made them sick. >> but first at 5:00 this tuesday evening, a man killed behind the wheel after an encounter with culpepper county sheriff's deputy. >> deputies tell us they had no choice after that driver "presented a deadly threat." this happened last night near the intersection of griffinsburg road in boston. that's a small community in culpepper county. >> news 4 kristin wright is live at that intersection with details on what led up to this shooting. kristin. >> reporter: well three deputies here at the culpepper sheriff's office were involved in this shooting. now, the department does not have body cameras and only some of the cruisers have dash cam. so a lot of people have a lot of questions tonight about what happened. all of this, police say, started as a call reported and assault and it ended with a 43-year-old man from culpepper

recks, i thought, okay, this is really a bad wreck. i don't need to be in the middle of this. and i left. >> sharon still is use to seeing car accidents in front of her home on sperriville pipe in culpepper, but last night was different. >> when i found out there were several shots. >> virginia state police is handling the investigation into the killing of a man by sheriff's deputies. deputies chased an assault suspect, eric clark, to route 522 last night. few details have been released about the encounter that led to his death. state police say during the subsequent encounter, clark was shot. the culpepper sheriff's said clark presented a deadly threat to deputies, so they fired. >> and i just heard a pop, pop, pop, pop, and i knew that that was a handgun. i heard somebody saying several gunshot wounds. i heard what sounded like a person in distress. >> state police say deputies recovered clark's

no information, so far, saying clark threatened deputies with that gun. people around here say law enforcement is a tough job, but they would like to know more. >> of course, i would like to know and get to the bottom of what actually happened because it concerns me because it's my community. it makes me -- it makes me nervous. >> reporter: sheriff jenkins posted on facebook saying he was saddened by what his deputies were forced to do, jim, so we expect more information on this in the coming days. also, i'll tell you, that these deputies are on modified duty, meaning that the sheriff will determine what their assignments will be as the investigation plays out. back to you. >> kristin, thank you. shots ringing out in broad daylight. but the victims in a series of drive by shootings hit by paint balls, not bullets. this evening, police tell us they have at least six attacks on hand. we're hearing now from some of the victims. news 4 pat collins is live for us in

new information, pat. >> reporter: jim, this is remnants of a paint ball shot on a building here. but not all the paint balls fired today hit buildings, some hit people. these paint balls are fired from guns. if you don't wear the proper equipment, they can do some damage. they go out at maybe 160 miles per hour or more. now, let's take a look at william minor. >> on the cheek they got you. and then they got him here on his right arm right here. >> and then the shoulder. >> reporter: and back on your shoulder. >> and in the back. >> reporter: this is william minor. he's 72 years old. he's lived in our city a long time. but he says he's never seen anything quite like this. >> something has to be done. it's not getting better. things are getting worse. >> you were just out cutting your grass. >> cutting my neighbor's

>> that's correct. >> reporter: you see there he was this morning cutting his neighbor's grass when out of nowhere comes a car and out of that car, a barrage of paint balls. >> a car pull up there and stop in front of me, i staired. i thought somebody was going to get out and say something to me. they wined the glass down and that's when it started popping like that, boom, boom, boom. >> reporter: a crew is working on a sidewalk project here. that gray car eases its way into the intersection and comes to a stop. the workers, they start to scatter. the window comes down and a voice calls out, hey, don't run, don't run. after that, boom, boom, boom. about 10 paint ball shots into the air. one hits the fence in front of the tree. one hits the tree, one hits the work tree. one of them hits one of the workers. a few minutes

out into the low 90s. heat index around 100. once again it's hot and humid, you get the storms developing, not a lot going on. most of our area is dry, but now we're starting to see them very popular, as we saw some back to the west earlier, look around sterling, very heavy rain right now around ash burn. herndon and seeing some heavy rain. look at this area right now, in towards parts of northeast dc, right on down towards the area, these are coming your way and they're moving slowly to the west. so downtown may get this storm, over the next half hour or so, again, it is raining tremendously heavy in some spots. we have flood warning. much more on the storms. much more on the heat making its way our way, the hottest temperature we've seen so far this year. we'll talk about it coming up. >> all right, thank you, doug. president trump trying to blame democrats after republicans in the senate failed to find a consensus on the latest health care bill. plan

care now and replace it later, also appears to be in trouble and off the table. chris lawrence is in our newsroom to tell us what happens now. chris. >> well, wendy, some republicans have suggested plan c, bite the bullet and work with democrats to fix what's broken. now, they failed short of getting the votes to replace or repeal the affordable care act and president trump seems to be let obama care fail. senate majority leader, mitch mcconnell, isn't ready to give up just yet. it says he will call to repeal the law. he said it will include a two-year transition period, allowing time to work out a new plan. but three republican senators oppose that option, including west virginia's shelly capito. despite the gop control both houses of congress and the white house, president trump is blaming democrats. >> we're not going to own it. i'm not going to own it. i can tell you the republicans are not going to own

democrats will come to us and then they'll say, how do we fix it. >> the time has come for the republican colleagues to take us on our offer of working together. we can work together to lower premiums. we can work together to stabilize the markets. we can work together to improve the quality of health care. >> a new nbc new wall street journal polls examine trump counties, areas president trump either flipped from president obama or out performed mitt romney. just 12% of those people polled think the house version of the health bill is a good idea. already, so far, 11 governors say they repose a repeal-only option, including larry hogan and virginia easter ri mckollough. they issued that the republicans come together to try to fix the

former congressional staffer accused of taking nude photos of his lawmaker boss off her cell phone and posting them online has pleaded not guilty. that man is juan mccollum. in 2015 he was featured on the 50 most beautiful list. also, i love new york. that was back in 2007. a grand jury charged him with two counts of cyber stalking his boss. former delegate, stacey from the virginia islands. he's also marked from using facebook and other social media sites. >> well, one man is now under arrest for the shooting of this one-year-old little boy. he was shot last week, caught in the middle of a shoot out in northeast dc and -- the police chief vowed to catch those responsible. he says he caught one guy, and he's looking for two others. mark seagraves has more on this developing story and a look at the suspects who are still on

arrested, 39-year-old derrick watson is the man seen in this surveillance video, leaning against a car and moments later, exchanging gunfire with two other men. police have identified one of the other suspects as 27-year-old shaheed washington. there is a warrant for his arrest. today chief peter newsome said there is another suspect they have not identified who they also want the public's health in finding. >> they're also asking the community to continue to look at the video that we provided to assist us in identifying the third suspect in this case. it is our belief that all three of these men were involved in some kind of a dispute where they resorted to fire arms. there was more than one child that was in the area as these grown men were firing weapons at each other. >> one-year-old

one of the children in the courtyard when the shoot out erupted. he was in the courtyard when the gunshots began and he was shot twice. the wounds were not life threatening. jeremiah is now home with his mother, who spoke exclusively to news 4 the day after the shooting. >> anybody that knows jeremiah, know he's playful, laughs, jokes, likes to clap and scream and all of that type of stuff. my son is full of spirit. how he just pulled through, not even 24 hours later, it's a miracle to me. >> now the one suspect in custody has been charged with assault with a dangerous weapon. police are hoping that the community will help them find the other two suspects. >> all right. mark sea graves, thanks, mark, a food scare at a popular restaurant change. new troubles for chipotle. it is a popular restaurant. ahead, why this chipotle in sterling virginia today is turning away

statement, knew row virus does not come from our food supply, and it is safe to eat at chipotle. we plan to reopen the restaurant today. >> two years ago the chain had a problem, a couple of reported cases of at the time they closed all of its location. gave them thorough cleaning and that its food is safe. well, tonight, this chipotle in sterling remains closed. but every other chipotle throughout our area is open for dinner. that's the latest live in sterling virginia, back to you. >> police hope a sketch will help solve a murder mystery. they released this image of a man whose body was dumped in a neighborhood in riverdale maryland. investigators hope someone will recognize him. someone found the man on the street early sunday morning. we're told the victim does not have any tattoos or distinguis

body. the medical examiner is trying to figure out how he died. >> getting a solid night sleep is crucial, not only to feel good the next day, but there is increasing evidence that it may also protect against dementia. nbc medical correspondent, dr. torres joins us again to help us walk through this. if it protects us against dementia, does that mean we're not getting a good night sleep, a lot of people, as they age, don't, contributes to dementia. >> wendy, that's exactly what it seems like these studies are showing us. what they found what just came out is that people don't get enough sleep, people that have a sleep disorder breathing, in other words, they're not breathing well during the night, that keeps them awake. we're talking sleep apnea, snoring, we're talking other types of breathing problems. they had more they're connecting the dots and saying if you don't sleep well, your risk is getting higher. we also found out in a separate

study, that the type of sleep you get is very important, you need that rem sleep, it helps clear out the brain. >> if you have not been able to sleep well throughout, say, the last ten years or so. is it too late for you or can you reverse it if you can just kind of fix your sleeping disorder. >> it's not too late for you, it might not reverse it. make sure no more gets laid down and that's what the study is showing us. the more you have, the more you have that waking up here not deep sleep we're talking about, the more likely you are developing as the years go on. even as you've had sleep problems in the past, getting under control. that means a sleep study. some people resort to sleeping pills, those are short term, i mean a couple of weeks. but beyond that if you're still using them rs you need to find out why you have to get the medical problem and on nightly news tonight, we'll find out from the gentleman who has breathing issues and has insomnia and what he did to fix those. >> my goodness. all right. thank you so much.

tonight on nbc nightly news with lester holt at 7:00 right here on news 4. a woman who broke a strict dress code in saudi arabia has been taken into custody. video of the woman first surfaced on snap chat and later on other social media platforms. the woman identified is seen walking around here in a mini skirt and crop top. this happened in the ruins of a very conservative part of the country. saudi arabia requires women to wear head scarves if they're mus li -- muslim. they took the woman into custody today. they're taking on an internet giant and one of the nation's power companies the battle for land that's been in their family for generations. >> and did you wait later in life to start your family. you're not alone.

well, the humidity has certainly returned after our beautiful weekend, and how high are the temperatures suppose to be getting later this week, doug. >> i've got to go into the

through the next couple of days. the at least the temperatures upper 90s. we'll be just about each day tomorrow right on through sunday, a very hot heat wave setting up here. we're in the heat wave with the hot temperature today. take a look, we've got some storms out there and strong storms. now a lot of the storminess back towards parts of west virginia. you see them along the mountains here. this is the area that i'm watching back towards leesburg. these are building to the west here so if you're around leesburg, yet, you're starting to see that area right now. this is the big storm. we could see a warning with this. it's not moving all that much, so we're not going to see it we could see very strong wind gusts and right on down through dc. let's zoom in more. a lot of lightning with this, too. you know it. very heavy rain fall as these are just kind of sitting here. they are not moving much at all, but they are building to

west around c pleasant right now. right around the chevrolet area. down towards district heights. now, notice right through downtown starting to come into downtown, as well. they're building to the west, very very slowly. speaking of western zones, up towards loudoun county. here is the radar site out at the airport. look at this, we'll zoom right on in here, starting to see some rain on the runway here. you can see some heavy rain along the toll road and right there along 28. we'll see a mess of afternoon. but most of you remain on the dry side tonight. we have some storms, up and down the east coast. big time storms, a little bit farther down to the south and west. you can see it on our city camera. look at that. now, we saw plenty of sunshine. it's still shining over towards the point. but in the city, the rain is starting to come down. it's going to come down very heavy as we move on through and see a little bit of wind out there, too. wouldn't be -- 86 degrees. winds out of the

miles per hour. east because the storm is actually to the east. the wind coming rite on to the city. 22 miles an hour wouldn't be surprised to see gust. 88 right now manasas. it has been hot and humid and it's doing to stay that way. as a matter of fact it's doing to get worse the next couple of days. high temperatures into the upper 90s to around 100 degrees. 97 often thursday, a pair of 99s, friday, saturday. i would not be surprised to see 100 any of these days. out towards culpepper, 100 in the city. chance of storm saturday, sunday and on monday, that could help a little bit with temperatures, but the heat index could be between 105 and 110. i do expect to see a heat advisory just about each of these days here. this is something we'll watch very close. it does look much better, though as we head towards next week. >> next week. >> yeah. we survive it. thank you, doug. he's a rising star on the tennis car, all over the world and thousand he's back at home

now at 5:30, a powerline power struggle, historic virginia neighborhood takes on dominion energy. concerned about where those powerlines are going to go. the carver road neighborhood in northern virginia has an interesting past. some of the properties near hay market were acquired under 1866 law. it allowed freed slaves to own land. but in june, the state allowed dominion energy to build powerlines in that area for a new amazon data center. residents are fighting back. news 4 darcy spencer is in herndon explaining both sides of this contest, darcy. >> reporter: we're here at dominion energy. her don offices, the company adamantly denying they're trying to take anyone's property. but residents here are not

convinced. nathan grayson is desen dent of freed slave, fifth generation resident of this home in prince william county. many residents here are elderly descendants of freed slaves who bought the properties in the 18 hundreds. >> this is their existence. this is their foundation. >> reporter: grayson is now concerned about how his home, his community and his family legacy will be effected by dominion energy plans to build high voltage, 100-foot powerlines here on carver road property. it's to serve a new data center owned by a sub ssidiary. >> they're about to destroy a black neighborhood that's been here since the 18 hundreds. >> they're serving the community. the lines will be taller more powerful. you won't be able to use his land as he always has. >> i can't put a playground over there for my grandson. i can't have a dog lot for my dogs. i can't park my bo

my existence is because of carver road. >> the state corporation commission had approved the plan to build here on carver road but then put it on hold friday, that was after a community group fighting the project filed an appeal. it's a victory for residents and supporters who held a press conference, they're demanding the county board of supervisors back them up. >> my property will be all of the trees will be cleared and 110-foot tower will be put on my property. >> chuck penn says residents have it wrong. he said the company will ask them and pay them to place the lines and towers on their properties. >> but it does not involve. kicking them off their land or taking any portion of their property. it doesn't happen. >> prince william county board of supervisors is meeting a closed session at this hour discussing this project. we hope to have an update for

6:00. we'll send it back to you. >> coming down there in herndon, darcy, thank you. >> the coast guard says it will close off part of the patomic. when president trump, whenever the president is playing at his golf course in northern virginia. that forced those to canoe, kayak and fish away from the area. the coast guard originally said it would notify people through a radio system that many say they don't use. a spokesperson now tells news 4, they're considering other options, such as sending out press releases to inform everyone. those notices will typically happen a day in advance. >> a vacant office building in our area gave people a pretty sweet surprise when crews got ready to tear it down. there haven't been people inside this building in south arlington since march, but it's been busy in there, 70,000 honey bees created an elaborate hive. the county
