. good morning. clocks ticking with just eight days to go before the election, the fbi obtains a warrant to search a reported 650,000 e-mail run by anthony weiner and abedin. >> i think that's called the mother lode, they found them all. >> and we need to stay focused on our goal. >> time running out quickly. a man accused of a strng of crimes in oklahoma is dead.

7:02 am
exciting. >> going back to cleveland, it is a lot of fun. >> how is your back? i know when you wear high heels sometimes you get lower back pain. >> fine. we will go with bombshells from the fbi searching through a reported 650,000 e-mail found on anthony weiner's laptop looking for any connection to the clinton's private server. >> as that controversy plays out, a new poll from "abc news" and "washington post" shows the race tighter than ever, just one point now separaing clinton and trump, which is a statistical dead heat. in the meantime, hillary clinton will be in florida and tim kaine in north carolina and donald trump and mike pence heading to michigan and florida. >> we have in-depth coverage on
7:03 am
alexander. good morning. >> reporter: matt and savannah, good morning to you. what if anything new fbi agents find on that laptop the fbi's announcement is certainly jolting this race. it's unclear whether there will be legal impact but the political consequences is already playing out with donald trump hying the news and hillary clinton and her allies descriing the director's movement forward as wrong and overblown. after obtaining a search warrant over the weekend the fbi we begin coming through anthony weiner and his estranged wife, huma abedin from hillary clinton's private server. with days to go before the election, the fbi's announcement

broil. harry reid sending a scating letter accusing him of possibly breaking the law of the hatch act even attacking comey for having a double standard insisting he's in possession of explosive information about ties between trump, his advisors and the russian government, a claim trump and the russians deny. this as hil c investigation. >> it's not just strange, it is unprecedented and it is deeply troubing because voters deserve to get full and complete facts. >> reporter: former continual eric holder seem as to agree writing it's incumbent upon director comey or the leadership of the department to dispel the uncertainty he created before

the moment is now. we're never going to have another chance. forget four years from now, it's not going to happen. >> reporter: that 21 million plus million plus, believe it or not, early votes at this time is already a record turnout at this point. in battleground states like florida and north carolina where the turnout is already up considerably, it's likely a third of the expected vote in those states has already been cast >> let's turn to pete williams working his sources at justice. what can you tell us? >> good morning. fbi agents are beginning to sorting through the newly discovered e-mail, a top priority for fbi and while it could take weeks, there is some chance it could be over quickly. late sunday a federal judge gave the fbi approval to go through the thousands of e-mail written by clinton aide huma abedin and
7:07 am
clinton was secretary of state and then weed out any not about government business. agents will use automated software to search what's left for duplicates they already found during the investigation of the clinton e-mail server and any remain checked for classified information. they say no way to know how long it will take. but if it doses go quickly and -- does go quickly and in the event anything classif days depending how many are duplicates and new to investigators. and the timeline about notifying drrpts comey about the e-mail. some say they first noticed the e-mail on the laptop earlier this month and agents said they got the computer to check for alleged evidence of sexting and no evidence in that search and
7:08 am
became clear. >> let's bring in our chief legal correspondent and nicole, i want to take you back to a year ago when bernie sanders famously said at that debate, americans are sick and tired of your damn e-mail. what are we talking about with eight days to go. is it an october distraction or october game changer. >> it's an october surprise the original sin is hers. the question none of us know the answer to, have voters taken this into account already? we know this will excite and animate and thrill the trump voter and will depress and discourage hillary clinton supporters, make them incredibly anxious. what we don't know all those voters, i wouldn't call them excited voters, disillusioned voters that don't like either
7:09 am
way? >> let's talk about james comey, assuing his investigators say we need a warrant to search this laptop and he figures that will leak out and that information will get out and i might as well get ahead of it and write this letter. on the other hand the letter is so vague it has the same effect anybody can use to their advantage. >> i think this headline not clearly good for clint going into monday morning, it's not bad for hillary clinton because the letter, vague as you point out, didn't say they found nothing yet, they just want to look. whether jim comey got too far over his skis is a question. >> it's vague but like hiing a piece of cheese in your desk drawer at work, whether you intended to hide it or not, sooner or later everybody is
7:10 am
who it was but later it did come out, huma abedin and anthony werner. and what he said was prudent. >> we're not ignoing you, nicole. the very people, democrats who were extolling the independence of jim comey who said i'm not going to prosecute are now saying shame on him and the other ones, republicans, and tru lackluster investigation. >> it's why they say if you want a friend, get a k-9 variety. a week ago the same poll we led with that has hillary clinton only ahead by one point had her ahead by 12 points. they're both wrong, she was never ahead 12 points and probably not in a one point race anymore. the polls were probably four to six points. what this will test is the durability of her lead going
7:11 am
trump? how does he play this hand? does he have to play it a little more carefully than he already started to play it? >> what he has to do is something he's been incapable over the entire haul of this campaign, be disciplined. he has been handed the dream message on the homestretch, if he can stay on message and not pick a fight on twitter with somebody else and create a topic that brings a new difficult thing to do. >> you have new polls in the battleground but taken before the comey news. >> that's right. what nicole was saying is right. you have a one point race. showing new enthusiasm from trump voters. two nbc polls coming out just yesterday, again, these do not take into account what we had
7:12 am
florida ahead by a point, basically a dead even race in florida, this is a must win race for donald trump. in north carolina, must win state for donald trump, this is the challenge for trump, this is why he needs this story to turn the campaign behind, six points needed to win. when you say you need a jolt from this news, you need every state great on this map right now, you need to win and you need to pick up one of these blta votes already cast. >> all right. steve, nicole, thank you all very much. we're not used to having three of you here. >> getting bigger. >> we'll have more on this including a closer look at the relationship between huma abedin and anthony weiner. now to a deadly end for a suspected gunman inoklahoma. blake has that story, good
