their silence. why jimmy feegen says it took him so long to get that passport back in brazil. and she's throwing out the first pitch tomorrow for the nationals. but tonight, you get a sneak peek with the interview with katie ledecky. >> news4 at 11:00 starts now. first up, new developments in the fight over where to house d.c.'s homeless population. >> this is the story that you're only going to see here. we obtained a copy of the lawsuit filed to stop the plan because of controversy over how it was rolled out. jackie bensen is live in ward three to explain. jackie? >> reporter: angie, the lawsuit was just filed. it does not ask the district to relocate the homeless shelter planned here at the second district police station. instead, it claims city leaders

hand. the lawsuit, brought by a group of 21 neighbors, claims part of the 2016 homeless shelter replacement act that was passed and signed by mayor in june violates the district of columbia anc act. they say the plan to relocate the homeless shelter on idaho avenue is unlawful, because it it did not give an opportunity for input. >> what we are going to court with is not to ask the court to change the judgment in choosing the site, but to go back to the drawing board and give the anc an opportunity to present its issues and concerns. >> reporter: the plan is part of the

main stretch will be open tomorrow. the flooding last month killed two people and destroyed several businesses. tomorrow, some streets will reopen. howard county officials say that crews still have a lot of paving work to do. they hope to have part of the downtown parking lot back open by saturday. a gruesome attack in virginia has no ties to isis. that's what the justice department is telling nbc news tonight. saturday, a man yelled the arabic phrase for "god is great" as he stabbed a pan and woman. both victims were seriously injured. police say they arrested the suspect when he showed up at the hospital asking for help for himself. he claimed he was hearing voices at the time of the attack. right now he's in jail without bond. tonight, police say they've caught the guy who created this

the 16-year-old is accused of writing anti-semitic words. today, we talked to the civic group that removed the graffiti each time it showed up. >> he tagged a sidewalk in various ways. one time it was nine rats were defaced at every corner. so it was really just -- it felt very relentless. >> the suspect is also accused of drawing swastikas at a star bucks in chinatown. our tom sherwood talked to the man who will take over for the d.c. police chief cathy lanier next month. he's been with the department since 1989, and assistant chief since 2002. he said his main priority is keeping residents safe and building on an already good relationsh w

graduation rates are up. so we're going to move forward. >> in a statement, the board chair said that he will remain focused on doing everything he can to make sure the head start program keeps operating. in the race for the white house tonight, hillary clinton's campaign is pushing back against an associated press report about donors to the clinton foundation getting more facetime with her when she was secretary of state. the clinton catch says the a.p. report used flawed data and cherry picked from clinton's schedule at the state department. donald trump has called for a special prosecutor to investigate whether clinton staffers gave donors more access or special treatment. >> it's a huge new target for the trump campaign to dive on top of, and a bunch of targets for the clinton campaign to have to depend. >> so far, nothing illegal has been uncovered, but it could be an issue that lasts all the way to november.

warning of a homegrown case of the zika virus in florida has popped up outside the known infection zone. five new florida zika virus cases were reported, including one in the tampa area. >> reporter: on florida's gulf coast, mosquito control teams stepped up their fight, but the governor says he's not declaring a new zika zone here yet. active transmissions are still a concern in the first identified zika zone, which today added four new cases. now, authorities are trying to figure out one zika case showed up more than 250 miles away on florida's west coast. to date, 42 homegrown zika cases in the city. anxious calls to mid wives from mothers to be

average. we haven't seen that very much over the haste two months. currently sitting at 74 degrees, wind s out of the south at 7 miles per hour. temperatures in the mid 60s in some areas. tom lives right about here just around the frederick, gaithersburg area. he saw temperatures of 57 earlier this morning. now, storm team 4 radar not showing any rain. we talked about this high pressure last week, dominating the area. that's what is happening now. look back to the west. clouds moving our way, that's a warm front on thursday. and that brings the heat right back. tomorrow, more clouds, highs into the mid to upper 80s, then the 90s. watching the tropics. this is what could become a tropical storm or a depression. right
