that might prompt the appointment of a special council. >> reporter: the president's lawyer painting comey as a leaker made days after the president tweeted about tapes of the conversation. >> i've seen the tweet about tapes. lordy, i hope there are tapes. release them. i'm good with it. >> reporter: it wasn't just the trump administration in t spotlight. here's comey on loretta lynch asking him to call the hillary clinton a matter, not an investigation. >> we had an investigation open at the time, and so that gave me a kweezy feeling. >> reporter: a person familiar with lynch's feeling tells nbc comey never said at the time he wasn't comfortable with the matter which lynch used so as not to confirm or deny an investigation. the senate intelligence committee expects the president's son-in-law to meet with committee staffers this month. two sources familiar with the planning are telling nbc news the committee expects kushner will meet wita

documents and take questions. a third source the timing conversation is still ongoing. all of this an conversation that despite the president's claims he's been vindicated, the russia information will remain front and center. >> all right. hallie jackson, thank you. corey lewandowski is a close confidant of the president. james comey called the sitting president a liar multiple times. he did it under oath. he did it seriously. he basically said i will stake my reputation as a career prosecutor who kept notes, my word against the president's. who do you think the people will believe this morning? >> i think what we've seen with jim comey's testimony not just yesterday but in thpa is he's made numerous mistakes when sworn in under oath. the previous time he had to go back and clarify his statements because he made a number of misstatements. wh

fbi director in that room and ask him about an active investigation? >> you know why that's appropriate? because jim comey is the one who originally asked for a one on one meeting with then president-elect trump on january 6th in trump tower. >> president-elect trump, not president trump. that was to brief him on a dossier. >> a false dossier which he knew was false. jim comey asked for the private meeting the first time, and so the pattern was set by jim to say i want a private meeting with then president-elect trump. >> to be clear on the facts. all the counterterrorism folks came to brief the president and comey stayed after to avoid em barrett for the president's sake. you should know thiis out there. quickly, because it seems like there is debate over what really happened, what was said in the oval office? the president hinted he has tapes. comey says release the tapes. i give you permission. you're free to do so.

comey's testimony? >> if you needed any more evidence that we live in two americas, cory gave it to you. i think trump's enthusiasts are going to stare at the trees they want to see the forest. the others will paint the picture of the forest they'd like to live in. the truth is what we learned is donald trump had a lot of interactions with comey as president-elect and president. in none of them did he ask a single question about the veracity of russia's mettling in america's democracy. that to me is the most troubling and really the big structural sort of blow for the president is that he's always worried about his personal legal ei equitiesnder im, l liabiliti of mike flynn. >> it is interesting, cory, we'll let you back in. it is interesting to me. on the one hand

things that were prab problematic with his testimony. it's a fair criticism on the issue of leaking to the new york times rather than going through the congress or what dianne feinstein asked him about, why didn't you stand up right then and there, but there are damaging parts to the president. >> comey testified under oath. he knew jeff sessions was going to recuse himself. he made that statement knowing saying i know attorney general jeff sessions was going to recuse himself. he didn't recuse himself until march 2nd. >> actually, he said we had good reason to believe he was going to recuse himself. he dropped something else. i'm going to play it for you right now. >> our judgment, as i recall, was that he was very close to and inevitably going to recuse himself for a variety of reasons. we also were aware of facts that i can't discuss in an open setting that would make his continung

suicide. they say michelle carter used text messages to encourage him to take his own life three years ago. late thursday the defense filed a motion to dismiss the case against their client. the judge will hear arguments on that later today. video serving as a warning for texting and walking. a 67-year-old woman was doing that in jersey. she didn't notice an open access door. she ran into it. she fell six feet down the hole. emergency crews got her out. they took her to the hospital. she is being treated for very serious injuries. that's like one of those reminders. >> it's a cautionary tale, and i'm guilty of it. >> you see people go off a curb into a street. >> there was a video of a lady falling into a fountain. also this morning, disturbing new developments about the nsa contractor accused of leaking a top secret document. prosecutors claim that

>> reporter: the parents say the four-year-old was briefly knocked over by a wave. he got back up and seemed normal. days later, this went quickly downhill. >> the night before this happened, we were supposed to -- i was playing catch with him. he was running around, and then saturday morning came around, and -- >> our world turned up side down. >> reporter: he woke up at night vomiting and in pain. >> he was like oh, he went like that. he looked at me with these hurtful eyes like i've never seen him before like that. >> reporter: an balance rushed the boy to the hospital, but he didn't make it. the family says emergency room doctors told them the cause of the death was dry drowning. >> they basically explained to us that it's something about him ingesting water into his lungs. >> reporter: when it occurs, secondary drowning usually happens after a child inhales water into the lungs which become irritated and start to fill up with fluid. >> breathing problem
