died at the hospital. one man was charged with the murders after a week of searching -- darren wint. this week he goes on trial. megan fitzgerald will cover the trial for us. jody fleischer is also digging in.a ladiest of ground to cover and a lot of questions to be asked. i'll start with the length of s timetember 5th is when this trial will start. it seems like a long time. three years. >> it does, but when you look at how big of a and case we are talking about here, it takes time to process evidence, the prosecution has to go through the evidence and then that needs to be turned over to the defe work through that evidence. but we have to keep in mind here that daron wt swi attorneys and they need more

time to go through the evidence. to retest it thesuelves to make that the dna is what is and so forth. that's part of the reason. plus f youacr in how big of a case this is as we all know, a judge has to block off two months' time to be able to, you know, accommodate a case like this and that's why we're oking at september 5th. >> the expectation is this will be a two month trial. let's walk through the case here. wint is facing 20 charges this case. walk us through what we expect prosecutors to be presenting over the two months. >>o the first thing is tha they are trying to prove that daron wint did this tcrime. jurors have to believe that it was daron wint. the biggest piece of evidence that we have reported was the pizza crust. the dna that was foundn that pizza crust which led police to daron wint, which led theth on nationwide manhunt to try to find this guy. and so, you know, they're going

through the process of showing evidence that he was the one who did this. but again, it's also been documented that on the record from law enforcement officials that they believed someone else did this -- did this c well. >> yet, wint is the only person who's been tried here. >> yes. >> jodyhen you consider the amount of time it's taken to pull this case together, when you consider the length of time that this crime occurred over what, 18 or 19 hours that this family was held in this home, tied up and tortured essentially, the complexity of the murder, the ransom that wase involved, the attempt to cover this up by setting the house on fire. you can't hp but wonder how this was a one-man job. at this point only one person has en charged here. >> well, in fact, we pulled all of the court recor and the initial warrants and the affidavits that the officers filed and they pointed out that they believe there was more than one person involved. that was no secret. that's what officers have said from the beginning. they have never strayed from the

theory that there were multiple people involved in this. now, once they arrested wint they, you know, kind of on him and focused in that direction and all of the evidence we have seen coming up for this trial has, you know, focused o t him. howevere are still many unanswered questions that remain about this case. with regard to wh else might have been there with him and who, you know -- who officers believe could have been an accomplice in this. >> a lot of inconsistencies that we have seen through these court documeous. if we go back to the documents that we read in the very beginning,kefficers l at jordan wallace. jordan wallace was savopoulos' assistant. he was hired a month before the murders. his duties were to be hitr chauffeur, thim around. and to do, you know, whatever his boss needed him to do. so that day or the night before the murder, savopoulos who issef co- it's documented in the court documents that we have reviewed sent a text message to

him, telling hy, look, i need you to pick up some cash and bring it to the house. >> $40,000. a lot of cash. >> exactly. a lot of cash. next day it was jordan wallace that went to savopoulos' accountant, picked up that cash. returned it to the home, went into the garage. put the money into the car according to investigators. but when we go back to the inconsistencies, jordan wallace lied toolice about how he received that cash. was it in a manila folder, a red bag, was the car in the garage locked? and it begs the question at that point intime, why? why would he lie about something like this, but i was going to say important to note though, he has not been called a suspect. he has not been charged. >> at no point was he a suspect. >> well, they did treat him like a suspect according to the search want of his vehicle which was found near the house, his personal vehicle. officers did refer to him as a suspect. they said they were looking for evidence lind to the crimes. and they really did check him out and focus on him fairl

heavily. to note, he has never been charged wit anything, which would lead you to believe they didn't find anything that linked him or they aren't ready to proceed with that part of the case yet. keep in mind, this case is heavily linked to dna. and there is every reason in the world that jordan wallace's dna should be in the house. he worked for the family, he was in and out and he s ose. that was not a way to prove involvement for him if he were a suspect. so they'd have to this in other ways. that's a much tougher thing to do. but again, to indicate ouey have saidnow nothing so far concrete to link him. di was there anything else in your document ? you have been through dozens and dozens of documents related to the case t anything elst stood out as we go into this trial next week? >> yeah. with regard particularly to jordan wallace, w expect him to be a key witness in this case. probably fth both sides. prosecutors and the defense. you know, we have not heard from him since the beginning of this.

and, you know, he has been scarce and it's not for lack of trying. but this guy has been laying low, you kno we think that the prosecuto are going to heavily focus on his time line, his whereabouts. i think the defse is also going to hone in on his time line and whereabouts. you know, we know the defense is planning to raise another suspect as their defense and it's possible that he would be the personhey would raise, just given his level of involvement. we know in some of the defense filings they have mentioned inconsistencies. they honed in on prosecuto providing all of the information of people who lied to police about their whereabouts or about other thing when they were questioned and he certainly fits into that category. >> we'll pse here for a second. take a quick break and come back and talk about this potential bombshell. the strategy that the defense team may be planning. stay with us. notebook." we are talking about the d con wint triing up on september 5th. jury election -- selection will be the first that happens here. if you live in d.c. and you have been here for a couple of yearha yo heard about this case. >> absolutely. nationwide too. i mean, i think this is one of the cases that everybody wants questions -- or wants answers to. jury selection is expected to start on september 5th. then it's supposed to be two days we're told. the 5th and the 6th. but there's so much to go through. there's so much to try and weed through to make sure thatetou can fair trial for daron wint. but it could possibly take a little bit longer. we know that the trial will be monday through thursday. they won't have trial on friday. that following monday is a holiday so it will start back up on september 11th. will jury selection continue on that day or will the trial begin? that's yet to be wseen. know that the attorneys have been going back and forth about the questions to ask those poteial jurors to kind of weed out the people they don't want

luand i the people they do to make sure that he does get a fair trial with so much publicity. they want to focus on certain things that the jurors -- you know, their beliefs. what they know about the case, what they have heard. you know, can they keep an open mind is anoer thing that's always important. but they have definitely been going back and forth recently in court s. hammering out what the questions will be for those jurors and making those decisions. >> let's go back a couple of months. the defense team made a motion to present some more evidence that motbe daron wint did commit this crime. >> exactly. that was sort of like the bombshell, if you pewill. ining with the defense attorneys -- well let me explain what happened. so in court, the defense wanted to use something called the winfield defense which means that it's somebody ee who did the crime, it's not my client. somebody else did it, but you can't just do th you have to show evidence suggesting that it really was or it really could have been someone else. so t defense team presented that evidence to the judge. the judge then had the opportunity to decide, e, is

this evidence credible, but not only that do they have to reveat this to prosecution? that day in court the judgvi decided thisnce is credible. that perhaps it was somebody else that did the crime. and no, you do not have to show this evidence to the prosecution. however, she did mention in open court that the evidence -- some of the evidence that the defense would be using is the same evidence that the prosecution released and discovered. >> we call it a bombshell but potentially not. the prosecutors should know exactly will be presented -- >> exactly. they handed over thousands and thousands o pages and exhibits to the defenno team. so youyou could be talking about a needle in a hay stack that the defense has honed in on and picking out something titical that the prosecutors didn'tnk was critical. because prosecutors are asking, tell us who it is you're going to present as your alternate suspect, you know, and the jud ys no, they don't have to, you have that information contained in wt you have already

provided. well, shoot, that's thousands and tyusands of pages that t now have to go back and try to figure out what is the defense strategy going to be. >> and could potentially be caught off guard when this case goes to trial. >> it really speaks what we know about criminal -- about murder trials in this country. there has to be beyond a shadow e a doubt to convict some murder. >> reasonable doubt. the question -- but that's critical because the question is what do the jurors cosoider to be rble doubt? what is reasonable doubt and, ow you there's always going to be a doubt. you weren't there, you didn't see it. but the prosecutors are going have to if they want to get a conviction they have to convince involved, because they really e can't backpedal now from what the police have said all along. it's writing, they were on tv tathing about it. chief herself said specifically we believe there were multiple people involved. they're kind of locked into this theoryin at this it's the prosecutor's job to convince the jurors while we o

said there werer people, we think -- you know, they have to convince beyond a reasonableub this guy was there and that this guy participated. that's goi to be the challenge. >> and that this guy killed them. >> that's the challenge. there's a felony murder component, being just present during a commission of a felony, he could still be held accountable for that by being there. >> right. >> instances of dna which, you know, the evidence has presumably shown and that's what prosecutors are going to argue his dna is on some of the items. that's hard to overcome. the jurors love sence and dna evidence and they're planning to hang this case significantly on that dna. >> we live in this law and order age, suddenly if the science says this person did it then how can you go against the science, the dnascience? >> well, they will argue that though. >> you know the defense team will poke holes in that. how is this collected, how is

this evidence treated? you know, how was it processed. in trying to weed through that it's possible they can sow doubt. you can't conclusively say that's what it is. dna i somewhat conclusive, but it's not all the way. ense have seen in the d files they intend to bring in issues of you know trace evidence and transfer of dna because there's evidence that dna can transfer from one person to another person. >> sure. >>o they mayry to argue some of these, you know, kind of lisle deta in -- >> how tactical is that? how much does the average persoo listens to something about trace evidence and -- >> well, that's why this trialt is going t two months because the experts are going to be hammering this out. one expert may say one thing, another expert something else td then the jurors have to decide which expery believe. when you talk about science, it takes a long time to explain thw concepts in t that the jurors will understand. and be able to process and then make a clear decision.

you know, they're goin and forth also about whether dna, is it conclusive that it's someone's dna or that this person can't be excluded from the sample? those are two different things. you know, there's -- daron wint also the suspect here has a brother who was at some point mentioned during the coue of this investigation in terms of his phone bng present in certain spots or him giving his identity when he was arrested. when you talk about bringing in a cloha family member may raise doubt about dna. you don't know which direction the defense will go in. >> we're out of time, i have to say. but i'm glad we'll have megan and jody on top of this trial. obviously we'll be watching september 5th to see how this gets started. ladies, thank you very much. that's "reporter's notebook" for today.
