get that straightened up. more breaking news, this just a mile away from derrick is, we're learning about another teen who was shot. police tell us the boy is 16 years old. he was found in the 300 block just after 3:00 this afternoon. right now, we know the teen is conscious and breathing. we'll bring you more updates as we get the information here. wendy. >> let's get the latest on the aftermath of harvey, his administration is working on emergency funds for those recovery efforts this as some families are starting to return home for the first time and they're just seeing the destruction that was left behind. in many areas tonight, search and rescue efforts are still going on. the death toll now stands at 39. the federal government says more than 33,000 people sought refuge in shelters. thousands are still there. and more than 364,000 people have already registered for assistance through fema. >> many families are

aftermath of harvey, but none quite like this moment you see here. her name is mona. four children of hers, died when the van they were riding in was swept away in flood waters. they range in age from 6 to 16. earlier today she shared stories and photos with her kids. >> what type of kids were they? >> they were very noble, nice, bubbly and social butterflies, always wanted to talk to everybody. they wanted to -- my son dominic would ask like a million questions to everyone. >> and as awful that situation is, it's even worse, folks, the kids' grandparents also died in the flooding. the uncle was driving the van. he was able to get out and was found clinging to

first at 4:00, the driver that is charged in the death of a toddler, he may not face a manslaughter charge in that death. the louden county prosecutor's say he they cannot prove voluntary manslaughter beyond a reasonable doubt. in the death of five-month-old tristan schultz. schultz was killed a year ago yesterday when a car hit him as his mother was pushing him across the street in a stroller. the driver, john miller, was indicted by a grand jury in that accident. his trial is set for october. he remains charged with reckless driving and that carries a maximum penalty of a year in jail and a $2,500 fine. >> new today the white house appears to be pulling back on president trump's threat to shutdown the federal government after over the border wall, at least for now, president trump is threatened to force a shutdown in october if the next expanding billoe

post, the white house has signaled to congressional republicans that there will be no shutdown coming in october. however, the administration says that the building -- building the wall matter, is still a top priority for mr. trump. the president also promising to announce a decision soon on the fate of so-called dreamers. >> his decision will effect hundreds of thousands of young and undocumented immigrants. edward lawrence is tracking this story for us at the white house with the latest. >> reporter: wendy, leon, the president saying the decision will come this weekend, maybe monday at the latest. now white house spokeswoman saying this decision will come on tuesday. still you have hundreds of business executives from apple to amazon who are call ing on te president to keep the dacca program. the program that protects young children, brought to the u.s. illegally by their parents. he said we love dreamers. he also faces a deadline to

states saying they'll sue the administration. we talked to rockville resident, who says that he came to the u.s. at 13 years old from peru. he's now 26 and a mechanical engineering graduate from the university of maryland. he says they trusted this country with their addresses and having the country be tray that trust will not be humane. dan stein says the president does not have the legal authority to set immigration policy and if congress wants to keep the dacca program, it's up to democrats to work with republicans to come up with immigration reform legislation. again, we should here some time between now and tuesday, depending on who you talk to in the administration, back to you, leon, wendy. >> thanks, edward. first at 4, lawyers representing the amtrak engineer accused of being responsible for a deadly two years ago in philly has asked a judge today to dismiss the charges against him.

train at almost twice the posted speed when it went off the tracks. eight people were killed. boston says he cannot remember what happened. investigators say he did not have alcohol or drugs in his system and he was not using his cell phone. philadelphia's district attorney and the state attorney general disagreed on whether he should be prosecutored. that argument is behind today's request to have those charges dropped. a man is blaming police and the city of charlottesville for the injuries he suffered when white supremacist and noe-nazi's beat him up. they're suing the city. the charlottesville police chief and superintendent, turner says he wants answers. he came to police, stood by. did nothing while he was assaulted at last month's white supremacists rally. charlottesville, city councilman bob today insisted the police were not told to stand down. >> now,

breaking news in southeast washington where a people was wounded and car was shot up in southeast. derrick ward is live now, derrick, what's the story there? >> reporter: we're here in the 1,000 block of minnesota avenue, just across the street from the subway station, in front of the friendship public charter school. this is the scene right now. you see that white sedan, you can see the passenger window has been shot out. we're told that one person was shot and wounded, shot in the arm. we don't know the condition or the extent of the wounds to that person. we don't believe this had anything to do with the school that was letting out at about the time this happened. we're also told there was another shooting, a short time ago, also on minnesota avenue, across east capitol street. whether or not the two incidents are related, remains to be seen. police have cor

beloved coach taken before the start of football season, tonight, before their first home game of the year, the james madison high school community is remembering schultz. >> he also taught special education. and late june, he and his nephew were pulled over in springfield trying to secure a boat and a truck hit and killed him. our bureau reporter david culver live as the team is preparing to play on in schultz's honor. >> reporter: they are, indeed, going to play on tonight. they're playing against fairfax. catching up with some of the students, they're preparing for tailgate. they're expected 500 students to fill in here. this is a guy who everybody loves. you mentioned he was a special education teacher, in addition to being the varsity coach.

africa. this is how far off it is. it has five or six days before it hits the islands, but take a look, the latest advisory of irma. watch the eye really form. the latest advisory came out at 11:00. winds of 110 miles per hour. the next advisory, i guarantee it will have category three or 4 storm. i'm thinking about 125 miles per hour winds. doesn't matter how strong it is, it's a fish storm. notice move to the south and then to the north of the islands, that is very good news for the islands here, especially for the u.s. virgin islands and puerto rico. it most likely will make a turn towards the u.s. what does it do there. does it stay out to sea. some computer models keeping it out to sea. however, a lot of them are bringing them to the east coast. this is something we'll be watching once again, it will be 7 to 10 days away we've got a lot of time to

cast, this american life, chronical true story. now it's an actual movie. it's the true story of collin warner who was wrongfully convicted of murder in the crown heights neighborhood in 1980. wind up spending more than 20 years in prison before it got overturned. it's one of those hurricane. the reason to see this is for the break out performance of the lead actor. he had a big part in straight out of compton. he was one of the brainwashed folks in get out earlier this year. he breaks out. also, any nfl fans are there, he's making acting turn, so, yeah, he's defensive back on the nfl now he's on the defense team as collins old friend trying to get him out of jail. it's kind of a softer, quieter procedural

labor day weekend, their wallets are taking a hit at the gas pump. prices are up about 16 cents over last week, the average cost per gallon now, $2.52. and harvey is to blame. >> supply is down, with 15 refineries being shutdown and capacity being up about a quarter. we're seeing a spike in demand. >> harvey's flooding is not more than a dozen gulf coast and major east coast pipeline who also shutdown. >> the system is not set up for everybody to be riding around with a full tank of gas. >> that 5,500-mile pipeline carries more than 300 million gallons from houston. they hope the to have it back online sunday, but spikes could be felt all across the country. >> it has been coming back. i think
