parents packed the auditorium. the school board meeting, many of them demand to snow why they say dr. kevin maxwell did nothing when he became aware of the record-keeping issues a year before the state audit. >> tonight we'll present our response to the independent performance audit. >> reporter: dr. kevin maxwell speaks about the controversy surrounding the school district. >> this response provides many overdue corrections to ensure integrity, accuracy and accountability. >> reporter: an audit found 5,000 students graduated without proof that they met graduation requirements. the audit found they lacked procedure clarity. does not adhere to graduation policies, has poor record keeping and grade change irregularities. dr. maxwell told the crowd he has a solution. >> we believe providing more

improve adherence to policies and procedures. we'll minimize the potential for fraud. >> news 4 obtained documents that the school system as aware of the record keeping issues after it conducted it's own internal investigation a year before the state audit. parents are outraged. >> you knew the entire time when you were doing press releases that you were misleading the public and lying. >> no one informed me at all in the school district those corrections had not been made. >> the report also shows that student records were not properly maintained. there was noncompliance with state mandates. >> in this instance, it took several audits in a statewide investigation to take it seriously on a year and a half later. now, in all fairness, dr. kevin maxwell says he's

he plans to submit a formal response to the state superintendent this week. and he plans to release more information to the public after winter break. i'm shomari stone. news 4. the senate expected to vote and pass the republican tax overhaul plan. the house will have to revote on the measure they passed on the technicality. it looked like it's going to go through. four things to know about the version of the republican measure. there will be seven tax brackets but the percentage rates are changing with some of them falling as much as 4 percentage points. the child tax credit will double to $2,000. the income cut off goes up to $500,000. standard deductions are doubling. that means for individuals you'll be able to --

>> two individuals who are under the influence of alcohol nearly drove through our crime scene. the second one, however, drove around the emergency vehicle and drove through our crime scene at a high rate of speed. >> sergeant o'brien with the montgomery county police department describes the scene late saturday night in the 1600 block of rockville pike. they were investigating a fatal crash where a suspected drunk driver shot this man as he drove his moped home from work. after blocking the crime scene on rockville pike with barricades, including a dump truck for safety, the reconstruction unit began their painstaking work to locate and preserve evidence. o'brien says those officers were then themselves endangered not once but twice by two more impaired drivers. >> both individuals were arrested for suspicion of driving under the

both submitted to alcohol testing which showed they were well over the legal limit. >> o'brien notes the moped -- it's uncomfortably close to the spot where an officer ws struck and killed right around this time two years ago. >> i'd be remiss to say that -- one mile north of this collision as a result of a drunk driver. >> we are told that that woman who drove at a high rate of speed into the crime scene here just 20 years old. live in rockville, jackie bensen, news 4. here's something we don't see every day. four people hauling $15,000 worth of tvs, ranging from 32 to 75 inches out of a building and putting the stuff into a u-haul. look at this surveillance video. it happened along main avenue in d.c. near the wharf.

suspects. if you recognize anyone in the video, call police immediately. tonight a grieving mother tells news 4 someone shot and killed her son over a pair of jordans. jane smith was wearing the new sneakers his mother had given to him as an early christmas present when he was shot and killed last night. this happened along a basketball court at the douglas community center in southeast d.c. someone tried to take the shoes off him. after some kind of argument, they shot him. >> i still haven't -- i still don't believe it. it's untrue. it's unreal. it's unreal to me. >> police are looking for whoever did it but they don't have suspects yet. new details on the deadly amtrak train crash in washington state yesterday. the ntsb confirmed today that the train was traveling 50 miles an hour over the speed limit when it jumped the tracks. we also learned that positive trn

safety system that slows the train when it's going too fast was installed on the track but it wasn't being used yet. >> at the end of the day, crashes like this one and the dozens that have happened before cost even more when it comes to the toll in human lives and in dollars. >> washington state transportation officials say the positive train control was due to be activated next year. the crash killed three people and injured more than 100 others. part of interstate 5 remains shut down indefinitely. tomorrow, a judge is set to make an election day recount official. the democrats go through a rare 50/50 tie with republicans in the virginia house of delegates. ballots were recounted and the race flipped to democrat shelly simon. she won by one single vote. proving every votere

[ bleep ]. >> prince george's county police had to pull him out aft locked bathroom at the police station today. this started when he was pulled over after he was swerving on the road. police say that he had bloodshot eyes, smelled like alcohol and refused a field sobriety test. once back at the station, he urinated on the floor, shouted racial and homophobic slurs at the police officers. prince george's county police chief released a statement saying he finds the incident disturbing and that he supports the actions taken by the officers involved. tran tham is

to come out of that bathroom. guys, back to you. thank you, leon. nbc4 responds to a former seller of a popular clothing brand called lularoe. she tells us she wanted to return some product and took advantage of the company's change in refund policy. >> but months layer, she's still waiting for thousands of dollars to be returned. consumer reporter susan hogan learned she's not the only one. >> lularoe clothing is sold by thousands of consultants across the country. this spring, they changed the return policy offering a 100% refund. but nbc responds started hearing from the consultants who were saying the company is dragging its feet. >> i've heard about lularoe from a couple of friends and said it's comfortable. you should try it. >> she not only tried it, she decided to sell it. >> i started thinking, this would be something fun do on the side. >> to become

paid $5,000 up front to get a starter kit of clothe. from there, she held private parties, put together a facebook group. but the sales weren't there. she says the company sales policies were -- >> you didn't pick the colors or patterns of what you were selling. you picked the sizes and each style that you wanted and it was a mystery as to what you got. >> in the spring when lularoe e-mailed consultants announcing a new change to the company's return policy, a 100% refund of the wholesale amount plus free shipping labels to send it back, she jumped at the chance. >> why even bother with a going out of business sale if i can ship it off and be done. >> kristin got packing and inventoried everything she was sending back. >> they received the inventory the end of july. >> five months later, she has yet to receive a dime.

consultants who reached out to our sister station nationwide. >> they have a retailer line specifically just for consultants to call. you can't get through. you spend hours on hold. news 4 reached out to lularoe regarding the whereabouts of the refund. the company didn't provide specific details about hers. but they said we are processing returns on cancellations of business requests as quickly as practicable. auto we're in communication with each retailer about the status of their requests. >> all she hears is in e-mails like this saying it's being process processed. >> i want my money back, what's right for me and thousands of other consultants. this is misleading. that's where i'm frustrated. >> lularoe has sent some refunds to consultants. however,

we clear out as the sun is starting to go down. temperatures around 48. down to about 42. it will be colder as we head into the day on thursday. take a look at the thumbs. down to 46 on thursday. that's the average high for this time of year. plenty of sunshine and a cold start to the day. 35. average of 32. little above average there. 52 on friday. more clouds. then saturday is an interesting day with another storm system. we're going to see the chance of rain early in the day on saturday and into the warm sector. mid-60s with brazen conditions. another chance of rain in the afternoon. much colder air on christmas eve. temperatures around 48. yesterday, if you remember, i had 65 here on a monday. on christmas. i told you, it's a battle between cold air and warm air. i thought the warm air would win out. now it's looking like the cold air might win out. we might be in the mid-30s now on monday. a chance of rain or snow. it's not a lot of moisture,
