more on this breaking fatal accident in a couple of minutes. it's dry right now, but storms potentially strong to severe later on today. the latest timing for the weather alert day coming up. it's a heated debate in one of the largest school districts. the big decision that could change what your students learn about sex and gender identity in the classroom next year. we begin with the breaking news, melissa just mentioned a construction worker hit and killed on i-95 in laurel. megan mcgrath has more information. good morning. >> reporter: good morning. you can see behind me they're making some progress in hooking up the crash -- smashed up vehicles. the tow trucks are on the scene but right now all of the lane closures are still in place. 95 only squeezing by on the left-hand shoulder. the ramp to the icc is completely closed. you can't get on the icc from northbound 95. this was a fatal accident that happened around 1:30 this

morning and a construction -- in a construction zone that had been set up on the northbound side of i-95. a tractor-trailer was headed through the area right near the accident for the icc, that truck hit a construction vehicle. it was one of the crash attenuators with the arrow on it. it continued on further, hit a second construction vehicle. there was a construction worker who was standing beside that second vehicle. the worker was struck and died later at the hospital. the worker has been identified as 62-year-old randy jury of halifax, pennsylvania. he's a construction worker -- a contractor working for state highway and within this construction zone early this morning. if you normally travel through the area, be aware. there are major delays. we are talking about several miles in terms of the back junes so you'll want to avoid this area with more on the work around, we'll send it over to melissa. what should folks do? >> megan what folks should do on 95 northbound at the icc

you're going to want to take b.w. parkway or 29 instead. right now, chopper 4 over the scene. they're trying to right thing, trying to get a lot of this debris out of the way so that things get cleared up. as far as backups go, 2 1/2 miles on the icc. and now we're also getting backups southbound as folks just sort of are looking at things that way. that clean-up is underway. the ramp to the icc is closed. again, if you're headed 95 northbound you can't get on the icc. amelia? a live look outside, we are seeing mostly to partly cloudy skies across the area. on storm team 4 radar though i'm keeping a close eye on this system mainly impacting parts of illinois and indiana. this is going to be our main trigger for rain and thunderstorms later today. notice these showers out here in ohio. i'm going to keep an eye on this

>> meanwhile, confessed killer dylann roof now has federal public defenders. that is seen as an indication he'll face federal charges in addition to the nine murder charges. new developments released from jail, the second prison employee arrested in the escape of two inmates in new york posted bail. gene palmer posted bail. he is charged with destroying evidence and promoting dangerous contraband. a prison seamstress told investigators she smuggled hacksaw blades and escape tools inside raw ground beef. the district attorney says palmer took that frozen meat to david sweat and richard matt's area in the prison where inmates are allowed to cook. palmer's attorney says he didn't know anything was in the beef. sweat and matt escaped nearly three weeks ago. police have zeroed in now on a cabin where investigators found

national guard fighter jet during a training mission. the f-16 went down last night in arizona. a pilot with the 162nd wing of the arizona air national guard was on board. his condition has not been released. ft. hood army base said their personnel is there to secure the site until the air force takes over the mission. it crashed near douglas this is five miles from the airport. the plane ruptured a gas line when it crashed, sparking a brushfire. military officials are investigatingeing exactly what happened. thanks, kristin. prosecutors in maryland are again for a judge to ban attorneys from sharing evidence in the freddie gray case. that's after someone leaked a copy of gray's autopsy to "the baltimore sun." now, the paper reports the state

is quote outraged. defense attorneys are leaking evidence to the press they say to make their clients look better. we are learning more this morning that hundreds of patrol car dashboard cameras in prince george's county are broken. according to our news partner wtop an internal audit revealed about 30% of them don't work. about 300 have hardware or software issues and others have playback errors and they don't switch on. the police department is starting to phase out the dvd based cameras. they will replace them with cameras that install information on a hard drive. take a look, this man is suspected of setting fire to tucker's bar and lounge in upper marlboro. take another look at his photo on the nbc washington facebook page. a firefighter was hurt as crews battled flames for six hours last wednesday morning. the fire caused more than

$2 million in damage and left 20 people without jobs. the casket that washed away in suitland will be reburied today. all the rain from saturday's storms buckled the retaining wall at the cedar hill cemetery. that was supposed to be fixed on tuesday. a spokesperson tells news4 only one plot was disturbed. charles severance and the lawyers will be back in court today to argue for even more proposals about his trial in october. severance is charged with three murders in alexandria over a space of ten years. today, defense lawyers will ask for a mental health expert to assist their team. prosecutors are asking the judge to rule that jurors will be told that they may not seek the death penalty. later this morning an attorney for james holmes will present their side of story regarding the deadly movie theater shooting in colorado.

they are trying to prove to jor jurors that holmes was movie theater. the trial is expected to run through at least august. holmes faces the death penalty if convicted. we're learning more about the man who was killed when his pickup truck ran into the downed trees in poolesville. the man is named elmer froelich. family members say he went out to buy gas for his generator after his power went out during the storms tuesday night. he hit the tree on darnestown road and died at the scene. [ bleep ]! >> you can hear a lot of screams and some other words we cannot put on tv at this hour after people at nats park witnessed this scene. take a look. lightning hit a construction crane tuesday during those major storms. that caused a huge sound, that sounded like an explosion. you can see the flames popping out of the construction crane as well. no one was hurt.

ereaders now instead of a book, and that light from the ereader is not helping you either. beautiful day this morning. weather and traffic on the 1s. storm team 4 meteorologist amelia segal is here to tell us more about the summer day ahead. >> good morning, eun and aaron and good morning to you. humidity increases throughout the day today. the morning, midday and early afternoon hours though, quite nice. temperatures will warm into the upper 80s again today. and you really aren't going to feel the mugginess until the late afternoon and evening hours. here's the latest on storm team 4. this storm is impacting heavy rain in indiana right now and is the main cause for storms later on today. the timing as we start off, you can see as the system moves to the areas, noon, we're still dry, but mostly cloudy skies at that point. 4:00 p.m., maybe an isolated shower or thunderstorm but i think it will hold off until 5:00 or 6:00 when we start to track areas of rain and strong to severe storms.

right now, closest to the crash which is right in this area they're at the exit for the icc. you see the left shoulder and now the left lane getting by. so that's a change from the past couple of minutes. behind this though we have a three-mile backup, if chopper can widen out for us, and you can see that no lanes are getting by much before this at this point. so still have this fuel spill and cleanup underway. the ramp to the icc is still closed. if you're on the icc you can get on to 95 north our south. and alternate is b.w. parkway or 29. southbound centreville road, browns lane, a brand new crash there. in that area. 395 north at washington boulevard, a crash. aaron? >> melissa, thank you. 6:23 right now. the ntsb hearing about metro safety can mean big changes. at day two of the hearing, a metro union representative said

employees are afraid to speak up about problems. the testimony raised some concerns that not reporting small problems could turn them into big ones. the hearing addressed the deadly smoke emergency that killed a woman in a metro tunnel back in january. the nation's top railroad regulator says she will enforce the december 31st deadline for amtrak to install critical safety technology. it's called positive train control. a lot of us talked about it after last month's deadly train derailment in philly. ptc could have prevented the accident and saved lives. railroad faces fines of up to $25,000 a day if they don't install it by year's end. amtrak says it will meet the deadline. most others probably will not. heads up if you drive a jeep, your car can be leaking water and damaging the controls.

breaking news on the roads this morning. a live look at i-95 in laurel right now. where earlier this morning a construction worker was hit and killed. it happened about 1:30 this morn. >> randy jury was killed when a tractor-trailer headed northbound on 95 struck two construction vehicles. the driver of the tractor-trailer was taken to the hospital. we'll get the latest from news4's megan mcgrath on the scene later this hour. but right now, melissa mollet is keeping a close eye on 95. how is it looking right now? >> it's improved quite a bit.

we are watching for possible ruling on same-sex marriage or the president's health care law. let's go live to nbc's tracie potts. tell us what might happen today. >> reporter: well, on same-sex marriage, the could -- they could say you have to recognize the marriages in another state or every state must do it to gain tee -- guarantee equal protection under law. on obamacare they're being asked to look at four words in that 2,700 page law. those are establish by the state. in other words, in states like virginia that do not have their own health care exchange, can people in that state get subsidies? right now, there are 285,000 people in virginia getting subsidies averaging about $258 per month. without them many of them could not have afford health insurance. this could be a decision that has wide reaching impacts including here in northern virginia. where so many people are getting those subsidies. we don't know if both decision or either of the decisions will

come down today or tomorrow or monday as the court winds down their term. >> tracie potts thank you. also on the hill today, we could see more fireworks as the office of personnel management director faces another panel of angry lawmakers. lax security cyber security at opm left millions of federal workers' data vulnerable in a pair of hacks last year. opm director katherine archuleta refused to say if the number is as high as 32 million. we learned that the i.t. department will get a major overall, however, a lot of lawmakers say archuleta needs to resign. parents, listen up. the school board will vote on the budget and we watched as they voted whether to give schools more money. now the board is scrambling to make ends meet even though it will have a smaller piece of the pie. we'll keep you posted on the

vote at 7:00. today, larry hogan is expected to make a big announcement that many suspect could reveal his plans for the purple line. news4's molette green has more on what this could all mean today. molette? >> reporter: aaron, good morning. yes, we are live outside one of the proposed stops -- the silver spring library behind me. a decision on the light rail line is one of the most watched in the entire state. now, the governor has been highly critical of the costs estimated at somewhere close to $2.5 billion. he's pressured folks to come up with ways to cut down that price tag. possibly asking montgomery and prince george's counties to chip in even more dollars. this 16-mile light rail line will run -- run by the maryland transit administration and

where he later died. now, this all happened right around 1:30 this morning. that tractor-trailer was headed north and the truck entered the construction zone. slammed into one construction vehicle. continued on and then struck the second vehicle with the construction vehicle standing next to it. that worker is identified as 62-year-old randy jury. and in terms of the traffic impact here we have seen some improvement. just within the last few minutes. they did open two left bound lanes but the ramp to the icc is still closed. so you will not be able to access the icc, at least not now, from northbound 95. back to you in the studio. >> thank you. it is 6:46 now and convicted boston marathon bomber dzhokhar tsarnaev is facing death, but the appeals process will now likely take years. >> he shocked those in court yesterday when he apologized to the victims and the survivors of the deadly 2013 attack. >> nbc's ron mott has more on

how the victims are reacting. good morning to you. >> reporter: to say this is a surprise may be an understatement when dzhokhar tsarnaev got up to speak, almost no one expected that. but he spoke in fact -- he spoke for a short while and in terms of reaction from victims and their families it was mixed. one person actually said that he was happy that he spoke. he said he should be given some credit for speaking to the victims and families even though it won't how he feels about hit. but others said it was an oscar like speech. he said they opened with religious references that i didn't like that. it took him a while before he got around to actually apologizing to the victims and the people who lost their lives in the bombings two years ago. but suffice it to say he's on his way to federal death row. one of 60 inmates with that distinction. he may be sent out to colorado to the super max.

a nice start this morning. as we work our way throughout the day, clouds increase and it's going to be this system that is our main cause for rain and thunderstorms during the evening hours. so your hour by hour forecast for today, 8:00 a.m., partly sunny. mid 70s. low 80s around lunch time hours. mostly cloudy. maybe an isolated thunderstorm during the afternoon hours. at 3:00 p.m., we hit 87 degrees. as we get into the evening hours, around 8:00 p.m. storms are likely and a temperature of 79 degrees. so the weather concerns this evening would be high winds that could produce some wind damage and some heavy rain. the torrential downpours that we have been seeing, we saw it on tuesday and saturday. that is possible again tonight. also we can't rule out some hail with the storm and the isolated tornado is possible today. of course, veronica and doug will be in this evening keeping you updated with the forecast. for tomorrow, a shower or thundershower is possible. rain on saturday potentially severe weather on saturday.
