sure. stay with us, "news4 today" continues now at 5:00 a.m. >> "news4 today" begins with breaking news. >> good morning. i'm angie goff with this breaking story out of vienna where an historic nuclear deal has been reached. a look of world leaders here taking photos a short time ago. taking a picture together after this deal with iran was struck. it curbs the country's nuclear program in exchange for billions of dollars in relief of sanctions. key parts include keeping iran from making enough material for a nuclear weapon for ten years. it also ups inspections at facilities that includes military sites. here in washington there's been some pushback over this deal. some don't think it's tough enough. congress could hold a vote and still disapprove the deal. we're working to find out when we can expect to hear from president obama on all of this. this is a developing story. we'll continue to follow it.

good morning i'm aaron gilchrist. >> i'm eun yang. welcome to this tuesday, july 14, 2015. we want to check our forecast first. >> storm team 4 meteorologist tom kierein has the headlines. >> we have had more rain again this morning. we have the passing fast moving showers that are leaving the pavement wet in northern loudoun county, montgomery county. right now the showers are coming into howard county, out of frederick county into carroll county. walking to the metro or walking to work, some of the pavement will be wet there. in the mid 70s. sunshine breaking out. partly cloudy in the afternoon. dry walkways, but hot. temperatures in the upper 80s, so dress accordingly. drink plenty of water, you don't need your umbrella or rain boots during the daylight hours, but sun block, sunglasses, short sleeves. a look at the new updated severe risk zone for the region later on today that's coming up at in the next weather and traffic on the 1s at 5:11. what is happening now melissa?

>> dry pavement, dry pavement right now, 66 just east of sudley roads. 270 of course as i have shown you all this morning pretty wet here this morning. especially the top portion of 270 once you get past germantown. suitland parkway, an overturned vehicle. most of the crash has been moved off to the right side of the roadway. should be able to get past that this morning. 66 into and out of town and beltway at colesville road, moving quite nicely. >> thank you. today lawyers will ask a d.c. judge to release a man who's been waiting for retrial for murder. ingmar guandique has a hearing this morning. five years ago a jury found him guilty of killing form earn d.c. intern chandra levy. however, the judge said that the testimony was unreliable in the case and the lawyers will ask for his release until that retrial starts in march. another hearing also happening today in d.c.

elijah smith will appear before a judge at 9:30. he is accused of the attack you see in the video. metro transit police say he beat up a 69-year-old man on an escalator at the eastern market metro station three months ago. the top politicians in d.c. maryland and virginia will be talking about your safety on metro. u.s. transportation secretary anthony fox scheduled a meeting for this afternoon. they'll discuss the financial problems and the search for a new general manager. they'll also talk about the safety fox says riders and employees need and deserve. a traffic alert this morning that may affect your commute. closures on 395 for months to come. those closures are a part of the effort to extend the third street tunnel and make room for the capital crossing project. all lanes will be open from 5:00 to 11:00 a.m. and 3:00 to 8:00 and 5:00 to noon to 11 p.m.

395 will be cut to one lane in each direction. these closures will be in effect through january of next year. in the future you could face higher penalties, tougher penalties for all terrain vehicle and dirt bike violations in the district. today kenyan mcduffie will introduce the bill to do that. coming up, megan mcgrath is live with the breakdown of the proposed legislation and why some say it's so critical to have it now. more traffic alerts this morning. your commute over the american legion bridge may soon be a little faster. vdot wants to extend the express lanes into maryland. vdot says it wants to fix the issue of priority in the coming years and they want to extend the express lanes all the way to the 270 spur. another bridge will be needed to address future traffic volume increases. 5:05 now. decision 2016, the campaign trail heads to washington. democratic candidate hillary clinton will visit capitol hill today. the former secretary of state will meet with house and senate

democratic lawmakers. she'll also meet privately with the congressional blacks, hispanics and asian pacific caucuses. this is her first formal visit to capitol hill since announcing in april. right now we are working to find out if donald trump's sign at his future hotel site will be taken down. charles allen is questioning whether the sign has the proper permits. he sent a letter friday to the department of consumer and regulatory affairs. allen says the sign may be interpreted as a campaign sign for his presidential candidate. news4 is learning that lawyers for the consumer and regulatory affairs hopes to respond quickly to this permit question. out of pamplona, spain, the final running is wrapped up. no one was gored, good news. but six people were hurt and treated for nonserious injuries.

this is all part of the nine-day festival. it dates back to the 16th aaron. >> thank you, angie. six minutes after 5:00 right now and we are hours away from the moment when the nasa spacecraft will pass by pluto. it's taken nine years and billions of miles but we could learn secrets from the dwarf planet's surface as early as today. we want to show you how precise this journey had to be. it's like throwing a strike of a baseball from about 3 billion miles away. this spacecraft has to hit the yellow box you see here or it won't get the critical information from pluto and one of pluto's moons as well. the green box that you see here is about 60 x 90 miles wide. the inner box is the one we're talking about, that has to be hit here. nasa says new horizons the spacecraft is right on target. it is scheduled to hit that prime location at 7:49 this morning and then fly on by. it was a devastating crash

in the day ahead, federal investigators will hold a hearing into a deadly cargo plane crash in afghanistan. the crash killed six crew members from michigan and one from kentucky. the boeing 747 crashed just after takeoff from bagram air base in 2013. it was headed to dubai. it was carrying 207 tons of cargo. the national transportation safety board will meet at 9:30 this morning. we have some new information

this morning about proposed memorial to honor president eisenhower. today, taiwan will announce it is giving $1 million to help build the memorial. the gift comes during a critical phase. right now organizers are trying to figure out if they can raise $20 million in private donations. it's been in planning stages for 15 years. last week it won the final approval for the overall design despite objections from his family. weather and traffic on the 1s. and tom kierein with what you need to know to get out the door. >> what you need to know, the pavement is wet frederick, washington county. because of some showers that are passing through. they're exiting frederick moving into carroll county. now we have a flash flood watch that's been issued. all this area in green for the metro area. it's in effect until 2:00 tomorrow morning. watch out for high water tonight and some thunderstorms that are coming through. here is the severe threat zone

you're watching "news4 today." >> a mother and an uncle are charged in the death of a maryland boy. police in washington county arrested 26-year-old oriana garcia and jacob barajas. both charged with second degree murder. jack garcia died after he was beaten for eating a piece of birthday cake without permission. this was in hagerstown. investigators says he uncle handcuffed him to the chair and his mother's boyfriend, 30-year-old robert wilson, beat him unconscious.

wilson is still charged with assault right now, since he was arrested before jack died. police say the mother turned away paramedics when they were first called to that home. she said the boy was congested. paramedics were called back four hours later and the boy died on july 5th. today a 23-year-old american is expected in federal court accused in an isis inspired terrorist plot. alexander ciccolo is the son of a boston police captain. a police source tells nbc news his father reported him to the fbi after learning he was plotting to attack college cafeterias. neighbors say they had no idea. >> a small community where we know each other. i know each other around here, neighbor to neighbor. when you hear something like that it's a big shocker. it really is. act of terrorism, bombs being made. right across the street from my house. >> investigators say an attack was unlikely because the man was under constant surveillance.

a source says he suffers from mental illness and he was estranged from his father. it's 5:18 today. a d.c. council members want police to crack down on people driving all terrain vehicles and dirt bikes in the district and is proposing tough new penalties. this comes as police are looking for people of interest seen in dirt bikes in the shooting death of a reporter. megan mcgrath has more on this story. good morning to you. >> reporter: good morning, eun. all terrain vehicles and dirt bikes it is illegal to drive them on district streets but the law is often ignored. if you're caught the penalties just aren't that stiff. but council member kenyan mcduffie is trying to change all of that. he's introducing a bill later on today that would create a tiered system where penalties fines and jail time would increase with each violation. now, police are looking for more than a dozen people of interest in the shooting death of reporter charnice milton.

surveillance video shows them riding atvs and dirt bikes. now, under this legislation being introduced today the first offense if you're caught riding one of the atv or a dirt bike, you could get 30 days in jail and a $250 fine. for a second offense, 90 days in jail, a $500 fine. you could have your license suspended for up to six months. for a third offense, 180 days in jail, $1,000 fine. and you could have your license suspended for one year. currently there's one penalty, 30 days in jail and a $250 fine. no matter how many times you were found in violation. and the council member is trying to change that and will be introducing this legislation later on today. reporting live from the wilson building megan mcgrath, news4. 5:19 right now and prosecutors are reviewing the death of a woman in fairfax police custody.

natasha mckenna died in february when sheriff deputies tried to transfer her out of the adult detention center. she was tasered multiple times and news4 spoke with mental health advocate pete earley on an ad hoc committee to reform police. >> he doesn't mention she was in jail for nine days, she was handcuffed, had leg irons on and then when she only weighs 130 pounds and she had six deputies around her in a controlled environment. and yet, somehow she's responsible for bringing all this on. >> police tell news4 there is video of the incident and it has been reviewed. there is a new push for federal aid for baltimore after the unrest in the city three months ago. several democrats signed a letter to the president asking him to recognize the violence there as a major federal disaster. that's according to "the

washington post." last month fema ruled it was not a major disaster and didn't deserve federal financial aid. maryland governor larry hogan is appealing this decision. are your kids getting too much screen time? pediatricians say the best time to curb the amount of time kids spend on their phones is to cut back yourself. they say young children often copy the behavior of adults. part of that study conducted at a restaurant found the majority of parents were using their phones while dining with their kids. those kids were also more likely to be spending time on their devices. >> yeah. set the example. although a lot of us do as i say not as i do. 5:21 and "news4 your health" that could have you questioning how long you're sleeping each night. this is especially true if you have insomnia. a new study shows that people aren't great at judging how much they actually sleep.

people who don't sleep much tend to overestimate their sleep and some people with insomnia are underestimating their sleep. that means there are people with insomnia who could be sleeping the right number of hours each night which is typically between seven and nine. i think i was a child the last time i saw seven to nine hours a night. >> an interesting study. we think we're doing something we're not actually doing. all right. 5:22 is our time right now. look outside look at that. >> just like that, aaron gilchrist. >> what is that, fog or clouds? tom, what are we seeing here? >> those are low clouds passing over the metro area now. they had been producing some rain north of washington. about half an hour ago. now that's quickly moving away. the storm team 4 radar showing it's in howard county now and coming out of frederick and moving into carroll county north of baltimore. a large area under a flash flood watch. northern virginia central shenandoah valley. the metro area. much of maryland in effect until 2:00 tomorrow morning.

mostly from storms coming in tonight. watch out for high water tonight as a line of downpours with thunder and lightning is going to move on through. by 5:00 p.m. we'll still be dry here, but some showers and thundershowers will pop up out of maryland and west virginia. then by 7:00 p.m., closer to the shenandoah valley and washington county and maryland with some downpours. it's after that that they're getting to the metro area, fauquier northern montgomery and frederick and maryland and right into the metro area from prince william and culpepper and right through fairfax county into southern montgomery and the district by 9:00 p.m. it's after that they're into the eastern and southern suburbs, prince george's, charles county. then moving into st. mary's, the northern neck and the eastern shore by midnight tonight. the impact very low chance of any tornadoes, but pretty good chance of high winds and hail as well as that flash flooding potential as the storms move on through. before then we'll be making it

dehydration. otherwise, she's okay. right now no sign though of the plane or word on the fate of her grandparents. 5:26 now. later this morning closing arguments will begin in the trial of man accused of opening fire inside a colorado movie theater. james holmes killed 12 people and hurt 70 others in that shooting three years ago. his attorneys have one last chance to convince jurors he was going through a psychotic episode. prosecutors say holmes methodically planned and carried out the attack. he could face the death penalty. the search for the father of a missing baby in california is over. matthew graham and his 6-month-old baby are dead. graham was shot and killed by police following a car chase yesterday morning. police are assuming the young daughter is also dead. earlier this month, graham told police his daughter was taken from the crib while they slept in sacramento. after inconsistent statements, graham became a person of interest. the search for the baby's body

take issue with that it isn't enough. it's unclear if they'll have the power to override this decision. which curbs iran's nuclear program in exchange for a lighter economic sanctions. now, under this agreement iran agreed to limit production and access for ten years while opening up to more u.n. inspections including at military sites. this is a story that is constantly being updated on the nbc washington app. an easy way to get some new information throughout the morning. aaron? >> thank you. it's 5:33. a developing story in the manhunt for the escaped mexican drug kingpin. joaquin guzman must have had inside help to escape from the maximum security prison, and investigators are questioning 32 prison employees including the director. this is the second time that el chapo has escaped from the prison. after the first escape he was on the run for 13 years. we are now waiting for the official announcement the associated press says the pentagon plans to end its rule

saying transgendered people can't serve in the military. it's one of the military's last barriers based on someone's gender or sexual identity. once that announcement comes out, the dod will have six months to implement that change. today, president obama travels to philadelphia to speak at the naacp convention. today he is expected to talk about criminal justice reform. and improving the justice system was part of his recent eulogy for the minister gunned down in charleston, south carolina. ♪ that is the maryland state song sung every year at the preakness stakes. now, the song "maryland my maryland" is under fire because it was written by a confederate sympathizer in 1861. last week a delegate from frederick county proposed having the song replaced by a poem. a long time annapolis resident suggested replacing it with "my

home my maryland." that was composed with the naval academy glee club. we know that faulty switches were responsible for 124 deaths and 266 injuries. that's according to the fund set up to compensate victims. victims' families are being offered $1 million each. gm was aware of the faulty switches on millions of small cars for more than a decade but didn't recall them until last year. check on your freezer. a major recall this morning involving stuffed chicken products. more than 1.7 million barber foods frozen chicken products are being recalled in the u.s. and canada. for a full list of the products which may be contaminated with salmonella, head to the nbc washington app. it includes stuffed chicken packaged in six individual packages per box. almost 60,000 products were recalled earlier this month and that recall is expanding after

contributing to the recent spike in d.c. crime. at a community meeting in southeast last night, a former synthetic drug user told news4 one of the draws is the price. we are also learning that the drugs are hard to detect in probation tests. >> initially, tests weren't developed to test for ka nab aboyds or synthetics and now there are tests that can detect. however, they can't detect all of them. >> d.c. police can shut down any business selling synthetic d for several days and businesses can face a $10,000 fine for a first offense. they risk losing their licenses altogether if caught a second time. right now herndon police are looking for a man that tried to kidnap a girl. that girl was waiting for the school bus on spring tide place yesterday. a man in his 30s or 40s offered her money to come with him and the girl walked away though. he then tried and failed to physically force her to leave with him. a warning now for walmart shoppers in virginia.

if you recognize this man you see here you may be able to help police in prince william county. a 20-year-old woman -- or a woman in her 20s said that the man rubbed up against her and touched her inappropriately at the walmart in dumfries on friday. we put the picture of the man on our facebook page. more women who say that bill cosby raped them are coming forward. beth ferrier and rebecca neal are asking for the release of the deposition from ten years ago. cosby said he gave drugs to women in order to have sex with them. part of it came out last week, but the women say that's not enough. >> we will pursue mr. cosby until the full truth comes out. >> cosby has been accused of sexually assaulting more than a dozen different women. he denies the claims and has not been charged with any crime. if you are one of the

cancer. this was published online in the "journal of the american medical association." 5:50. we are a few hours away from the moment that a nasa spacecraft will pass by pluto. it is being led by scientists in laurel, maryland. storm team 4 meteorologist chuck bell is right there. we're both geeking out about this. we are waiting for the pictures to come back from pluto, right, chuck? >> absolutely. it's going to take a little while before we get the pictures back, but it's an exciting morning out here. the new horizon spacecraft left cape canaveral 9 1/2 years ago and it's been a long time getting out there for sure. sending back a lot of information. it did a close pass by jupiter years ago but it's just the distances that get you amazed at all of this. so pluto is several billion miles away from us. and these are some of the images they're sending back now. the spacecraft is only 61000 miles away but look at how fast it's ticking by the miles here. when you're driving your car at

60 miles an hour you're doing a mile a minute. i did the math, it's moving along very, very quickly. less than two hours away from the closest approach and keep in mind, it will be a little less than 8,000 miles away. but that's four billion miles from here and aaron it takes eight minute for a beam of light to get from the sun to earth. it takes that same beam of light five hours to get to pluto. when they have to send information to and from the spacecraft it takes 4 1/2 hours to get the message out and then 4 1/2 hours to get it back. a great technical achieve by nasa and we'll talk to the folks who are out here and this is one of the great geeky science things for sure. >> major achievement that you understood all that and were able to explain it so that i could understand it too. >> what? >> i got it. i got it. i got the important point there.

>> and it's a quick fly by too. it will be snapping pictures as it goes by. can't wait to see the images. so exciting. well, here this morning as you look at your screen, it's the radar and showing some showers that did pass on through quickly overnight just north of washington. some of the pavement is wet. now quickly moving off to the north and east, getting a few showers from the island over to chester town. this is a big area under a flash flood watch. green areas from the central shenandoah valley northern virginia, much of maryland. in effect until 2:00 tomorrow morning. watch out for high water tonight as we'll have some heavy downpours likely moving in, but not until tonight. this is as of 5:00 p.m., still fine. most of the area. but a line of some showers and thunderstorms will begin to develop in western maryland and west virginia. by 7:00 p.m. they're into hagerstown martinsburg, winchester. after that, around 8:00, around leesburg warrenton, up to frederick, maryland. then getting closer to the metro

area, coming right into northern virginia and from fairfax county down through prince william and stafford and spotsylvania and culpepper, and then up toward montgomery county and the district by 9:00 p.m., that's when they'll come on through. eastern suburbs after that by 10:00 p.m. into southern maryland by 11:00 in the northern neck. now it has a very low chance of any tornadoes. but a pretty good chance of having high winds with storms. hail and flash flooding as they move on through. they will have a moderate to high impact, if you're out and about this evening with the heavy downpours coming through with some high water. then tomorrow, much better lower humidity moves in. it will be in place thursday and friday too. only a small chance of a storm for tomorrow. next chance for storms is on sunday. melissa, what's happening? >> brand-new crash here, 66 east. we are seeing a 2 1/2 mile backup as you're approaching 123. center lane is blocked. going to cause some issues. outer look at 395, crash on the shoulder and another update 95
