6:16 am
hogan are here with us. you learned new details after you filed a public recordsre est. tell us what you learned. >> we filed it weeks ago and justhe received this week. inside there were some stunning details that describe what exactly happened the das w that wesley died. there's also a letter from attorneys and their inten to sue fairfax county and all employees in the gym at the . particular ti the documents claim at that time there were actually two teachers and o afterschool employee a one of those teachers -- which was redact sod ed so we't d hav name -- sought wesley and asked themo move the motorized partitioner, use the key to open it up which was just like, according to the attorneys and we spoke with them as well, they were stunn by that. number one, there should be no children operating these motorize partitions according
6:17 am
to tm sohey said why ask wesley to help them with moving were artition when the two teachers and an afterschool employdu? there weres in the room. so they're suing them in terms of negligence is what they're saying. basically allows wesley to attempt to p close ttition in the first place, failing to follow proper procedures and failing to properly train employees. g is there any indication or explanationen for asking the child instead of asking the adult? >> no, and that'she big question is why ask a little b to help move a motorized partition which is extremely heavy. the force of it opening and/or closing is so incredibly strong. and what they were doing, which we just learned, there was aha dance evening so they were
6:18 am
looking to close the ptition to break up the gym in order to have the dance so that's what the lawyers were saying is why asking a an eight-year-old boy. >> obviously there were procedures that were not t followt should have been followed here. there will be changes. tell us what the schools apl ning to do in the wake of this. >> right after wesley's death fairfax county public schools put in policies in place, one of which is wherever the partition is open or closed -- and this goes for all of the schools -- no children can be in the gym or wherever the partitions are perform only specific teachers or employees are allowed to use the motoriz partitions and then also only a few people, adults, can have the key to move the partition to close them or open them. >> one other question. we have sensors o our garages that prevent them from closing if we're standing in the way. why don't the schools have these
6:19 am
sensors for these partitions? >> great question. that's the question a lot of people are asking and a couple people we'vein rviewed, a former teacher was asking, wesley's parents are asking, the lawyers are asking because these sensors do exist. there are sensors that you can put on these partitions that cost between $5,000 and $6,000 aliece per and they do as you're closing the partition if child were to run through it or get near, it will stop so these exist but we found in our investigation only one school in the d.c. area, the whole region has one of these. the lawyers pointed out in their lawsuit that fairfax county has audget of $2.8 billion so why don't they have the money to pun hese safety mechanisms. >> that's a question we'll have

to wait to get an answer to. the news 4 i-team found a squatting scam is spread bug city officials think what the i-team found may mean changing the law.ing but city officials think what the i-team found may mean changing the law. scott, tell us how the food truck scam >> of all the things we've seen this is possibly the most knucklehead. in southwest d.c., parking spaces are as rare and as prized as they are in other high-impact parts of the city where there's a lot ofederal workers and people want to park their cars but in southwest d.c. there's a lot ofederal lunch eaters. the federal work force wants lunch so what some trucks have done is taken public parking ter spaces and made them their own. years.ng on them for two trucks arrive for lunch each day, sell their lunch to the federal work force, then at 2:00 the truck operators move junk cars into the place of their trunks to save their spot all night.
6:21 am
then they bring their foodruck ck, replace the car many and save their place for lunch servings. they've done thisay after day and the people who live and work there are frustrated. we investigatede this, thought this would be an easy fix. e showcase it had problem, the dpw for tows the trucks. but d.c. trucks don't permit them to tow cars at a meter.d t dpw for tows the trucks. but d.c. trucks don't permitrs them to tow t a meter. they're changing the law that would allow them to break up a parking scheme. >> so ahey're parking meters and paying? >> they may be paying, they may not be. some days they may pay the meter, some day they may take a chance but even if they get a ticket, even if you get aicket 15 times at that same parks space it's $30 each time which is recouped by selling two lunches in the first five minutes you're operating. >> so they'reth taking u
6:22 am
spaces. what are they doing to the lunch business crowd and t businesses? >> well, they're serving the federal work force whichants od truck food at their doorstep so there are customers who are quite pleased thisme scs going on but they're crippling both the businesses, the brick-and-mortar restaurants nearby which paid the rent assuming there would be no food trucksut front. they're also damaging the food truck lottery. d.c. has a famed 10 food truck zone system where you have designat areasor food trucks who do business. these pirates of parking spaces are setting up -- withinight they're almost 100 food truck zones. >> we'rexpecting the counsel to pass new legislation when? >> they have passed it. ne mayords to sign it or allow it to go through. that should happen f a weekm today. >> we'll take a break and be right back. st with us.

facebook has been under fire on capitol hill. now d.c.'s attorney general charges facebook failed to protect the data of millions of users. he spoke specifically on the cambridge analytica scandal where a third party personality quiz collected user data before 2016. racine says half of all d.c. residents were affected by that. news of this lawsuit obviously comes amidst the avalanche of charges that facebook is facing but how significant is this d.c. lawsuit? >> pretty significant because it's the first one and it really was one of those things where the ag is saying what facebook is doing is going after o personinformation, our data, but allowing the thirdti p to somehow get by our -- if we

chked off like w wanted privacy data and all of that, we don't want them to have our data, you can check that box, somehow they're cir amventing th this is for certain companies that they've basically given car blanche to so the ags office is stepping in and saying absolutely not. scott and i were talking about this earlier. with facebook it's one of those things where we as users know when w log on we're throwing our information out there. you know, it's- we know things get shared. uttingind of -- we're ourselves out there but what the ag is saying and why they're getting a o lot bad press this week is the fact that, you know, the fact that they're allowing these companies to circumvent our privacy policies and retrieve our data and use it without our knowledge. the lawsuit in d.c., is it the beginning of something big? >> yeah. days from now the complexion of congress changesdr

atically. it goes from republican rule in the house to democratic majority in the athouse. the s majority changes inside but nothing changes politically for facebook. no matter who is in control, the's increase scrutiny for them. it's one unifying political fact ofxi ourence is that both parties are concerned about social media platforms and privacy. i believe when the new congress takes effect january 3, hearings will be seduled soon after. >> racine is asking facebook to change privacy practices and pay restitution. what do we do? >> i think, you know, until it happens i think it's buyer beware or user beware as we were saying. you've -- a i've seen lot of people on facebook yesterday or on twitter saying i'm out, i'm done. so people are leaving facebook. it'sre -- as we also saying, too, it's free and you get what you pay for. if you're putting your stuff out there, if you don't want this, if you're angry about what you're hearing, get yourself off

6:29 am
how bad was that the outside they could care less about because that you can repair orou just call it a total. they want to see how safe we are in t ca did the dashboard come intohhe cras dummy? did the crash dummy's air bag do what it was supposed to do. >> did the people inside survive? >> exactly. that's what they care about. >> you have to tell us about the picks. ty >> 57 cars got the top safety pick, which is remarkable. that's basicallyaying manufacturers are getting smarter, our cars are getting safer. the top subaru -- which is not surprising, subaru always cam out onop with its top safety picks, it's always been there -- but theyad seven top safety pick this is year. two minivans, the pacifica and honda odyssey came out on top. >> scott, i don't want a car for christmas, some federal workers just want it to be working. >> it was a crazy day.
