speaker of the house shocking his own caucus. now there are real concerns about what will happen next. steve handelsman is on capitol hill with the latest developments. >> doreen, it is a stunner. some are worried there is a mccarthy personal problem and most say it is a confirmation and there is a civil war in the republican party. >> good morning. >> reporter: kevin mccarthy wore a smile maybe because he was quitting the battle. the right hand man to speaker john boehner looked a shoo-in to succeed him. despite tea party challenges from daniel webster and jason chaffetz, but when mccarthy tallied his votes for today's speaker election he was short. >> i think i shocked some of you, huh? >> if we are going to unite and be strong we need a new face to help do that. >> reporter: mccarthy made republicans look bad last week admitting the point of the house committee investigating hillary clinton is to kill her presidential prospect prospects republicans were already in turmoil and that's why boehner is leaving. >> our conference will have to

do a lot of deep soul-searching. tea partiers say they beat the old guard again. >> this is a victory for the american people who are demanding change in washington. >> reporter: change on the hill might not be for the better. >> house republican disarray could make all of the people hate about issue what wash even worse. >> reporter: fights this fall over the debt ceiling, planned parenthood and spending that could close government, a shutdown that kevin mccarthy had vowed to prevent. now more speaker candidates are sure to jump in and the election is postponed and boehner might have to stay on as speaker into november or further and he is said to be pressuring paul ryan to succeed him and ryan who loves being chairman of the ways and means committee and he ran for vice president in 2012 has said he doesn't want the speaker's job. still, he's under pressure and his office said again today that is a hard no, but a lot of people up here say they want paul ryan and ryan, jim, has canceled fund-raising and possibly other activities for the next two days.

back to you. >> a lot more to come on this, thanks, steve. >> now to a big change in the federal prosecutor's office in d.c. the white house has announced that it will nominate channing phillips as the next u.s. attorney for the district of columbia. tom sherwood broke that story on twitter today and now reports on what it could mean for a high-profile corruption case. late today the white house confirmed a major change in law enforcement here in the nation's capital. channing phillips, if approved by congress would take over one of the biggest and most active u.s. attorney offices in america. it handles international and national cases as well as major local prosecutions in the district. phillips is a native washington an and a veteran justice department official and he most recently has worked for attorneys general eric holder and loretta lynch. phillips and vinny cohen were among top candidates for the d.c. job. cohen announced late today he

will resign october 18th and return to private practice after five years with the federal office. as u.s. attorney phillips would take over the near five-year probe of mayor vincent gray in the $660,000 shadow campaign that helped elect gray mayor in 2010. gray has denied involvement saying last year -- >> i maintain these are lies. these are absolute lies. >> both cohen and former prosecutor have overseen the gray probe with a half-dozen guilty pleas plus three council members who were forced to leave office on fraud charges and other cases. prosecutors told us today that gray case is continuing. >> well, i'm sure it is, but i guess my question -- does this mean that they have to start all over again from ground zero? >> no, but once channing phillips gets through the senate he'll have to be beat from the attorneys and some for nearly five years and he will have to decide whether to keep going or to shut it down.

vinnie cohen could have done that last april when he took over and he decided to keep going apparently and he'll have channing phillips' turn. >> it could be third strike, you're out. >> we'll leave it at that. >> thank you, tom. >> the man who crashed a stolen car into a fence at fort meade managed to elude capture for 13 hours by hiding out in a storm drain. the ordeal began last night when police trayed to pull over a man driving a stolen car. the driver, dante small led police on a chase for about five miles. he crashed into the fence at fort meade and then he took off running. officers spotted him this morning in a storm drain not far from where hundreds of soldiers live. >> when he reappeared in the storm drain he was immediately apprehended by law enforcement when he reappeared above ground. >> investigators say they did not find any weapons and nobody was hurt. for the second time this

year someone has been murdered in alexandria and for the second time, whoever did it is still a mystery. the shooting happened just before midnight on belle preway. pat collins is there learning more about the victim. >> reporter: he had two little girls and a steady job and had a lot of friends. why would anyone want to kill leon williams? the victim, 37-year-old leon dwayne williams. his nickname "chip." he was the father of two little girls. he worked for jiffy lube. tonight, a friend came to the scene and placed a bouquet of roses near the place where leon williams died. mr. williams' mother tried to visit the scene earlier, but she was so overcome with grief her friends led her away. now this happened in the courtyard of the belle pre plaza

apartments in alexandria. there was a barrage of bullets, leon williams fell dead to the ground. there were a number of stray rounds, a number of close calls. meet now anthony giuliani. a couple of years ago he was shot and wounded in baltimore. he said he moved here to be safe, but last night he was nearly hit by a stray bullet while he was riding in his car. >> as we came within the alleyway here at 4:00 and one of the bullets hit my car and i told my fiance, honey, it's time to go. we go, go, go, go, and he sped off around the corner here into the parking garage. >> reporter: the murder last night happened in the courtyard of the belle pre plaza apartments. it was the second murder in alexandria this year. the first murder in alexandria happened down here in july on

north fayette street, not far away. >> we would be remiss if we didn't look into the possibility of a connection, but right noi we don't have anything to connect the two crimes. >> reporter: in this year in the city offal expected ria two murders, no motives and no arrests. back to you. >> pat collins, thanks, pat. >> that last murder was in july, elliott tibs was shot and killed. his family tells us he was hanging out with his cousins when he was shot. his mother says he was about to meet her on the metro. no arrests made yet in that case. >> here at the live desk we're getting new details about a developing situation in montgomery county. we brought this to you as breaking news in the left hour. a man was found dead in a park and now we learned he was 22 years old. chopper 4 was over edgewood neighborhood park and it's in the brigs cheney area. police were called there because they got a call that there were

shots fired, but when they arrived they found the man's body. they still don't know if he died from a gun shot wound or if that call was unrelated. all of this taking place literally right down the street from an elementary school. shomari stone is on his way to the park and we'll push out alerts on the nbc washington app and at the live desk i'm chris lawrence. a long start for prosecutors as testimony opened in the case against charles severance. today three women, including one who survived being shot testified that they saw severance in the neighborhood. julie carey is live with some of today's dramatic testimony. hi, julie. >> reporter: hi. well, can you identify the man who shot you? that was the crucial question asked of a woman who took care of murder victim ruthanne lodato's elderly mother and those of us who covered this

case now didn't know what her answer would be. she survived the gun fire at the front door of this home. she was taking care of lodato's elderly mother when someone knocked on the door and opened fire. i heard boom like this and i started screaming very hard. lodato, a beloved music teacher was killed and her rec elections in the midst of terror was put to the test when prosecutors asked whether franco could identify the accused charles severance as the man she saw that day. at the prosecutor's request, severance told franco, have you seen this man before? franco, yes. prosecutor, does he look like the man who shot you? franco, yes. attorneys challenged franco pressing her about this composite she helped create. she described a man with a trimmed beard and severance's beard was full and bushy. you're not certain this was the man who shot you.

franco replied, it is. franco isn't the only witness who says she saw severance in the alexandria neighborhood where three prominent residents were shot to death. marlene recalls walking her dog about a week before the murder and seeing a man whose vacant stare so unnerved her she changed her route. when she heard a brief description of the killer she immediately called police and told them i think i've seen the guy. a woman who runs a cleaning service in the area called police a month after the lodato murder and said she was filling the car with gas when she saw this car, severance's car driving fast running a stop sign. she didn't think anything of it until she saw a news report on severance's later arrest and remembered the redford escort and his face. in starting with the ruthanne lodato murder, it's clear prosecutors think they have the strongest evidence in that case, but they have two other homicides to try to connect to charles severance including the death 12 years ago of nancy

spencer stone is recovering in a hospital tonight. he is one of the americans whose credited with stopping a terror attack on a train in france back in august. police in california say somebody stabbed him several times outside a bar last night. nbc's jay gray has our report. >> reporter: sacramento police are investigatinga know overnight attack on spencer stone, the air force airman who helped stop a suspected terror attack onboard a french commuter train. >> this incident is not related to terrorism in any way, and we do not believe in any way -- we know it's notty related to what occurred in france. >> reporter: in august the 23-year-old was honored as a hero in france and by president obama after he tackled a gunman armed with an ak-47 on a train bound for paris. he pinned the assailant using a choke hold as friends wrestled his gun away. stone was injured in that melee

and his thumb nearly severed. >> it showed an altercation in a downtown district during a spite where stone was apparently stabbed several times. >> he was stabbed more than once and significant injuries to mr. stoeb. >> a statement released to by uc davis medical center said the family of airman spencer appreciates the support. police continue their search for suspects in the case. jay gray, nbc news. >> there's something of a twist involving a second american who stopped that attack in france. >> his name is alec skarlatos. he's the one there wearing a green polo shirt. skarlatos was enrolled in classes at umpqua community college in roseburg, oregon where a gunman killed nine people last week. skarlatos was not on campus at the time and he's competing on the reality show "dancing with the stars," he sent a tweet today asking everyone to pray

for the family of his childhood friend spencer stone. >> their job is to keep america safe and today three top security officials warned the senate that lone wolf attacks -- the potential attackers are inspired by overseas through social media. >> isis has injected new energy and life with homegrown violent extremists. >> it's a message that that comes in an entirely new way because it buzzes in the pockets of troubled souls and unmoored people all over the country all day long. >> fbi director james comey noted it is typical for people in the u.s. to make contact with isis supporters over social media and then they shift to encrypted conversations if the fbi cannot monitor even with a court order. >> michael horn is the president of volkswagen's american division. he told angry lawmakers today he did not know that his company

was cheating on government emissions tests. horn plamed the deception on engineers and the environmental protection agency announced last month that volkswagen rigged its diesel cars to automatically switch into a mode designed to pass emission tests. and the cars will revert to the regular driving mode after the test. >> i would like to offer a sincere apology. these, vents, and i fully agree on this, are deeply troubling. >> how do you sleep at night? how do you call yourself a member of the human race when you knowingly poisoned the planet? >> michael horn told congress the vehicles are safe and legal to drive until volkswagen comes up with a plan to fix the emission issue. >> metro is admitting it's at a low point. recent delays and breakdowns are causing some riders to just, plain turn away. tonight there's talk about ways to give back to riders when

service is poor. transportation reporter adam tuss joins us from the playstation with more on this concept, adam? >> doreen, when you don't get good service you don't expect to pay full price. metro is at least talking about that with its rail service. when you start having a pattern of poor service you get stories like this. >> my first day at work on june 1st and the ac was off and there was a delay, and it smelled like a gym locker. elsy guerrero has since cut back on riding. i've been walking, like today i walked the 20 minutes over here and i don't want to pay the peak hour, so i walked. if metro is having a bad day, should you have to pay full price. he talked about prices when service is bad. another idea keep off-peak fares just one price and not distance based and downey was honest about the current service. >> you feel like riders are getting quality for the service

that they're paying. >> they're getting quality a lot of the time and they're not getting the reliability that they count on. >> something that isn't trending in the right direction is metro ridership and by their own accounts, metro is getting 40,000 trips per day and they're using millions of dollars of revenue per month. with revenue being drained, a very real consideration to fare increases to make up the difference. the worry there, though, even more riders will leave. >> reporter: guys think about this, in the last ten years, fares on metro rail have jumped by 51%. jim, back to you. >> that's a lot. adam tuss, thanks, adam. >> the case of measles has officials warning about possible exposure in parts of northern virginia. a suspect crashes a carjacked vehicle after driving past security here at fort meade. the base commander admits that security issues here are an

friday is moderate, but this really is for the afternoon as you'll see in just a moment. even in forecasts we've had high clouds to move in and we're at 72 degrees after getting to a temperature of 78 again today. upper 60s by 9:00 and still mild and we'll open up the windows by 11:00 and it will be nice and cool ask by morning way cool and temperatures drop to the low and mid-50s and a cool start with a few clouds around the area and more clouds around the afternoon and here is the timing for what we're expecting tomorrow. your future weather and this is at 7:00 a.m. and dry conditions throughout the area and watch what happens as we get into the afternoon hour and 1:00, still dry and by 2:00, 3:00, there is your front. around petersburg and elkins. where you see the yellow that's where there could be some thunderstorms producing high wind and baltimore to leesburg at 6:00 and almost right on top of us and i-66 and areas around i-95 and moving south and east,

by the latter part of 7:00, 8:00 into southern maryland in the northern neck and quickly moving away though and that's good news because earlier in the week, it looked like the rain would be lasting until early saturday morning and we clear out by saturday morning and look at this. that's the sky partly cloudy early in the day and a lot of sunshine for saturday afternoon and our main threat for tomorrow's storms with high winds across the area and not a big threat at all for saying any hail, but it's the gusty winds that we'll have to worry about. make sure you secure anything by tomorrow and the early part of the day by your house and seeing some of those high winds down toward fredericksburg and around waldorf and areas around annapolis and toward baltimore and even columbia maryland and we could see some high wins around 6:00, 7:00 and that weather front is right on top of us and keep that in mind if you keep exercising the recreational forecast from the 60s to low 70s and this is the best time of day

was shot and the bus driver who helped save him. a woman who got sick after eating at the fig & olive restaurant shares her story. >> i was nauseous, throwing up. >> we'll tell you why it took so long for her to figure out it was salmonella. and a warning from local health officials after a confirmed case of measles turned up in northern virginia. >> it was a long and tense night for a suspected car thief and the officers who spent hours trying to find him. the man was arrested on the ground of fort meade this morning he he managed to elude kapt our a storm drain last night and it was on arundel mills boulevard when police spotted a car. >> after a brief chase the driver crashed into a fence at fort meade and then ran away. megan fitzgerald with what's being done to make the base more secure. meagan? >> we had a chance to speak to the base commander and he admits

security is a problem and there is a plan to fix it. >> it took more than 13 hours to find 41-year-old dante small. anne arundel police chased small. that pursuit ended here on the campus of fort meade. colonel brian foley is the insulation commander here. he says small managed to bypass security guards before crashing the vehicle more than a mile inside the base and running off, but how did small manage to make it past armed guards in the first place? it's a question the colonel says they're looking into. >> we will investigate fully this incident, how it occurred to determine if we can make any procedural changes. >> reporter: in the meantime, small was finally captured in a storm drain at around 10:15 thursday morning. colonel foley says it wasn't far from where 400 soldiers live. >> the proximity of the storm drain was near several buildings

where we do have service members. >> this incident is one base official say highlights the need for better security measures at checkpoints. >> in fact, foley says it's a problem they're aware of which is why the rockenbach checkpoint has been in the process of being upgraded since june. >> to improve the access control points, the security on the control points on this installation. >> reporter: until then, he assures the community that they're doing all they can to make sure the area is secure. >> the physical safety of all that work and live on this installation is my number one priority. >> the colonel says construction of the rockenbach road checkpoint is expected to be complete some time in the summer of 2016. as for the suspect dante small is still in the hospital and he has not been charged. >> thanks, meagan. >> charges have now been filed against a 15-year-old kid accused of flashing a pellet gun

on a school bus. >> the teenager was taken into custody near culpeper county high school yesterday. he's now been charged with brandishing a firearm and taking a weapon on to school property. police say the boy flashed a pellet gun similar to this one on the bus two days in a row. three schools were placed on lockdown while they looked for that teenager. nobody was injured. a health alert in northern virginia. a measles case confirmed in fairfax county and health officials say the child got the virus even after getting a vaccine. news 4's mark segraves is in alexandria outside one store where people may have been exposed. mark? >> reporter: doreen, this is the costco on richmond highway in alexandria and yes, this is one of the places the child visited while contagious. health officials say this child did have the age-appropriate vaccine that was given to children within the first 12 months of being born, but it

takes two vanning sinning as to protect you fully from the measles. >> that is part of our investigation right now to determine where he contracted the measles from. >> the child who has made a full recovery has now reached the age where a second vaccine is reblg mended. health experts warn it's important to get two vaccinations to prevent measles. >> although this child was age appropriately vaccinated we want to make sure that everyone in the public reviews the vaccination records to make sure they've had two doses of vaccine to protection of measles. >> for anyone who may have come in contact with the child while contagious and they're targeting four looks mostly doctor's offices where the child visited, and this costco and a day care center are also on that list. >> one of our roles in public health is to interview all individuals who could have possibly had an exposure as well as interview. this case is any friends or parents of that individual to ensure that we have all of the sights where this person was.

that is what the basis for that exposure list is that we've released. >> reporter: the child was at this costco last thursday night. that day care center where the child was also seen is on the campus of fort bellvoir. health officials say you could still show symptoms as late as october 26th if you had come in contact with this child. doreen, back to you. mark segraves. all of this comes amid a new warning that nearly 9 million children could be at risk for getting measles based on analysis by the infectious disease society of america. that's because of large gaps in vaccination coverage in parts of the u.s., but keep in mind, most kids in the d.c. region do get their immune zags. this case in fairfax county is a good remind tore keep an eye out for symptoms including fever, dry cough, sore throat. people also develop a skin rash made up of large, flat spots. measles is contagious four days

before that rash develops and for about four days after it appears. for a closer look at each of the locations, the child with the confirmed case of measles visited, head to our nbc washington app. lots of south carolina bracing for even -- and the people are in cleanup mode as the water starts to recede, but the storm water is flowing down swollen rivers toward the ocean and several coastal towns are in the danger zone. people are being urged to evacuate their homes and the state has already closed major highways that they expect to become impassable. >> in the next 12 hours and georgetown will start to flood. >> it will get worse and it's going to last up to 12 days. >> 400 roads and bridges all over the state are already closed as the crews continue to assess the damage there.

celebrity chef jose andres is firing back at top at trump's $10 million breach of contract lawsuit. he was set to open a restaurant in trump's new d.c. hotel after the presidential candidate's controversial remarks about immigrants. in newly filed court documents attorneys say trump's comments

themselves were the initial breach of that contract, so trump has no one to blame, but himself. >> a woman who suffered salmonella poisoning at the fig & olive restaurant in west hollywood california. >> she says she is still recovering a month later. >> her name is nicky berteau. initially she thought she had a stomach virus and she went to the hospital and they didn't pick up on what it was and they sent her home with antibiotics. she didn't find out until two weeks later that she was suffering from salmonella and she found that out when she got a call from the health department. they were able to track her down through her restaurant reservation. >> i was nauseous and throwing up. it kept getting worse. i want to make sure first and foremost that this doesn't happen to anyone else. there are now more than 150 salmonella cases connected to fig & olive restaurants throughout the country, that is, including the one in d.c.

although the exact cause has not been pinpointed yet. dishes containing truffle oil have been removed from the restaurant's menu. police are looking for victims of a self-proclaimed psychic accused of ripping people off. this is shanice bell. she scammed a woman out of $77,000 over the course of nine months and went to new york. a curse had been placed on her at birth and harm would come to her unless the victim gave her cash and gift cards to perform a spiritual cleanse. bell was arrested in queens last week and now police want to know if anybody else locally might be a victim. >> coming up, a teenage girl kidnapped on the way to school. we'll show you the quick decision that might have changed her life. why she says a higher power

tonight, a 17-year-old is recovering in the hospital after he was shot in the leg during a robbery in waldorf, maryland. it happened last tuesday. a charles county school bus driver stopped to help that boy and in fact, may have saved his life. today that bus driver told chris gordon she believes fate intervened that day. >> charles county school bus

driver chiquita posey was running late and took a short cut tuesday afternoon otherwise she would not have come across 17-year-old jaivon cole flagging her down in this neighborhood. he had just been shot in the leg by two robbers who stole his bmx bike. when i stopped and told him to get on the bus i thought i might lose my job, but i'm not going to let this child bleed to death óñ1whis street. >> she slowed the bleeding and that may have saved his life. >> i'm glad i was there for him. it hurt may heart to hear him say everyone drove past me. that could have been my child. she later learned something else about jaivon. >> her birthday was the same date that her mother died this past april and she felt when she came to this rescue that she heard her mother speaking to her. >> everybody was, like, it was your mom, telling you go help that child. yesterday javivon mother told me
