serious. right now, in germantown, part of middlebrook road has been shut down after a woman was hit ar there. this is right at the intersection with ridgecrest drivpp >> c 4 flying over the scene earlier tonight, take a look. we know the woman was taken to the hospital with life threatening injuries. a second person was also rt, but it's unclear if they're the driver or another pedestrian. we're told the car did stay on the scene. now, to downtown d.c. 7th and pennsylvania avenue, where two pedestrians have been hit, this is n rightr the national archives building. >> ten years ago, two woment wee nd killed when they were walking in this same area. news 4'sne shomari s is there. what have you learned? >> reporter: well, right nw, i'm pennsylvania avenue between 7th street hwnot and 9th street northwest. i'm near the penn cor r metro station, across the street from

stop-gap funding bill this week and senate democrats agreed to it. this measure would keep the government running until early february. the government, by the way, has already shut down twice this year, so, we've been here before. the senate's bill version does not give president trump the $5 billion he d wasemanding to build a wall along the southern mexico border.>> oing to make sure we don't end this year the way we began it, with another government shoutdown, because of democrats' allergy to ssible immigration policies. >> people do remember that president trump as a candidate said that mexico, not the ooerican taxpayers, were going to have to the bill. so, it's wasteful spending to have to build a bigtiall for the border. >> now, up to this moment, presid ht trump not said anything publicly about signing a short-term an. the short-term government spending bill would have to get through congress and then go throh the reconciliation process and then it will be signed by the president and it has toye signed midnight

a developing story that you'll only see on news 4 tonight. >> our consumer investigative team has uncovered new details in the tragic death of a fairfax county third grader. 9-year-old wesley dd lastay after he got stuck between a motorized partition and a wall at his elementary school. >> documents obtained by news 4 show the family plans to sue, and revealed newounformation the accident. consumer investigative reporter susan hogan has been following the story from t beginning, and has more on this major development.

>> reporter: we filed a public records request from the county a few weeks a thate just received it. now, inside, the documents cim that a teacher acrossed wesley wall rate this motorized despite reports that there were two other adults in the gym at the time. >> he was a dear, sweet little boy. the kind of did that wanted to help, wanted to do the right aiing, you know? >> reporter: caroly is friends with wesley's grandmother. she also spent a lot of times teaching in fairfax county schools. wesley's death left her with a lot of questions. >> how could that have orppened? >> rr: but now, these documents obtained by news 4 are shedding more lightn the traged attorneys for wesley's parents sent this letter to fairfax county last month stating their intent to sue, not just the school ctdist but any employees present at the time of wesley's death. the documents claim there were two teachers and one after

hool program employee in the itm the afternoon wesley was killed. believed one of those teachers asked for wesley's help closing the motorized partition for a dance laterhat evening. attorneys say the county and the employees were neg in wesley's death for a number of reasons, among them, allowing wesley to attempt to operate the wall. failing to follow proper procedures. failing to properly train he employees inafe operation of the wall. >> you must have traichng. dren are dying. >> reporter: kathy cole owns the company that makes a device called safe path. it usesotion sensors and will stop a partition from movingf someone or something gets in its path. a news 4 consumeres igation found there are nearly 500 motorized partions in schoo in the d.c. region and only one of them has an additional safety device like sith paafe inth.
