will deliver an update at noon. a lawyer for the train's engineer says his client doesn't remember flying off the tracks. dozens of people are recovering in the hospital. eight are still in critical condition at temple university. but we learned they're all expected to survive. investigators are spending their second full day on the tracks today. the search for survivors is on going and the ntsb says the man they really want to talk to is that engineer. news 4's transportation reporter adam tuss is following the latest from philadelphia. adam, what can you tell us? >> that's right, barbara. overnight we learned the engineer's name. 32-year-old brandon bostian from queens new york he had been an engineer on this line before so the ntsb obviously wants to have a word with him. this is the second full day on the tracks with daylight and there's plenty of activity going on out there right now. we've got workers and crews trying to clear as much debris as they can. and they're being very methodical about the way they go

about clearing the scene. being to bostian, the train engineer. as you mentioned, his attorney is speaking for him right now saying that he doesn't remember at all the incident we know he hit the emergency brake right before the crash and what the ntsb will be doing is interviewing the crew over the next couple day, doing a detailed analysis of recorders, testing the signal system and they want a word with the engineer. listen to what the lead of the ntsb told msnbc earlier today. >> we want to make sure we conduct our own interview and do it in a non-threatening environment for him that he can just tell us what he recalls. >> now i think one thing that's really important to remember here is that this is still a recovery operation. there are still people who are missing, who have been reported missing. we've learned search dogs from

the pennsylvania task force have been in here helping with the search. so very important to remember that this is not a done deal when it comes to finding everybody on those trains. back to you. we are working to learn the names of two others who died in the derailment. we've learned derrick griffith is one of the fatalities. he was a dean at medgar evers college in new york city. he also founded a prep school in new york. that school is closed today as his staff remember him. griffith was 42. here are pictures of the five victims identified so far. griffith justin zemser rachel jacobs jim gaines and abid gilani. you can read about them on nbcwashington.com. amtrak is running limited service for a second day, fewer trains are running and there is modified service between washington and philadelphia. all training between philadelphia and new york have been canceled. if you have train tickets outof d.c. check with amtrak before you leave for the station. and there are about a dozen

morning at an apartment building on brooks drive in forestville. news 4's megan mcgrath is live in forestville now. megan, what have you learned about this case and about the search for a suspect? >> reporter: well pat, it happened inside the oak crest towers apartments. actually in a hallway. this complex has a lot of surveillance cameras. and take a look at this. one of those cameras captured the suspect on tape. police are hoping someone will recognize the man in this video and give them a call. this happened at around o'clock wednesday morning the. man followed the 12-year-old into an elevator. when she got out he pushed her to the ground and sexually assaulted her. the suspect has shoulder-length dread dreadlocks and a tattoo on his left forearm. we spoke to a number of women who live at the apartment complex and they say they would like to see more security. >> they need to crack down a little harder. i think they should have like a police right here a police on

every corner in here. it shouldn't get to that level. >> we need to probably do more surveillance on who's coming into the building. >> and police are going to come here to the apartment complex later on this evening. they'll have pictures and will be talking to people hoping that someone recognizes the man in the video so they can make an arrest. >> thank you, megan. in just a few hours congress will hold a hearing focusing on the behavior of the secret service. the inspector general for homeland security will testify about the night two senior agents crashed a car on the white house complex. the ig's report says both agents "displayed poor judgment" and were likely impaired by alcohol. both men denied being drunk. the men spent five hours at the fado irish pub running up a significant tabitha night. the report says the secret service alcohol policy is vague. it goes on to say the secret service director found out about the incident from an outside party. one of the agents was second in

right now, crews are removing the wreckage of two more train cars from the deadly derailment in philadelphia. they're looking for more victims. about a dozen people are still unaccounted for. amtrak canceled all trains between philly and new york. service across the northeast corridor is also limited right

now. today congressman bill schuster is at the crash site to learn more. he's the chairman of the house transportation committee and happens to be from pennsylvania. meanwhile, a baltimore family is pleading for help to find a missing amtrak passenger. they worry bob gildersleeve jr., died when on that train when it flew off the tracks on tuesday night in philadelphia. he boarded the train in baltimore where he lives with his wife and two teens. gildersleeve's father says he's angry at amtrak because it's slow to give him answers. >> he was in the first car, okay? it's turned inside out. they found his phone. his phone, they found but they can't find him or his belongings. >> the 45-year-old is vice president of corporate accounts for ecolab. his father and children plan to pass out missing flyers in philadelphia because they want a sense of closure. with gildersleeve has not been

i.d.'d among the seven people confirmed killed when the train jumped the tracks while speeding around a curve. pat? there are more questions today about why the derailment area doesn't have what's called a positive train control system. the news 4 i team did digging to learn more. the system can automatically sense a speeding train in areas where the speed limit is restricted. the ntsb says it might have saved lives had the system been in place before this derailment happened. >> positive train control is designed to prevent derailments due to overspeeding. so this is exactly the type of an accident that positive train control should prevent. it's designed to do that. >> congress mandated positive train control after a crash between a freight train and a commuter train in california in 2008. the system is used along parts of amtrak's northeast corridor but, again, not in the section where the philly derailment took place. we are expecting new information from philadelphia's mayor today at noon. ahead of that we'll check back

in with news 4's transportation reporter adam tuss at the seen of the derailment watching as investigators continue to comb through the wreckage. >> five firefighters are okay after being trapped in a house fire in montgomery county. fire officials tweeted out this photo of the flames shooting from the roof of the house. firefighters were called to that home around 1:00 a.m. this morning. fire officials say the firefighters sent out a mayday when the wooden roof partially collapsed. the house suffered around $800,000 in damages. amelia tell us about the weather today. barbara, beautiful. temperatures right now in the low to mid-60s, reston as 64 gaithersburg 61. plenty of sun and comfortable once again, a little bit below normal. gorgeous low humidity not as breezy high of 71. mid-70s for highs tomorrow but more in the way of clouds and maybe an isolated afternoon shower back over the mountains well west of the d.c. metro area. getting into the weekend,

humidity builds in on saturday. it's warmer mid-80s. upper 80s on sunday and it's down right muggy both saturday sunday. there's the chance of scattered afternoon showers and storms. the chance of showers and storms on monday. cooler with maybe a lingering morning shower tuesday. right now joos in the boston marathon bombing trial are deciding whether dzhokhar tsarnaev should face the death penalty or get life in prison. prosecutors want the death penalty, his lawyers are hoping for mercy. this is the same jury that found tsarnaev guilty of 35u8 30all 30 counts against him. take a look at this surveillance video from new york city. if you watch closely you'll see a man swing a hammer at two police officers. he hit one repeatedly in the head then officers chase him and shoot him. the suspect is in the hospital in critical but stable condition.

trail issen authorities are barking, you could say, at actor johnny depp over his dogs. they say they should fly the dogs out of the country or he will be euthanized. australia's agriculture minister accused depp of smuggling his yorkshire terriers aboard his private jet when he returned to australia last month. he has until saturday to send pistol and boo back to the u.s. or the dogs will be put down. australia has strict quarantine regulations to prevent diseases like rabies spreading to its shores. depp is filming the fifth "pirates of the caribbean" movie right now. you may have seen this last night. rebel wilson got the best of jimmy fallon during the whisper

right now, the search continues for that u.s. marine corps helicopter that disappeared on a mission in nepal. the helicopter disappeared

bostian from kweepsqueens new york. that's the name of the train engineer who the ntsb wants a word with. before we get to, that i want to set the scene for what's going on in philadelphia right now. that's the crash site. we have workers on the tracks. this is their second full day in the sunshine out here trying to figure out what exactly went wrong. let's show you an overhead shot from the chopper of what the crash scene looks like. it's still a very wide crash scene here in philadelphia. a lot of work to be done a lot of details to figure out about what went wrong and a lot of heavy lifting to do here as there are plenty of crepes. now back to the engineer bostian. his attorney says he has no recollection of the incident whatsoever. we do know he hit the emergency brake right before the crash. of course the train was going 106 miles an hour in a zone where it should have been going 50 miles an hour. that's a serious problem. the ntsb telling msnbc earlier

they want to talk to the engineer. >> we find that most transportation accidents, the operators -- the surviving nd we appreciate that. our agenda is simple, we just want to find out what happened so we can learn from it and keep it from happening again. >> of course we should not lose sight of the fact that this is still a recovery operation here in philadelphia. there are still people who are missing and haven't been accounted for. i've been told the pennsylvania task force has brought in their dogs to continue to search for people in the wreckage here in pennsylvania so we'll have to wait and see. the mayor of philadelphia will give us an update in a half hour from now. back to you guys. >> he was wonderful. he was absolutely wonderful. everybody looked up to my son. there's no other words i can say. right now mothers are crying friends are remembering their loved ones and families are making funeral plans for the people who died when the train

careened off the tracks. we now know the names of five of the victims, including abid gilani. his family lives in rockville. he worked for marriott in bethesda for several years. his wife says they worked together to help others. >> abid was a dear person. he was a very kind person and it's a big tragedy. i. >> gilani had two children. he was heading back to new york after attending a funeral here just days ago. naval midshipman justin zen sierra zemser was on his way home to new york. >> it's clear from the naval academy news conference that justin's friends are heartbroken. he is described business his family at the naval academy as an exceptional young man in the classroom, on the football field and in his character. >> i only knew him for two years

but i was closer with him -- i knew more about him, he knew more about me we were closer than i am with any friend i've had my entire life. at this point, i'm just in -- i don't think i've come to recognize it's happened. >> justin had a 4.0 at the naval academy. officials there say he was working toward becoming a navy seal. pat? 48-year-old jim gaines worked for the associated press. his wife said he was "more precious to us than quick adequately express." gaines lived in new york. his son is 16 his daughter is 11. rachel jacobs had a two-year-old she was going home to in new york. she was in philly for a new job at a tech company. she was the company's new ceo. her family says she was a wonderful mother daughter sister wife and friend. >> so many sad stories. if you're catching amtrak

may 30 will be a huge day for former maryland governor martin o'malley. that's when he will officially announce that he's running for president president. o'malley will do it in baltimore where he was mayor. hillary clinton dominates the

polls. o'malley is presenting himself as a fresh alternative. today former u.s. ambassador to the united nations john bolton is expected to announce his bid for the republican nomination. bolton is widely seen as another underdog but his hawkish presence in the race could pull foreign policy debates to the right. bolton served on president george w. bush's foreign policy team and was a staunch advocate for the iraq war. his decision to run comes just as the iraq war he favored is emerging as an issue in the republican campaign. that brings us to former florida governor jeb bush. he's already under scrutiny for a series of conflicting answers about how he would have handled the iraq war. now he appears to have accidentally let some big news slip. take a listen. >> i'm running for president in 2016 and the focus is going to be about how we -- if i run, how do you create high sustained economic growth. >> you heard it. bush seems to have gotten a little ahead of himself there. he has not formally announced

he's running for president yet he all but said it to reporters yesterday then tried to correct himself. staying unofficial for as long as possible can have big benefits. campaign finance rules don't kick in for bush until he officially declared. right now, president obama is at camp david meeting with arab leaders. there are a lot of concerns among arab nations about whether a nuclear deal with iran will spark an arms race in the middle east. in what's been described as a snub only two of the six nations invited sent top leaders to sit down with the president. we'll hear from president obama this afternoon at a press conference. news that could give starbucks lovers a jolt. we'll tell you how hackers are targeting the chain's popular mobile payment app and gift cards. stay with us. we'll be back.

new information this morning about the engineer of the train that derailed in philadelphia. his name is brandon bostian and his attorney says he remembers trying to reduce speed as the train entered that curve before he was knocked out and suffered a concussion. he says he remembers nothing about pulling the emergency brake. the death toll stands now at seven. right now, cranes and heavy equipment are working to right the overturned cars.

nbc's peter alexander tells us how this didn't could have been prevented. >> reporter: in the maimed remains of this amtrak train, an urgent question -- is the safety of america's rails still on track? while plane crashes have dropped to their lowest level since the '50s, these days you're six times more likely to be killed in a train accident than a plane crash. last year counting freight trains more than 1200 trains jumped the tracks in the u.s. roughly 100 every month. on a passenger train, you put your safety in the hands of an engineer. the man driving the train tuesday night, brandon bostian, was interviewed by philadelphia police wednesday. investigators say his train was going twice the speed limit of 50 miles an hour. >> the train was traveling at approximately 106 miles per hour. >> reporter: this train also hit 100 miles an hour twice the posted speed limit when it jumped the rails in spain in 2013. 79 people killed. speed also to blame in the crash

of this new york commuter train that killed four. unlike on airplanes with two pilots in the cockpit, the train engineer is often alone in the cab, aided only sometimes by something called positive train control, or ptc, an electronic system which can take control of the train if it's traveling too fast or runs through a signal. sections of amtrak's heavily trafficked northeast corridor from new haven, connecticut to boston and philadelphia to washington have ptc installed. but not on the stretch of track where amtrak train 188 took a curve too quickly. >> we feel that had such a system been installed in this section of track this accident would not have occurred. >> reporter: experts say it could have saved lives. >> we expect to continue to get updates throughout the day from philadelphia. there are a number of ways to stay on top of this story. follow us on twitter and facebook and download the nbc washington app. >> right now police in prince george's county are asking for your help in finding a man

hoping to be adopted soon and he's hoping for a family that likes pets. he's been living in a group foster home where he hasn't had the chance to raise his own cat or dog but he'd love to have one or even a bigger pet, he says that would be nice too. meet james. there it is are you excited? >> yeah. >> i'm kind of excited, too. hi georgia. georgia bay, program director at the lift me up therapeutic horse back riding center in false church welcomed james who happens to love horses. would you like to meet our horse something. >> yes. >> oh boy. >> we have 11 horses here that are part of our program. this is tor johnson who will be our volunteer. >> james, nice to meet you. >> and this is niles. >> niles! hi buddy. >> the first horse james saw was niles and it was love at first sight. >> would you like to brush niles? >> all right. how about if we get you a helmet and some brushes so you can go in there and work with him? >> james has been in nosterfoster care since he was three.

>> james enjoyed grooming niles and georgia explains this is a way to make friends with a horse. james said "this looks like a great home for horses." >> the horses can get some freedom and they're not locked up all day. >> that's important, isn't it? >> yes. they need their exercise. >> he says he loves the outdoors himself and enjoys playing just about every sport. >> soccer basketball hockey. biking hiking. >> those who know james say he needs a family to help him to realize his potential and to be motivated to succeed in all that he does. he was certainly motivated to learn how to ride niles. how does it feel? >> it feels great. >> james wants the love of a permanent family. >> it takes a forever family not just a staff of people who are paid to care for him. >> she says james needs a home. he says he hopes that home has pets. >> i think i'll take niles as my own pet if i could. it's happened again. hackers apparently targeting this time starbucks gift cards and mobile payment users around the country. the new scam is so ingenious hackers don't even need to know the account number of the card that they're stealing from. criminals are using starbucks accounts to access your linked credit cards, taking advantage of the starbucks autoreload function hackers can steal hundreds of dollars in a matter of minutes. starbucks says it's working to fix that problem. it's no secret most dogs hate baths. this morning, we're getting a look at a husky that really hates it. >> come on. come on.
