breaking news, one person has died after falling from a roof and down a boiler shaft in northwest. dc fire and ems say it happened on the 1500 block of new hampshire avenue off of dupont circle. dc police are investigating how this happened. the death toll in turkey has risen to 39 people following a brutal terrorist attack in istanbul. another 69 people were hurt. a manhunt is underway for the attacker who reportedly was dressed in a santa claus costume. officials say the attacker killed an officer and another person outside the club before going inside and firing out rounds. the white house is condemning the attack and offering to help turkey. security measures have been heightened throughout the country. ♪

yesterday afternoon. both planes were flying under visual flight rules and were not in contact with air traffic control when the crash happened. one of the planes crashed into a storage facility. the other crashed on to a road. three people on board the plane died. no one on the ground was hurt. the city of cleveland is taking over search efforts for a small plane that disappeared over lake erie. that plane vanished shortly after taking off thursday night. a family of four was on that plane including two of their sons and a friend and their daughter. piloting the plane was the dad, john fleming, the president of columbus-based beverage distribution company. the family was reportedly heading back home after going to a cavs game. the start of the year can mean purging what is old inside of that closet. >> that's good news for local charities who need donation. this was the scene at the goodwill store in

degrees. off to a milder start. the view from our storm team 4 tower camera is showing just a few high clouds drifting over the capital, starting off at pre-dawn here on this first day of 2017. right now at 0 40 degrees in washington. off to our west we have temperatures generally in the upper 30s, near 40s. the only spot below freezing is culpeper at 40 degrees. no rain or snow anywhere in our region. if you're traveling today up 95 towards new england, should be dry. if you're traveling down 95 south running into rain in the carolinas, down into georgia, northern florida later today. off and on throughout the day, we'll have the clouds coming and going. we'll stay in the upper 30s and low 40s for another few hours, climbing to 50 degrees by early afternoon. so a mild day. then at fedex field, late

next. >> we're back in 15 minutes with more of the top stories. good morning. welcome to reporters notebook. this morning there are many questions surrounding the murder of d.c. yoga instructor, 46-year-old trisha mcauley. she suffered blunt force trauma and according to court records she was sexually assaulted. mark segraves and aaron gilchrest are with us. mark, you covered this story which involves a bizarre sequence of events. what have we learned about this case so far? >> and how it happened. >> bizarre 24 hours. still a lot of crucial questions unanswered. we don't know how the victim and suspect first came in contact with one another. and we also know from the suspect what we know now he has a long history of petty theft, simple assaults. but nothing thatwo

this level of violent behavior. >> christmas afternoon, trisha mcmaculey is supposed to have dinner with friends. never shows up. 24 hours later she is found dead in the backseat of her truck. the suspect drove around in her car, went to one cvs where he tried to steel bars of soap. >> one case happened ten days before. >> he was arrested ten days before for stealing bars of soap. police find him. he has the keys to her car. he admits to driving around with the body in the backseat for 24 hours. he says they had

s.e.c. asex and then she committed suicide. >> aaron, what stands out to you about this case? >> i think this resonated with a lot of people. we saw quickly after she went missing that her friends, the yoga community in d.c. which is sizable, they got really concerned very quickly and tried to mobilize people to search. we saw the police talk about it the night before. they found her car, they were able to start piecing things together. for people in general, this resonates because of the way it happened. it happened on christmas, that resonates with people. and people seem to think they would know where she was. she was supposed to be in this place, and then goes missing. wow, this could happen to anyone of us. it touched people in that way across the area. >> mark, one of the big questions about the case is whether he should have been

on the street and not have been monitored by police. >> correct. if we work backwards to his most recent arrest before the murder where he was arrested for the misdemeanor theft at a cvs, when he appeared in court for that crime, the u.s. attorney's office was not prepared to go forward. this is what the u.s. attorney acknowledge and the judge said in court yesterday. they were not prepared to go forward. so there was little recourse for the judge but to release him. the defense attney wanted mental health evaluation. you can't put them into a high intensity super vision. all the judge could do was order a gps bracelet. that is then incumbent upon the suspect to go in the next day and have that put on. he didn't do that. that's why he was back out on the street and not monitored. the larger picture is over the years he has a history of not only being arrested but not complying with court orders to either show up for his next hearing or in this case

up for a gps device that raises the questions of why over and over again he continued to be given the second, third, fourth chances. >> is the u.s. attorney responding, saying anything about this? >> no. it's hard to get comments out of judges. it's hard to get comments on things like this, especially pending cases from the u.s. attorney's office. >> we did see an advisory neighborhood commissioner come out quickly and say this is yet another example of the criminal justice system in d.c. being flawed. another example of how someone in this case, with the u.s. attorney not being prepared, that someone can slip through the cracks because the city wasn't ready to hand the them in another way. >> it's also another high profile murder of bloomingdale resident. >> bloomingdale has had some tough times. seth rich, the young dnc worker murdered. >> yeah. in july. these are not related. these appear to be random. certa

neighborhood. it's important to point out and something that the chief said to me yesterday, in hindsight we can look back and say this guy was repeated release and never complied. but the fact is there's nothing we can see now in his history that indicated this level of violence. that's one of the questions we don't know. one, how the two came in contact, but what led him to go from a petty thief who could be suffering from mental illness to a violent predator. >> a lot of questions yet to be answered. uber drivers picking, choosing and canceling rides. local passengers accuse uber of discriminating based upon your destination. it's reportedly been happening a lot at airports. one man said he called five times before he could get an uber car. how is uber doing this when drivers are not supposed to really know where you're going until you get into the car. >> i think it's partly in

surcharge we got earlier this year where drivers are saying it's not worth it for me to -- i've had this issue where an uber has canceled on me going to the airport. i know i have that $4 extra charge that will be there. my trip to the airport is probably three miles from where i live in d.c. at the navy yard to reagan national. the drivers are saying it's not worth the time or the gas because i won't make a lot of money doing this. uber says the rules are, you don't know where the person is going until you're in the car and you're supposed to take them there. >> so they're using apps? >> the driver might call you and say i'm on my way, where are you going? then they cancel. >> i don't want go there. >> or there's an app that circumvents the system. uber has told our transportation reporter who broke this story if a drive her has too many cancel rides

they will not be able to use that app. and remember, taxicabs, this was a big issue for taxicabs, particularly for african-american customers trying to get to ant cosicostiae at night this reminds people of that situation and cabs are prohibited from doing that type of thing. so this raises the question again, are uber and these rideshare companies being treated differently. >> that's something people on our website, facebook and twitter have complained about. the fact that they're not regulated. when maryland tried to regulate them, uber threatened to pull out of there. so you have this inconsistency of who gets picked up, dropped off and where. >> i can't help but

metro is not only keeping longer hours this weekend, wifi is coming soon to all underground stations. right now it's only offered at six. service will begin expanding this summer and should be expanded to all of the underground stations. all metro stations will be connected by 2018, and it's free. that's one of the best parts. >> it's great, and it will be great when it finally gets in place. but we're still waiting for cell service which they now say 2020. with everything, we hope they're successful with metro. part of this, i think, is om

putting a lot of pressure on metro about communications, emergency communications, inside the transit system. i think this is one way for them to address it. so it's good for the passengers, it could help metro when they go before congress. but, you know, like everything with metro, the devil is in the details. the implementation. so, you know, we've been waiting for cell service for a long time. it's coming. >> is it sort of like putting the cart ahead of the horse? >> doing the wifi before getting service? >> yeah. >> i don't know. they piloted this in six underground metro stations, the wifi service to see how it worked, whether it worked and how people responded to it. it will be a $5 million expense to get this system-wide which they hope to pay for with new advertising work in the metro stations. as long as people seem to be finding use in it, you can say it's worth it. if it's a safety question, if suddenly people have the ability to communicate from inside a tunnel if a train i

because now there's another way for people to reach out for help if a train becomes disabled. there's still that issue of the reliability of the system that's constantly being questioned even with some of the improvements made. >> communication can only be a good thing. >> and we're getting music in metro. started with christmas music and now thinking of extending that to other stations. lots of changes. >> that will improve the experience. >> that's right. social media has brought the world instant access to news and information, but the rapid spreading of fake news means we all need to be more vigilant and more news literate. case in point, a story published by nbcwashington.com and the fact that no d.c. marching bands have applied to perform within the inauguration. within one day that story had changed. >> it's surprising and not surprising at the same time in terms of how quickly thi

morphed into something else, where suddenly schools were boycotting trump's inauguration. hats off to one of our digital editors, writers, andrea swalik for keeping track of the story she generated, and watching it change. that wasn't the case. there wasn't a boycott. some people thought here's a story getting traction, let's jazz it up. the headline gets tweaked. this fact gets tweaked and then it's a different story in some other part of the country. >> yeah. we were victimized here at nbc washington. andrea is a brilliant reporter who did hard work. 16 sources that she talked to about this. and did a really thorough job of reporting. within 24 hours, it morphed into fake news. that was hurtful to people and cast high schools in a bad light, the president-elect in a bad light. they all went back to nbc

source. so when you watch this piece -- i urge people to watch the piece that jim vance fronted on this. it's a brilliant look at how quickly real news becomes fake news. >> i do think -- i don't know how new this is. obviously we have social media. everybody has a phone. we can see it more quickly now. but this is something that's not new to news. not a problem that's unfamiliar to us because things get picked up and tweaked a bit. suddenly the facts are not facts anymore. we have got to be -- we as people who convey information and then the consumers of information have to be more alert and aware about what we're getting, how to put that information to use. >> that story got changed. but there have been a lot of big stories this year. what would you say some of the biggest stories of the year that stand out? >> locally metro is a huge story here in our region. certainly the

well. as far as elections go, you know, jamie vaskin, and the biggest winner is vince gray. a year ago was facing the possibility of an indictment and now seems vindicated and has been re-elected to his ward 7 council seat. those are big stories, big winners in d.c. tough year for mayor bowser, she can point to a lot of successes, affordable housing and crime down, but she lost three big allies on the d.c. council. that makes it harder for her. >> i would agree that metro is one of the biggest things we've had to deal with. the safe track program, trying to revamp the culture of safety and the physical system itself. that march shut down

saw, 29 hours of no metro service unprecedented in this area and impacted a lot of people. it tells us this will be a different sort of metro when there's a problem that is significant enough, this general manager is willing to say forget it we're not running trains until we can be sure there won't be a big fire in a tunnel that someone will die in or a wild derailment that might happen. that was big this year. the other thing was the deonta carraway case in prince william county, almost 3300 counts of child pornography, and numerous children involved. we need to make sure our kids are as safe as they need to be every single day. >> thank you. thank you, that's "reporters notebook." stay tuned for

increasing clouds by late evening. rain starting off the first week of 2017. a look at that coming up. first respond verse had a busy 2017. during the first hour of the new year, d.c. fire and ems tweeted that it responded to 72 emergency calls in the district. that's an average of more than one per minute. the second day of the district's foam ban goes into effect today. news 4's mark segraves looks at the impact this is going to have on businesses. >> reporter: for the past year, anyone selling or giving away food in the district has not been able to use styrofoam containers. >> it also impacts, non-profits, churches, temples that may serve for a sunday brunch or something. also hospitals. >> reporter: they could use anything else they wanted. beginnine

that changes. >> not only can those businesses and organizations no longer use styrofoam, they must use compostible or recyclable food products. they must use recyclable products. >> for restaurant owners, that means a bit more work. >> that's going to be something that you just have to make sure when you're buying, you ask the question. and awareness is good. >> businesses that don't comply can get up to an $800 fine for repeat offenders. >> our compliance rate hovered around 80% consistently throughout the year, which is particularly good. >> reporter: while caston doesn't use styrofoam in the restaurant, he uses a lot of styrofoam coolers for his fish business. >> used to go straight to the landfill. >> reporter: a few years ago, he bought this densifier, it takes his used cooler s and turns them into rock hard styrofoam bricks which he then sells. >> the labor to produce is more than what we sell it for. i believe we get a penny and a half a pound. >> reporter:

not making any money by selling the styrofoam, but he said it's more important to do what's right for the environment. in the district, mark segraves, news 4. also going in effect today is the extension of the smoking ban in gaithersburg. the previous ban did not include vaping or e-cigarettes and it also applied only to enclosed spaces and near city playgrounds. the city amended that ordinance back in october and now all formals of smoking are banned in all public buildings and spaces. there is a fine involved for breaking the new law. the move is meant to help protect the health of residents. montgomery county police say a man was killed by a train last night it happened around 9:30 along the cst train tracks in germantown. the commuter train was going westbound. police are working to learn why that person was there in the first place. in northern

state troop serer is recovering after a woman rammed his patrol car. dema hadieh was caught speeding, reaching speeds of 90 miles per hour in a 55-mile-per-hour zone. when a trooper tried to pull over, she took off and reached speeds of more than 110 miles per hour. all of that happened before she ran into the trooper's patrol car. this is a look at the damage here. moments later police say she tried to make another run for it when her van caught fire. hadieh faces a series of charges. it's not clear if a chinatown restaurant will reopen today following this kitchen fire. a witness shot this footage from d.c. yesterday. you can see that smoke billowing from tony chang's restaurant. a sprinkler put out the initial fire, but smoke spread to the duct system. no word yet on what sparked that fire. we have new dls

homicide in suitland we first told you about yesterday morning. the woman killed is 34-year-old terria petty. she was found dead on silver park drive with trauma to her upper body. detectives are trying to figure out a motive and a suspect in that case. we also now know the name of the maryland man killed in capital heights friday night. prince george's county police say 27-year-old carington carter ii was shot and killed on white perl place. investigators are working to find out who is responsible and are offering a $25,000 reward in that case. the district's youngest victims of violence are being remembered. ♪ ♪ ♪ i'm going to live with the lord ♪ the northeast performing arts group held its annual

we had been traveling for a couple hours in the air. >> reporter: landon says he had to go through five separate uber drivers before one finally picked him up at reagan national recently. the reason, the drivers thought his short trip to downtown d.c. wasn't worth the trip. now an uber driver is supposed to know your destination until the trip starts. but some drivers called landon ahead of time to figure out where he was going. >> he was like i just wanted to know where you're heading. oh, just downtown d.c. another minute later, he cancelled. >> reporter: other drivers may have manipulated the uber app or used a separate app to figure out the final destination and decided they didn't want the trip. we reached out to uber, which sent us this this statement saying, we believe uber is helping reduce transportation inequities across the board but take feedback about issues like this seriously. most drivers here at reagan national didn't want to go on camera, but they knew all about the technique. some flat out admitted they have ended trip requests based on

city playgrounds. the city amended that ordinance back in october and now all formals of smoking are banned in all public buildings and spaces. there is a fine involved for breaking the new law. the move is meant to help protect the health of residents. montgomery county police say a man was killed by a train last night. they say it happened around 9:30 along the csx tracks in germantown. the commuter train was going westbound. police are working to learn why that person was there in the first place. anyone with information is asked to give police a call. in northern virginia, a state trooper is recovering after a woman rammed his patrol car. police say it happened yesterday morning off 495. they say dema hadieh was caught speeding at eisenhower avenue, she was going 90 miles per hour in a 55-mile-per-hour zone. when a trooper tried to pull over, she took off and reached speeds of more than 110 miles per hour. all of that happened before she rammed into the

>> tom, thank you very much. the man accused of killing a young pennsylvania state trooper is shot dead. jason robinson was killed during a confrontation with police yesterday morning. they say he's the man who killed trooper landon weaver on friday night. trooper weaver was shot and killed during a domestic dispute in central southern pennsylvania. a queen anns county sheriffs deputy shot during a domestic dispute call is getting better. deputy first class scott hogan is expected to undergo more surgery today according to our news partner. on friday his condition was upgraded from critical to serious. a gofundme page has been set up by the fraternal order of police for the county. >> drunk and unconscious. police in calgary alberta, canada say that's how they found a sunwing airlines pilot inside the cockpit. he spent yesterday morning slumped over in his seat. and the plane had 99

it was preparing to leave for cancun. the pilot's blood alcohol was more than three times the legal limit. they also say he was from slovakia and in canada on a work visa. another pilot was brought in to take over. the airline apologized to passengers for the potentially dangerous situation. so when you request an uber you expect the first available car to pick you up. but passengers are telling news 4 that has not been happening at local airports because the uber driver may not like your destination. >> reporter: call it destination discrimination. uber customers say drivers are not picking them up at the airport because the driver doesn't like the destination. >> just wanted to get home. we had been traveling for a couple hours in the air. >> reporter: landon says he had to go through five separate uber drivers before one finally picked him up at reagan national re

the reason, the drivers thought his short trip to downtown d.c. wasn't worth the trip. now an uber driver is supposed to know your destination until the trip starts. but some drivers called landon ahead of time to figure out where he was going. >> he was like i just wanted to know where you're heading. oh, just downtown d.c. another minute later, he cancelled. >> reporter: other drivers may have manipulated the uber app or used a separate app to figure out the final destination and decided they didn't want the trip. we reached out to uber, which sent us this this statement saying, we believe uber is helping reduce transportation inequities across the board but take feedback about issues like this seriously. most drivers here at reagan national didn't want to go on camera, but they knew all about the technique. some flat out admitted they have ended trip requests based on destination. >> i know that i have cancelled drives before that i thought were too long. >> after we did this story, some people said the similar
