cooler than this afternoon. i'll be walking you through your forecast hour by hour, coming up. a woman is accused of poisoning her co-workers. i'm shomari stone. i'll tell you all about it, at 11:00. >> announcer: news4 at 11:00 starts now. only on news4, a dc judge makes a surprising ruling in a jail rape case. >> a transgender woman claims dc correction officers deliberately placed her in a cell with he sexually assaulted her. her efforts to get justice went nowhere for nearly four years. >> but now a big development. news4's jackie bensen is outside the dc federal courthouse with the exclusive story. jackie? >> reporter: doreen, this new ruling is from a federal judge, and it allows the victim to sue the district and two corrections officers for placing her in a cell with an inmate who had previously been investigated for

>> because every day i think about, i was traumatized. i was raped. i can't -- i can't deal with it. >> reporter: those are the words of the victim, known only as jane doe, when she spoke to news4 in 2013, shortly after attorneys began representing her in a lawsuit that faced many that correction officers' actions on the job are protected by immunity. >> two of the guards were prevented from going to trial on constitutional claims that they violated the eighth amendment. >> reporter: in july of 2012, jane doe was serving time in the dc jail for a probation violation. court documents noted her file

transgender. ks means keep separate. she was initially housed alone in a protective custody cell. the lawsuit alleges on the night of july 17th, two corrections officers placed another inmate in her cell, a man who had a known history of violence in the dc jails. >> the guards knew what they were doing. this wasn't just an accident. >> reporter: the lawsuit claims that a review of security footage from that night during which jane doe says she was threatened with a knife and raped twice cell checks, standard procedure at the jail, were not conducted. >> nobody came to check up on me, no nothing. >> reporter: a spokesperson for the dc department of corrections says the agency does not comment on pending lawsuits. the trial is scheduled for december. live at u.s. distribute court, jackie bensen, news4. >> all right, jackie, thank you. you can hear that wind blowing in jackie's live shot. temperatures are falling fast in

and that's not the only weather development storm team 4 is tracking for you tonight. >> doreen, we're seeing the winds start to pick up. you can see the flags outside our studios in northwest washington. overnight tonight, we're going to have gusts from 15 to 20 miles per hour. what does that mean to you? not much tonight. it's not going to keep you up. the winds aren't going to be that strong. tomorrow, make sure those halloween decorations are tied down. if you're heading o you're dressed in layers, one of them being wind proof. we're going to have gusts tomorrow from 25 to 40 miles per hour at times. that's a pretty stiff wind throughout the day. right now you can see the wind gusts anywhere from 30 in manassas to 15 in gaithersburg. and that's going to produce an additional chill in the air. the latest check of storm team 4 radar, light rain in southern maryland. we're keeping a close eye on

his closing argument and a preview of his first hundred days as president. brian mooar, news4. students who work on the newspaper at parkview high school wore either donald trump or hillary clinton shirts to school as an experiment. 76% of the kids at parkview high school are minorities, mostly hispanic. it revealed most students were candidate but found it tougher to dig deep on the issues. developing right now, the pentagon has named the american service member who was killed in iraq yesterday. u.s. naval officer jason finen died of wounds sustained in a rowd side bomb attack in mosul. the anaheim, california native was part of a team advising and assisting iraqi occurred fighters. finen was the first u.s. servicemen to die in combat

state held city of mosul earlier this week. a new hospital coming to prince george's county could heal more than patients. county leaders say the new prince george's county regional medical center will breathe life into largo. it's replacing the current hospital and will take shape at capital center. that development became a casualty of the economic crisis several years back. officials say the new hospital should stabilize the area and commercial development. >> we're bringing world class health care. we're also revitalizing what was kind of a not quite the right direction in terms of economic development at a metro station. we're fixing that. >> this is a partnership with dimension health care and the university of maryland medical system. crews plan to break ground this spring and finish by 2020. construction on the silver line will tie up traffic a bit longer in a section of herndon. we told you about this project last week.

station boulevard will remain reduced to one lane while water line work is done near the nearby silver station. a flagger will direct traffic there until the project is finished. a former law enforcement officer now charged with possession of child pornography. thomas joseph mueller lived in missouri but a stafford county, virginia sheriff's detective uncovered the crime while detective says he traced pictures back to mueller. once police in missouri searched his home, they say they found several hundred pornographic pictures of kids. it's national prescription drug take-back day, with 5,000 collection sites across the country. the dea organized the event.

shomari stone is live in loudoun county. >> reporter: i'm sure most of you have a coffee maker at your office with creamer, sugar, and cups. but this woman is accused of making more than a fresh pot. coffee machine to poison her co-workers at a freight company in sterling, virginia. tonight she's in jail, charged with felony assault. >> a really messy situation. >> reporter: he worked next door in this industrial complex. >> it's crazy. we share a coffee pot here. i can't tell you how many times i brewed a pot of coffee for my colleagues here. >> reporter: she took window cleaner, they say, and poured it

deputies arrested her after employees drank the tainted coffee, became sick, and reported what happened. she doesn't work here anymore. >> we used to go there and say hello all the time, packages would get delivered over there. we're shocked to hear. >> reporter: shomari stone from news4. investigators didn't tell us a motivate. we tried to talk to someone from the company. this woman works nearby. >> i hope everybody is >> reporter: tonight she's being held without bond at the loudoun county adult detention center. in sterling, virginia, shomari stone, news4. talk about a hair raising moment. someone thought they saw a child trapped inside jasmine turner's car in suffolk, virginia. so they called police. well, officers rushed to shatter her window trying to save that child. but turner doesn't have kids.

blankets. of course turner is upset and wants police to pay to replace that window. surveillance video at a high school in new jersey shows a deer running right into a bus, then bolted into a school's lobby. take a look at this cellphone video. you can see the animal trying to stand up on -- aww -- the newly-waxed floor. the deer is obviously sre disoriented. >> before, he ran into the bus. and his head sliced right here. so it was like, he was bleeding. and then in this video right here, his legs are just like done. >> that deer was stuck in the lobby for five minutes before running out and back into the woods. >> that's just sad. >> hope he's okay. everything in moderation, even screen time for kids. >> that's the new recommendation

pediatrics. for nearly 20 years pediatricians recommended no screen time for kids under 2 years old. now research suggests children younger than 18 months can recognize faces and learn over video chats. >> and for kids ages 2 to 5, the academy recommends no more than an hour a day of screen time. it also recommends no devices at all an hour before bedtime. nbc the community to prevent suicide. tomorrow i'll take part in dc's "out of the darkness" walk. it starts at the sylvan theater stage at the washington monument at 4:00 p.m. the event has already raised more than $200,000 for the american foundation for suicide prevention. i hope a lot of people will come out and join us. i'm a little concerned about the weather tomorrow afternoon, as are a lot of people. we have a lot of things going on in our area. >> yes, no matter what you're

layers. one of them should be wind proof. and you might even want the gloves. and when you're going to be out there tomorrow evening, doreen, you'll find temperatures in the mid-50s at that point. with the wind strong all day, it will always feel a few degrees warmer. certainly a shock to the system after a workweek filled with 80s. the 24-hour temperature change is anywhere from about 10 to 20 degrees cooler than this time last night. waking up tomorrow morning, stepping out the door, question in your mind that fall has returned to the area. and because of the winds tomorrow and the cooler temperatures, the weather having a moderate impact on your day. and there's so much going on tomorrow. it's going to be windy all day and just downright cold. dress in layers. maybe that isolated morning shower. but most of the day completely dry. as you head out the door, windbreaker, and if you get chilly easily, i recommend gloves, hat, scarf, sunglasses
