tuesd tuesday. i'm adam tuss. >> a man accused this morning appeared in court. >> police say he a doused with gasoline and lit her on fire last month. news 4 justin finch. both the families were there, right? >> reporter: that's right. good morning. want to set the scene. this was thought to be very contentious court hearing. you have two families hose loved ones are at the center of the case. both familying feeling strongly about their loved ones. you have accused of them. the goal of this hearing though was to see if there was enough evidence to move forward in this case against philips. and we now know that there is. this case will be moving ahead. now, take a look here, representing philips was jay windel gordon, that's his

questions in court today. top of his list was to find out from the police detective who was there if he actually said that philips is the one who set her on fire. the prosecution says there was sufficient evidence linking him to the case and act that happened there in that apartment. now, on september 8th, 2017, in capital heights, that's where you might recall that andrea was seen running from that apartment on fire. and she said that she was set on fire by someone in that case. now, philips attorney said there is no proof that she identified him as the one who burned her. >> why not bring in some information? this case is built on something they are trying to build an airplane in the air and they can't do it. >> reporter: and as you heard mr. gordon say, there does not appear to be strong evidence in his opinion in this case

forward. nevertheless, it will be moving ahead. november 9th is the next hearing. at that point it will be a mission to dismiss. so he says if they don't put up, the prosecution, that his client may actually not have to face these charges here. as for her, she remains in critical condition still unable to fully communicate we are told. and as to fill imgs facing charges azar son as well as attempted murder. >> back to you in the studio. >> such an unfortunate story. thank you. well, hell on earth, that's how they describe the fire there. >> the weather is expected to further complicate things today. nbc joe fryer talks to people who barely escaped. >> this is my neighborhood. in flames. >> reporter: for many there was little time to flee as fast moving flames tore through northern california. fueled by dry conditions and wind gusts

changes. right? >> yeah, we have changes heading our way. one thing i went to mention about the northern california fires, good piece of news, i know they said they may for today could get a little worse, but really think the humidity is coming up there. and that is a good thing for them. and winds coming down. so hopefully by today they'll be able to get some of the fires under control. but they do not have a lot of rain in the forecast. >> no rain for us out there today. temperatures right around 80 degrees. and we'll continue to take those temperatures into the mid-80s for daytime highs today. so another sticky day. but we have rain in our area. we'll time it out because that's coming tomorrow and also take a look at the fall lake temperatures everyone has been expecting. that's coming up. >> thank you, lauryn. just in a driver who struck and killed a baby is found guilty. today john miller the iv was con visited of two lesser charges. maximum sentence is a year in jail. miller struck mindy

her son while turning. the baby was five months old and died. they saw they kobt couldn't prove it beyond a reasonable doubt. >> new information this morning, we now noah 52-year-old woman, laura cornelius was killed. said she was hit and killed by a car en route 1 at the intersection of gun stun road last night. chopper 4 was over the scene. it's to the clear if she was along the road or crossing the road at the time. a father is in mourning after his daughter was shot by police. they say she ran over an officer, that's when the multiple officers fired several shots. video you are about to see, i want to warn you, may be tough to watch. >> get down. police ordered

out of the car but stepped on the gas instead. a short time earlier, police say she ran a red light then hit several cars. died at the hospital. her father still trying to put the pieces together. >> it's hard to expression the amount of pain and distress you feel. her father says she doesn't understand why she would not listen to police. and police are waiting to see if she had any drugs or alcohol in her system. friends and family of a be loved seller are sailors. one of some killed over the summer. you are looking at him in the navy. funeral services in alexander. a military burr sell then going to take place at ar hinge ton national cemetery. back in august he was killed after the u.s. mccain collid.

i posted this on my facebook page. then we take a look out to the west. no rain for california where they need rain for the wildfires. here in the area we have mostly spotty but stay dry today. tonight is when the rain moves in then tomorrow. then we head into thursday and friday, we will chances of rain. looks like mainly drizzle for our area. but good news by the time we get into the weekend i think we'll be able to save that and have sunshine for the weekend. so 85 daytime highs. sticky humidity starting to drop little by little. maybe a spotty sprinkle out there but that's about it for tomorrow. temperatures in the mid-70s now. humidity falls overnight. so not looking at a muggy day. but a cooler day. but still above normal. average temperature about 70 degrees. continue to see rain showers throughout the day. over cast skies, and that is

in texas taking a 19 year old student in custody after a massive manhunt. is he accused of capital murder. police say daniel's was initially taken into custody to be questioned in a drug related case. while he was at the police station, 'ledge he hadly shot a campus police officer then took off. not clear he had the gun on him or took the gun from ta officer. there is anger and disappointment among parents at liberty high school after a series of online threats. tells us what's being done about the threats. >> reporter: parents are scared. worried about the safety of their children. and feel like nothing is being done about it. frustrated parents walked out of a town hall meeting. they are upset that students who made threats online against other students won't be charged with any crime. the students involved called it operation will to kill. th

were doing other stuff. >> so this is the prep work. >> yeah, this is the prep work process. pretty important when you are doing any kind of cooking at home, work, to make sure that you stay organized and stay ahead of yourself so you don't get caught unaware. >> yeah, sure, of course. that's one of the big things everybody has to be concerned about. and during a lot of this stuff chopping helps you get there. you guys actually have three locations. >> we do. we have a location in person which is where i'm from, downtown, and frederick maryland. >> and you do this every year around the fall, the barn. >> yeah, this is our third one. and like i said this year it's been hosted in georgia's mill. and we try to work with local companies every time we do this so that our guests can see what we are about as a restaurant. >> right this
