family and friends will remember transgender victim. tonight the vigil gets under way at 7:00 p.m. it's at the state park. this morning we're learning more about a fight that led up to zella diona's murder. >> reporter: acourts to documenting police were called at 5:17 thursday for a report of three to five people fighting with sticks. one had a knife. detectives believe she was hit with a stick at that time. the man now charged with her murder, 20-year-old rico was also engaged. at this time it's not clear how officers resolved that incident but 20 minutes later, 5:40 p.m.

police were called to the area again. this time she collapsed and a man stood over her and fired shots into her. >> i saw a man standing over a person, firing more shots. >> detectives stated in the document they believe the victim may have been lured to the valley after the initial fight. that's where a man jumped from behind dumpster and began shooting. witnesses say he had a monster mask over part of his face. it was found near the scene. news of the arrest was bittersweet. >> that still won't bring her back. it won't bring her back. >> jackie bensen reporting there. well, developing in your firs first4 traffic this morning, crews have blocked all lanes.

drivers had to get off the road. take a look. we caught the work just as it was clearing a few hours ago. vdot says there's more work on 395 in that area this coming monday night. >> we're working to learn the name of the man killed while crossing the street. this happened friday night on annapolis road near kenilworth avenue. police are calling this a hit & run. police are looking for a late model ford with damage to the right front headlight and bumper. >> we now know the name of a woman killed in a crash in rockville. a woman slammed into a traffic pole yesterday morning. officers saw her speeding. they say she didn't have her lights on. she died at the hospital. no one else was hurt at that crash. an amazing picture of a motorcycle up in flames just minutes after it crashed into a car it happened in the crestwood neighborhood of the district yesterday morning. the man on the bike was rushed to the hospital. no word on his condition. it looks like montgomery

county school enrollment is going up. this year they increased the students up to more than 156,000. officials believe the increase is attributed to rising birth rates. to make sure there's enough room for everyone, they're doing a large building and renovation effort. today is the only day off for school this week for hundreds of kids in prince george's county. students and families have the chance to samle that program yesterday. it includes a motivational program and two hours of instruction. the goal is to raise test scores and better prepare students for careers. >> the country is going to need more workers m graduates so we can be a successful country. >> i came from this area. my wife did too. to be able to go this far is great and programs like this is what propels people further. saturday's school will run 20 weeks. it's available for students all

and it will be even colder tomorrow morning. another freeze warning for sunday night, monday morning for everywhere along and to the west of i-59. it includes fredericksburg, manassas and everywhere west. if you don't have a freeze this morning, likely to have one tomorrow morning. in the freeze, 28 to 33. the district itself, parts of southern maryland will be protected from the cold. it's going to be chilly nonetheless. outside, gaithersburg, 28. rockville, 33. howeverly temperatures today, most into the 30s and low 40s by 9:00. a reasonable recovery today, but highs only in the low to mid-50s. that's some ten degrees or so colder than average. quite chilly indeed. there on radar you can see the snow showers. snow showers have made it all the way into parts of southwestern pennsylvania. one of my weather watchers in kaiser, west virginia, had snow showers yesterday and there could be another random

snowflake or two north of the mason-dixon line this morning. no, we're not going to get snowflakes in the metro area at all. the only thing that might have a sliver of a chance is right up here toward smithsburg, maryland, maybe martinsburg. most of us will jump into the low to mid-50s. by midnight tonight back into tupper 30s and low 40s, and by sunrise time tomorrow morning, a lot more neighborhoods will be below neighborhoods freezing tomorrow morning. west of 95. cover up things if you don't want to risk losing to the cold. highs tomorrow after a cold start, we should recover a bit after the mid-50s once again. the real warmup begins on tuesday. i guess we can call it indian summer for most. we'll have the first frost or killing freeze as we get into tomorrow morning. 55 today. a cold start tomorrow morning, 56 tomorrow afternoon, but then things really start to improve quite a bit. by tuesday, sunshine and 56.

surroundingi in surroundings. joe, you sort of have to do this, don't you? >> you do. it should have been done a long time ago. i'm going to tie in a national story with this. i think one of the reasons you're seeing this is because you had ben carson talking about he would tell people to grab the and i think that got so much publicity and people started saying, yeah, and debating is this what i should or should dmot. and i think, quite honestly, they're trying to offset what i think is illinoi-advised informn that came oust the campaign. >> i think we might be giving ben carson a little bit more credit. it might be the case of what happened at tcu, what happened in arizona, and what happened in oregon. think i what's happening here in maryland is the chief is just reminding folks to be aware f some of these things were

already put in place a few years ago after the incident in virginia tech and some other schools. so i think this is a reaction -- i think carson's reaction is a reaction to the shootings at the community colleges and the universities, and at a school like maryland where you have 38,000 students and it's a larger community outside that, think i this had to be done. >> the reason i bring this up is this is not new. we've had shootings at universities and college campuses years ago. virginia tech was a perfect example. and you didn't have these instructions given out at that time. that's when they should have, and they weren't. >> i think it's a good idea obviously. i think it's proactive. they want people to take part in alerts, prepare for it, a drill. what do they actually say? it's an interesting thing with the words here. run, hide, fight. maybe the fight thing, maybe they were, you know, thinking of ben carson when they said that.

>> that's the last resort. not the first resort. >> we don't know how well it will work until god forbid it happens and we pray it never happens but it's certainly the consciousness level is raised and i think that's an important thing. you don't have to look for a parking space. if you drive around verizon center, you'll soon see a sign that will help you find a space. the city will install new signs that will identify open spaces. they'll keep tabs on the vai canal and used spaces. they'll let you know. that i hope to have the signs in place in coming weeks and then next year, a new app will be available to let you know where the space are. joe, you're in that area often. >> it's my stomping ground. >> and you already have some of those parking apps on your phone. >> well, yeah. my children put them on the phone, and i learned how to use them. >> you know, 25% of downtown traffic is from people looking for parking. >> looking for a parking space

and delaying it, and then you add pedestrians who are jaywalking. the only thing about this that i would remind people and they may not have caught it in the news story, it also temporarily can raise the parking fee. now, you would ask, well, wait a minute, because now if you put a quarter in, you get eight minutes in the city or whatever the length of time, depending on where you live. you can't increase that because it's a meter. but now what they can do, depending on what's going on at the verizon center, they can increase the parking fee. >> and increase revenue. bremante, but, in terming of easing the traffic or the gridlock and ease the strain of trying to find a place to put your car in d.c. >> i think that's great thing if you have the app, if you're technologically -- >> -- inclined. >> -- inclined. some of us aren't as much as

others. so if you're not, i don't know if it will help you that much. i this i the interesting thing is the point you made earlier. d.c. parking and transportation, this traffic thing and raising revenue has become a big issue in the district in terms of speed cameras in different places, fines if you go through a cross walk when someone may be walking. so i think the district has recognized this is a way to increase rev nurks especialenue where joe traffics most often. >> i walk. >> he walks. in terms of technology and the means to do it, that's great thing. in terms of easing traffic jams, we'll have to wait. you're assuming everyone has an app and knowing where to go. >> maybe it's the parking wave of the future. >> it could be. i wonder how much help it will provide. if you've got an app -- i know guy's got an app.

you're both facing the spot and you're both not going to get it. we try all of these solutions every so often and we think that they work and then things get bad again because more and more people come with cars. it's an interesting thing to watch. in an exclusive i-team report, law officials talk about those stores that sell packets of synthetic drugs. new laws allow the city to shut the stores down. the new law is the packages and to find them unlawful and shut the stores down. how successful will that be? >> it means anybody may be able to buy it, especially if you think it's candy and they're selling it as scooby snacks.

now we're dealing with old school policing. you're going have to get out on the street and deal with dealers on the street. cathy lanier says we want to get to the suppliers, not so much the buyers in the street. you have to deal them like you have been. >> anyone who gets arrested or who sput on probation or parole will soon, beginning this month, be tested by pretrial services. >> this is classic response to the drug problem. and i think -- it all makes sense. we shouldn't forget in the discussion, why do people go to drugs in the first place? what's going on with their life and their home place or economic situation that gets them into that and maybe we should be thinking about that too. >> i hope you don't overreact the way we have done with marijuana use and, again, start filling up jails because now they're using artificial marijuana. i think the real emphasis should

be, one, on suppliers, no ifs, ands, buts about it. something's really strange when you confiscate a cruise ship full of illicit drugs and only two people get arrested. i mean who owns the ship? and we should have -- i think we said this on the program a long time ago -- i think they babied these store owners. these store owners knew they were selling -- they saw channel 4 news. they kept on selling it. so now what are they doing, pat? they're taking their licenses, shutting them down, and putting them in jail. >> i think that's the big thing. they're putting these people on notice. >> got to take a break. we'll be right back. stay with us.

metro oversight transfer. transportation secretary fox rejected the ntsb recommendation to transfer oversight to the several railroad administration. dave, what kind of difference do you think this should make in terms of improving safety? >> well, the idea would be that the -- this agency is better suited to deal with this problem. that's arguable. the other agencies haven't done the job, so we've got to switch it over. you will notice, however, there was a distinct lack of overwhelming enthusiasm for it. as i read it they said, well, nice, okay, i have other things. i remember senator mikulski said i have something to bring out later. so i think it was less than overwhelming. it was the way the officials saw it and the way the secretarying

atted as he did is not a surprise to me. >> will it put teeth in metro's safety? >> i think anthony fox is hoping that, the transportation secretary. and i think the issue here with him with the ntsb is whether or not it would be oversight by the federal really association or federal transit administration. and his point was, listen, we'd have to have a legislative change to put it in. so we don't want to do that. that's going to take more time. i think he is acknowledging that there are problems. we need to move quickly. he believes the federal transit administration can move quickly. and one other point. he says that the tri-state oversight committee which is supposed to oversee metro really doesn't have the infrastructure to do it. they can't level the fines and penalties they should and that's what they need. that's really the important thing coming from the transportation secretary saying we need stronger oversight. >> what do you think? >> they don't have the leadership either. that's why they're having such a hard time finding someone to

come in and really crack the whip and get this in order. but i always smile when we get these alphabets of agencies. fta, ntsb. the reality is metro riders don't care what alphabet you use. darnit. get it fixed. >> the problem has been management, funding, commitment, middle level people. how many things have we talked about on this program as to the problems of metro. you have to really wonder is switching it from one agency to another going to change that. >> what do you guys think about the new secret surveillance violence app? >> we're all suspects. >> it's a new crime-fighting app that engages residents and businesses and police in reporting suspicious people and activities. >> yeah. >> this is a group thing. and there are complaints and concerns whether this will result in racial profiling. >> this is the dumbest -- i mean it's so awful.

i'm going tell you. oprah would be a suspect. she's been followed around because she looks suspicious. aretha franklin was a suspect just recently at a johnny rocket restaurant. you know, diana ross at one point. so if i'm with my wife and she's in, say, a retail store and i happen to be dressed not like i am now, someone could go to an app to say, oh, this guy looks suspicious. it's always subjective. and i think this is just awful. and that's why you're seeing 70% to 80% of those folks who are using that app who are identifying who? african-americans. >> and the lead in the story was that a clerk at a posh shop was worried about two people outside in the alley making loud noises. well, it probably sounded not great, but i don't they have security in the store who can

quite casually take a look outside, make a judgment, and if they're intent of attacking the store -- pardon me -- make problems in the store, but to call the police for, oh, suspicious people, that doesn't make sense. >> this is where police and the business district of georgetown will have to address this because they're together on this. they put this together. there's an article in the "washington post." i give them credit for it. is it about safety or is it about racial profiling. any time the numbers come back, 90% of the profiles happen to be african-americans and in the stories you see some of the business folks saying i had to get off of this app because when i look at it, i thought, well, wait a minute. there may be latent biases i may have. this isn't just in california. it's in the district. >> thank you, gentlemen. that's reporter's notebook.

now to a big story. a man is facing charges for escaping a police cruiser and attacking several officers. take a look. it ended up with police chasing and tackling him. he assaulted two. then in college park he somehow escaped the police car and attacked the officer at the wheel. that officer then tased him. >> the road is shut down in fairfax county. crews are cleaning up downed wires there. take a look. this is tenth street and i street. a car hit a transformer there. we now know who the police are looking for for a bizarre murderer. this happened on rochelle avenue near walker well road. he lives in the building but

investigators still don't know why he shot her. he's now facing murder charges. a d.c. street is being dedicated to honor a hit-and-run victim today. ruby whitfield was killed by a drunk driver after as she left an usher's meeting from a church in 2013. the process was finalized this year by current mayor muriel bowser. the ceremony is taking place this morning after the 10:00 a.m. service. some women's most private moments may have been caught on camera at to understandly university. they found a smartphone inside their locker room. it may have captured some video, pictures, and audio. some were upset the school did not announce what was going on. >> i feel like we should know if there's an incident like that going on where there's a potential where somebody's trying to invade people's

privacy. well n a statement to baltimore's wbal, townsend university officials say, quote, our students' welfare and well being continues to be our top priority, end quote. meanwhile they're offering counseling for the members of the team. it's not looking food for the californians trying to dig out of the massive mudslide. in some places there is mud waist deep. hundreds of people had to be rescued thursday when those mudslides buried roads trapping people if their cars. take a look at some of these images. luckily no deaths or injuries were reported. it could take days, though, to dig out. >> we just learned that all 19 people killed in the historic south carolina flooding were in their vehicles. 12 of them died after being trapped by water or swept away. the others were weather-related crashes. many were swept up by creeks that normally can't be seen from the road. an ma accused of shooting a

woman in a wall marlt parking lot is in the hospital. police say they shot at him after he fired at them in pennsylvania. the walmart locked down with lots of customers still inside. >> there was a guy with a gun in the store. so i went to find my kids. got him. >> it's still not clear what the suspected shooter's condition is right now. police say when the man recovers, he'll be charged with six counts of attempted homicide. a man credited with saving lives is now talking about what happened. chris mintz posted on facebook that on october 1st he held the door open for students to escape after running to the library to warn people, he ran back toward the gunman. the gunman accused him of calling the police and shot him. mintz told him, it's my kid's birthday. another church door was set on fire. it's the fifth church door over the last two weeks. it happened around 4:00 a.m. yesterday morning. authorities say this church fire

has been the worst with more than $10,000 in estimated damage. fugitive drug lord joaquin el cha powe guzman barely escaped capture while hiding in the mountains in mexico. we learn just last week they zeroed in on him after they intercepted cell phone video. th they say he has a hurt leg and face after that incident. a new cancer drug may be the answer for some parkinson's patients. doctors at georgetown says it reverses symptoms for several people with parkinson's. this is only part of a preliminary study. they want to see the drug to see if it can help other diseases as well. well, you may have seen a huge vigil outside.

the secret service shut it down. >> i know what you're going through and the courage you show and it will be an inspiration to me because even big top secret service agents have bad days. that was the director of secret service apologizing for forcing the individual to reschedule. agents said they stopped event because the president was entering the white house at the time. >> folks that made over transportation plans when they heard about the pop uber strike are scratching their heads. even though they plan to strike over low wages we're checking the smart app and there are drivers to be found in d.c. those striking are demanding a 60% rate increase and an option for users to leave a tip for their driver on the app. well, the arlington board voted unanimously to formalize a

>> there's always something going on, of course. a busy time. hillary is going to be on the hill this week. you know, this came up in the debate this week. we're tired of hearing about the e-mails and all this stuff, but what are you expecting to hear from her this week? >> look. i expect her to play the card she got hand-painted with kevin mccarthy and then another member of the republican house also saying this was just designed to target her. i expect her to say that a lot over and over again, but make no mistake, they're very nervous about this, the clinton campaign. she had her last event until benghazi yesterday. sunday, monday, tuesday, wednesday. you know what she's doing for the next four days? she's preparing for this testimony. they know this is an important next step. are they going to get this behind her? no. there's still an fbi investigation. if they're able to answer it and come to a draw, they calm her supporters down and they at least have an opportunity to put some of this behind them. again, that fbi investigation is

something they can't control, but that's what they hope to achieve. >> and we're a couple of days past the debate. she's still riding the tide of a solid performance. i read an article that says this is going to make joe biden's decision a lot harder. >> i think it does. so right after the first 48 hours after the debate, there was all sorts of, oh, there's no room for joed my booiden, just this, you know, it makes it harder. so what has he done in the last 48 hours? he's trying to make it clear, hey, i'm still thinking about this and i'm actually leaning more toward running, not less. his closest adviser puts out a letter saying, hey, he's thinking about it. yesterday he makes a key statement. he's like, oh, he sounds to me like he's running. i think he doesn't like hearing that the debate is somewhat harder and he wants to send the

message. >> yeah, he's still here. we heard this back and forth between donald trump and jeb bush about 911 a/11 and george bush's name got back in here. >> he did. he took offense. he said it happened on george w. bush's watch. he ice trying to imply this happen happened only because of george bush. any time he's attacked, jeb bush takes it personally. he needs something to jump start his campaign. i think the campaign was looking for an opportunity to sort of show some strength and go after. so i think any little thing trump did, i think they were looking to pounce. >> what trump's not doing is addressing reporters on this. i don't know what that signals because this is a guy who has no problem being unapologetic but he's not touching this one.

>> we'll see. i do believe we're going hear from him thiz weekend. >> i'm sure. you can count on one thing. >> a reminder you can see "meet the press" every sunday right here on nbc 4 right after "news4 today." well, metro has been narrowing its left of general manager candidates, and now is down to two. sources tell "news4" the two finalists are transportation professionals and the metro board is expected to select a new general manager in early november and make an announcement then. metro's been without a general manager for almost a year. cycling. that's a huge way of getting around our region and there have been growing pains as we're forced to share the road. now a new bike lane is taking shape in the city of fairfax. the city is expected to install its first ever designated bike lanes. >> a sign of the times in historic fairfax. more room on how to get around.

bikes are getting their own space for the first time. this will change from two lanes of traffic in each direction to just one lane of traffic along with a bike lane on each side and a turn lane down the middle. cyclists happy to have it. >> it also gives you a sense of i have a safe place to be in. >> he says he's been pushing to get more of this type of infrastructure around the city, but he also understands the dynamic that plays out on the road. >> in any culture there are, you know, respectful and not respectful cyclists. i think everybody has to follow the rules of the road. >> when you talk about infrastructure, good design comes into play. nancy lofton voted against this plan for bike lanes because it doesn't make sense because it can dump bikes into heavy traffic and complicate matters. >> if you're going to do it. let's do it wisely.
