as the storm moves in. virginia executes its first inmate in three years. tonight, the last minute appeals that did not hold up. powerful words from president obama about gun violence. >> somehow, this has become routine. witnesses describing terri y terrifying moments at a community college in oregon. we just learned the name of the gunman. >> first, tonight, folks, this is just the beginning. our nor'easter is here, heavy rain, flash flooding all coming our way the next 36 hours. >> virginia's national guard mobilized 800 troops tonight to be ready to respond to flood damage. tomorrow, another alert day and our team coverage starts once again in the storm center with doug. what can we expect overnight? >> i tell you, this is one nasty raw 24-36 hour period and extend that to saturday night. we have rain and wind coming in.

this is towards union station and winds gusting at 24-25 miles an hour at the airport and notice a few rain gusts. the radar, all lit up with rain. most on the light side in montgomery county, fairfax, loudolou loudoun. it will get heavier at times, still a ton of moisture around our region the nor'easter starting to get developed and will bring all this in the next couple of hours, why we have a flashflood watch in effect, 1-3 inches of rain across the area and flashflood watch saturday. look at this. this is the latest track of joaquin, the latest advisory of 11:00, still category 4 storm with 130 miles an hour winds. look how far east the track is, way out into the ocean right now. absolutely no impact towards our

area. we will talk much more about this in a few minutes. the one area it may impact, towards ocean city where veronica johnson has been all day long. >> reporter: a wet, soggy and windy one at the beaches. maryland under a state of emergency. this there have been no evacuations ordered here. with joaquin curving and going out to sea, that will not happen but concerns of flooding possibilities. a coastal flood warning goes to 4:00 p.m. friday could be extended because i think conditions will continue to be high impact to friday and maybe even saturday morning. i spoke with the mayor earlier today, and he was really concerned with two primary zones today. >> those who live in the a and b zones can anticipate moderate to severe flooding. look what happened in sandy and may not be that. could be worse with joaquin so let's address it in the same

manner. >> zone a, bay area and zone b, ocean city inlet as much as 3-4 inches of rain that could lead to pretty major flooding. winds could top out to 50 miles an hour and the storm surge as high as 5 potentially 6 feet. that's the latest out here. ocean city, maryland, back to you. >> utility crews made quick work of a tree that came crashing down on a power line in northwest d.c. tonight. >> you can bet more trees are going to be falling. shomari stone now with a look at the cleanup happening tonight. shomari. >> reporter: good evening. the crews have really done a good job cleaning up the tree out here. pes sco came out and firefighters responded quickly. that's the thing others in the neighborhood are concerned about, that more trees could fall because the ground is wet. >> i think we got very lucky.

>> reporter: cynthia potter counts her blessings after this tree brings power lines down. >> i am grateful no one was injured and no cars around. >> reporter: the tree uprooted snapping a power pole in half at northwest and 38th street. here's the problem. this ground and throughout d.c. and maryland, virginia, is saturated. firefighters tell me they are concerned about this. >> that big one is already leaning. >> reporter: jerry hawkins isn't looking forward to the weekend. >> i'm worried about those tall trees across the street. if one of those were to go over it could easily hit my house. >> reporter: that's why cynthia potter isn't wasting time. >> i called a tree trimmer today because i'm concerned about our old trees. >> reporter: that's right, a lot of people in this neighborhood plan to call tree trimming companies and keeping a close eye on the weather forecast.

what's interesting they're not coming out during the weather, will buy groceries, fill up tomorrow and take it easy this weekend. i'm shomari stone, news4. >> thank you. maryland and virginia have already declared states of emergency tonight. many weekend events are rescheduled. others like the popular taste of bethesda canceled all together and a warning to look out for scams. police want you to be wary of landscapers or home repairmen going door-to-door and offering services. always make sure they are licensed before you pay them and to be proactive in a city that sees flooding often, there was an effort to clear storm drains and fill sandbags to protect businesses in old town. the governor s of virginia and maryland say residents have to take re-cautions, too. >> we will see plenty.

oregon dealing with an unspe unspeakable act of violence, 10 people shot dead by a 26-year-old. we now know he forced people to stand up and state their religion before he shot them. the school was only in its fourth day of classes for the fall. >> my teacher had come running into the room in a very big panic, telling all the students 20 plus to come into a teacher's room in this back and hide and duck down. >> the gunman identified tonight as chris harper mercer died in a shootout with police. he was not a student there. federal officials are working to figure out why he chose this particular school. this is a political choice that we make. to allow this to happen every few months in america. we collectively are answerable to those families who lose their loved ones because of our inaction. i hope and pray that i don't

have to come out again during my tenure as president to offer my condolences to families in these circumstances. but based on my experience as president, i can't guarantee that. that's terrible to say. >> sobering and raw emotion tonight from president obama in response to those killings in oregon. eevoked memories of columbine, virginia tech, newtown, lamenting the routine of these mass shootings, he said gun violence should be a political issue in this country because it affects everyone and he challenged americans who believe the shootings are a problem to elect leaders who reflect those beliefs. the president's entire statement lasted more than 11 minutes. you can watch it in its entirety right now in the nbc washington

app. >> we have some breaking news this evening, serial rapist and killer ail fray do prieto convicted of two murders in fairfax county and one in california linked by dna to six more was killed by lethal injection at the correctional center in jarratt, virginia. >> reporter: jim, there was no last minute call from the supreme court or governor of virginia, no stay or delay of execution, the time had come. on this cold rainy night, 49-year-old alfredo prieto of el salvador lost his last appeal, the man prosecutors called a serial rapist and murderer was put to death by lethal injection 27 years after the crimes he committed in fairfax county. >> death was pronounced at 9:17 p.m. mr. prieto did make a last statement. that statement was, i would like

to say thanks to all my lawyers, all my supporters and all my family members and get this over with. >> a member of the clergy was with prieto until the end. >> i asked if he had asked for solution of his since and crimes. he would not confirm or deny that of course. >> prieto was convicted and sentenced to death in connection with a double murder in virginia. in 1988, two bodies were found in a vacant lot in reston. 22-year-old april, a graduate of george washington university was raped and murdered, along with her companion, warren fulton, who was shot in the back. tonight, in the front row, witnessing this execution were the two fairfax county prosecutors who got the death penalty conviction in 2005, along with the detective who helped close this cold case. that's the latest live in jarratt, v.a., news4. >> we're tracking the nor'easter

some parents in d.c.'s trendy neighborhood are looking for ways to get out of their

expensive leases after a violent summer. they got a chance to voice their anger after finding out much has to do with what's happening near a community playground. >> reporter: the inviting beautifully designed playground at kennedy rec center on 7th street northwest has hosted far fewer children lately, a summer that saw a resurgence of deadly violence within the swing-sets and climbing bars prompted many to keep their kids away. >> parents don't feel safe going to this playground. for us, how can we make it saver for everybody who lives in this community. >> reporter: neighborhood residents met with city officials and representatives of the d.c. police department this evening. they say they fear the months of violence including the innocent bystander murders of a mother and former capitol hill starve may turn back the tide of progress. >> the residents are concerned

about that and the people harmed in our neighborhood. this summer has been a changing moment for us. >> reporter: tonight's meeting marks the removal of the crime tent that was put up by the d.c. police department after the violence began over this summer. in northwest, jackie bensen, news4. big scheme at the big box stores. the news4 i-team caught it on camera. one virginia man cost local taxpayers more than a million dollars in just one year. scott mcfarland with an update on this news4 i-team investigation. >> reporter: it was a multi-million dollar scheme happening in a place many visit each month. check out this morn virginia man's shopping list, 70,0$70,00 cigarettes in one trip to a fredericksburg, costco, so many cartons a store employee had to help him roll it out to his van. the news4 i-team watched this buy information weeks and filed paperwork claiming he's buying

in bulk for his businesses. we know his mom and pop shops weren't real. one had a listed address at this tiny industrial lot in fredericksburg. no sign on the door. another at a home in an upscale subdivision and this one, address that led to an abandoned lot in the woods. turns out this guy is a cigarette trafficker who bought virginia's low tax cigarettes in bulk and help eed ship them nor where they can be illegally sold for big bucks. paul carey investigates cigarette smuggling for the tax board and knows this guy's operation. >> reporter: is he the top of the piyramid or somewhere in th middle? >> the middle. >> reporter: his name is steve chan and when i-team tipped about his operation and the big buy the feds swept in and arrested him for laundering. i, mr. chen, i'm scott for news4

i-team. before he was caught, he managed to buy $13 million worth of cigarettes in a little more than a year. he admitted to selling 20,000 packs out of that unmarked industrial park building to an accomplice. why did you do it, mr. chen? he didn't answer. investigators say he isn't the only one doing this, there are more. >> the exact same operation, opening an account and purcha purchasing from boxed stores and selling the cigarettes. >> reporter: the proceeds often end up in the hands of violent crime rings. and taxpayers take a bath. $13 million in illegally traff c trafficked cigarettes cost taxpayers a bundle in lost revenue. >> one guy cost taxpayers about $1 million. >> correct. >> reporter: just on cigarettes? >> just on cigarettes. >> steven chen is facing up to five years in prison. >> both sams club and costco

winds gusting over 20 last hour. gusting over 20 miles an hour tonight. radar showing the rain across the region right now. most on the light side. it wilton be into the morning hours as the nor'easter gets cranked up. you can see in the last couple of frames here, watch how it starts moving down this way. that's the nor'easter part of it and why we're seeing so much rain. speaking of so much rain, we would get 3-6 inches up here and the track has shifted a little bit for the heaviest rain. how much rain in portions of the caroli carolinas? 15-20-inches of rain, talking historical rain. thank goodness it is going their way and not us. not in that proportion all because of the nor'easter, high pressure making its way on shore with that nor'easterly wind and because of that we will see flooding on the chesapeake and

potomac and beaches including coastal coastal -- and 4 or 5:00 tomorrow morning and the strongest day is late tomorrow rather windy and could see some gusts over 40 miles an hour especially east of i-95 close to the chesapeake bay. what are we worried about? we won't see a tornado but only a medium threat for high winds and we saw a couple trees down tonight with 10-15 miles an hour and as the winds increase, we could see more trees down and power outages. heavy flooding. future weather, rain at 4:00. everybody seeing the rain and here comes the haven't rain, overnight to midnight, very heavy rain and saturday just dealing with showers, back to the west and more rain and we will see more rain saturday and not a complete washout. how about joaquin?
