how police are gearing up for more protests on inauguration day. the first signs of the tolls you will be paying on i-66. the project forcing closures overnight tonight. a local family in shock tonight. grieving the sudden death of their 3-year-old boy. >> he died around lunchtime today after he stopped breathing at his day care inside the u.s. department of labor. sglt little boy's name, sterling moore. we have reaction from the family and the day care. >> reporter: good evening. this young boy's parents are absolutely devastated tonight. they are too upset to talk on camera. the mother works in the department of labor behind me on an upper floor. her son is in the day care on the bottom. for some reason, he just stopped breathing. right now, the gra

>> i'm still in shock. >> reporter: 3-year-old sterling was a happy boy who watched cartoons, played basketball and rode a three wheeler. this afternoon, he stopped breathing at day care and died at a hospital. >> i'm angry. i'm angry. i'm very, very angry. >> reporter: his grandmother demands to know how this happened. sterling's mother dropped him off at the child development center at the department of labor tuesday morning. his mother is a department of labor employee. she says the day care worker told her, sterling choked on a meatball at lunchtime. >> i want some answers. i just don't understand how he is saying he choked off a me meatball. >> reporter: an official released a written statement saying --

trained staff immediately responded, called 911, performed the behi cpr. >> what were they doing? how long did it take for them to realize he was choking? >> reporter: i asked the day care employee those questions. she referred me to a spokesperson. they will not answer those questions and referred me to the written statement that was released. i also reached out to d.c. police. they are aware of what happened to little sterling moore. the officers are waiting for the medical examiner's report before they decide what to do next. >> such a sad story. thank you. also new tonight, there's road work going on right now on one of the busiest commuter routes in our region.

later this year, some of you will have to pay tolls during rush hour. overnight tonight, crews are putting the first pieces of the toll road into place. >> reporter: i feel like we should have special theme music for this. take a look over here. behold, you are seeing the future of i-66 as a good segment of it, the segment inside the beltway gets ready to become a toll road. preparation begins. for big changes. >> we're going to be lifting a toll gantry. there will be 50-minute inter l intervals where we will start traffic more around midnight -- between midnight and 4:00 a.m. >> reporter: mid 2017 is the estimated time for i-66 to under go a transformation.

two or more people inside, hov, were permitted during rush hour. solo drivers will now be permitted to use i-66 during that time but will have to pay. the proposed hours are from 5:30 to 9:30 a.m. and 3:00 to 7:00 p.m. the so-called dynamic tolls are estimated to be $5 or $6 per trip. the project manager notes there are more changes ahead. >> when we open outside the beltway, the express lanes we are proposing, it will open in 2022. >> reporter: they estimate the system will reduce delays and speed at 45 miles per hour. drivers have been slow to warm up to the toll road concept. >> i don't know. >> reporter: obviously, people have a lot of questions about this. we have a lot of answers on our n

the rest of the night tonight if you are out and about. tomorrow morning, too, predoawn with the fog around. sunshine tomorrow and a look at inauguration day. new timing on rain as well as a look at the weekend. that's in a few minutes. new tonight, swift reaction after president obama commuted the sentence of former army intelligence analyst chelsea manning. house speaker paul ryan called the move outrageous saying it sets a dangerous precedent. nbc news learned defense secretary ash carter also did not support the president's decision. tonight on twitter, edward snowden thanked the president for granting clemency to manning. many called for snowden's pardon but he pleaded to act on manning instead fearing for her life. chelsea manning was arrested in 2010, you will recall, when she was known as bradley. she's more than six years into a 35-year sentence for leaking

starting tomorrow, you will be noticing big security changes around town because of the inauguration. the main hall of union station is close and will stay shut down through friday morning. train passengers will have to enter the station through the west portico. also tomorrow, bike share stations within the inauguration security perimeter will shut down. they will remain open saturday morning. d.c. police tell us they are ready for the big crowds and the possibility of protests. today, the police chief asked people to be civil. >> a message i would send out to folks who are coming to the inauguration, bring your patience. anticipate that there will be some folks here who have different views than yours. but let's all be respectful and agree to disagree on some issues. >> more than 3,000 officers from other departments across the country will assist

on inauguration day. the chief says police are ready to handle the women's march on saturday. the family of a beloved grandmother shot in her wheelchair on her way to the store is begging witnesses to come forward. 68-year-old vivian was caught in the cross fire. police think a lone gunman was out to avenge a beef and she was in the wrong place at the wrong time. today her son pleaded for the shooter to surrender. >> sitting around with the guilt knowing you did something like that. eventually, you are going to realize that you did a whole lot to a whole lot of people. something is going to say something. you might as well turn yourself in. >> there are security cameras in the neighborhood. police have not saying whether they captured the shooting. a manhunt comes to an end tonight. how police hon

back here at the live desk, breaking news out of florida. police have captured the man who killed an orlando police officer. markeith loyd was wanted for killing debra clayton last week. before that he was accused of killing his pregnant ex-girlfriend. police arrested him at a home in the orlando suburbs. he

clayton's handcuffs during that arrest. >> he was taken into custody. he did resist arrest. he does have facial injuries. lou tieutenant debra clayton's handcuffs were placed on him. he was transported to police headquarters. >> we learned he will be charged with two counts of first degree murder. with three days left until the first family departs the white house, a large moving truck was spotted outside their new home. the obamas plan to live there until their youngest daughter graduated from high school. a couple years ago. the president and his family will travel to palm springs, california, for a vacation. they will leave after donald trump is sworn in as president on friday. big welcome home rally is planned for vice-president joe biden and his wife jill back in delaware on friday. it will be at the chase center

attend friday's inaugural ceremony. they will ride the train to wilmington as he did so many times as senator. that rally is open to the public. the affordable care act also called obamacare is as popular as it has ever been. that's according to a new nbc news wall street journal poll. the poll finds 45% of americans believe the health care law is a good idea. 41% say it's a bad idea. it's the first time in the poll where more people support it than oppose it. 50% say they have little to know confidence that republican proposals to replace the law will make things better. tonight, congressional leaders, local officials and residents gathered to discuss what they consider the dangers of repealing obamacare. >> americans, including a lot of people that voted for donald trump, who are in for a very rude awakening. when the

dense fog advisory until 4:00 a.m. wednesday, including western louden, northern montgomery, points north and west. this is where we could have visibility a quarter mile or less. use your low beams when you get off to work tomorrow morning. use your low beams in the dense fog that will linger until around dawn. visibility down to half a mile in frederick, winchester. half mile up at fort meade. storm team 4 radar, all dry here. we have had a few sprinkles to our north. temperatures, look at this contrast. 47 in washington. 11 degrees warmer in fredericksburg. this mild air trying to push up from southern maryland and from central virginia. it's bringing in humidity. clashing with the cool air. that's why we have the fog around. our temperatures into the morning right around the low 50s.

7:00 a.m. may be in the upper 40s. tomorrow morning, patchy fog, near 50. then for your lunch hour tomorrow, in the mid 50s. hitting upper 50s to near 60 degrees tomorrow afternoon. fast forward two months, it feels more like st. patrick's day, not january 17. it's more like march 17. these are more like march temperatures over the next ten days. we will have highs in the 50s all the way into next week. morning lows staying above freezing. certainly, unjanuary-like into the mid 50s on thursday and partly sunny. then as we get into inauguration day friday, it might get a little sun in the morning. temperatures right around 40. then quickly clouding up and during the afternoon, climbing into the low 50s. right now the rain timing does look like light rain chance is not until after the swearing in ceremony. the rain may not arrive until 2:00 or 3:00 p.m. is the way it
