cosby's attorneys have been asking the judge to call a mistrial. and now we want to get you to the latest concerning the shooting that rocked the nation this past week right here in our area. >> we do want to recap that for you. on wednesday morning just after 7:00, investigators say that james hodgkinson opened fire on 22 gop lawmakers. the shooting happened at a neighborhood park in alexandria. the congressmen were practicing for the annual congressional baseball game. four people were shot including gop whip steve scalise, house whip scalise. and he's in critical condition at last check. police shot and killed hodgkinson. and nbc's justice correspondent pete williams reports on the concerning list that hodgkinson wrote down.

deration let's get to nbc's ron allen live at the courthouse in norristown, pennsylvania. ron, let's take a step back, talk about this one piece at a time. what can you tell us? >> reporter: the jurors dera hha cntcolt is amistrial. not unexpected turn of events i should say because again the jury deliberated so long and they come out two days ago and said they were deadlocked. so again, it is a mistrial and we've already heard from the prosecution, the d.a. said they're going to retry this case again. just to refresh your recollection, this all revolves around an incident that happened in 2004, andrea constand, mployee of university, by bill cosby at his home one

the defense was able to to dif inconsistencies to police over time. cosby testified in other proceedings and in statements to police saying essentially that this was a consensual encounter, on-going romantic relationship he had with constand. so again, the jury is deadlocked. we don't know what the split is, there are 12pittsburgh, a more neutral jury than here in montgomery county. the cosby talked about negative publicity, complained about length of deliberations, had been asking for mistrial each time the jurors came back to the courtroom perhaps a dozen times to have testimony read back or to ask questions of the judge. at one point they asked what's reasonable doubt which sounded good for the prosecution. we hope to hear from the
