rking. >> first 4 traffic tracker out and about, headed north on virginia, 95 northbound here. so what we're hearing is we had a little bit of that kind of construction or gravel sort of left over from overnight road work there on 95 northbound as you're passing dale boulevard. that's what the driver is telling us this morning. so kind of a warning. we were seeing some slowdowns in the area. we sent her to check it out. that's what she's seeing here. westbound dale boulevard, closed at giddeon drive. some road work happening there. some construction. 66 east of compton road eastbound and westbound. everything is moving just fine. a wide look at things overall, don't have any major problems. a little slow 395 inbound from late clearing road work as well. should be out of the way in the next couple of minutes. b.w. parkway, no issues and same thing when you're taking a big look here at the southern part of the beltway and prince george's county. back at 5:11. a developing story out of baltimore now. today the justice department could announce plans to investigate the city's police

department. the agency would look into possible civil rights vieolations according to "the washington post." six police officers were charged in the death of freddie gray. prosecutors say officers illegally arrested gray last month and he died after being hurt in police custody. ladies, i ask you to please respect -- this is a business meeting. >> the motion passes. >> you can hear it boos and cheers and extra security for a vote about gender identity in fairfax county. the school board voted in favor of changing the nondiscrimination policy to include gender identity. the emotions flowed. so many people tried to get into this meeting school officials had to lock the door and put officers at the entrance. while the board voted overwhelmingly in favor of the change the crowd at the meeting was largely opposed to it.

some parents say they're confused about how the changes will affect their children. >> i urge you to protect our transgender and gender nonconforming students. >> how are teachers prepared to handle the situation when a child comes monday who happened to be johnny on friday and monday he comes dressed as jane? >> this school district will hire a consultant to help plan policies include bathroom use and locker rooms. 5:02 now. firefighters tried to rescue a man who got stuck in the elevator shaft. somehow he wedged himself between the service elevator and the wall. this is in a building on connecticut avenue. he was trapped from the waist down. as you can see. this video shows firefighters talking to the man as they try to figure out how to get him out of there. a half hour goes by and rescue teams got him on the stretcher and on his way to the hospital. firefighters had to use air bags to separate the elevator from

the wall. 5:03. today the metro transit police say a man who attacked a 69-year-old man inside the metro station will appear in court. elijah smith has a preliminary hearing this morning. he punched albert langeberg inside the eastern market metro station. if a jury convicts smith he could face quite a bit of jail time. that's because of a d.c. law that allows for harsher penalties if the victim is over 65. also today, the sentencing phase for the man who murdered a howard university student. rasdavid lagarde murdered omar sykes in 2013. he and an accomplice tried to rob them as they walked back from campus after watching fireworks. lagarde faces 20 to 30 years in jail. today, crews begin work on new white house security measures. new vehicle check points have been approved at the ellipse.

officials approved a new sharp spikes along the top of the existing fencing at the white house. both are designed to stop people from jumping over the fence on to the white house grounds. the spikes will be installed in july. i always break into tears when i think of my dad working in all those years in the -- you know, for the war. but fortunately he came home. he was not wounded. >> that is kathy samuelsson the proud daughter of world war ii pilot miles hamilton. samuel samuelsson joins hundreds of families for the incredible tribute on the mall. dozens of aircraft will fly in formation to mark 70 years since the allied victory in europe. news4's megan mcgrath has a preview. should be a beautiful day for this. >> reporter: oh, a beautiful day and quite a sight to see for sure. the flyover at 12:10 today and world war ii aircraft they're going to be flying along the

national mall as well as here by the world war ii memorial. now, take a look at this video here. you see some of the aircraft involved. they have been gathering at the manassas airport. now, this is all to commemorate the 70th anniversary of victory in europe day. the aircraft are doing to fly in formation. among them, the b-29, the only one left in flying condition. the b-51 mustang, the b-17 bomber just to name a few. hundreds of people are expected to gather here at the world war ii memorial as well as along the national mall to watch the flyover. now, you can see a slowdown of traffic in the area as the aircraft go by because it is going to be quite an attention grabber. so keep that in mind as well. the aircraft will fly in formations representing the major battles of the war. and then it's all going to end with a missing man formation to taps. 12:10, that's when it's scheduled to begin. should be quite a sight to see.

there are less than 500 days to go before the summer olympic games in rio de janeiro and construction of a number of venues has yet to begin. companies have not yet been selected even to build at least half of the eight temporary venues set to host events like beach volleyball and rugby. i think you need a lot of sand. organizers say there's nothing to worry about and that all will be completed by the time the world turns its eyes to rio in

parts of the country right now bracing for yet another round of tornadoes and storms. we have a new picture into the

newsroom this morning. this is at dallas-ft. worth airport where flooding is causing problems. people there are stuck waiting. this is a passenger who tweeted this photo after landing at dallas-ft. worth airport. he says 4 1/2 hours after he landeds he landed he was able to leave and his taxi drove through six inches of water. several tornadoes were reported in slidell, texas. they were under severe thunderstorm watches and flash flood warnings until late in the night. look at how dark the sky is there. and more flooding is expected today. three to four more inches of rain. at the live desk i'm kristin wright. >> thanks. the fire on a greyhound bus in stafford county may have been started by a man stowed away in the luggage compartment. the man is badly burned and police say he entered the compartment in new york somehow. the bus was headed to atlanta.

the driver pulled over on 95 wednesday afternoon when he noticed smoke that led to the major traffic packup as you -- backup as you can see here. offices are closed today at the tornup physical therapy business. a driver faces negligent driving charges. one woman was seriously hurt. she worked as a receptionist at pro action. and police took three others for the hospital. police are retracing the last known steps of a missing howard university student. lance buckley's cell phone picked in montgomery county yesterday. police found no trace of him though. he was dropped off at a commuter lot on tuesday. he sent his wife a text message, he was near howard university at the time. his family has not heard from

him since. take a look here, these are some pictures of two people d.c. police want to talk to about a pair of armed robberies. a man and a woman held a georgetown student at gunpoint and demanded his wallet on wednesday night. that was outside the mcdonagh business school. and another robbery happened at 31st and "k." a d.c. police officer could go back to work after a jury cleared him of the attempted murder of his wife. a jury found samson lawrence not guilty of all charges including second degree attempted murder. prosecutors say lawrence sprayed his wife's face with lysol, choked her and pushed her down the stairs after an argument. the defense team said the physical evidence didn't support the theory. >> when you look at the dna evidence, and fingerprint evidence, none of which belongs to my client the jury found that ms. lawrence was not telling the truth that day. >> we brought charges that reflected the seriousness of the

offenses. >> this was the second trial for lawrence. the first resulted in a hung jury. lawrence's family wants him reinstated to the police department so he can return to duty. a new v.a. clinic is coming to spotsylvania county. it will open on spotsylvania avenue. it will have a full service emergency department and lab. tom brady speaks out for the first time about the deflategate scandal. a report by the nfl says the patriots quarterback was probably aware that a staffer was deflating footballs. but brady says he can't react to any allegations yet. >> it's only been 30 hours, so i haven't had much time to digest it fully. when i do i'll let you know how i feel about it. and everybody else. >> are you that slow a reader? [ laughter ] >> investigators think the patriots employee improperly

deflated the footballs before the afc championship game against the colts. the report says some of brady's claims were not plausible or contradicted by other evidence. brady's agent released a statement calling it biased and insinuated they ran a sting operation to get brady and the patriots. the nfl is looking into possible penalties now. well, if you're expected to have -- try that again. if you expect to have a baby pretty soon we have some new advice this morning. silence your cell phones. a small preliminary study from why kof heights medical center shows rings and vibrations may startle babies in the womb. this is according to what to expect.com. they used ultra sounds to monitor the babies in the womb. then they turned their head and blinked more frequently with the ringing phone.

champion. he has seen our kids so many times. >> you have a lot of noses to think about. 5:21 is our time right now. let's see what we'll find when you step outside today. tom? >> i have good news on the pollen. it looks like the oak tree pollen which is the predominant one we have had for the last week or two, it has peaked and it's now decreasing. pollen counts are still considered in the high range, but not nearly as high as last week. it's still mostly oak and some mulberry and pine. it is decreasing now. those counties in fog, southern fauquier and culpepper and the eastern shore, this is dense fog advisory in effect until 10:00 this morning. maybe some visibilities down under a quarter of a mile there. temperatures in the mid to upper 50s and in the near by suburbs. in the low 60s by the bay. hour by hour, by 8:00 the mid 60s a few high cloud, upper 70s by noon. then by mid afternoon, into the

mid 80s with low humidity. looking beautiful tomorrow too. great weather for the race for the cure. we'll be in low 80s on saturday and partly cloudy. some clouds in the morning, a small chance of a sprinkle and then sun. then on sunday partly sunny for mother's day, into the mid 80s. we have a possibility of an afternoon shower that is mainly south and southwest of the metro area. most of the region should be dry on mother's day. the timing on that will have some clouds in the morning and then some sun breaks out by mid-morning. a few sprinkles on the eastern shore, but then an area of showers associated with the coastal tropical system anna may begin to move in by 4:00 p.m. south and west of the metro area into culpepper and prince william and fauquier and shenandoah valley into the evening hours. but most of the metro area should stay dry on mother's day. we'll have temperatures again above average with a few showers around into the mid 80s. then warm on tuesday. partly sunny, then a nice break

it's unclear whether the person accused in the stabbing will face charges. crime scene markers dotted throughout the charles county apartment complex where the deadly fight happened yesterday morning. one neighbor says trouble started to brew several nights ago. >> they smashed my wind shield and painted my car. spray painted my car and my apartment door. >> why? >> they wanted the boys to come out to fight that night but they didn't come out. >> police are trying to figure out a time line of events here. if you have any information, police would like to hear from you. family, friends and fellow officers will remember slain nypd officer brian moore today. tens of thousands gathered for wake on long island yesterday. new york governor cuomo was among the mourners. officers patrolled the streets outside the funeral home. he was shot in the head. the fbi tried to warn the texas police department about a gunman hours before he started shooting. three hours before the shooting at a controversial texas art

show. the fbi sent a bulletin to the garland police department with the photo of gunman elton simpson. the bulletin noted that simpson was quote, interested in the interest. james comey said that the agency had no reason that simpson intended to attack the event. simpson and a second gunman soofi was shot and killed by the police. the man killed has been tied to the "charlie hebdo" attack in paris. this is not him in the video. al qaeda claims the leader's son and brothers were killed in the air strike. new details about that massive blue bell recall. the fda says that the company was aware of listeria bacteria in at least one of its manufacturing plants. this goes back as far as 2013. at least three listeria deaths in kansas are linked to the company's ice cream. blue bell pulled the products last month. violations at the plants include

a suicide bomber blew himself up in a parking lot. we're hearing most students living there were already in class. people were jumping out of windows and over walls to escape. many of them were hurt trying to get away. boko haram is the same group that kidnapped hundreds of school girls last year. there's an on going effort to drive the extremists out of towns and villages and destroy their camps. i'm kristin wright at the live desk. >> thank you. 5:33 and a developing story, the nsa's controversial bulk gathering of phone data is illegal. the federal appeals court ruled on the controversial issue yesterday. lawmakers now have to find a balance between national security and privacy. tracie potts is joining us live with the latest. >> reporter: good morning. they're working on it lawmakers have come up with something called the usa freedom act that they think essentially be tweak -- will tweak that law to allow the program to continue, but satisfy the courts and satisfy the public. people who are concerned about

privacy. they don't have a long time to deal with it though. that law expires june 1st so they have less than a month to make the changes and get them approved so that this program can continue. the nsa, the government has argued that building that database by collecting all of our phone records allows them to search for contacts between overseas terrorists and people in this country. but the aclu sued and said that it was an overreach. the court said it was unprecedented and unwarranted and could lead to the government collecting other records. like your banking records. other records like your medical records. so right now lawmakers are trying to make some changes to that law. they have got a few weeks left. the house is supposed to vote on this usa freedom act next week. >> tracie potts, thank you. it's 5:35. a federal grand jury now says the man who plotted to attack the u.s. capitol was trying to help isis. the grand jury added a new charge to christopher cornell's indictment. they say he was attempting to provide material support and resources including himself to

foreign terrorist organizations. cornell was charged in january with attempted murder of u.s. officials and employees. at the time he pled not guilty. cornell is due in court again next week. the million moms march is set for this weekend. that march is designed to support mothers who have lost children at the hands of police officers. this morning, the group will lobby on capitol hill. this afternoon they'll host an afternoon social at the lincoln memorial park. tomorrow's march starts at 10:00. we are seeing yet another sign that former governor martin o'malley is serious about a presidential bid. he's hired a former aide. in 2008 she was the obama campaign southern regional political director. o'malley says he'll announce his 2016 plans as early as this month. this morning, d.c. mayor muriel bowser is set to announce several new members of her cabinet. she'll also take questions from

the media. later this afternoon she's headed to the white house for the national small business awards week ceremony. today, purple line advocates will take maryland governor larry hogan on a listening tour of the planned light rail system sort of. they'll explain the benefits to a cardboard cutout of the governor that tour begins at the silver springs library this morning. advocates want the governor to publicly endorse the purple line sooner rather than later. the metro will open two hours later tomorrow. the stations are metro station, federal triangle and archives and the greenbelt station will be closed this weekend. free shuttle buss will replace trains between college park and greenbelt. genetics lifestyle, a lot of things can cause a heart attack. >> but a call to customer service? we'll tell you about the

malaysia airlines. the airline is struggling after two jet disasters last year and a damaged image. a new ceo has been brought in to oversee a turn around. we're hearing the airline will shrink in size and cut staff by 6,000 people. at the live desk i'm kristin wright. >> thank you. a virginia woman is suing verizon wireless for the heart attack she had during a customer service call. the virginian pilot reports that angela hawkins is seeking $2.35 million in damages. the 53-year-old said she called verizon last year to straighten out a billing problem. she said the call was so upsetting she went to the doctor the next day. she had a heart attack. they declined to comment. >> there were a lot of people who felt they were experiencing an ailment as a result of a customer as much as call. >> we'll keep an eye on this. you can check out the european unions embassies

raging in the night sky. this is denton, texas. huge red flames just billowing into the sky. we're told this is some sort of gas well fire. firefighters took them about an hour just to get it under control. we're told no one was hurt. it's unclear what started such a huge fireball. but we do know that severe thunderstorms with frequent lightning were moving through this area at the time of the fire. at the live desk, i'm kristin wright. my first thought was oh god, what if this has something to do with the threats? >> a university of mary washington student murdered grace mann was one of several targeted by cyber attacks. now a feminist group says the university didn't do enough to protect them. grace mann was one of the officers. feminists united member julia michaels said they lived in fear

ever since the cyber threats happened. the threats poured in on the social media after they criticized the men's rugby team for a chant glorifying rape. mann was mentioned by name in some of the threats. >> people gave out the locations of some of the members and they were threatened to rape and ill kill us. i was terrified. >> the administration was asked to block the app but we're told that could infringe on the free speech rights. they take the allegations of gender based violently. police are hoping you can give information on a man who touched a girl inappropriately. they say the man touched the 17-year-old's arm before the girl got into a dodge ram pickup and drove away. it does not appear the man intended to harm the girl but police want to talk to the man. if you have any information, give prince william county police a call.

leaders in prince george's county want to combat the issue of absent fatherhood. tomorrow, the county council is hosting a free summit. it runs from 10:00 a.m. to 2:00 p.m. in clinton. attendees will brainstorm strategies to tackle this issue. according to the national fatherhood initiative children growing up without fathers are two to three times more likely to experience poverty and drug use and to engage in criminal behavior. today the man who flew a gyrocopter on to the capitol lawn will face a court. hughes was charged with violating restricted air space and operating an unregistered aircraft when he landed on the west lawn earlier this month. hughs could spend one to four years in jail if convicted. prince george's county says governor hogan should give county schools the money they're owed. baker and members of the county council sent a joint letter to the governor. they're asking him to release $21 million next year in the

budget. the governor has been at odds over school funding. it's not clear whether the governor will honor the request. liquor sales will be on the docket for the montgomery county council this morning. they'll take a look at a new ordering system that was launched in february. many restaurants and beer and wine stores say the system is not efficient and deliveries weren't timely. the officials at the department of liquor control say that they're still working out the kinks in that system. and it should get smoother in the coming months. get ready to firm up your memorial day travel plans. this morning aaa officials head to reagan national airport for a press conference. the forecast is a helpful heads up as you budget for gas prices, hotels and airfare. it includes data about whether the prices are going up or down. aaa will share predictions of how many drivers will be packing the roads for the memorial day weekends. always tons of folks. next week maryland officials will swear in the youngest mayor

ever in state. 19-year-old college student brandon paulin won in the town of indian head with all of 239 votes there. he's a student at the college of southern maryland. swearing-in ceremony for paulin and two other members will be next tuesday. new changes to the kennedy center expansion project. a floating stage on the potomac river has been scrapped. instead, they'll build an outdoor pavilion overlooking the river. it will cost $100 million and because of the changes won't open until 2019. mother's day is sunday. and of course we are all getting ready to celebrate our mothers and all the wonderful things that moms do every single day to care for your kids, to get everything going, get your family together in so many ways. we have now -- this is a video of my mom and me and she is just just -- i can't -- you know how i feel about my mother. >> a god send. >> she really is. we are send -- sharing our
