we start tonight with guns in america. it is an issue that has been front and center all week and in about an hour president obama will host a town hall meeting in fairfax on the issue. >> also tonight a local lawmaker is taking steps to tighten the rules in her state as gun shop owners react to the president's executive action. news 4's meagan fitzgerald is live in fairfax with tonight's top story. hi, meagan. >> reporter: hey, doreen. when a german town woman, state delegate, kathleen delay said she was encouraged to draft legislation to keep that from happening again and we spoke with many gun dealers who say that's not the answer. they need to enforce the rules and laws that are already on the books and they say in doing so that can help prevent them from selling guns to the wrong people. there are many reasons why law-abiding citizens choose to buy guns. earl curtis hears about it every day. >> people are more afraid than anything else.

with the terrorist shooting in california people want to learn how to handle a gun safely. >> reporter: curtis is the president of blue ridge arsenal. he says sales have increased ever since tuesday when president obama revealed a series of executive actions to prevent mass shootings. obama said anyone selling guns on the internet in stores or at gun shows must be licensed. he says a background check must be conducted and he said more will be done to help the mentally ill. curtis says he and many of his customers don't believe more gun laws are the answer. >> we currently have laws in place that need to be enforced. if they're enforced they will work. >> reporter: he says aufsh times gun sellers don't know a person has a mental illness unless it comes up on their background check and that's something that doesn't always happen. >> with mental health, find out if someone is adjut kated find out it's on his record, when prosecutors say he purchased the gun online to kit sade adbayou

in june. >> he was not supposed to have a possession of a handgun, and replicas and antique handguns are excluded under law. >> kathleen demay is introducing legislation in maryland to try and stop anyone who shouldn't have a gun from purchasing an antique replica in stores. >> for those people who are prevented from having handguns this exception should not exist. >> reporter: demay says she's hoping to introduce this bill towards the end of the month, but it is important to note that it has not been endorsed by any republican members. reporting in fairfax county, meagan fitzgerald, news 4. thank you, meagan. >> developing right now a former high-ranking cop will soon learn whether he's headed to prison. he's admitted trying to make meth while on duty at the medical institutes of maryland. >> reporter: prosecutors and defense attorneys have been calling witnesses and showing witnesses, and arguing over the sentence for this former federal

law enforcement official since 9:30 this morning. about nine hours later they are still arguing. >> reporter: christopher bartly admits he tried to make meth on a building on a government campus he was supposed to be patrolling off i-270 in gaithersburg on a saturday evening in july. he's already pled guilty to a felony, but in court today his lawyers are arguing he should be sennence toed probation. arguing he didn't endanger others and did so in a remote section of the campus. prosecutors late today showed a series of photos from inside the lab in this building 236 in which bartley admits in making the lab and photos of draino. and windows blasted out of the room and the temperatures jumped up to 180 degrees. when firefighters responded to a heat alarm they say they found bartley badly burned and bartley

lied to him and claimed the explosion happened as he was trying to light a butane lighter. final word is expected to be from christopher bartley himself. for now in greenbelt, scott macfarlane, news 4. >> the first officer charged in the death of freddie gray is appealing the judge's ruling. a ruling that would force him to testify against one of his colleagues. a lawyer for officer william porter argued that giving him immunity would not protect him from new charges. officer porter is scheduled to testify against officer cesar goodson next week. officer goodson was driving the van when freddie gray died last april. he's been charged with second-degree murder. his trial begins on monday. a man murdered outside his home in charles county, maryland, has been identified and in the meantime police are trying to find whoever it was that killed him.

lydel wood was shot in the parking lot of his town home and it happened in waldorf yesterday afternoon. several nearby schools were told to shelter in place as police searched for the shooter. >> now to the controversy over what some would call the birther battle and the republican presidential contest. donald trump is on the attack against his closest competitor. ted cruz was born in canada to a mother who was born in the u.s. steve handelsman is looking into the questions trump is asking about cruz's citizenship. >> reporter: legal experts say no federal court in washington or anywhere else in the nation has issued a final ruling over what's meant by a natural-born u.s. citizen. as trump and cruz surge together far ahead of their rivals trump is trying to use this birther issue. donald trump's latest headline grab is giving away thousands of tickets for his rally tonight at a vermont venue that holds just 1400, but trump's attack on ted cruz is a bigger headline.

charges will be filed against a silver spring man who led police on a chase into virginia. that chase went from the beltway to i-66 to route 29 where the vehicle lost control and hit a patrol car and two other police cruisers were hit as they bocked in the driver. the suspect's name isn't being released. he's in jail tonight. two men inside of his car were taken to the hospital. there is a program in virginia that could make getting emission tests a lot easier. drivers can now bypass their mechanic in order to get those tests done. transportation reporter adam tuss explains now how it works. >> reporter: this is going to be a huge change for thousands of drivers here in northern virginia. here's how it works and you drive through the green boxes there and an infrared beam is shot across the road and it measures your emissions on the spot and if you pass you get a bill in the mail and you pay it. if you want to make sure that your vehicle is super clean and there are some simple things you can do. this is a test you want to pass.

all across northern virginia this rapid pass program being deployed to test emissions as cars drive by at regular speeds. a lot of drivers will know on the spot if they pass. so what's the best way to get an a-plus on your emissions test? jim sands is the president of opus inspection who is running the rapid pass in northern virginia. >> keeping the car maintained and keeping the air pressure in your tires at regular limits and doing the oil changes and those are -- those are just good, solid maintenance issues that some people just don't pay any attention to. >> reporter: if you do pass and only if you pass the test you'll get a letter in the mail saying you passed and you have the option of paying your emissions fee online. it's the same $28 charge you'd pay at a typical garage to get the test done. matt howard was the first resident to get that letter. at first he didn't think it was real. >> i got the notice in the mail and i had never heard of rapid pass and i thought it was junk

sdepding to the floor of the mine when the elevator got stuck. rescue workers used a crane to get the men out a few at a time. >> they huddled together. they did what they could do to keep each other warm and keep each other's spirits up and prioritized who should come out first themselves. >> the mine will remain closed until the problem with the elevator is identified and then fixed. paris prosecutors say it was a terror attack. a man with a meat cleaver and a fake bomb was shot and killed at a police station. it comes on the same day as the "charlie hebdo" massacre one year ago. bill neely is in paris where police may be zeroing in on the man's identity. >> reporter: paris police and prosecutors are aren't at the moment confirming local reports that this man was in his early 20s, was born in morocco and was arrested for theft two years ago. they're gleaning that information apparently from

fingerprint, but that's not concerned. we do know around 11:30 this morning a man brandishing a butcher's knife approached a police station and started shouting allahu akbar, god is great. when they approached his body they found something bulky underneath his jacket and a wire hanging out of it. they used a robot with a camera to examine his body and it was discovered that whatever it was was a fake suicide belt and there were no explosives on his body and they did find a homemade drawing of an isis flag and a letter in arabic in which this man or someone pledged allegiance to isis. the timing is significant because he approached the police station almost to the minute at exactly the time that one year ago at 11:30, the kouachi brothers approached the offices of the french satirical magazine "charlie hebdo" armed with

kalashnikovs and began killing 12 people. also when he approached the police station the french president francois hollande was finishing a speech to police officers praising their anti-terrorist work. so france continuing its fight against terrorism. this is a city and a country that feels itself very much at war. those were the words the president used and it's a city and a country braced for more attacks. back to you. >> bill neely reporting. a man who has held two of the nation's top security positions has a chilling warning about the terror threat. leon panetta has served as cia director and secretary of defense today. he told nbc's andrea mitchell that the u.s. needs a more intense military strategy to take back isis territory in syria and iraq. >> mark my words, i think isis has the potential to conduct a paris-type attack in this country and because of that capability, because of that clear and present danger, i

think we have a responsibility to do everything we can to defeat that enemy. >> leon panetta also made political news today. he endorsed hillary clinton for president saying she has the best credentials to provide world leadership as well as govern here at home. there is a move under way to strip bill cosby of his presidential medal of freedom. that medal is the highest civilian award. president george w. bush gave it to cosby back in 2002. president obama said there is no mechanism to rescind the honor. a lawmaker from arizona wants to change that. congressman paul gother says he will introduce a bill tomorrow to give the president the power to revoke the medal. cosby was charged last week in a sexual assault case that dates back to 2004 in pennsylvania. more than 50 women have accused him of sexual misconduct. he has repeatedly denied all of the allegations against him.

new speed limit signs are causing confusion on a busy montgomery county road and the sign is posted on wisconsin avenue and reads 15 miles an hour and police say they're not enforcing it. news 4's chris gordon is live with where the signs are posted and who might have put them up there. >> reporter: doreen, during the day there are work crews on side streets here along wisconsin avenue in chevy chase, but at night no crew. so why are work area speed limits posted round the clock? motorists may be confused. some signs say work area 15, double fine. the next post, the usual 35 mile an hour speed limit here along wisconsin avenue between chevy chase and bradley boulevard in bethesda. the different signs are troubling because there's a speed camera here taking photographs and issuing tickets, but montgomery county police tell me they are not enforcing the work area 15 limit.

>> in this situation for work zones the speed limit is 35 miles an hour and the camera is set for 35 miles an hour issuing tickets at 47 miles an hour. >> the director of traffic in montgomery county tmps me he's never seen a sign like this before. >> definitely not. >> it might have been put up by -- >> it could have been put up by the construction company putting the work. the speed limits in maryland are never less than 20 miles an hour so 15, as i said, that's the first time i've ever seen a speed limit of 15 miles an hour. >> reporter: the signs may confuse drivers, but they also slow them down, making it safer for the crews installing gas services to homes on streets along wisconsin avenue. >> our priority is safety first. they've got to slow down especially in this area. sometimes people are coming out of the work zones and they're over 35 or so. so i mean, for me, it is safer to slow down. >> reporter: we reached out to

the pipeline company doing work in this area to ask if they posted the work area 15 mile-an-hour speed limit signs. i called a number of times and left messages, but so far we have not heard back and we'll let you know if we do. that's the latest live in montgomery county, chris gordon, news 4. we are just getting some new pictures into the live desk from metrotransity police and they show the man suspected of robbing someone on the train. this man approached a passenger on tuesday and they run a yellow line between georgia avenue and u street stations and he told the man to give him his stuff and when the victim didn't, they got into a scuffle. this happened at the tail end of rush hour, right about 7:30 tuesday night. vance? >> thanks, chris. flames racing through a house as a family ran for cover. tonight, the common household mistake that led to that fiery scene.

a little bit of a warm-up today and that was welcome, but now i guess our next challenge is going to be fog? >> fog and we have a little bit of a roller coaster. and we'll go like this for the next couple of days and just in time for the redskins game we'll come crashing down as far as temperatures go and it will have an impact on that game and we'll talk about that coming up in a bit and right now it is on the milder side compared to where we have been. 43 degrees and winds out of the east at 6 miles per hour and that will allow for fog later this evening. some of the areas could see some dense fog and that's something that we'll watch out for. 39 degrees in leesburg and down to 34 in winchester and you can tell exactly where the clouds are because of how much cooler we are back to the west. clear skies allow for cooling conditions and that's why it's 29 in petersburg and 41 in manassas and we've seen the clouds all day to the east of

the blue ridge. take a look and no rain across the area and here's the cloud cover and here's the mountains and notice where they form and look at the clouds out towards the east and southern maryland and parts of northern virginia and to the d.c. and metro area and west of the blue ridge, we saw mrept of sunshine earlier and now we're dealing with the clear skies and everybody has a chance to see fog tonight as we continue to see the easterly wind and more most you are in the atmosphere. back to the west, we're watching this storm system back to the east and it won't mean a whole lot for us and most of us will be up in the chicago area and with that, we have a chance of shower activity during the day tomorrow. most likely tomorrow evening, but if you're going out tomorrow at all, you'll get to keep the umbrella handy and tomorrow evening there could be areas of fog and cloud cover tomorrow evening and here's where the rain is and it's just showers and light, but if you're going to dinner tomorrow night you should take the umbrella just in case and the best chance of

now at 6:30, our reporters are gathering new information on this day's top stories. tracee wilkins has the call to crack down on an illegal practice that's putting lives at risk and pat collins has the growing excitement for redskins fans. we begin now with david culver. for the past nine years fairfax county public schools have had to scale back on spending, but tonight the head of the region's largest school district is about to tell the school board that she's done cutting budgets. david's in fairfax county tonight to explain why. david?

♪ ♪ >> vance and doreen, you'd think with all of the noise behind me we're at the lead-up to some big game. would you believe it, this is the start of budget talks in fairfax county in in years past, the superintendent had to go into these talks with the anticipation of cuts. no one has asked her to make any cuts yet and she's starting with a different approach. she's not going to make any cuts to the school budget and she's getting a lot of support. they have a rally gathered and you've got teachers. you've got parents and students all in support of dr. karen garza's no-cuts budget. >> if they choose at this point, david, to continue to cut in their schools they'll be cutting their own future. they're going to be fleg electing their children and they'll be setting themselves up for all kinds of infrastructure problems in the future. >> for the past few years, steve greenberg has cut led the

federation of teachers. >> our class size is so large that we don't have the ability to work with them individually to meet their individual needs. >> it's not the moon and stars. it's the basic essentials. >> reporter: thwhich is why reducing elementary class sizes giving teachers better pay is non-negotiable according to karen garza. >> we are losing teachers to other surrounding jurisdictions and we opened the school year with 200 vacancies and unheard of in fairfax county. >> i'm surrounded by such excellent teachers. >> it seems students are noticing it, too. >> sammy ahmed moved from pakistan six years ago. he worries the county resources that helped him adjust are thinning. >> teachers are the most valuable asset that we have because it was that sort of human capital which really helped me realize my intellectual goals. reporter: garza is holding strong to her no-cuts budget and ultimately it's up to the county

board of supervisors to sign off. >> what are the numbers being presented to the board of supervisors? >> i think it will be devastating and tragic if this budget is not completely funded. ♪ ♪ >> reporter: and in about 30 minutes dr. karen garza will officially present the next year budget to the school board. this is just the beginning of the process, though. later this month residents in fairfax county will get a chance to weigh in and then in the spring and the county board of supervisors will make the ultimate decision on the fiscal year 2017 budget. >> david culver in fairfax. scenes like this played on on a beltway and a delegate says it's part of of a growing problem. dozens of atv riders taking over the road and as our bureau chief tracee wilkins shows us now, the lawmakers say it's time to crack down on these illegal rides. hi, tracee. >> reporter: well thshgs is the problem and this is why, doreen.

this issa s s sa rural area wel metropolitan area. they don't want any laws that will keep doing them from doing that, but when they come on to the city streets they are violating laws in prince george's county and that's what this delegate says needs to be stopped. >> i was standing still and he lost control of his vehicle and almost hit me. >> jay walker was walking down national harbor with his wife when atv and dirt bike riders ripped through the quiet evening. >> you only saw half the pack and that was a lot. >> reporter: it happened last week. he caught it all on cell phone video and he said there were 57 to 100 riders, some of whom took to the sidewalk to avoid car traffic. >> i know i can move out of the way, but what if it was someone with a stroller. >> i heard a loud rumbling. >> patricia johnson heard and saw the ruckus last night. >> they were popping wheelies and weaving in between the cars

which was very dangerous. >> reporter: prince george's county police released this statement saying when officers responded to this call for service a supervisor determined any attempts at stopping the bikers would likely result in them fleeing. thereby causing greater danger to other drivers and pedestrians. it was the same day atv and dirt bike riders took over a portion of the beltway in prince george's county. >> there is a good 30 to 50 if not more motorcycle riders popping wheelies. >> walker had met with police and the county council to try and find a solution even if it means new laws from the state legislature. >> right now we're trying to search for a solution, but it's clearly a problem. >> reporter: in that statement from prince george's county police the interim chief said this is going to be his top priority, one of them in his new administration to make sure they crack down on all of these issues. maryland state police say they're working with local law enforcement partners to come up with a task force to better deal with illegal atv riders who take

advantage. i'm tracee wilkins, jim, back to you in the studio. >> thanks, tracee. a common household mistake sparked a fire in montgomery county. a teenager inside the home heard the smoke detector at 5:00 this morning. he got his family out safely and that house is on window knoll drive in derwood. investigators tell us that ashes from the fireplace improperly discarded started the fire. damage there estimated at $350,000. d.c.'s mayor muriel bowser has made another change in her public safety stat. today the mayor named karima holmes as the new head of the district's 911 call center. miss holmes used to hold that same post in texas. the previous director in d.c. resigned back in may following several high-profile incidents where dispatchers either failed to act in a timely manner or

sent responders to the wrong location. the city has seen a big spike in 911 calls recently. until last month the call center had not hired any new dispatchers or call takers in years. a man charged with animal cruelty after the death of his family's dog is in the clear. travis evans was charged last july after his yellow lab named buxton was euthanized. investigators claim evans left the dog suffer too long during a battle with cancer and a seizure. prosecutors confirmed to news 4 that the charge has been dismissed. the family tells us they are ready to grieve the loss of buxton without the charges hanging in the balance. still ahead, new advice on what to eat and what to avoid. we break down the latest government guidelines. they are making a new beer here called terry's cure. coming up, you'll meet the beer-making family that's

>> the federal government is urging all of us to eat less sugar. a lot less. new dietary guidelines were released today and for the first time they suggest limiting your intake of added sugar to no more than 10% of your daily calories. that's equivalent to a can of soda and one little fun size candy bar. the guidelines also suggest cutting back on salt and saturated fat and incorporating other forms of protein into your meals. things like nuts and seeds and seafood. a special beer is brewing tonight in northern virginia. it's called carrie's cure. it's named for a young mom fighting stage four cancer. her husband owns a brewery and as bureau chief julie carey reports, his colleagues are now stepping up to help. when matt rose and his wife carrie learned last year she was

pregnant after years of trying they were elated. little lance was on the way. then in her 27th week of pregnancy, a terrible discovery. carrie had stage four stomach cancer. >> it's not a diagnosis you ever want to hear at any age and -- we heard it -- i'm -- we're very happy that lance is okay. and that's the first and foremost. >> because the cancer lance was delivered early in september. carrie is now hospitalized and chemotherapy didn't work and she's receiving immunotherapy treatment. herr husband runs forge brew works and when they learned of what he and carrie faced they jumped in. >> it hit us pretty hard and we were, like, what can you do so we immediately turned and said let's do what we do well. let's brew a beer. >> we're steeping the grain. >> the idea for curry's cure was born. word went out and 20 brewers answered the call.
