6:04 am
announced the robbery and that's why the officer shot him. >> it's believed the suspect was homeless. in the third presidential democratic debate, bernie sanders, a member of his staff accused hillary clinton's private voter campaign as well. nbc's chris pollone has the following. both sides moved quickly to stifle the bad blood. sanders apoul pohl jazzed aet the beginning of the third democratic debate admitting a member of his staff accessed clinton's voter data information. >> yes, i apologize. this is not the type of campaign that we run and if i find anybody else involved in this, that i will also be fired. there was a private i'm server.
6:05 am
clinton chose not to hammer sanders over this week's brief. >> i think we should move on because i don't think the american people are all that interested in this. i think they're more interested in what we have to say about all the big issues. >> what issue is? gun control, terrorism dominated much of the discovery. the democrats taking aim at each other. >> we must work with them, not demonize them as the republicans have been doing. >> reporter: former maryland governor o'malley slammed them both. >> senatevery election year it .

"storm team 4" tom kierein with more on the winter forecast, what you do think, tom? >> it's going to be record heat moving in by thursday. between now and then we'll have it warming quite dramatically. today, though, another day with temperatures near average for this time of year. 6:15 am
degrees by mid afternoon on friday and then clouds close back in again for next weekend. could get some rain next saturday. that's the way it looks, adam. >> all right. break out the barbecue for christmas. not bad. thanks. next up, "reporter's notebook." a look at the community's stories. we're back in 15 minutes with more of the top stories. >> welcome to recorder's notebook. i'm aaron gilchrist. we'll start with the baltimore officers, the first of six charged in the death of freddie gray. he was charged with manslaughter as well as three other counts. this jury could not reach a verdict. could not decide on any of the four counts in the three days that they deliberated. where do you make that this story ended up? >> they look at this and they this is a precursor to some of the other trial nace come. i think on the upswing for the city, i think they have to feel
6:16 am
good about so far nothing, you know, has happened to sort of put them back in the news in a negative light, but i think in terms of how these trials will go, in this case it's probably not the most explosive trial in terms of the accusations that will come forward. i think also the fact that the attorney for freddie gray as family came out and said the family really wasn't upset with the jurors. they're not really surprised that they didn't come up with a verdict. in that sense, you know, i'm sure that the folks in baltimore t regular folks won a verdict, found guilty for the police officer. but in terms of the city as a whole, they have to be at least breathing a sigh of relief in term there being a mistrial and the way it's sort of being handled now by the folks in the the and even the attorney again for the family. >> again, several things. one, it's a bump in the road as attorney murphy said. this is a bump in the road
6:17 am
toward justice, and so that's number one. number two, i think you also have to give credit. you have new police leadership. you have a police chief who went in. he met even with some of the old rioters, community beefpeople and got some agreement with them. number three, this case, porter, is the low man on the tote em pole. the real issue has to be, i think, whether or not -- and we don't know because of this sunday morning -- you know, how will this decision to or not to continue another case impact these other cases, but, you know, we ought to keep in mind. juries always have a problem convicting policemen. >> they do. this is one they really thought they could win. they wanted to get off to a big start, convict porter, move onto
6:18 am
others. for some reason they weren't able to do it. one, you have to wonder about their case, how strong was it really. and yet when you look at the overall thing, guy gets on, complains about being sick, don't do things they normally procedurally would do. what goes on there. one, they didn't normally do that. he didn't look that sick. he did notice he had a problem when he tried to move him. but then he didn't go further -- he told the guy that was driving what was going on. so, you know, that -- trying to prove a case when you have that kind of evidence gifrp in trial might make it more difficult. >> this is willful neglect. the rules are you put a seatbelt on. the reality is he did ask for medical help. he should have called and he didn't. i think one of the difficult things that this jury might have is the fact that this guy grew up in west baltimore, he was part of the community. he actually knew freddie gray.
6:19 am
>> yeah, yeah. >> but you talk about woeful neglect. do you think this jury said that it's not there beyond a shadow of a doubt and so we can't -- early some people felt that way? >> i think that's true. they may think, yeah, he didn't do everything he should have done. but he did a lot. he wasn't aware of the situation. they didn't want to get to. >> we don't even know the numbers in disagreement. it could have been 9-2. that's why it makes a difference. but i do think the officers are going to look at this case and poke the same holes that porter's defense did. >> i spent some time in baltimore after the rioting back in april and the impression i got from the people who live there is that all the crazy ps th ness that went on. this time the message was put out there really hard. you know, we don't want chaos
6:20 am
and rioting in the streets of baltimore. do youly was an overanticipation that might happen? >> there has to be an overanticipation, i don't know if i would use that word overanticipation, that phrase. but i think what happened again, the new police chief. they learned from their lessons. they talked to the community. they did whatever they could to make sure there would not be an outburst. remember, thoerks it was a hung jury. he wasn't convicted nor was he found innocent. >> the community probably learned from what happened. >> yeah. >> you see that cvs burning down and you see older folks using that for prescriptions. they're saying, wait a minute, was there any benefit in that happening? they can talk about what the community learned. >> oh, yes, i agree. yes. >> i want to start on the topic of vincent gray and the fact
6:21 am
that the u.s. district attorney in d.c. said -- i think the quote was, theed a miserable evidence is unlikely to sustain a criminal -- >> i wonder where they found out. >> what did one prosecuting attorney see that the other didn't see or thought he saw what the other saw. >> it's very difficult. >> what do you read into those words. does that then say on some level this was a witch hunt if this new prosecutor comes in in. >> that ooh a charge that's been made that is correct they started this thing too long, went too hard, and made the announcement about the indictment of jeffrey thompson right before the election which, of course, sank him as a fewtut mayor. >> it's deceptive. the former jattorney general sad
6:22 am
either ta mayor was ignorant or compliant, that's a lucky man. that's how he supports it. i'm sure those for vincent gray says this was a witch hunt, the timing was done on purpose and obviously the mayor will use it to his advantage if he comes back into public life and he's said he would. >> wheel talk more about that. we need to get a quick break in here. we'll come back and talk about that here on report 'eers notebook.
6:23 am
welcome back to report 'eers notebook, i think vincent gray has hinted he might run for d.c. council or the mayor's office again. what do you think of that? is that a likely hood? >> i think he will. if i was in his place, i would.
6:24 am
look, i'm one of these people who believes -- i'm not ready to call it a witch hunt, but i'm telling you, the prosecutor knew the impact the charges would have on the election. that prosecutor could have waited. there's no ifs, ands, buts about it. here we are now after the election and we've come up with a result that, like i said earlier when you introduced this story, when did you find out you did vnl enough information. at what point was it you were ready to stop. so i think this -- this was a total ial injustice to vincent . >> i think we should also add gray hasn't been acquitted. the fact remains they simply could. make a case. it's not like they dropped the case and said he's free and is
6:25 am
set to go. >> do you think the electorate was so caught up in this t scandal hanging over his head, that the people really supported him, wanted to elect the mayor, but did this so he runs again? >> remember, you had this low turnout. >> the turnout was low, bad weather. and so that played a large part in it. then you put a cloud over his head. i'm sure gray would say that's really what sort of knocked me out. hi could sort of take the position, look at where the city is moving. i was sort of at the helm as the city is moving forward, bowser has come up behind and picked up on that. he's been very quiet in the 11 months that bowser has run and he never endorsed her. >> oh, there was no -- there was no chance he was going to endorse her. >> well, she's a democratic nominee, i agree with you. but some could say -- >> oh, no, no, no. there was bad blood from get-go. there would have been no chance
6:26 am
for an endorsement to happen there. no. i think that this really was a low turnout, a cloud was over his head. it really was injustice on the part of that prosecutor. now who knows where that prosecutor is off somewhere. >> he says that the u.s. attorney owes him an apology. >> i think he does. he won't get it. >> i think we all are owed a better explanation of what went down there, what the reasons was, why, again, going back to the root question here, what did one prosecutor find that the other prosecutor didn't. >> three. >> and, again, the office has said that at some point they will come out and explain what they did or did not find. now, when that comes out -- i think the mayor probably has to be careful, you know. he's sort of off the hook. i don't know if he really wants to push saying that i want an apology because as dave said earlier, has he been vindicated,
6:27 am
they're saying they don't have enough evidence to. >> he's going to push it. they pushed him out. he might as well push back. >> okay. i wonder if there's real value in that for people who are going to vote in a council election or mayoral election is. there value in getting an apology or pushing for an apology. >> the more we know through an apology or better explanation, i this i that's better. people can be better informed. >> that's right. >> okay. i want to move into virginia, a story that got a lot of attention on nbcwashington.com, about this young man who dug a cave in a park in fairfax 15 feet deep. it was sort of set up like there was room even. police discovering this case that had been covered over with plywood. the young man showdown up, charged him with destruction of property. this story has really resonated
6:28 am
with people. he was a homeless man who was forced to live there and studied english. what do you make of the fact this story created a groundswell in the public? >> i think first of all a hole 15 feet deep and not straight down but sort of curved where he could go into that, i think probably what he was try dog with his life and learn english, you know, sort of plays into that. but as we know in the past couple of weeks, especially with the district and trying to move the folks out under bridges and different areas in the city, i this think is an issue in the city and homelessness is something people can gravitate to. but i think what make this one different is you know a little of his backstory. you see officials coming in, moving the tents out, i think because the story has been personalized a little bit, folks are gravitating toward that more. and also the scene of it. it's not a tent. it's a 15-foot hole.
6:29 am
>> i'm sorry. go ahead, joe. >> he put a different face on the homelessness. >> right. >> that's what he did. that's what people need to understand. when you walk by a homeless person, you really don't know what that person -- what that person has gone through. we don't know that most homeless people in the district in this area are veterans, by the way. the other thing is this also speaks to a bigger issue, how expensive it is to live in this district, not to be able to have a place to live other than a carob. he put a different face on homelessness. >> it's interesting. he didn't sit under a bridge or live in a pup tent. he with some skill created this incredible cave situation. once he's found and judged something, maybe community serve service or something.
6:30 am
i think people will find it hard to be hard on him. >> i think what's amazing is no one knew he was digging this. >> a lot more to this story to be uncovered. you can read about that on nbcwashington.com. gentlemen, we appreciate your time. thank you. >> thank you. >> that is reporeporter's noteb. we appreciate you joining us. ah, yeah. it's a bit chilly out there. brrr. that's how you're going to spell today's forecast. the cold is back with temperatures in the 20s and 30s around the area, but there is something to look forward to. the supplying and warmer weather for this christmas week. let's get straight to the weather with tom kierein. good morning, tom. >> good morning. have o'ryan setting in the western sky, venus and jupiter

museum ba sa. all passengers were safely evacuated and the device was taken off the plane. vaeping story now. d.c. police are looking for a man who committed two violent robberies and a sex assault. police say the assault happened just before thanksgiving on eighth and south street. then later he robbed someone on ives place. take a look here. all of them happening between the hours of 9:15 and 10:45 at night. there you go. you see the surveillance video. well, a scary incident near the university of maryland in college park. a woman said she was in bed early in the morning. she woke up to find a man standing above her. the woman said she asked the suspect his name, he told her and left. they say he walked through an unlocked door and may have been intoxicated. a report by a "news4" i-team shows a sharp spike in

6:41 am
yes, they're going to write about it. yes, it becomes one of the main story lines but it makes perfect sense. >> for those who don't know exactly what we're talking about, the voter list? >> the voter lists. they both pay to have access to it. they both do their modifications but they all keep it within this program b something wasn't -- the sanders people didn't hack it but they got access. it was as if the door got left open in the house and they were like, oh, look, we can look at it. it was wrong do but a larger kerfuffle. >> good for him to get it out of the way. then trump comes out right afterward and attacks everybody again. he still remains strong. >> you know, he does. you know, look, we're going to talk to him this morning. he's trying to run a very different campaign, we're 40 days to iowa. he is -- nobody has visited it
