the horrible carnage going on in his words, referring to that city's homicide rate, quote i'll send in the feds. it turns out the president was likely watching fox news that ran a segment on that topic minutes earlier. >> all right. thanks. how is the latest news about the border wall playing along the bordered? >> this is a small piece of the 700 miles of secure border fencing we have in the united states. the rest of the u.s. mexico border is relatively unprotected. it doesn't have a fence, it has border parole. mr. trump has said he wants a border wall. he wants to mexico to pay for it. this part of the fence costs $6.8 million to make residents around here will tell you they have seen people cb

it was a constant refrain we heard during his campaigns. pop chanting build the wall, build the wall. people in this region, people that live along the border that we have spoken to say they don't think a border wall will be particularly effective unneless it's patrolled. this fence is straight into mexico. people can climb over this in about 20 seconds. but it remains to be seen how much an actual border wall will cost. estimates are $8 billion to $10 billion right now. donald trump saying he wants mexico to pay for it. mexico saying they are not going to help with these costs. back to you. >> thank you. ari melber is here with today's fact check after the trump administration doubled down on that debunked claim that 3 million to 5 million people illegally voted in the last

>> that's right. monday president trump telling congressional leaders he lost the popular vote because of the allegedly illegal votes. sean spicer said a 2008 study by the pugh research center supported the claim that a high percentage of people were non-citizens. we can tell you this morning, both those claims are false. according to the findings of authorities. there was no major voter fraud in this election. that's typical. it's rare for people to take the personal risk of breaking the law to vote when they're not authorized. republican and democratic officials oversee voting in all 50 states. they responded to the latest claims reiterating there's no evidence that supports the voter fraud claims made by president trump. what about the one specific study mr. spicer mentioned? it's not entirely clear which he was referring to. what spicer was said a study out of pew in 2008. there was a pew

accuracy of government voting records, not voter fraud from 2012. finding 24 million records were inaccurate because voters died or had been inactive. the paper records are not evidence of fraud. when aides wrongly claimed back in november the study showed there was fraud. there author stressed his report had no findings about fraud. he spoke out again tuesday saying there's zero evidence of fraud in the latest election. in the past team trump has cited a 2008 survey that found 14% of non-citizens telling pollsters they voted in 2008 and 2010. that survey did not prove in person voter fraud either. in any event it was in 2010, not about this 2016 election. bottom line trump and his aides have reason to know all of this evidence and reason to know they are currently mischaracterizing it. that makes the repetition of these falsehoods stated with the authority of the u.s. government all the

>> the scope of the allegations would seem to warrant an investigation. the white house won't rule that out but says there isn't one right now. >> that's the most concerning part. move aside from the fact check and say, here you have the government representative saying there were three to five million crimes occurred and at the same time they're not going to investigate or prosecute them. that's an inconsistency that's very hard to square. >> thank you very much. good to have you here. >> as we said president trump is promising to nominate a new supreme court justice next week. nbc's steve kornacki has a closer look at three names in the running. let's talk first about what is going to need to happen in order to push through his nominee and what kind of fight can president trump expect from democrats? >> the fight over the fight. you have the rule in the senate traditionally the filibuster if the opposition party doesn't like the president's pick they can force you to get 60 votes. there's been chipping away on that by the democrats. now here's a hint that

mount a filibuster, maybe they'll go all the way, change the rules again, destroy the filibuster, bottom line if they want to do that they can. >> let's talk about the names we'll be hearing a lot about. >> we've got three here that nbc is kind of focused in on. we think trump may be down to these three. william pryor. he was the attorney general of alabama. if you look at the pros and cons here. there we go. here we go. first of all this is what the right has been waiting for. the left a seat vacant for the entire campaign. this guy very out spoken on social issues. on a scale of one to ten, this fight would be an 11. there's all sorts of ammunition here for democrats to go after. this would rile up democrats to say the least. neil gorsuch. a little bit of his background. what are the pros and cons trump might be li

he shares the philosophy but not the temperment. a third possibility thomas hardman, a federal judge. you can look at his background in turns of what he might be looking for. he drove a taxi in college, did not go to the ivy league. a different route than we usually see. they might be interested in that story. there's the idea of a stealth factor. a little bit less of a paper trail here. that makes conservatives nervous. they want to know one of their own is on the court for the long time. >> nicely done, thank you very much. president trump is tweeting about the voter fraud issue saying i will be asking for a major investigation into voter fraud

to vote in two states. action from the president even as we were talking about it just a couple minutes ago. a quick note, greta van s t susteren is interviewing paul ryan. tuesday we show you video of dayton collapsing. the governor announced he has been diagnosed with prostate cancer and will undergo either radiation or surgery. doctors say the collapse was not related to the cancer. dayton says he plans to finish the final two years of his term. he turns 70 tomorrow. forget the flu this year, the bug to avoid is the noro virus. outbreaks across the event are bringing misery to millions of families and forcing some schools to close. tom costello has more on that story for us. >> good morning, nice

you. welcome back. not a very good morning though for a lot of folks nationwide who are sick in bed this morning. infectious disease experts say the noro virus is the hardiest bugs known. it spreads fast in places where people share close quarters. hospitals, cruise ships and schools. the systems are enough to send you to bed for days. vomiting diarrhea, stomach pain. sometimes fever and body aches. this morning the noro virus is spreading misery across the country. some moms dealing with multiple kids sick at the same time. >> my middle child had it saturday. sunday my older one had it and tuesday after school my youngest one got it for the second time. >> in one chicago high school, more than a thousand students and 50 teachers caught the virus in just a few days. classes canceled. out breaks in rhode island causing several schools to close to disinfect class rooms.

secondly, because i wanted -- i believed our criminal justice system works. and the criminal justice system gets it right. but it doesn't always get it right. >> she says her son should have been convicted of the lesser charge of involuntary manslaughter. hughly admitted to grabbing her by the neck but didn't choke her. she said the injuries came from her falling off the bed. >> he had absolutely no intent to hurt her. she was his best friend. >> show points out to what prosecutors said after the trial. >> there is nothing that suggests to me he enter would the specific intent of taking her life. >> does it permeate? >> every day. it's right here. all the time. it's -- it doesn't leave you.

interviewed for the story. when asked if hughly meant to kill her daughter. sharon love told nbc 29. >> i know he did kill her. i know he did. i can't imagine anybody that could even do anything harmful to her. so i don't know what was in his head. >> the case shed like on domestic abuse on college campuses where alcohol use and emotions can run high. after the death, her mother started a foundation in her honor. george hooughly will be 40 whene is released. she knows there will be nothing like this for the love family. >> people look at this how can i feel compassion for his mother or her son. because there is a life that is gone.
