called and said should i bring boxes in? yeah i hope you did because you're talking about heavy rain right on top of you. here's 301. this will come right over towards crofton in the next 10 to 15 minutes. farther south, you see around the mt. vernon area clinton, down towards waldorf seeing some of that rain around quantico. thets let's zoom into this heavy shower towards la plata. right on down 301 as it crosses bridge down towards king george county seeing that rain too. this is round one. we have another little area trying to make its way through, so we could still see a couple of showers tonight. i mentioned earlier this afternoon, make sure you keep that umbrella handy this evening. i think you may need it tomorrow too. so that evening planner tonight, 70 degrees with showers. temperatures may actually go back up around 7:00 as the rain
