that. jim, i'll tell you about it next hour at 6:00. >> adam tuss, out in front of the metro story once against. thank you. right now in baltimore, witnesses taking the stand against the trial with one police officer charged in freddie gray's death. edward nero's bench trial began today. he loaded gray into the van where he suffered a fatal neck injury. outside the courthouse covering it all for us, chris. >> reporter: officer nero had the right to a trial by jury, like so many other defendants, but he chose instead to have a nonjury trial. legal experts disagree whether or not it was a good choice. officer edward nero decided to waive his right to a jury trial, and let judge barry williams decide the case himself. nero is charged with assault, reckless endangerment and misconduct for

belt freddie gray to load him facedown into a police transport wagon. gray sustained a broke en neck, and later died, tryingeriiggeri riots. monitoring the trial, says he agrees with the defense's decision this should be a nonjury trial. >> a judge obviously is able to put away the emotion and compartmentalize that and focus on the facts and law. >> but warren brown tells me there a din injury in letting the judge decide the case himself. >> it is a risky choice, but it reduces the number of people who have to conclude that the state proved you guilty beyond reasonable doubt from 12 to 1. >> prosecutors say he was one of three bike officers who choiced freddie gray. they say nero shackled gray's legs, but failed to secure

he was found dead in his home this afternoon. we don't know the circumstances, but police do not believe foul play was involved. they do not believe this was a homicide. walls was 38 years old. he was the youngest person ever elected mayor of district heights. he first took office in 2006. turning to the right to the white house. hillary clinton, back at her home state in new york. speaking with hiv and aids activists in brooklyn, she told the group she wants to see an aids-free generation. she called for more research and expanded use of medications. yesterday, the washington informer published an op ed by clinton. they said if she is elected, she will be a vocal champion, writing in part, hard as it is to believe, america is the only democracy on the planet that treats the residents of the capital this way, by fighting to bring about the creation of a 51st state. i believe we can breakdown a barrier that stood in the way of

and after he left washington, he tweeted, he had a great day with gop leaders. ryan said during the closed-door meeting, trump expressed interest in keeping him on as chairman for that convention this summer in cleveland. he is encouraged by what trump had to say, and believes they're planting the seeds to unify the party. ryan says what trump has done in the primary season has been nothing short of remarkable. >> he has gotten more votes than any republican primary nominee in the history of our country, and this is isn't even over yet. it is very important that we don't fake unifying, we don't pretend unification. this is our first meeting. i was very encouraged with the meeting, but this is a process. it takes time. you don't put it together in 45 minutes. >> ryan and trump issued a joint statement after the meeting, saying they're committed to working together and there will be more discussions over the next couple of months. that d

a montgomery county man who died rushing to save a woman's life, is laid to rest. friends and family said their final fair wells to malcolm winfeld. he was

west field montgomery mall. derrick ward talked to his family about his legacy. >> reporter: malcolm winfeld answered the call from a woman in distress. he didn't have to, but he did. those who knew the kind of man he was, it wouldn't be any other way with malcolm. >> that's my brother, very helpful. he will go out and help anybody that asks. and if she did ask him, he will run over there and help her. >> reporter: he was shot and killed last friday in the parking lot of westfield montgomery mall. the man who shot him was already wanted and desperate to he is came. they said he already killed his estranged wife and trying to carjack another vehicle. winfeld couldn't have known all of that. >> no one saw it comes. >> now all his

scene. >> reporter: indeed, jim. the scene is right down the street here, right down on eli place, we're told by police they found the body of an adult male outside one of the apartments here at the. it is a big crime screen. in fact, it extends across the street, into the parking lot of the national's youth baseball academy. you can see over there, there is police tape in the parking lot, in fact, some cars and some people who are in that parking lot were held up as they continued to process the scene. we're waiting for the chief. we're waiting for a spokesman to come down from the police department to tell us exactly what they found here. but again, they found the body of a young man outside, shot to death, near that apartment on the street on eli place. there are a number of police here processing the scene, looking for clues and evidence. we're standing by.

this is all, and i showed you this graphic last week, it is because of cold air damning, feeling more like seattle, that's right. high pressure to the north giving us the flow off the ocean and it creates cooler air, rising motion along the mountains and that's why we're stuck with the cloud cover. you get showers an drizzle, the pattern breaks tomorrow. remember, it's kould cold air damning, a wedge, cold air wedge moving in. the pattern will break tomorrow. it doesn't mean it won't rain tomorrow, because it will rain. but at least it will break the pattern of the clouds. notice the showers, we talked about these earlier, they're falling apart. towards clark county, seeing showers there just to the east of winchester, and maybe, maybe getting to lees burg before they die. this is the one that will break the pattern. it will come threw and bust up the wedge. it will give us some rain

tomorrow. wind, it won't be early. tonight, dry side, except for west of the mountains. 8:00 a.m., here is the rain, in and around the d.c. area and a chance of a thunderstorm with a line that comes through around 1 or 2:00 tomorrow afternoon. here is the good news. i mention it breaks the pattern. it also breaks out into abundant sunshine. it is really looking quite nice as high temperatures will rise to a high of about 75 degrees. on saturday, another chance of rain most likely between noon and 3:00. temperatures around 71. 62 on sunday, 63 on monday. we do cool again in the wedge tries to build back in next monday and tuesday. we'll see how much cloud cover and how cool things are. right now, watch out for the showers tomorrow. tomorrow night and even saturday night, looking pretty good, guys. >> all right. it was a

welcome back to a busy half hour at 5:30 tonight. 12 students in serious trouble at culpepper county high school. it's not what they're accused of doing that's got some parents upset. >> the parents say it's just that the crime, the punishment doesn't fit the crime. northern virginia bureau reporter is live at the school to tell us about that, david. >> reporter: wendy and jim, we should point out the parents reached out directly to us, concerned they say the punishment they face is excessive. >> culpepper county high school has been very stressful for the kids. >> reporter: mom tracy johnson has two kids attending cull pep ter county high school, where she says moral is low. >> there a cloud over there. with all the allegations of hazing. >> reporter: the allegations don't involve tracy's children, but some of the athletes here. trays see is

the claims is they amount to no more than immaturity in a locker room and they were not physical. >> they went too far with their punishment. >> reporter: students involved initially got suspended for ten days, and then a whole year. >> a 365 suspension is ex is he sieve. >> reporter: they were made aware of the misconduct involving some of the athletes, 12 altogether. the division cannot and will not comment more specifically about the disciplinary actions or the alleged conduct. >> the tension in the school is extreme right now. i know one of the moms described it as a witch hunt. >> she worries about the long-term impact. >> the future is down the drain because of these allegations. >> reporter: but tracee said if they are more serious, the school should communicate them to the parents. >> when the school board and administration sees the effect they're having on the kids

northeast corridor, something that could, experts say could have prevented the derailment. robert hewitt was riding in the first railcar. he says the crash changed his life forever. his injuries, permanent. >> right before i lost consciousness, i crashed head on with another gentleman. and i woke up laying on a pile of rocks. all my clothes had been ripped off. i couldn't move my legs. i couldn't see out of my right eye. and i was scared laying there. i could see the end of the train cars were upright. fires were starting. i couldn't move, i couldn't get away. i started yelling for help. and when the

shined his flashlight on my head, and yelled for help. and i remember him saying this guy has got to go now. the whole back of his head is coming off. >> hewitt says he believes it this photo showing the first responders, carrying him from the wreckage. he says he is still searching for them so that he can thank them in person. an auction for the gun george zimmerman used in the shooting death of treyvon martin appears to be back on. zimmerman planned to auction the gun this morning, but minutes after it began it was no longer available. it went on sale on a different site. zimmerman was acquitted in murder of martin's death back in 2012. he said he was selling the weapon because of strong interests from collectors, including the

now time for results, and nbc 4 responds. a leesberg woman says she got caught up. >> it led to a contract dispute and cost her $21,000. the consumer reporter, susan hogan helped her get it back. we tell folks when you're looking for a contractor, you want three estimates, and the homeowner we're about to introduce you do did that. when she tried to cancel with the highest bidder, the company didn't want to hear it and pushed back. >> they're taking these out, these are casement windows. >> what was supposed to be a fairly standard home improvement job, turned into an epic disaster. >> i didn't want to hurt the guy's feeling

nice of them to come out. >> carol wanted to share her story, but didn't want to share her identity. she has quite a story to tell. because what happened to carol could happen to you. here's the deal. carol got a quote from a home improvement company, signed a contract and put down a $21,000 deposit. according to the contract, if carol wanted to cancel, she could. at any time prior to midnight of the third business day, after the date of the transaction, by providing in writing the intent to rescind. that was good news, considering she got another quote from another contractor, saying he would do the job for less. >> the windows, the siding and roof. >> carol said she called to cancel the first contract, sent them the certified letter on the third business day. >> i told him i was getting a better deal from someone else. >> but carol said canceling wasn't as easy as they claimed. they tol

received it after the third day, it would not cancel the job. >> he got very mad, and just told me i couldn't, and just wouldn't accept it. >> carol found herself with two contracts now. the first one, and she signed a second contract with the cheaper company. but the first company told carol it already moved forward with the job. >> next thing i knew, he sent me an e-mail and said we already ordered the windows. so we would like to put the windows in. >> carol's $21,000, gone. that's when she contacted nbc 4 responds. >> and we contacted the home improvement company and they emphasized her written cancelation came too late, even though it was postmarked on the third business day. the company however admitted they were hoping carol would allow them to do the work, but decided to refund the deposit. she got it yesterday, fedex. now, if yo
