outside. and caught in the nick of time. the rare disease that nearly cost a local man his legs. >> they started to talk about amputation options right then and there. news 4 at 11:00 starts now. first tonight the showdown is set for arguments over president trump's executive order restricting travel to the u.s. >> d.c., maryland and virginia all filed briefs today supporting washington state and minnesota in their battle with the trump administration. a federal appeals court in san francisco will hear arguments tomorrow at 6:00 p.m. eastern. >> each side will get 30 minutes to argue via conference call whether or not to keep a seattle judge's ruling in place keeping the travel ban on hold until the courts determine if it's legal. nbc news justice correspondent pete williams explains the

choice the court faces tomorrow. >> which is best? who gets hurt more? the states say, well, we get hurt more if you let the government continue to enforce the travel restrictions. it hurts our universities, the faculty can't travel, students are hung up, companies are hurt economically, they can't recruit the best talent. the government says, no, we're hurt more because if we can't enforce this potentially bad people could come into the country. that's the balance that the appeals court has to decide right now. >> in the meantime tonight, that hold on the executive order remains in place. >> we've seen more images like this today at dulles international airport, reunions for families split apart when one person traveled overseas and wasn't allowed back because of the ban. >> news 4's jackie bensen spoke to a virginia couple reunited tonight. >> reporter: the reunion came after a week of incredible stress for this couple.

his wife as a tornado was trying to tear her away from him. >> thank everybody who stood with us. all the american people, the good people. i thank my colleagues at work, the lawyers, aclu. >> reporter: three weeks ago nabila left their home to go see her mother who is getting cancer treat in qatar. on january 28th, she was on the flight home to virginia when president trump's order to temporarily ban people holding passports from seven muslim majority countries including syria went into effect. while hundreds gathered to protest the order at dulles that night, nabila was at the arrival checkpoint downstairs, denied entry to the u.s. she was forced to return to qatar and terrifying uncertainty. >> when they sent me back, it really make me afraid and i felt that maybe i will not see my husband again. >> reporter: when the travel ban

local activist coordinated her return. her grateful husband, a medical resident at a d.c. hospital who is not used to being in front of a camera, wants people to know something. >> i would say they targeted the wrong people. >> yeah. >> we're good people here. we're working, we're paying our taxes. >> reporter: and those lawyers who started camping out here at the time that the travel ban was announced, they are still inside still volunteering their services. live at dulles airport, jackie bensen, news 4. we're keeping an eye on capitol hill where democrats are staging a marathon all-nighter in a last-ditch effort to derail president trump's pick to lead the education department. take a look. you're looking at live pictures from the senate floor as democrats try to keep betsy devos out of the cabinet. her confirmation vote is scheduled for noon tomorrow.

democrats are promising to hold the floor till the last minute. two republican senators say they won't vote for devos and they're desperately trying to convince one more to switch sides. right now it's deadlocked 50-50 and vice president mike pence could break the tie. >> from my home town of alexandria writes this, while many of our president's cabinet picks worry me, none worry me more than betsy devos for secretary of education. >> she's fundamentally incompetent to be its leader. >> demonstrators have been outside the capitol protesting her nomination. while reformers say she could shake up the education system. these protesters say she's not qualified for the job. they say she has no experience in a classroom, never attended public schools or even sent any of her children to one.

morning. bottom line, it will be a long night on the hill. >> sounds like it, chris, thank you. capture or kill a terrorist leader? nbc news has learned that was the goal of the deadly strike in yemen last week that killed an american navy s.e.a.l. but tonight military officials say the leader in yemen is still alive. he released this audio message taunting president trump calling him, quote, the fool of the white house. according to nbc news, military leaders told the president that capturing al remy would be a game changer and they doubted president obama would have been bold enough to take the risk. the white house has declined to comment. new tonight we've learned metro's least reliable rail cars about to go into retirement starting next week. the 4,000 series will be phased out along with the 1000 series which they've been retiring

rail car mechanical issues accounted for half of all delays in 2016. the manager says all 1000 and 4000 cars will be out of service by the endothis year. we learned today that metro is just about to cut another 200 jobs. it eliminated 500 positions last year and that number could rise to 1,000, affecting managers and front-line employees. the transit agency is dealing with an almost $300 million budget gap. tomorrow the d.c. council will look at new ways to combat a shortage of city police officers. new recruits are not keeping up with the pace of retirements, but tonight some groups say more officers is not the answer. our shomari stone has our story. >> this is an emergency bill. >> reporter: ward 7 council member vincent gray says the d.c. police department is at a ten-year shortage for the amount of officers on the force. he says the department has about 3700 officers

>> what i'm deeply concerned about now is the loss of officers that we've experienced. you look at the number of violent acts, the number of homicides in the district of columbia. we had 164 in 2015. we had over 130 in 2016. >> reporter: former police chief cathy lanier told them about the shortage more than a year ago. she said that the department's hiring can't keep up with the rate of retirement and officers leaving. >> we've had 4,000 severs in the past, so if we get back to the 4200 it recognizes we're a growing city. >> reporter: his emergency bill would use money already being collected for automated traffic enforcement fees and fines. the new officers would work in high crime areas. tonight about 200 protesters demonstrated against the bill outs

not needed. >> there are other ways to actually promote public safety that have big results but don't involve the divisive tactics of the meese, the racial profiling, the mass incarceration. >> now the council is expect to vote on this emergency bill tomorrow. if it doesn't pass, council member gray will continue to push the permanent bill he introduced last month to hire those extra officers. some breaking news in the district right now. one person's been taken to the hospital after a fire broke out inside an apartment building in northwest. some people evacuated on their own, some were told to shelter in place. the person taken to the hospital was sheltering in place. that fire started inside an apartment building on connecticut avenue right across from the zoo. we'll bring you any new information as we get it. in virginia, state senators passed a bill today that would allow victims' families to sue so-called sanctuary cities over

immigrants. state senator kick black pdick proposed the measure. terry mcauliffe has not yet announced his position on the bill. fire crews are looking for hot spots now that the flames are out in lorton. that fire engulfed three stories worth of trash and burned for days. it started last thursday. it was finally extinguished earlier today due to the massive amount of garbage, searching for hot spots could take days. coming up at 11:00, a pilot manages to walk away from a plane crash in prince george's county. why his first call was not to ni 911. doug's tracking another roller coaster forecast. >> roller coaster for sure. early tomorrow some shower activity could affect your morning commute. then record high temperatures and a chance for snow all in the forecast.

just minutes after takeoff a small plane ended up right where it started -- on the ground. a witness heard the plane's engine go out, then that plane went down. it had just lifted off from potomac airfield off gala han road. the pilot clipped some trees in the woods on his way down. he managed to walk away from the crash and call his wife, then he called for police. >> i think the safety systems did their job. he was seat belted in, obviously, as most pilots are. certainly by the

on it. >> he is expected to be okay. he was flying back to rhode island after visiting his children and grandchildren for the weekend. news for your health tonight on a rare disorder that can stop some of the healthiest among us in our tracks. it can be tough to diagnose and disastrous if it's not identified in time for treatment. meet a local man who survived. 34-year-old joel patton is an i.t. specialist and a fitness trainer. >> from the moment i get the chance to move, i'm happy i'm alive. >> reporter: but a rare disease which can affect young athletes almost cost him his legs last year. >> they started to talk about amputation options right then and there because it's that far gone. your arteries are destroyed. >> reporter: the symptoms had begun a few months earlier and gradually they got worse. >> it was one leg, the left side. i just noticed again my leg from the knee down, it went from

>> reporter: heng pain even tho diabetes runs in joel's family, he tested negative for that and other illnesses. the doctors were puzzled. >> well, you're so young and you're so active and everything on paper checks out as far as you being healthy. >> reporter: but after an mri doctors sent him immediately to dr. rajesh malik. >> so joel had a relatively rare disorder that you see in young athletic people. he had what's called popliteal artery entrapment system. >> reporter: there's a main artery that goes from your groin down below the knee. once it goes below the knee it breaks off into different branches. paes

almost always e worked congenital and can be activated by exercise. and it is rare. this was the first time dr. matic had seen a case outside of medical school. >> he had quite advanced ischemia or lack of blood supply to his foot and had he was at risk of imminent loss of that leg. >> reporter: he treated joel with blood thinners at first to get the leg in better shape for operating. >> it went very, very well. we were able to see a muscle band constricting the artery and able to release it and get a very good technical result. >> reporter: joel's right leg seemed fine but dr. malik said it's rare for only one leg to be affected. so he operated on joel's right leg a few weeks later. although joel patton says he still questions why this happened to him, he feels grateful it was caught in time. and he's working toward building up his strength and getting his life back

joel patton's on the way backto. knowing how close he came to losing his legs has given him new perspective. dr. malik will share what he's learned about this rare disorder at a medical conference in june. today the national zoo revealed its 3-year-old band da cub will be leaving for china in just two weeks. starting next week the zoo will hold special events to celebrate bao bao before her departure, february 21st. she was the first surviving panda cub born at the zoo since 2005. the zoo has a cooperative breeding agreement with china which requires all cubs to return to china by the time they turn 4 years old. we posted a gallery of bao bao photos through the years on our nbc washington app. search bao bao. >> they eat a lot of bamboo. w

better chance of showers toward boundary -- it's a warm front, moves across our region. as it does so, we will see that rain during the day tomorrow. let's time it out for you. 7:00 a.m. is the time that i think it will affect most of the area here. maybe starting off to the west around 5:00, 6:00, 8:00 moving to the east a little bit. this is right around the beltway, right around the times of the morning rush. make sure you tune in tomorrow, chuck bell, sheena par veen. this moves out quickly, we see a couple of showers, but also some breaks in the clouds. that means sunshine and temperatures get into the mid to upper 60s. again, 67, a record high temperature tomorrow. but it won't last. let's take you all the way through wednesday. wednesday morning no problem here, right, looking good. still warm on wednesday. then we get to wednesday night. here we are 8:00, rain moving on in here. look what happens here. the r
