bethesda, had had some road work happening there. beltway at branch avenue, inner loop, outer loop, everything rolling along just fine there. 66 looks good. 95 a little slow earlier there as we're approaching dale city. right now looks good. green moving up to the northeast here. you can see the bw parkway, 95 and 29 all looking quite good. nice and green. i'll see you back here at 4:41. this morning, the fairfax county police department is defending the officer in this video. the officer used a taser on a man after he reportedly resisted arrest. the suspect's brother says the use of force was unnecessary. police say elton cansler walked into the sun trust bank last week and stole a worker's sunglass sunglasses. when they confronted cansler, they say he started to reach into his pocket.

police say he was carrying a 6 inch knife. >> it is a utility knife that folds out. that could be a deadly weapon if he was to get it. >> the tape clearly shows he never reached for it. so where was the threat? no imminent threat to that officer to use that type of force on my brother. >> marco crosby says his brother has cerebral palsy and was shaken by the incident. they have hired a lawyer. defense attorneys say they need more time because they have new evidence from prosecutors. the trial for officer william porter is supposed to start first and that's supposed to be about two weeks. judge williams decided the officers will be tried separately. we expect a former state department official who already admitted to a list of crimes in d.c. to face accusations he solicited sex from a minor in virginia. news 4 was outside court in july when daniel rossen pleaded guilty to 11 counts of stalking

in the district. police say he record as many as 25 women in their most intimate moments without their knowledge. detectives found the footage on his phone as they investigated had him. his sentencing for the d.c. charges should happen next month. 4:35. the u.s. supreme court is the last hope for prisoner facing execution in virginia. governor terry mcauliffe denied a last minute attempt to delay the execution of convicted serial killer prieto yesterday. the execution is scheduled for thursday. defense lawyers argue that prieto was mentally challenged and wanted to move the case to california. mcauliffe said the case has already been decided in the courts. firefighters in prince george's say good-bye to their former deputy fire chief. she served prince george's community for 20 years as a firefighter. blue died in a car crash two weeks ago, the cause still being

investigated. she was 48. this morning her funeral will be at mt. ennon baptist church. the viewing is at 10:00 and the service at 11:00. president obama meets with cuban president raul castro in new york today. this will be the second time they met since both countries restored relations. the two leaders were expected to talk about the economy. president castro has said the u.s. economic embargo is still a major obstacle for cuba's development. live at capitol hill, lawmakers will need to pass a spending bill by midnight tomorrow so as to avoid a government shutdown. senate republicans are upset the majority leader mitch mcconnell struck the provision that would cancel federal funding of pl planned parenthood. this morning we'll have new reaction to the intense dugout

a man is recovering in the hospital this morning after being rescued from sugarloaf mountain in maryland. a maryland state police helicopter lowered rescuers to the trail where the man fell about 75 feet. you can see here the hiker being lifted into the chopper. it happened yesterday. the man is believed to be in his 20s. he suffered a head injury. there is no word on his

condition this morning. virginia has 11 days to issue driver's licenses that meet new federal security guidelines. the commonwealth's real i.d. extension runs out october 10th. congress passed the real i.d. act in 2005. it created a set of standard security checks for licenses to make them harder for terrorists to get. i.d.s that don't comply could be rejected at airports starting next year. virginia is currently in the process of getting another extension. it is now 4:41. time for weather and traffic. looks like we need our umbrellas today. >> chuck bell will time out the drive time forecast. >> good morning once again. very cloudy and mild start this morning. little light rain now right through the heart of alexandria and arlington, moving into southern prince george's county, over the capital beltway. could have a little wet pavement this morning. temperatures are already in the upper 60s and low 70s. school day forecast, plan on humidity in the atmosphere.

lawmakers have to act fast to avoid a government shutdown. the deadline to pass the bill is tomorrow at midnight. tracie potts joins us live now from capitol hill with speaker john boehner now stepping down. are house republicans less or more divided now? >> they're trying to figure out where they are and who they can get to lead them forward.

we're expecting a meeting behind closed doors in the capital basement. republicans in the house talking about who is going to take over for boehner stepping down officially at the end of next month. right now the leading candidate is kevin mccarthy, the house majority leader. they have to discuss when they're going to hold elections, don't know that yet. and who will take over for mccarthy. right now we're hearing this morning that cathy mcmorris rogers of washington will not be in the running. the other big thing they have to deal with is the shutdown legislation. the senate tried to move something forward to extend our current budget until december 11th to give them a few more months to deal with it. it looks like it is possible that they can get that done by midnight tomorrow night by the deadline. one of the big hang-ups there was funding for planned parenthood. and the president of planned parenthood will be here on the had hill to testify. >> tracie potts on capitol hill for us, thank you. she continued to hit me on

my face. after that, i lost consciousness. >> a translator you heard there helping lina tell news 4 she considers the action in this video a clear case of excessive force. she says she may sue the police department. it charged her with assaulting the officer who hit her outside a bar in prince george's county in july. >> now uribe's attorneys say this grainy video shows the officer throwing her to the ground and hitting her head. pictures show her face in the hours after the incident on kennelworth avenue. she spent three days in the hospital. >> translator: when he twisted my arm to the back, he threw me down. >> with sides, of course. the police department telling a different story, saying uribe was throwing beer bottles at people inside the bar. police say she spit, punched and scratched the officer who hit her in the face.

the cop was off duty in uniform working security at the bar when this happened. he remains on active duty this morning. 4:48 now. today, share your thoughts on what the relationship between police and your community is like. tonight the aclu is hosting a forum to talk about effective community policing, starts at 6:30 at the metropolitan church. a man is facing charges for a series of shootings that damaged office buildings in northern virginia. matthew mccarney was arrested last friday. he's accused of shooting over the past couple of months in both herndon and leesburg. in one case, police say the shots caused thousands of dollars in damage. no one was hurt. the companies filed a motion to reconsider, arguing the merger would make electric and gas service more reliable and stabilized prices.

those against the merger say it would do the opposite and harm the environment. d.c. mayor muriel bowser says the companies are working on a settlement that would address regulators' concerns. this morning, we're learning new information about the kind of latex that spilled into the potomac river in allegheny county. the company that creates the chemical compound says this kind of latex will not affect people who are allergic to the natural form of the rubber. the maryland department of the environment says this spill does not pose a health concern. here is something we know you might like to hear. you could be eligible for a refund. the supreme court ruling found maryland essentially double taxed people who paid income taxes within another state between 2011 and 2014. maryland governor larry hogan says around 55,000 people may be eligible to get the county portion of their income tax back. be sure to check the nbc washington app to see if you're one of them. we tweeted out a link for you. a new project is breathing new life into a community in

southeast. the old sheraton terrace community is called sheraton station near the anacostia metro station. the new development has more than 300 new apartments and town homes. most are rentals, about 80 are set aside for affordable home ownership programs. >> commit $100 million each and every year to closing gaps. and that's in affordable housing projects all over the city. not just some ward 8, but affordable housing in every ward. >> all of the units at sheraton station are available for families who make up to $64,000 a year. in prince george's county, some of your children are getting free fruits and veggies at school this year. the county receiving $900,000 grant. it gives 29 elementary schools the money to give students a fresh veggie or fruit snack every day. it is part of the u.s. department of agriculture's fresh fruit and vegetable program to improve students' health. a street smart campaign kicking off today in maryland.

baltimore county leaders are warning drivers across the state to watch out for pedestrians and cyclists on the road, especially as days get shorter and daylight savings ends. more than 2700 pedestrians are hit by cars in maryland, that's each year with an average of more than 100 pedestrian deaths. you can ride the fairfax connector for free today because the bus service is now exactly 30 years old. happy birthday. the board of supervisors decided to provide free rides on the connector as a sort of birthday present to commuters. they also said they want county residents to think about and discover all the different transportation options they got. that's a custom to give on your birthday. here you receive presents. >> everybody is getting something out of this. >> i love that. what are we having? my birthday is not until june. we'll go out then. >> david, yours. >> april 1st. >> what about you? >> may 9th. april, may, june, we're all
