hundreds attend a candlelight vigil tonight for a teenager killed by an amtrak train. and a dog separated from his handler and why they say he's not allowed to bring his long time partner home. >> we begin tonight with new reaction to charges filed against jesse matthew, now accused of killing a second college student in virginia. >> for six years, investigators have been working to investigate the murder of morgan harrington. chris lawrence starts us off at the live desk with major developme developments. >> a grand jury indicted matthew on abduction and first degree murder charges and we're checking to see what that means to morgan harrington's mother. >> it's some satisfaction. >> she disappeared after she went to a metallica concert at the university of virginia and a couple months later her body was

discovered in charlottesville. the case went uninvolved fm an naw graham disappeared about five miles away. even though harrington was already charged with killing graham, jill hager son embraced this jury's decision. >> it was very important and i don't know why it was so important for both dan, me and our son, alex, to have some acknowledgement of the fact that morgan's life was taken, she was robbed from us. >> it's only been a couple months since matthew pleaded no contest to sexually assaulting another woman in fairfax 10 years ago and will be back in court tomorrow on these harrington charges. >> thank you. hundreds gathered tonight in montgomery county to remember a teenager killed in an accident on the train tracks. they packed difference maker's church in damascus tonight,

family, friends and classmates. jackie bensen was there to see many members of the community still in shock. >> reporter: the rural damascus church that formed his teen years glowed with candle for 16-year-old john. including dozens from clarksburg which john attended packed the rustic open ear difference ma r makers church clinging to each other for comfort. eyes were still red from tears 24 hours after hearing the sh k shocking news. john, his girlfriend, the two are seen in this picture, and her sister, were taking pictures along the railroad track in boyd yesterday afternoon when john was struck by an oncoming amtrak train. choking back tears, friends described him as one of those who could easily bridge the gap between high school cliques and bring people together. the church's pastor says he's

aware how much the sudden tragic loss is affecting the entire community. >> he was real. he was real. and these kids know that. they're real with each other and that's what -- i think that's the comfort they're drawing from, you know, the reality of peace in his life. >> reporter: the tragic incident that took the life of the young man that just touched so many people remains under investigation. in damascus, jackie bensen, news4. >> as we wait for investigators to determine how this happened, we're learning tonight more about what a train actually sounds like when you're standing on the tracks. the federal railroad administration says you can barely hear a train when it's coming towards you, compared to the sound of a car driving by or person shouting. also, trees surrounding tracks can muffle the sound. the fra says 27 people in maryland have been killed by trains in just the last 3 1/2

years. most of the victims were walking on the tracks when they were hit. new at 11:00 tonight, police near annapolis are trying to figure out how a person ended up dead in this middle of the street. chopper 4 was over elliott drive and washington avenue near thomas point where the man was found shot. police say the scene is still very active at this hour and we will bring you updates overnight on the nbc washington app. two montgomery county firefighters recovering after a ceiling collapsed on them tonight. they were battling an intense blaze at this apartment at the leisure world retirement community when the roof crumbled. you can see the hole from chop ur 4. all residents got out safely and at least eight damaged forcing at least 11 to find another place to live. the locations of a salmonella scare will reopen tomorrow. they received the okay from the

department of health and will star serving at 4:00 p.m. so far up to eight cases and possibly 70 cases linked to the restaurant. all of those at fig & olive that ate or drank there, the source of the salmonella still not known. they've been partners for years but a montgomery county police officer have no idea where his dog with, the dog he trained and lived with his family. the police department knows where the dog is. we went to find out why the two partners have been separated. >> brokenhearted. >> tonight, montgomery county police officer gill, a 27 year veteran is missing his best friend, chip, the canine. >> it's tough. it's hard. it's hard to talk about chip not being here. he was a very vital part of our family. >> reporter: montgomery county police ordered the officer to return chip back to the department even though the two

worked together for four years. >> not only did he work for the police department but he lived here with my wife and six kids. >> reporter: police say the department no longer owns chip and he's with a reputable canine rescue organization. the department acted with the dog's well-being as a priority and officials tell me they can't talk about why chip was removed in detail. around five months ago, the officer tells me chip bit him during a recertification exercise. he says it's the first time that's ever happened. >> i think it was stressful situation and chip bit me. >> reporter: i talked to two retired police canine officers. have you ever been bitten? >> several. >> reporter: what about you? >> several times myself. >> reporter: were your dogs ever taken away? >> never. >> reporter: the family tells me chip would often play in the yard and on this walk way and have a good time. they're ask themselves two questions, number one, where is chip and number two, why was he taken in the first place.

flash floods are unlike anything they've seen in years. at least 15 people have been killed and crews are finally able to pull cars and muck out of the mud. at least three hikers were killed in a national park when they got caught in a narrow canyon. the other victims were extended family of mothers and their kids in a van and suv when a huge flash flood, maybe 300 to 400 feet wide came up around them, swept their vehicles away. >> everything looks good. >> thank you. oh, my gosh, thank you! >> a rare moment of joy and relief in fire scorched california. putty buffington returned home to find her home unscathed by that massive valley fire. she feared she'd never see her wedding ring or priceless family photos again. the fire has destroyed 600 homes and scorched more than 60,000 acres and only 15% contained.
