a man was hit by a train before 10:00 this morning. metro says they're investigating but think the man intentionally stepped in front of that train. this is impacting service right now and here's what you need to know. service on the blue, orange, and silver lines is suspended. shuttle buses are available and metro says riders can take the green and yellow lines. keep an eye on the nbc washington app for any updates. >> well, this man could spend life in prison for killing his pregnant girlfriend but will not face charges for the child's death. >> montgomery county prosecutors just wrapped up a news conference. >> he will not face additional charges and now we have a

if convicted he faces life in prison. he could be locked up without a chance for parole, a judge would decide that. prosecutors say he killed laura around september 3rd. she lived in montgomery county. she was a teacher in howard county but never showed up for the first day of school. after police found her body buried in a field and arrested tessier many questions have been raised about whether he should also be charged in the death of the fetus. we found out today the fetus was autopsied and here's what we were told about why he won't be charged in the death of the fetus. >> at the time of her murder the child was 14 weeks old. based on medical testimony the child was not viable independent of her. based on those medicalin

maryland as a result the defendant is not chargeable with the second count of murder related to the child. >> if tessier is convicted a judge could consider the fact that laura was pregnant in sentencing. the trial is estimated to start in february. back to you. >> kristen, thanks. the death toll continues to climb as wildfires torch northern california. the blazes have killed at least 31 people making it the deadliest week of wild fires in california's history. thousands of homes have also been destroyed. nbc has the latest from napa. >> two of the fires burning in northern california merged into one overnight bringing the total number of fires in the state to 21. as more than 8,000 firefighters enter day six of what is now considered one of the worst fire seasons in california's

they're realizing how much has been lost. >> i didn't know what gone meant until i saw it. nothing left. >> fire captain is among the 18 first responders that lost their homes but kept working. in all some 3,500 homes and buildings are gone. including farms critical to the areas economy. >> there's a lot of small farmers out there who have invested their life savings and for a lot of them it will be gone. >> details are emerging about the fires victims. a navy veteran and his wife are among the 30 that died. most were senior citizens. >> some of these remains are actually intact bodies. much easier to identify. much easier to get things from. some are merely ashes and bones and we may never get truly confirm tif identification on ashes. >> officials now have the grim task of searching for the 400 or so peoe

but we'll have an update on the nbc washington app. >> later today the man accused of killing a rirj virginia teenager will be in court. there's a pretrial hearing set for 22-year-old darwin torres. he's charged with killing the 17-year-old during a road rage incident in june. court documents say he chased the teen and her friends with his car as they were walking to their mosque. police say they found several blood stained items in the 22-year-old's car. he was found dead in a pond. torres lead them to her body. >> m he'll be campaigning for the lieutenant governor. they plan to host a round table to talk about the so called g-3 campaign plan. get skilled, get a job, and give back

we're work to learn the name of a new orleans police officer killed this morning in a shooting. >> the officer died after a shoot out with a suspect while he was on parole. the accused shooter was also shot. he surrendered to a s.w.a.t. team after hiding out inside of an apartment. the police chief says the entire city of new orleans now grieves. >> news 4 is working for you to protect your family as you gas up today. take a look at this surveillance video taken at a gas station on allentown way on camp springs. it took less than ten seconds for this guy to open the unlock passenger door and snatch something off the seat. prince george's county police were investigating four of these bold thefts at gas stations. they all happened on tuesday. police believe the same suspects are linked to all four cases. a closer look at one of the suspects. call police if you recognize him and remember to keep your

avoid the danger. >> well, it's not unusual to see this in our area. especially recently. some venturing out into the roadways and of course this time of the year it is one of the most dangerous times for deer and motorists. it is mating season which is maybe why you're seeing so many. i have literally seen them every single morning while i'm driving to work. more today than what i have seen recently. she is here with advice to keep you safe during this busy deer time. thank you for being here. >> thank you for having me. >> so this is serious problem in our area. we have over a million, 1.5 million deer and vehicle crashes a year and this is a dangerous time of year. why is it so dangerous now. >> so they're most active through dawn and dusk. that's when they became a little bit more bold and they

be a little bit more, i guess, aggressive and trying to go after them. >> okay and sometimes even running into your car right? just blindly running into your car. >> blindly running into your car. i never heard of that. but they tend have problems with seeing which direction the cars are going to go in. so if a person who is driving swerves, then that caused the deer to have, i guess, confusion of which direction it should run into which could lead to other accidents. >> so maybe that's why i've heard a lot of people say the deer ran into my car. i tried to cross the road. >> right. >> swerving. >> slow down. that is the most important thing. you don't want to honk. >> you don't want to startle them. >> you don't. >> they'll just freeze. >> they're very sensitive to noise. so if you honk you'll startle

that will either cause them to freeze in the middle of the road or run in another direction that will be much more dangerous. >> okay. >> so how you should avoid collisions, should you use -- they tend to have a good reflection at night? >> you would see it and obviously you would see the body. when you see a deer on the side of the road, you want to make sure that you're aware that there will be other deer nearby. they're pack animals. they always roam in groups. so if you see one on the side of the road be careful because there's probably five other deer in the wooded area. >> what do we do if we do unfortunately hit a deer? what do we do? who do we call? >> d.c. animal control. we're open 24/7. we have an officer on duty and an officer will go evaluate the situation. >> it would be really hard to leave that until you show up. if you're on a
