is facing charges. and new denials tonight from alabama senate candidate roy moore, showing no signs of backing down despite fast-fading support in his own party. breaking news, about a half mile away from the new carrollton metro station in prince george's county tonight, a man shot to death outside an apartment building. >> officers from new carrollton and prince george's county police department still on the scene along 85th avenue. that's where we find news 4's jackie bensen with the latest on this. jackie? >> reporter: doreen, this is the first murder in the city of new carrollton since last year. the 911 call started coming in to new carrollton police around 7:30. >> when they arrived they found a male lying on the sidewalk with a gunshot wound to the upper bod ryy.

police chief david wright says officers tried to assist the injured man while they waited for an ambulance. >> the officers performed some life-saving measures until ems personnel arrived. when they did, they took over of course. when they got him to the hospital, unfortunately he passed away. >> reporter: the shooting happened near a parking lot of the garden apartment complex in the 5300 block of 85th avenue in new carrollton. prince george's county police detectives will investigate the murder. the man who was killed is said to be in his 20s. he's not been identified. live in new carrollton, jackie bensen, news 4. >> jackie, thank you. the owner of a food truck that collided with a family car back in september, killing a mother and seriously injuring her teenage son, is facing charges now. tony dane will answer the charges for the first time in court tomorrow. news 4's shomari stone has new reaction from the victims' attorney. >> there's a sense of relief. i think the family

justice will prevail. >> reporter: michael shevlin is an attorney representing the kaplan family in a wrongful death lawsuit. he tells me they're relieved food truck driver tony steven dane is charged with involuntary manslaughter after a horrific crash. >> the family is appreciative of the law enforcement official. >> on september 8th about 4:50 in the evening police say dane's food truck ran a stop sign and slammed into the kaplans' station wagon, killing the driver, aaron kaplan, injuring her teenage son ben, her two daughters, and their grandmother. they all survived, but ben has spent more than 50 days in a hospital. news 4 spoke to them two weeks ago. >> i have a broken heart over the loss of my mother, but every day gets a little better, and i couldn't do it without my grandma. >> reporter: his father talked to us last month. >> i mean, i'm sad. i'm extremely sad about the circumstances. >> reporter: the food truck driver is also indicted on charges

insurance, no operator's license, and failure to have the vehicle inspected. the first hearing is 9:00 on tuesday morning. and he's expected to be there. >> i think it takes them one step closer to believing that justice will prevail. >> reporter: in fairfax, shomari stone, news 4. new at 11:00 tonight, d.c. police are looking for a man who robbed a woman at gunpoint, then sexually assaulted her just steps from galaudet university. this all happened saturday morning on 10g9 street northeast. according to a police report, the suspect stole the woman's cell phone out of her back pocket. then he pulled the gun and forced the victim into a nearby alleyway, where he sexually assaulted her. police did not get a good description of the man. they'd like to hear from anyone who might have been around that area around 6:30 saturday morning. leon harris here checking in at l

seeing more republican senators withdrawing their support from alabama senate candidate roy moore. a fifth woman has come forward today and said that moore sexually assaulted her. now, just a few hours ago moore denied those allegations and even though he apparently signed her high school yearbook moore denied even knowing beverly young nelson after her emotional press conference today. >> he said you're just a child. and he said i am the district attorney of etowah county and if you tell anyone about this no one will ever believe you. >> reporter: nelson says she was 16 years old in the late '70s when she says moore sexually assaulted her after offering her a ride home from her job as a waitress at a restaurant he frequented. texas senator ted cruz now has become the latest gop senator to withdraw his support for moore tonight. and that now leaves senator rand paul as the only republican senator who has not withdrawn his endorsement of moore.

today that he believes the women accusing moore of sexual misconduct and now moore's actually using that to raise money with his supporters. dismissing mcconnell as part of the establishment. now, what some gop senators have said, that moore should be expelled from the chamber if he does manage to win next month's special election. and right now there are no signs that he's going to be dropping out. so we'll have to watch and see what happens. doreen, back to you. >> leon, thank you. also developing tonight, the man roy moore is running to replace in the u.s. senate, attorney general jeff sessions, has ordered federal prosecutors to evaluate whether a new special counsel should be appointed to investigate democrats. nbc news received a letter written by assistant a.g. steven boyd to the chairman of the house judiciary committee. it says justice department lawyers will make recommendations to sessions about whether a special counsel should be appointed to investigate things like former fbi director james comey

handling of the e-mail scandal, the dealings of the clinton foundation, and the sale of a uranium company while hillary clinton was the secretary of state. all three have become republican talking points amid the robert mueller investigation into possible collusion between russia and the trump campaign. donald trump jr. tonight's accusing a congressional committee of leaking conversations he had with wikileaks on twitter before and after the election. the "the atlantic" first reported those exchanges. the president's eldest son posted screen shots of what he called all of the interactions. trump jr. appears to ignore most of the messages from wikileaks but in one case wikileaks sent a link to its data base of linked e-mails. then candidate donald trump later tweeted that same link. in another message wikileaks suggests that trump jr. link one of his father's tax returns to them so they could app m

impartial. turning to our weather now. we had a little wonderful sunshine this afternoon but now it's cold out there again tonight, doug. >> that's what happens this time of year, when the sun goes down temperatures fall and they're going to continue to fall tonight. not going to be quite as cold, though, as it has been the past couple of nights. today kind of cold. during the afternoon we got up to 53 degrees. 49 gaithersburg, 56 in annapolis. the average high is 59. even though we were well below, that temperatures did moderate some from where they were over the weekend. this is what i'm tracking as we move on through the next couple of days. first off a touch warmer tomorrow and into wednesday and then especially thursday. but some big changes coming on thursday. that sets the stage for a big weekend storm. that weekend storm is going to have big implications if you have weekend plans. we've got it for you. results from have va's election will remain too close to

voters have a -- republicans currently hold a slim majority in the house of delegates. 51-49. tomorrow stafford county will allow voters who cast provisional ballots to come in person to argue why their ballots should be counted. the court is also expected to rule on whether 55 absentee ballots found at the post office the day after the election should be allowed. tomorrow morning jurors begin their first full day of deliberations in the gang-related murder of a 15-year-old girl in fairfax county. the jury began to deliberate late this afternoon before the judge dismissed them for the day. prosecutors say 21-year-old wilmer sanchez serrano stabbed 15-year-old alexandra reyes to beating back in january. they say the murder was revenge for the part reyes had allegedly played in a previous gang killing. in news for your health tonight, the definition of high blood pressure took a new

today. new guidelines will classify half of all americans with high blood pressure. the american heart association has lowered the targeted blood pressure from a 140 over 80 to 130 over 80. the goal is to help fight heart disease and stroke. that means more patients will need medication. but most of us will just need to add more exercise and lose weight to control our blood pressure. >> the goal is to get off the medication completely, control things naturally through exercise and diet. >> doctors also suggest cutting back on foods with a lot of salt. eating more potassium-rich vegetables like sweet to taitz and butternut squash can also help. next at 11:00 tonight, local women serving our country talk to news 4 about life in the navy and whether our armed forces have leveled the playing field. plus the cable news controversy that has some coffee drinkers bashing their keurig machines. and an emotional return tonight for jimmy fallon, back for his first "tonight show"

fox news host shaun hannity called keurig's decision to pull ads from his show a, quote, assault on conservatives. and now some on social media are responding with videos like this one. check it out. destroying their coffee makers and calling for a boycott of the popular brand. keurig pulled ads from hannity's fox news show over the weekend. that move came after a number of twitter users questioned keurig about its support for hannity, citing his coverage of the allegations against alabama senate candidate roy moore. we went to sleep last night, doug, and had a little rain. can we look for more tonight? >> no. >> okay. >> no. you can look for some cooler temps. i thought the coffee wasn't strong enough. i thought that's what was going on. >> it was decaf. >> yeah, exactly. let's take a look outside, guys, and show you what's happening out there right now. ye

not nearly as cold as it has been the past couple of nights. we've been in the 30s by this time. right now sitting at 43 degrees in the city. winds out of the northwest at seven miles per hour. as we look on through the rest of the overnight hours take a look at the numbers now. into the 30s in most locations. we're at 35 degrees manassas, 34 degrees in culpepper and 40 right now in the gaithersburg area. as you mentioned, team 4 radar not showing anything right now. that is ground clutter that you're looking at right there. i show this sometimes. but let's just get rid of everything on -- boom. there you go. all that is now gone. nothing on the radar picture. that means we will stay dry not just for tomorrow but probably for the next couple of days. next best chance is going to be on thursday for that. as far as our storm system goes, we saw some rain last night. that storm system moved off quickly to the north and east, bringing some snow into parts of new england. it is that time of year. we're starting to get that mix with the warmer side of rain, the colder side on the snow. for us we've been on the warmer side of things. notice the cloud cover coming across. we'll see a few clouds as we move on in through the

temperaturewise up to 54 degrees tomorrow. it's going to be another mild day considering where we were for the weekend. but still about five degrees below average. a chilly start. a nice afternoon. cool but not too bad. yeah, you might need the coat to step out the front door because again, temperaturewise we are definitely going to be on the cold side to start. 39 degrees in the city. that puts most of you into the mid 30s. i don't think we'll see too many areas around freezing, but maybe some areas of frost early out there. so heads up for that. coats likely -- yeah, for sure. 48 degrees by noon. probably need the jackets if you're going to head out for lunchtime. 52 degrees by 5:00. not too bad if you're bundled up for it. next couple of days here's what i want to show you. nice little temperature trend as we move up. 55 on wednesday. up to 55 on thursday. that comes with a storm system. that storm brings rather breezy conditions, a chance of a shower early in the day, but most of thursday looks dry. look at the end going back toward friday. only 52 in the city. that puts many of you in the upper 40s on friday and then back up ahead of
