about to get. >> our area is officially on royal watch. prince harry's schedule starting to firm up two days before his visit. >> first, we're following breaking news, a car has been found overturned in a small pond off the washington parkway and a man's body has been found inside and we sent you a breaking news alert as chopper 4 arrived on the scene. the wooded area to route 98 in laurel. u.s. park police tell us a park service worker cutting grass in the area this afternoon, saw the car in the water when police arrived on the scene. u.s. park police and fish and wildlife police went into the water and confirmed a man's body was found there. they are still on the scene. we are told the off-ramp to 198 and the vw parkway have reopened and in the meantime, jackie benson is on the way there and we'll get a live update from her as soon as it's possible. for now at the live desk, i'm

scott mcfarland. to new developments and a police shooting in frederick. >> a trooper shot and killed a man outside a gas station and we are hearing from a witness about the moments before the shots rang out. it's along east patrick street. news 4's pat collins is live at the scene. pat, what are you learning? it starts when a stolen suv rams a police car. the suspect gets out of the suv, he tries to run away and police gun him down. >> i saw a police officer, a state trooper approach a vehicle and shouted many times, get your hands up, get your hands up, get your hands up and the next thing i heard there were tires squealing and he was leaving the parking lot. >> that's bill day, a witness to

the confrontation and the man shot and killed linked to this lincoln navigator which was stolen in an armed robbery last night in baltimore. early this morning a trooper spots the navigator here at the sheets. he calls for backup and when the man comes out of sheets they call for him to put his hands up, put your hands up, but they say the man, he gets into the navigator and then rams the police car that's just arriving on the scene. then they say the man gets out of the navigator and tries to run away on foot. again, they call for him to stop and when he doesn't, one of the troopers opens fire. >> i am not sure what he said whether it was get on the ground or get your hands up. i'm not sure. >> reporter: how long after those commands did you hear the shots? he gave those commands four or five times and they were very quick after that. >> reporter: then you saw the man on the ground and once i walk around the vehicle when i could see around the pump.

>> reporter: now police say the suspect didn't have a gun. the officer that was in the car that was hit is said to have nonlife-threatening injuries. before all of this happened a witness says the suspect was in a mens room here at sheets displaying what you might call unusual bathroom behavior. more about that coming up at 5:00. live in frederick, pat collins, news 4. >> i'm meagan fitzgerald here at the corner of calmea and georgia avenue northwest and d.c. police have been on scene here since 9:00 this morning investigating after police shot and killed one of two suspects. they tried robbing this morris miller liquor store on the corner. >> when the officers arrived on scene they saw one suspect running on the outside of the store. officers confronted the suspect who was in the back parking lot.

he started shooting at police and they fired back and the man died on scene. the second suspect was found 15 minutes after the shooting in an alley four blocks away. police say no one else was injured during the shooting and we are told this area will remain taped off until the investigation is complete. coming up at 5:00, hear from business owners and neighbors who describe what was happening during and after the shooting. >> all right. thanks, meagan. two teenagers are facing charges that they were hashing a plan to shoot up their school. investigators say the plot involved calling in a bomb threat and then the accused teenagers planned to shoot teachers and students as they were leaving the school. >> darcy spencer is in spotsylvania and she'll look at the role other teenagers played in foiling this plot. >> the state flag is now history in more ways than one at the university of mississippi. ole miss quietly took the state flag down.

after the students voted to recommend its removal from the campus. mississippi state flag contains a confederate emblem. it's gotten a lot of criticism since the deadly shooting of nine african-american church members in charleston back in june and campus leaders called a flag a symbol that undermines diversity. >> a levee burst after a weekend of heavy rainfall in louisiana and now that same system is headed our way and southeastern louisiana. that caused water to spill into a surrounding neighborhood. sandbags are being brought in to help fill the breached area. residents are being asked to stay in their homes. the levees in that very same area were deemed to be substandard several years ago. the floodwaters are finally starting to recede in parts of texas. heavy rain from patricia drenched several cities this weekend and up to 20 inches of rain fell across the state and in houston, it sent raw sewage

spilling on to roads and crews are working around the clock to disinfect some of those streets. closer to dallas, the flooding washed up debris in some cases and washed away roads in others and swept a freight train off the tracks while it was hauling cement. rain is already making its way back into the headlines for us this week. doug, you have been telling us a lot about how even though a hurricane is done and has trickled out, its effects can be felt for days and even a week out. >> the moisture is down into louisiana and down toward florida and they'll be dealing with very heavy rain and eventually that moisture moves up toward our region starting tomorrow night and today when we have some sunshine and we're dealing with cloud cover and temperatures across the mid atlantic and in the upper 50s and it's been a little bit on the cool side a cross our region and 59 in hagerstown and 57 in richmond and it's all because of the cloud cover that we've seen and we've seen the front down to

the south and helped to bring in the cooler weather and these are the remnants of patricia and look at this, a very good signature here and look around the new orleans area and it is pumping in a lot of moisture right in toward the florida panhandle and around pensacola around the destin area and for us this moves toward our region during the day tomorrow and wednesday. so what to expect, most of the rain will fall on wednesday and not worried about tomorrow for rain and rain, some of it heavy at times and that's what we'll be watching for and not too worried about the flooding issues and one to two inches and winds gusting 25 to 35 miles an hour, too so your wednesday is looking rather dreary. we'll talk much more about that and we'll show you when it moves in and what the impacts are coming in 20 minutes. those of us in the community and generations of listeners are mourning the loss of radio legend ed walker. the host of the broadcast on

wamu died early this morning just hours after he listened to his final sunday night broadcast. ed recorded that show from his hospital bed after a recent cancer diagnosis. his voice projected out over the d.c. air waves for more than 60 years and he was the most blind student ever and he helped found wamu. he was one-half of the joint boys duo with willard scott. ed walker, dead at the age of 83. >> he was operating a low-powered transmitter in his basement when he was 8 years old and here he is 70 years later inducted into the radio hall of fame. >> he's a great friend to us here at wrc where he walked the halls and where we had lunch with him many, many, many days, many years. >> what an honor. thanks, pat. >> something to think about tonight when you're feeding the dog. before you reach for the treats, check the label. there is a big recall we're going to tell you about next. royalty in virginia, what

forecast. >> today we've been in and out of the sunshine and has been on the cool side with our temperatures in the 50s to around 60 degrees and you can see the clouds that i'm talking about and the area split up across northern maryland and that's where most of the sunshine has been today with cloud cover arc cross southern maryland and of course, a lot of cloud cover right here down south. that's the system that's going to make its way up into our area. our rain chances will be going up to a 40% chance on tuesday, 100% chance on wednesday. it's not only going to be wet, but it will be windy and very nasty. then no rain chance for thursday as we start drying out, but boy, roads are going to be impacted

4 video. investigators say a park service worker who was cutting grass spotted the vehicle overturned in a small pond. this is near route 198 in laurel upon u.s. fish and wild life officers were the first to respond. chopper 4 was over the scene as they worked to try to get one of the car's doors open. inside they found a man's body. news 4's jackie benson is now on her way to find out more. she'll join us live at 5k c:00, not before. a recall on dog treats that can not only get the dogs sick, but their owners, as well. the good fun sticks. they have expiration dates with july 2018. the dogs can come up with pretty nasty stomach trouble and a risk to humans who touch the treats. you can return it to the store for a full refund. some answers to your question about a new report

linking certain meats to cancer. the world health organization reports some processed meat do cause cancer and that red meat probably does, as well. processed meats are generally salted, cured or smoked and things like hot dogs, sausages and bacon contain a lot of it. the report found that people who ate 50 grams a day, the equivalent of two or three slices of bacon had an increased risk of colon cancer. meat industry groups slammed the report as misleading and however, nutritionists say the truth is somewhere between. >> the bottom line in nutrition is to eat a little bit of as many different things as possible. >> the recommendation is no more than 70 grams per day aof red o processed meat. >> the way red meat is cooked matters. >> high heat cooking like barbecuing is more likely to produce higher amounts of carcinogenic chemicals.

husband antoine sullivan. evidently one child was in the house along with the grandfather. the grandfather was the one to report this. wilkerson sullivan is an employee of the prince george's county government. police have recovered about the weapon used and what they're saying about it. outside of police headquarters, i'm tracee wilkins, news 4. >> investigators are waiting for autopsy results on the two teenagers who were found dead in the back of a locked minivan. they were both high school seniors and grief counselors spent the day at indya davis and lyle ferringer's schools. both are 17 years old and were reported by their parents when they missed curfew friday night. they were found in carson park in dale city. >> when you have kids you always worry about them and just don't want to have any kids. very sad. >> a spokesman for the school says right now they're just

200 people were killed in afghanistan and pakistan. as ron mott reports many of the victims are children. >> the massive quake hit about 2:00 in the afternoon local time causing widespread building collapses and triggering rock slides and sending people scurrying to get outside. it was centered about 150 miles from kabul and was felt all of the way to india. afghanistan's chief executive said it was the strongest quake felt there in decades and this is an area that gets them rather frequently. >> we do have assets that could be helpful and we stand ready to do what we can to help the government as they respond to this terrible situation. >> the confirmed death toll is over 200 and officials say it is expected to rise as casualty reports come in from rural areas in the hours and days ahead. among the dead, about a dozen students at an all-girls school in afghanistan who were killed in a stampede as panicked teachers and kids tried to escape the region. tonight they're bracing for

fairfax county courthouse where lawyers defending accused serial killer is trying to raise doubtses about whether a prosecution witness actually saw the defendant in the victim's neighborhood. this woman, a prosecution witness testified earlier in the trial about a man she noticed in the neighborhood shortly before rutharound lodato was killed in 2014. she called detectives after the murder and described an older, bearded man wearing a tan jacket that so unnerved her she began walking her dog on a different route. today defense attorney suggested it might have been another bearded man she saw, not severance. an alexandria detective testified he stopped a man matching the sketch and the woman's description in old town two days after the killing. the man was questioned and gave police his tan carhart jacket. the defense team hopes jurors might conclude that the woman saw that man and not severance.

back to you in the studio. >> thanks, julie. true or false. students in big city public schools spend up to 25 hours a year just taking standardized tests. well, according to a new study that's true. nbc's mark barger has details on the new obama administration plan to scale it all back. >> reporter: growing concern about the emphasis on standardized testing in public schools has the obama administration calling for new limits on them. educators are meeting with education secretary arne duncan to discuss the way forward. >> the goal here is not just to test. the goal here is to improve teaching and learning. under a new plan the president is recommending schools that use 2% of classroom time for standardized tests and the test enhanced teaching and learning and provide a clearer picture of how students are performing. >> learning is about so much more than just filling in the right bubble. >> so we're going to work with

states, school districts, teachers and parents to make sure that we're not obsessing about testing. >> according to a recent study, students in big-city public schools currently take on average 112 mandatory standardized tests between pre-k and high school graduation. while the goal of standardized testing is accountability, many agree it's gone too far and is often redundant. >> it is important that we have accountability and testing, but we need to make sure that it helps the teacher and the student and the parent knows what to do next to make improvements. now a largely bipartisan push to put the focus back on teaching and less on standardized testing. mark barger, nbc news. >> the nation's leading group of pediatricians is urging lawmakers to raise the legal age for buying cigarettes. studies show the vast majority of adults who smoke started as
