the required votes to move forward. we will start with nbc's white house correspondent kristen welker. kristen, good morning to you. >> reporter: hi, savannah. good morning to you. this is a devastating blow to one of the president's top agenda items and biggest campaign promises, to repeal and replace obamacare. now, the white house was caught by surprise after a frenzied push to lock in the votes for the gop senate bill, two more republicans detected overnight bringing the total no votes to four, that's just too high to get it over the finish line. for now the bill is dead on arrival and the new plan is controversial. repeal now and replace later, much later. overnight the republican plan to replace obamacare officially falling short with two more gop senators unexpectedly pulling their support. senator jerry moran of kansas and senator mike lee of utah, both tweeting their opposition at 8:30 last night on

trump was meeting with several key republican lawmakers at the white house and just hours after the president appeared confident the legislation would pass. >> so we're going to get that done and i think we're going to surprise a lot of people, but we're getting it together and it's -- it's going to happen. >> reporter: president trump tweeting out a new strategy late last night, republicans should just repeal failing obamacare now and work on a new healthcare plan that will start from a clean slate. dems will join in. senator majority leader mitch mcconnell saying that vote to repeal much of obamacare could come in days with a two-year grace period to allow for a stable transition, but senator mcconnell stressing even that will be a tough path, the defeat coming just hours after senators delayed a preliminary vote on the bill because they were missing a key vote, senator john mccain who is recovering in arizona after surgery to remove a blood clot. >> we miss him. he is a crusty

washington, plus we need his vote. >> reporter: senator mccain weighing in overnight. we must not repeat the original mistakes that led to obamacare's failure. the congress must now receive input from members of both parties. but the republicans are facing a fierce opposition. many who made their voices heard on capitol hill monday. leader mcconnell didn't give an exact date for the vote to repeal obamacare, but indicated an announcement will be coming soon. republicans privately acknowledge even securing the votes for their fall back plan will be difficult. savannah, willie. >> kristen, stand by there. i want to keep this conversation going but bring in nbc's casey hunt who covers capitol hill for us. are there the votes for this repeal now, replace later idea and is there any reason to think this gets easier with te?

is a reason to think it does get easier with time. the reality is they set out down this repeal and replace plan originally because leadership knew that they didn't have support to just do a straight repeal. this is really the difference between being a party that's opposing a president, barack obama, in congress and having to be the party that governs. you've actually had some senators out at home at town hall meetings acknowledge that up front, say, hey, it's a lot harder to govern than we thought, and frankly the repeal only push came out of a party that was trying to oppose instead of one that was trying to write laws. so i think this is still a very tricky political calculation twieg to only repeal it. >> kristen, repeal and replace was a core promise of the trump campaign over the course of about two years now, we've been hearing it also from republicans in the house and the senate. now, yesterday as you point out in your tweet the president changing to let's at least repeal this thing and then we will work with democrats to replace it later.

this development last night? >> reporter: oh, they are shaken and they know this is a risky strategy. look, the republican plan now is to force democrats back to the table to negotiate over a new healthcare plan by repealing it. the thinking is that democrats will feel political pressure to try to make sure people don't lose their healthcare all together but the reality is there is no indication democrats will play ball with them. in fact, senator minority leader chuck schumer pushing republicans to start negotiating now to improve obamacare. in a statement he said overnight rather than repeating the same failed partisan process yet again republicans should start from scratch and work with democrats on a bill that lowers premiums, provides long-term stability to the markets and improves our healthcare system. now, of course, this all underscores the political risk for republicans if they can't get democrats on board with their new plan. the gop could really pay for this in the midterm elections by losing seats, willie. >> let me take that hot potato and kick it back to casey on that. what do you hear on the

would democrats be willing to get together with republicans and try to do something if it's in the same of replacing obamacare? >> i think that if the frame on this is we have repealed president obama's healthcare law, we're trying to replace it with something better i don't know that democrats are going to go for that. look, the politics of healthcare have gotten so calcified, both sides are way down in their trenches, you right now have it set up as trump care on the one hand versus obamacare on the other. i think if there is a very visible failure, if republicans fail to push forward a plan then you may see a situation where democrats work with them to try to make basically smaller fix to those individual obamacare markets that we have talked so much about, the ones where many states only have one plan, for example, but i think we are still a ways away from that if you still see president trump looking for a victory. i do not think there is any way democrats will try to help him out with that. >> all right. our team on capitol hill and at the white house on this breaking development.

>> inks that, guys. also this morning we have new information in a controversial and deadly police shooting in minneapolis. the officer who opened fire on a woman who had called police for help is now speaking out. the victim's heartbroken family still demanding answers. nbc's blake mccoy has the very latest for us. blake, good morning. >> reporter: willie, good morning to you. new this morning, the medical examiner is ruling this a homicide, saying justine damond died from a single gunshot wound to the abdomen, but why she was shot and killed by the police officer she called for help remains a big unanswered question. fighting back tears justine damond's fiancée appeared before cameras for the first time. >> the death of justine is a loss to everyone who knew her. she touched so many people with her loving and generous heart. >> reporter: 40 years old and engaged to be married next month, damond was shot dead by a minneapolis police officer after calling 911 for

assault in the alley behind her home saturday authorities say two officers responded, one of them, and it's unclear why, fired his gun at damond, killing her. the officer's body cameras were never turned on. investigators say the squad car dash cam also failed to capture the shooting. >> this call of a woman in trouble turned into an officer involved shooting. >> reporter: the officer who fired that fatal shot joined in force in 2015, celebrated at the time as the fifth precincts first somali officer. noor has had three complaints filed against him, two of which remain open. noor's lawyer releasing a statement overnight saying in part the current environment for police is difficult, but officer noor accepts this as part of his calling. the news is making headlines back in australia where damond is from. >> why she died remains a mystery. >> reporter: one newspaper

for a man who was swept away by flash floods on saturday. at least nine people were killed when a fast moving downpour sent a wall of mud and debris into a usually calm river at cold springs. dozens of new volunteers from across the state are expected to join the search now for 27-year-old hector garnica. they still have hopes to find him alive. breaking overnight six people were injured late monday when part of a restaurant roof collapsed in atlanta. between 30 and 35 people were inside the restaurant at the time. officials say it is possible the roof couldn't handle all the heavy rain that had fallen in the area. four people were taken to the hospital, none of the injuries, thank goodness, are life-threatening. there are new developments to tell you about in a double murder mystery in indiana. investigators have released a composite sketch of the man they believe killed two young girls who disappeared near a hiking trail. it's a story that

headlines because the man's voice could be heard in chilling audio that was captured by one of the girl's cell phones. gabe gutierrez has more on these developments. gabe, good morning. >> reporter: savannah, good morning. throughout the course of this massive investigation there have been several arrests on unrelated charges, but still no answer to the central question, who killed these two young girls. now local police hope that this new picture from an fbi sketch artist might lead to a crucial break in this case. this morning police hoping someone will recognize the face in this new sketch and lead them to the person who killed 13-year-old abigail williams and 14-year-old liberty german. it's been five months since the teens vanished while hiking near this abandoned railroad bridge. their families devastated, but today hopeful. >> today was the first day that i've really been excited through this whole process. it's the most optimistic we've been. >> reporter: investigators say more than

might even still be in the area. this community simply wants answers. savannah. >> indeed. gabe, thank you very much. two people aboard a small plane were killed on monday when the aircraft made a crash landing on a golf course in mesa, arizona. officials say the pilot reported mechanical problems. they could not reach the airport a half a mile away. federal crash investigators are returning to that scene this morning. a massive fireball was caught on camera after a broken down truck on the side of a road was clipped by another truck and then exploded on monday. this happened in eastern china. amazingly there were no serious injuries reported, but that smoldering wreckage shut down the roadway for nearly two hours. the exact cause of the accident still under investigation. back to that dramatic video we showed you at the top of the show. take a look at the top of your screen here, a 43-year-old woman in rome steps on to a train then decides to back

recent years. >> even the slightest amount of tcp in water would be a potential health effect. >> tpc got in the drinking water because dow and shell oil company saw an opportunity to take waste at their chemical plants and sell it to farmers. >> reporter: todd robbins is an attorney representing 30 communities in the valley, getting them to cover the cost of cleaning up the water. internal memos show dow chemicals calling it garbage. they were selling this chemical to farmers knowing it didn't do what it was supposed to do, kill the pests. >> that is direcorrect. >> reporter: did they know it was dangerous? >> by 1970, they knew. >> reporter: companies have prevailed but settled other lawsuits and lost one. with a jury verdict of $22 million for the community. we're
