department. the agency would look into possible civil rights vieolations according to "the washington post." six police officers were charged in the death of freddie gray. prosecutors say officers illegally arrested gray last month and he died after being hurt in police custody. ladies, i ask you to please respect -- this is a business meeting. >> the motion passes. >> you can hear it boos and cheers and extra security for a vote about gender identity in fairfax county. the school board voted in favor of changing the nondiscrimination policy to include gender identity. the emotions flowed. so many people tried to get into this meeting school officials had to lock the door and put officers at the entrance. while the board voted overwhelmingly in favor of the change the crowd at the meeting was largely opposed to it.

some parents say they're confused about how the changes will affect their children. >> i urge you to protect our transgender and gender nonconforming students. >> how are teachers prepared to handle the situation when a child comes monday who happened to be johnny on friday and monday he comes dressed as jane? >> this school district will hire a consultant to help plan policies include bathroom use and locker rooms. 5:02 now. firefighters tried to rescue a man who got stuck in the elevator shaft. somehow he wedged himself between the service elevator and the wall. this is in a building on connecticut avenue. he was trapped from the waist down. as you can see. this video shows firefighters talking to the man as they try to figure out how to get him out of there. a half hour goes by and rescue teams got him on the stretcher and on his way to the hospital. firefighters had to use air bags to separate the elevator from

the wall. 5:03. today the metro transit police say a man who attacked a 69-year-old man inside the metro station will appear in court. elijah smith has a preliminary hearing this morning. he punched albert langeberg inside the eastern market metro station. if a jury convicts smith he could face quite a bit of jail time. that's because of a d.c. law that allows for harsher penalties if the victim is over 65. also today, the sentencing phase for the man who murdered a howard university student. rasdavid lagarde murdered omar sykes in 2013. he and an accomplice tried to rob them as they walked back from campus after watching fireworks. lagarde faces 20 to 30 years in jail. today, crews begin work on new white house security measures. new vehicle check points have been approved at the ellipse.

national mall as well as here by the world war ii memorial. now, take a look at this video here. you see some of the aircraft involved. they have been gathering at the manassas airport. now, this is all to commemorate the 70th anniversary of victory in europe day. the aircraft are doing to fly in formation. among them, the b-29, the only one left in flying condition. the b-51 mustang, the b-17 bomber just to name a few. hundreds of people are expected to gather here at the world war ii memorial as well as along the national mall to watch the flyover. now, you can see a slowdown of traffic in the area as the aircraft go by because it is going to be quite an attention grabber. so keep that in mind as well. the aircraft will fly in formations representing the major battles of the war. and then it's all going to end with a missing man formation to taps. 12:10, that's when it's scheduled to begin. should be quite a sight to see.

the driver pulled over on 95 wednesday afternoon when he noticed smoke that led to the major traffic packup as you -- backup as you can see here. offices are closed today at the tornup physical therapy business. a driver faces negligent driving charges. one woman was seriously hurt. she worked as a receptionist at pro action. and police took three others for the hospital. police are retracing the last known steps of a missing howard university student. lance buckley's cell phone picked in montgomery county yesterday. police found no trace of him though. he was dropped off at a commuter lot on tuesday. he sent his wife a text message, he was near howard university at the time. his family has not heard from

him since. take a look here, these are some pictures of two people d.c. police want to talk to about a pair of armed robberies. a man and a woman held a georgetown student at gunpoint and demanded his wallet on wednesday night. that was outside the mcdonagh business school. and another robbery happened at 31st and "k." a d.c. police officer could go back to work after a jury cleared him of the attempted murder of his wife. a jury found samson lawrence not guilty of all charges including second degree attempted murder. prosecutors say lawrence sprayed his wife's face with lysol, choked her and pushed her down the stairs after an argument. the defense team said the physical evidence didn't support the theory. >> when you look at the dna evidence, and fingerprint evidence, none of which belongs to my client the jury found that ms. lawrence was not telling the truth that day. >> we brought charges that reflected the seriousness of the

offenses. >> this was the second trial for lawrence. the first resulted in a hung jury. lawrence's family wants him reinstated to the police department so he can return to duty. a new v.a. clinic is coming to spotsylvania county. it will open on spotsylvania avenue. it will have a full service emergency department and lab. tom brady speaks out for the first time about the deflategate scandal. a report by the nfl says the patriots quarterback was probably aware that a staffer was deflating footballs. but brady says he can't react to any allegations yet. >> it's only been 30 hours, so i haven't had much time to digest it fully. when i do i'll let you know how i feel about it. and everybody else. >> are you that slow a reader? show. the fbi sent a bulletin to the garland police department with the photo of gunman elton simpson. the bulletin noted that simpson was quote, interested in the interest. james comey said that the agency had no reason that simpson intended to attack the event. simpson and a second gunman soofi was shot and killed by the police. the man killed has been tied to the "charlie hebdo" attack in paris. this is not him in the video. al qaeda claims the leader's son and brothers were killed in the air strike. new details about that massive blue bell recall. the fda says that the company was aware of listeria bacteria in at least one of its manufacturing plants. this goes back as far as 2013. at least three listeria deaths in kansas are linked to the company's ice cream. blue bell pulled the products last month. violations at the plants include

a suicide bomber blew himself up in a parking lot. we're hearing most students living there were already in class. people were jumping out of windows and over walls to escape. many of them were hurt trying to get away. boko haram is the same group that kidnapped hundreds of school girls last year. there's an on going effort to drive the extremists out of towns and villages and destroy their camps. i'm kristin wright at the live desk. >> thank you. 5:33 and a developing story, the nsa's controversial bulk gathering of phone data is illegal. the federal appeals court ruled on the controversial issue yesterday. lawmakers now have to find a balance between national security and privacy. tracie potts is joining us live with the latest. >> reporter: good morning. they're working on it lawmakers have come up with something called the usa freedom act that they think essentially be tweak -- will tweak that law to allow the program to continue, but satisfy the courts and satisfy the public. people who are concerned about

privacy. they don't have a long time to deal with it though. that law expires june 1st so they have less than a month to make the changes and get them approved so that this program can continue. the nsa, the government has argued that building that database by collecting all of our phone records allows them to search for contacts between overseas terrorists and people in this country. but the aclu sued and said that it was an overreach. the court said it was unprecedented and unwarranted and could lead to the government collecting other records. like your banking records. other records like your medical records. so right now lawmakers are trying to make some changes to that law. they have got a few weeks left. the house is supposed to vote on this usa freedom act next week. >> tracie potts, thank you. it's 5:35. a federal grand jury now says the man who plotted to attack the u.s. capitol was trying to help isis. the grand jury added a new charge to christopher cornell's indictment. they say he was attempting to provide material support and resources including himself to

foreign terrorist organizations. cornell was charged in january with attempted murder of u.s. officials and employees. at the time he pled not guilty. cornell is due in court again next week. the million moms march is set for this weekend. that march is designed to support mothers who have lost children at the hands of police officers. this morning, the group will lobby on capitol hill. this afternoon they'll host an afternoon social at the lincoln memorial park. tomorrow's march starts at 10:00. we are seeing yet another sign that former governor martin o'malley is serious about a presidential bid. he's hired a former aide. in 2008 she was the obama campaign southern regional political director. o'malley says he'll announce his 2016 plans as early as this month. this morning, d.c. mayor muriel bowser is set to announce several new members of her cabinet. she'll also take questions from

the media. later this afternoon she's headed to the white house for the national small business awards week ceremony. today, purple line advocates will take maryland governor larry hogan on a listening tour of the planned light rail system sort of. they'll explain the benefits to a cardboard cutout of the governor that tour begins at the silver springs library this morning. advocates want the governor to publicly endorse the purple line sooner rather than later. the metro will open two hours later tomorrow. the stations are metro station, federal triangle and archives and the greenbelt station will be closed this weekend. free shuttle buss will replace trains between college park and greenbelt. genetics lifestyle, a lot of things can cause a heart attack. >> but a call to customer service? we'll tell you about the

ever since the cyber threats happened. the threats poured in on the social media after they criticized the men's rugby team for a chant glorifying rape. mann was mentioned by name in some of the threats. >> people gave out the locations of some of the members and they were threatened to rape and ill kill us. i was terrified. >> the administration was asked to block the app but we're told that could infringe on the free speech rights. they take the allegations of gender based violently. police are hoping you can give information on a man who touched a girl inappropriately. they say the man touched the 17-year-old's arm before the girl got into a dodge ram pickup and drove away. it does not appear the man intended to harm the girl but police want to talk to the man. if you have any information, give prince william county police a call.

leaders in prince george's county want to combat the issue of absent fatherhood. tomorrow, the county council is hosting a free summit. it runs from 10:00 a.m. to 2:00 p.m. in clinton. attendees will brainstorm strategies to tackle this issue. according to the national fatherhood initiative children growing up without fathers are two to three times more likely to experience poverty and drug use and to engage in criminal behavior. today the man who flew a gyrocopter on to the capitol lawn will face a court. hughes was charged with violating restricted air space and operating an unregistered aircraft when he landed on the west lawn earlier this month. hughs could spend one to four years in jail if convicted. prince george's county says governor hogan should give county schools the money they're owed. baker and members of the county council sent a joint letter to the governor. they're asking him to release $21 million next year in the

budget. the governor has been at odds over school funding. it's not clear whether the governor will honor the request. liquor sales will be on the docket for the montgomery county council this morning. they'll take a look at a new ordering system that was launched in february. many restaurants and beer and wine stores say the system is not efficient and deliveries weren't timely. the officials at the department of liquor control say that they're still working out the kinks in that system. and it should get smoother in the coming months. get ready to firm up your memorial day travel plans. this morning aaa officials head to reagan national airport for a press conference. the forecast is a helpful heads up as you budget for gas prices, hotels and airfare. it includes data about whether the prices are going up or down. aaa will share predictions of how many drivers will be packing the roads for the memorial day weekends. always tons of folks. next week maryland officials will swear in the youngest mayor
