guaranteed it will hear his appeal but ruled today a few minutes ago he can remain free from prison while they consider it how long will that be? could be months. the supreme court of the united states is not supposed to reconvene formally at the high court until october. it could take some time after that as well. at the live desk, i'm scott mcfarlaacfarlane. extreme recklessness, now a loudoun county judge describes a deadly stunt that killed a 17-year-old kid. his friend pleaded guilty in a case of car suffering. news's david culver is live outside the house in leesburg. what are you hearing? >> reporter: defendant 19 years old signed that guilty plea in court today admitting to driving recklessly in august of last year. i want to show where you this happened, it was in a shopping center not too far from dulles town center. now, the suspect in this case, the defendant, was driving the car at the time as his friend was sitting on the trunk. the stunt then took a tragic and

deadly turn. >> he was going approximately five miles an hour and the car shifted into neutral or he shift it had into neutral. that jolted momentum was enough to cause his friend to slide off. >> reporter: so, kareem will spend one month in jail. he has got to pay a fine and also got a suspended license. we did talk to him outside of court here. he has a message to the parents of his friend and he is going to share that ahead at 5:00. he also had some pretty tough words from the judge. the judge was very blunt in what toad say to him i will share that in our next hour as well. barbara? >> thank you, david. a george washington university student is missing in south africa. nick upton was swimming near cape town yesterday and was pulled from shore by a rip current. upton is a junior and he is from connecticut. he was studying in south africa. he belongs to the kappa alpha order and is a member of the

men's rowing team. i'm mark segraves in the district, where over the weekend, police put just about every available officer on the street to deter violent crime. and yet, there were two murders and several shootings. we spoke to local leaders who called the all hands on deck initiative a success. but neighbors are calling it something else. and they say putting more police on the streets does more harm than good. coming up at 5:00, you will hear from both sides and you will hear what's next in the mayor's plan to fight violence. right now, thousands of students in our area are making their way home from the first day of school. among those starting the new year, montgomery and charles counties in maryland and prince william county and loudoun in virginia. our back-to-school coverage starts in virginia. >> reporter: i'm julie carey in loudoun county where this year, there are more full-day consistenter garteners than ever before in the district even though it is not offered to all

students. last year, just 11% of loudoun county's kindergarten-aged kids attended full-day class. this year with added funding, it has been bumped up to more than 30%. preference is given to children that might face learning challenges. >> with that expansion, ber targeting students who will benefit the most from kindergarten that includes students from low-income families, special needs students and also english language learners. >> reporter: other end of the school spectrum there, is a big change in louden county. you think all mild and high schoolers would be celebrating no more mandatory midterms or finals but coming up on news4 at 5:00, you will hear from students who are sceptical about that. a record number of students went back to school in montgomery county today as well. more than 156,000 students are enrolled there this year. they can look forward to a little more sleep. middle school and high school students are starting 20 minutes later this year. elementary schools are beginning ten minutes later. students also went back to class in charles county today. the school district built more

snow days into the calendar by shortening spring break. to celebrate the growth of its free breakfast program over the past five years, charles county will serve up breakfast for all students next week. and george mason university started classes today as well for 34,000 students. there are students from all over the 50 states and 130 countries. more than 6,000 of them live on campus. some in the new taylor hall, which opened its doors to students for the first time this year. doug's been warning us about the muggy weather that was moving back in our area. and now we are looking at maybeí a few showers. >> a couple showers, but the real thing that we are going to be dealing with the next couple of days is going to be the heat and that's, of course, something we will be watching the next couple of days. >> looking at the kell lan dar, too the last 90 we had around here was last monday, now we are talking about getting back to a streak of back-to-back 90s. it's been a while. >> it has been a while we were supposed to get there this week. yesterday, a high of 89 held down by some of the cloud cover today. even more cloud cover, but we

have seen those clouds move out and now starting to see sunshine and the temperatures are responding. near 90 in fredericksburg it is 90 in winchester, toward frederick, 88, leesburg, 86 in manassas. a very warm, humid day today, what we expect. we mention the shower chances, nothing around the d.c. metro area but just back to the west, up around the martinsburg area, hagerstown, back into portions of west virginia, we are watching some showers making their way down to the south. if you live out this way, winchester, blue mount or frederick, you may see showers this evening. the rest of us, sunset tonight, sun going down at 7:40, days continue to get shorter and shorter. 86 degrees at 7:00. by 11:00 tonight, around 79. a very warm night, a very humid night, the heat comes back. veronica has more on that in a minute. >> thanks, doug. right now the family and friends of adam ward are remembering the photo journalist in virginia. they are gathering at salem high school where he grant waited. ward and fellow journalist, allson parker, were shot to death during a live tv broadcast last week and his funeral is set

for tomorrow. the only survivor of that on-air shooting is doing well. friends and family of vicki gardner are posting regular updates on her recovery on facebook. one post from sunday said she did a couple of laps around the hospital icu. and has shown great endurance and strength. gardner had several surgeries since being shot during that interview. a deputy gunned down in cold blood. prosecutors lay out the evidence in a murder that leaves a family without a dad. the pope is coming to the u.s. in about three weeks. we have got new word on how it's goin

including new information about the handgun police found in miles' home. president obama is making an historic trip to alaska right now to talk about climate change. the president left this morning and is expected to land in alaska within the next two hours. this is the first time a sitting president has visited the alaskan arctic. he plans to visit a receding glacier and talk to coastal villagers whose homes and livelihoods are threatened by eroding shore lines much the trip is the latest in his high-profile push to highlight the impact of climate change. thousands of people are expected to travel here to get a glimpse of the pope. we have an early look what the that means for your commute to work. why is kim kardashian

we are just about three weeks away from pope francis' first visit to the united states and d.c. and a lot of people are starting to get excited. >> even if you don't plan to catch a glimpse of the pope, the visit could have a huge impact on your daily routine. news4's transportation reporter, adam tuss, join us from the bat silica of the shrine of the immaculate conception. >> any idea of the scale of these road closures? >> reporter: chris, i think it's safe to say that this is going to be a challenge for everybody involved. look, the pope lands september 22nd. it's a tuesday. lands in the afternoon. and he is going to be moving around the area for the next three days. so, the national parks service

hasn't released an exact detail about full road closures but what we've seen with past events like this is full rolling closures as the motorcade moves around. we know the pope is going to be in places like here, the basilica, the national shrine of the emaccue late conception, the white house ant capitol building. it is going to be a challenge over those three days getting around. >> you have been talking about transportation issues when the pope is here. what about metro? how will the pope's visit impact them, the folks who ride? >> reporter: certainly, an increased focus and increased demand on the rail system. the brook land station here at catholic university, just a few blocks away from the main event. the pope is going to be holding an outdoor mass here, 25,000 people with tickets expected to attend the mass here at brook land. so that station's going to get a bit of a workout that day. metro says on that day, probably going to be running full rush hour service throughout the entire day. so you're going to be experiencing larger crowds throughout that day certain labor day over those three days.

>> adam, i mean, we know those crowds are not just going to be folks from our area. any indication our rain the going to be busier? >> reporter: you know, chris, i asked the airport authority if it had seen an uptick in any sort of private jet bookings, any of those kind of things going on in this area during those three days, they say they haven't seen anything like that yet but as the date gets closer, they will probably know more. we do know from past inaugurations that they have seen those kinds of upticks. so we will fee that happens this time. all right, thanks, adam. >> thank you, adam. well, you may have seen some extra police activity around the u.s. capitol this morning. it was just a drill. and it will start again this evening. u.s. park police, capitol police and officers about the district are conducting evacuation exercises. the drill will get back under wait 6:30 this evening. the choppers will land on both the east and west fronts of the capitol building. you may run into some street closures in the area around 8:30 tonight. the solar system's smallest planet has captured the world's attention it has been fueled by

crashes. louisiana is the worst state in the country for drivers. now to a heartbreaking case of animal cruelty a lot of you are talking about online a humane society in maryland charged the animal's owners with 15 counts of cruelty and we want to tell you, a lot of you are going to find this video a bit disturbing. animal welfare workers found three horses earlier this month emaciated, with hooves so overgrown, they curled. a vet put down one of the horses. the other two are in critical condition. today, they settled into a rehab facility in woodbine about halfway between frederick and baltimore. a belle fair worker says the animals likely had not seen a vet in 15 years. this video shows one of the horses running around with their newly treated feet. people, especially women, continue to sign up for the infidelity website ashley madison, even after hackers leaked personal information about millions of its clients. today, the website's parent company, avid life media, says

more than 87,000 women signed up for ashley madison in the last week. and sent more than 2.8 million messages through that site. avid life media also struck back at reports that predicted the company's demise saying "despite having our business and customers attacked, we are growing." kim kardashian got into trouble for tweeting about a morning sickness drug and ignoring the side effects. the food and drug administration scolded the drugmaker behind the social media campaign and officials say leaving out disclaimer details can mislead the public. the fda will issue new social media guidelines for drug companies and their celebrity clients to follow. six inches of rain fell in charleston, south carolina, today. check it out. all of the rain caused major flooding. drivers in downtown charleston drove through high water. the rain fell between midnight and 8 a.m., making for a rough drive to work. high tide along the south carolina coast contributed to that flooding. >> boy, oh, boy you see what

here toward the north. talking about areas around the martinsburg area, zoom into this shower here, around martinsburg, in through jefferson county, zoom in one more time, around the charlestown area, where we are seeing some of the showers, you can see some heavier showers just to the south of shepherds town, these are moving toward harpers ferry along 340 here toward charlestown. heads up in that region. the rest of us are going to stay dry tonight, i think. here is the cloud cover we saw come through. watch the clouds this morning, everybody in the clouds, look at the line move through, the last hour or two. there's that heavy rain down toward the carolinas. that is not coming our watch what is the heat. and look at the numbers for tomorrow. high temperature, 91, leesburg, 92, culpepper, 91, d.c., plenty of sunshine the day tomorrow, but very hot and very humid, the outlook, if you are exercise, going to be best early and then again late, but we have got nut green here, recess for the kid, lunch for you, we have got you on the moderate side, will be very hot and humid, both rush hours looking very, very good, no matter what. weather should not have an impact on the morning or evening

chief meteorologist doug kammerer with you. looking out toward the woodrow wilson bridge a great day to be on the water after what was a fairly good weekend across our region. temperatures on the warm side, continue to warm up, we move on through the evening, the next couple of days, too. 88 in college park, 89 right now, rockville. manassas coming in at 86 degrees. warrenton very close to that 90-degree number, even along the bay. temperatures in the mid-80s as a result of a little bit of a westerly wind flow there. we will continue to see those warm numbers right on through the next couple of days and even into the low to middle 90s in some areas. tomorrow's impact, still going to be on the low side, used to the heat and humidity, but the humidity is going to be a bigger fact tort next few days than it has been. you can tell right now, you step outside, you have got that humidity factor to deal. temperatures tomorrow, 77 at 8 a.m., 88 by noon, 91 by 4:00. that's when see the heat and mum mid come in, temperatures 85678 the entire seven-day forecast, including an all-important labor

[ cheers and applause ] those are workers cheering for the first delivery truck leaving the bluebell creamery in texas this morning. bluebell issued a voluntary recall four months ago and shut down production after ten listeria cases were linked to the company's ice cream. production is limited. the rollout will come in phases, the first shipments headed for central texas. a tough discussion to start. doctors say you need to start talking to your kids about alcohol long before they take their first sip. the american academy of pediatrics says nearly a quarter of kids try alcohol before their 13th birthday. experts say that means you need to start talking to your kids about drinking by the age of 9. the report also encourages pediatricians to question preteens about their alcohol

long-time braves fan who fell to his death during a baseball game at turner field. the team held a moment of silence for greg murray. police say he fell over the upper deck railing on saturday night. today, the medical examiner ruled his death was an accident. murray was a braving season ticketholder for 23 years. this is all that's left of a small plane that was on its way to virginia when it crashed in the everglades. first responders say it's a miracle anyone survived. the plight and his pannen xbrer were both able to walk away.from the crash injured but alive. they were flying from fort lauderdale to lynchburg when the engine fail old sunday. >> completely destroyed. the fact anybody was able to get out is simply amazing. >> he, like any good pilot, looking for a place to put the plane down. hard him. the plane burst into flames, they were both able to get out. >> the pilot and his pan passen a couple from fort lauderdale. his wife is already released from the hospital.
