stretch of rail that was repaired during metro's safetrack program. why that part of the system is having issues now. first , a local woman is demanding answers. >> he died as the city -- he was a published writer and we're learning how the jail is working to repair the conditions inside. mark segraves is in south d.c. with a new response from the corrections department and a new interview you'll only see on news4. mark? >> reporter: good afternoon. lester irby was 70 years old when he fell ill. it turns out, he was an accomplished writer. he had spent decades in and out of various prisons and jails around the country and during his time in jail, he took up writing. in 2007, he co-authored

>> he had a heart of gold. he was really a brilliant dude. whatever you could say to him, he could put on papers. >> reporter: fell lish sha remembers her father as an inspired writer who couldn't make a go out of it outside the prison walls but found his voice from inside a prison. >> it helped him put it on paper. he did it well. >> reporter: those who knew him said irby was a prolific writer. one of the short stories was included in a 2007 called "d.c. noir." he suffered a stroke inside the d.c. jail. inmates tell news4 the temperatures in the cells have reached the upper 80s and low 90s. >> it's a mess up in that jail. no air conditioners. i mean, the people over there

inmates well. they are just living under foul conditions. >> reporter: department of corrections officials have said that the cooling system cannot keep up with the ongoing heatwave. a spokesperson tells news4 a heating and air conditioning contractor has been on site and completed work to enhance the air flow and circulation systems. we have no reason to believe that there is a correlation between elevated temperatures and the recent death of an inmate. as for irby's family, that statement is not enough. >> reporter: it's terrible. i think they need to do something about it. where does our tax money go to? i thought it was helping people. they are not doing anything over there to better these people that are getting incarcerated. >> reporter: now, felicia says that the family is considering hiring an attorney to get the answers as to what

her father. we asked if we could look at the conditions and the correctional facility did not respond to our requests. >> mark segraves, thank you so much. breaking news from prince george's county. this is the northbound lanes of the bw parkway closed right now. so in the last 30 minutes or so, we have learned that this accident is involving a worker that was cutting grass on the side of the road. it happened at route 410 in riverdale. police say he was on a long tractor that was hit by a car. he was taken to a hospital with life-threatening injuries. the northbound lanes of the bw parkway remain closed right now while park police investigate this crash. and some sad news just in to our newsroom this evening, legendary redskins fan chief zee has passed away. his real name was zema williams and he's been a fixture at redskins games all the way back to 1978. he was voted the biggest reds f

hall of fame back in 2000. we'll update this story as information comes in to us. a man accused of dragging a police officer more than 300 feet with his car has pled guilty to assault. >> reporter: right there. >> prosecutors say danny harvel ran out of his car after dragging an officer and striking a tree. the officer in this case suffered a broken leg and nerve damage. the state attorney's office hopes the guilty plea will send a message. >> harming our police officers and first responders is not something that we will tolerate. >> harvel will face three to four years behind bars. fairfax county school officials are delaying new regulations. the county school board voted in may of last year to extend i

include gender identity. the board now says it needs more time to evaluate the legal issues surrounding that regulation. that includes a case involving a transgender student from southern virginia that is now pending in the supreme court. a former top security official is about to learn his fate. he faces 40 years in prison for the death of his adopted son. news4's chris gordon is outside the courthouse in rockville where the judge is expected to announce the decision any moment now. chris? >> reporter: jim, we are inside the courthouse because the sentence is being handed down as we speak and we're here to get reaction but he's not been sentenced yet. this hearing has been going on all day. prosecutors concluded by saying, he beat his child to death, hurling him across the room. in court just moments ago, the defendant, brian

spoke. he said there are not good enough intentions to repay my debt to him. the judge is handing down the sentence right now. we don't know what it is yet but we hope to before this report is over. prosecutors are asking for the maximum, 40 years in prison. a combat marine in iraq who is said to have participated in the rescue of p.o.w. jessica lynch, he returned home with post-traumatic stress disorder. a character witness who he worked with in wounded warriors testified something must have triggered the ptsd. the witness said he was stunned when he heard callahan was charged with killing his newly adopted korean son, 3-year-old. it happened at his damascus home february 2nd, 2014. at first,

slipped in the bathtub. he died days later. the autopsy revealed he had a skull fracture. these advocates for global adoption came to court to say that they believe he deserves a long sentence. >> we have been outraged by this death. we are upset that mr. ocallahan is having several witnesses speaking on his behave but no voice for the child who has been murdered. >> reporter: the prosecutors are speaking for the child asking for the maximum and the judge is handing down the sentence, or is about to hand down the sentence, we're standing by to report it to you and to bring you reaction. ahead at 6:00, how and why he lied on his application to catholic charities in order to adopt this young boy who had disabilities and special needs. ths

montgomery county circuit court, chris gordon, news4. erika, back to you. >> thank you. jarrett lewis is scheduled to enter a plea agreement in d.c. federal court. earlier this month, the news4 i-team reported that he was charged with pretending to be the civil rights icon chief of staff. the feds say jarrett lewis did so to score passes for the washington redskins and special treatment at a lounge in south beach. he's facing up to three years in prison. the congressman spokeswoman declined to comment saying it's a matter for the courts. a chaotic crash on the beltway is cleared up now but this is what it looked like earlier. this is the scene over the wreck right near rockville pike in bethesda. two of the vehicles actually fell off a car carrier truck and then flipped over. nobody was hurt but traffic was

backed up for several miles since the clean-up continued early into the afternoon. >> montgomery county police are trying to track down a suspect at a dollar tree store in rockville. pat collins has more. pat. >> reporter: jim, that's the scene at the dollar tree store. the suspect appears to be a large man. he carries a big, red bag but don't you go comparing this guy to santa claus. you see, he's something less than jolly and, well, santa never carries a gun. when these customers saw what happened at that dollar tree store, well -- >> scared, too. >> well -- >> you just never know. >> reporter: i'll let them speak for themselves. >> it is very, very scary. >> nothing is safe anymor >> this is surveillance video of an armed robbery at the dollar industry store in rockville. look at the suspect.

look at the employee. her hands zip tied behind her back. now watch as the robber pulls out a large red bag and then begins stuffing it with cash from the safe. he cleaned it out. this happened july 5th around closing time. the employee went to check the restroom and that's when she was ambushed by the gunman. >> one can only imagine checking a bathroom and being confronted by a suspect armed with a handgun, particularly at closing time when you may or may not be the only one in the store. >> her hands were bound? >> right. he was in that office for some time. >> right. he was in there taking his time. >> now, before he left the store, the robber did something most unusual with that gun. i've got video of that, too. i'll show it to you coming up at 6:00. erika, back to you. >> pat collins in rockville for us, thank you, si.

in the race for the white house tonight, donald trump is expected to officially become his party's nominee when roll call kicks off in just about an hour from now. but today, the big focus in cleveland has been the fallout over last night's marquise speech by trump's wife. there have been accusations that her speech sounded oddly similar to michelle obama's 2008 convention speech. >> from a young age, my parents impressed on me -- >> barack and i were raised with so many of the -- >> the values. >> the same values. >> that you work hard for what you want in life. >> you work hard for what you want in life. >> that your work is your

so a terrific night for baseball. st. mir wry's county, areas in green in the northern neck of virginia, that's the effect of the big storms around richmond right now. a couple of other minor showers from south of culpeper. those are tracking well away from the metro area. temperatures right now, 89 in washington. over to leesburg and winchester, low and mid-80s around the chesapeake bay. the clouds there as well. and then by 8:00 p.m., nice evening coming up. by dawn tomorrow, low 70s waiting for the metro and the bus. should be a comfortable morning under a clear sky. by noontime, noticeably less humid. upper 80s on wednesday. and then on thursday, the humidity is going to start moving in. temperatures up around 90

just went through one of those safetrack shutdowns. riders are getting fed up and metro is not quite sure why it keeps happening. more track work needed in the two weeks since the safety surge ended here. take a look. july 4th, a signal problem. july 5th, switch problem. july 6th, two signal problems. the 8th, a switch problem. the 15th, a signal problem. the 18th, a switch and signal problem. >> it should have been taken care of a long time ago. right now it's a big inconvenience for everybody. >> reporter: a metro chief says, "needless to say, it will remain a priority until we are sure that we are getting a fix." riders who already went through a safetrack surge to fix the

shouldn't be happening. >> they could be doing a better job with the upkeep of the service. >> looking at a train going by, one of the signals along this elevated section of track, things are moving smooth tonight. but coming up in the next hour at 6:00, why the federal government warned metro about this section of track even before safetrack. back to you. >> adam, we'll see you then. metro tells us construction dust led to big issues at the pentagon city issue. dust filled the tunnel just after blue and yellow line riders began their commute. the station had just reopened after being closed for safetrack work service and it wasn't impacted. the fairfax county police department is shedding some light on recent use of force incidents among its officers. 540 times, one of the cases w

department rules. also of note, 40% of cases involved african-americans who make up only 8% of the county's population. the report was released as an effort to be more transparent. in the wake of the 2013 killing of john gear by a police officer. it's a case that could impact the election. the restoration of voting rights for nearly 30,000 convicted felons by governor terry mcauliffe. if upheld, mcauliffe's action could tip virginia in favor of hillary clinton this november with a vote that is traditionally very close in presidential elections, attorneys for the state legislature argued that mcauliffe exceeded his authorities by restoring rights for all felons rather than

case-by-case basis. summer olympics are just over two weeks away and now officials with the olympic international committee are exploring options over doping allegations with russian athletes. the ioc is considering a full ban of the russian team against allowing some russian athletes to compete. a report uncovered a state-run doping scheme by the russians that masked more than 300 positive tests. d.c. residents concerned about an uptick in crime in the bloomingdale neighborhood can attend a safety walk tonight at 7:00 p.m. many are concerned after a man was fatally shot and killed two blocks from his apartment this month. tonight, starting at 7:00, leaving from the

funding fiasco. when the company missed several delivery deadlines, many investors started to worry they'd never get paid for it. consumer reporter susan hogan is joining us now with what she's learned. susan? >> that's right. crowd funding is a great way for start-up companies to develop a product but when an arlington man invested into a company that was developing this really cool mini drone, he says their promises left him grounded. jay is a drone enthusiast. >> now as an adult, we somehow get to fly through the magic of drones. >> reporter: he's flying a drone around a park in reston and something else caught his eye. >> the world's first nano drone. >> reporter: a mini drone that has all of the capabilities of a large drone but this can fit in the palm of your hand.

there was fantastic footage. >> reporter: the company used a crowd funding site to develop the product. jay signed up, paid $260 and was told his new mini drone would be delivered in march. did it get delivered to you in march? >> as of today in july, it still has not been delivered. >> reporter: in fact, abc responds had a couple other complaints from viewers in california who never received their mini drones either, although we did get our hands on one and we found out that ongofly was crashing. other investors angry for not receiving their drones despite repeated promises from the company. the complaints are numerous and many complaining that the battery doesn't hold the charge and it doesn't function the way the company promised and when they called customer service, there was simply no

more than an expensive pursuit. this video explains that they only expected a few thousand requests for their mini drones. instead, they got more than 17,000. >> here we are. nbc 4 responds reached out and although we never reached out, the company reached out to jay and issued him a full refund. the company is addressing concerns regarding its features to it is customers and says that it made a series of updates to its software. the company raised more than $3 million and also says it has now completed shipping out all u.s. orders. if you have a consumer problem you need help solving, tell us about it. open up the nbc
