and opposing trump. >> and spotsylvania county murder, taking a close look. the fog is already creeping in parts of our area. here's a live look at route 7 near leesburg. visibility dropping below half a mile. >> it's thick out there. doug, is this something we have to worry about on the drive in tomorrow? >> i think it is in some areas, most of those areas are just west of the i-95 corridor. areas that stayed in the fog a lot of the day during the afternoon. leesburg a quarter mile as far as visibility is kerconcerned. five miles in d.c., 2 1/2 in fredericksburg. we have seen this area in leesburg through fauquier county and montgomery area and parts of southern frederick, that's where we're seeing the visibility a quarter of a mile. patchy fog early tomorrow

morning. you might need extra time. temperatures around 43 degrees, tomorrow afternoon, no problem. temperatures today got up to an average high of 49. look where we go looking at possible record high temperatures. coming up? thank you. a d.c. charter school is pushing back tonight against protesters targeting a new pl planned parenthood in the district. >> the school filed a lawsuit asking them to stop making any contact with the children outside two rivers public charter school. it's off florida avenue in northeast d.c. jackie bensen now live to explain why it's become so contentious. >> reporter: this is all happening in a fairly tight space here on 4th street northeast. let show you. this is the two rivers charter school. follow along here just across this alley. that is the planned parenthood facility that is still under construction. as you can see.

directly across the street the building two rivers uses as a charter school and what they have been seeing, what's been going on is a request for an injunction that would include prohibiting protesters from holding signs that are obviously aimed at students. in the injunction includes a photo, a banner that say, they kill babies nearby, tell your parents to stop them. the legal filing also contains images of very graphic signs that have reportedly upset students, some of whom are kindergarten age. the school, we're told, has resorted to using a side door to keep children away from prote protesters and the injunction also requests that no signs the protesters are holding be allowed more than 11 by 17-in 17-inches. this planned parenthood facility is not scheduled to open until may of 2016, may of next year.

this is obviously something the school feels so strongly about they have asked a d.c. court for an injunction to prohibit protesters from being within a certain distance of the school. live in northeast washington, jackie bensen, news4. man behind a shooting at a planned parenthood in colorado springs declares he was guilty in open court today. 57-year-old robert dear called himself a warrior for babies, interrupted proceedings several times and said he didn't want to go to trial. three people died in that sho shooting. several others were injured. dear's attorney asked for a mental competency hearing and also asked the judge to impose a gag order. it's still not clear whether prosecutors will seek the death penalty. san bernardino wasn't their only target. sources tell nbc news suspects side si sayed farook and tashfeen malik might have been interested in

jihad even before they met each other online and even before the rise of isis. investigators say they didn't know either was committed to an attack when malik applied for a fiance visa. >> the visa was approved and she immigrated here and 14 body bags later we are trying to figure out what went wrong. >> farook first started talking about staging an attack three years ago with his friend who supplied the two assault rifles, enrique marquez. the fbi is looking into the possibility farook and malik's marriage was arranged by a terror organization. >> we're keeping an eye on what's happening in chicago. tonight, there is a new effort under way to try to force mayor rahm emanuel out of office. demonstrators have been walking around town blocking streets around the magnificent mile and

now introducing a plan that could allow for emanuel's recall. protesters are demanding emanuel step down after video of a police shooting was kept under wraps for a year. right now, chicago has no process for a mayor to be recalled and no stating whether the house or senate would approve that plan. emanuel says he won't step down and the next election is four years out. tonight, police in prince george's's county are still trying to figure out what led up to the crash in clinton, maryland, that killed oa 9-year-old girl. the mother speaks out for the first time. >> when this happened it took everything inside of me out. i felt empty. >> reporter: tonight is this first time rashelle brown speaks out about what happened november 2nd, the tragic night her daughter died in a car crash. >> no one expects to bury their child. it's usually the other way around. you expect your child to bury

you. >> reporter: it especially hurts because rashelle was at the wheel. she was driving her bmw and tried to make a left on canberra dried and woodbury road. they turned in front of this car and it flipped over. >> i don't know where we were hit. i didn't see a car coming. i didn't see lights. >> reporter: police are investigating the crash. the other driver had two broken legs and injured back. medics tried to revive her daughter at the hospital. >> hen i held her hand and looked into her eyes, i knew she wasn't there. it hurts so bad. no mother should have to go through that. >> reporter: tonight, she looks at a video of her daughter ir ironically singing a song called the beauty of pain. ♪ ♪ the beauty of pain >> rashelle said her belief in god gives her strength. >> i believe in jesus and he's been my comforter and he's been

comforting me and my family throughout this whole tragedy. >> back out here at the scene you can see the brown family made this makeshift memorial and encourage people to hang christmas ornaments to pay tribute. i'm shomari stone, news4. new developments in this murder of a 21-year-old murder of a woman in spotsylvania county. police released pictures of heather cic orciccone's car. she was killed by a gunshot. her car was found where she didn't live. police want to know if any saw the car and are trying to find out what it means as to her murder. it was a cloud for half a decade and tonight that cloud is gone and saying justice delayed is justice denied.

they're ending their investigation into the former mayor with no indictment. they're trying to prove gray knew about an illegal slush fund that helped him get elected in 2010. seven people connected to the former mayor pleaded guilty in the case. gray maintained his innocence. today, gray criticized prosecutors for timing of some of those indictments just days before the 2014 election. >> you have to be very cautious before you publicly allege somebody violated the law, especially in this case, eight, nine, 10 days before the election everyone pretty much agr agrees, cost his defeat. >> a lot of people are specul e speculating gray will run for d.c. council but a few weeks ago at the turkey bowl he tell mark se graves he hasn't made any decision just yet. >> d.c. police investigating the 153 murder in the district so far this year. in this case a man was shot

multiple times inside his apartment on capitol street southeast. he died at the scene. police have closed 12 homicide investigations but dozens of murders still unsolved. things back to murder in northwest d.c. after several blocks were closed to traffic after nearly 10 hours and police spent that time negotiating with 22-year-old warren stephenson suspected in an armed carjacking last month and barricaded himself in a home but eventually surrendered. the police officer charged in the murder of freddie gray testified in his own defense of gray. he said he didn't call for a medic for gray because he had no physical signs of injury and was unable to give a reason for a medical injury. gray suffered a critical spinal injury in the back of the police van. porter is the first of the police officers to go to trial

search s.a.g. the s.a.g. awards air next month. many of you are waiting for the golden globe awards nomination and watch it live during the "today" show. torrential rain and massive flooding causing serious problems for thousands of people in the pacific northwest. in portland, oregon, a woman is dead after a large tree toppledton her home and after days of hazardous weather landslides closing major highw y highways and high winds knocking out power to thousands. it is the latest in a number of dangerous cases involving this holiday must have item, caught on camera, a hover board catches fire in a seattle mall. an employee quickly doused the flames with the fire extingui extinguisher but the smoke trigger sed fire alarms forcing the mall to evacuate, tracing back to lithium ion batteries.
