interview with nbc news overnight pushed back he said, look, if this is a counterintelligence investigation, if national security is at stake, why wasn't there a report? why don't wenow the findings of this? does he have a point there, chuck? >> shockingly, no, kristen. he doesn't have anything close to a point. in fact, he has it 0 degrees wrong. if it is a counterintelligence investigation, perfectly reasonable, perfectly likely you would never see the result of , at least not publicly. counterintelligence investigatioon are in secret. very few of them result in criminal charges. most oakthe time, we the fruits of those investigations to inform policymakers, perhaps to fashion a diplomatic response. but the notion we would s what happened as a result, as mr. nonsensesuggests, is >> there's a lot americans are trying to digest as it relates to the russia investigation ght now. i think the big question is

what, if anything, does this tell us about the mueller investigation, whether this is still something that's being pursued, and does this give us you anyetter indication the mueller investigation may be winding down? >> i don't thinkle you can that, peter, that it is winding down, from the fact they had counterintelligence investigation opened. look, i always thought of these things as intertwined, as braided, if you ll. counterintelligence and criminal investigations can run together. they can run simultaneously. here's a good example. when the mueller team indicted2 the russian gru military intelligence offiwars, tha a criminal case brought in federal district court. it was clearrom reading that indictment that there was also a significant counterintelligence investigation of those russian officials. the government can do many things with theharuits of investigation. they can put it into federal court as a criminal case, or they can just use the fruits of the investigation to ingmrm their jt and shape their

ross the country. they want to know, when is this going to end, and who feels more pressure to blink first? >>yeah, that's question we don't have an answer to at this hour because there seems to be no end in sight. at the white house, the president is struggling to figure out ann exit prom this shutdown, as it becomes the longest in history. the democrats are unwilling to give him the wall he demands. they view it as immoral. they view it as ineffective. there does not seem to be an end ramp, the way this government reopens quickly. >> phil, the president traveled to the border a couple days ago. you and i both traveled down there with him. you had a chance to pose questions to him alongrdhe bo there. he made it clear he thinks he has the absolute right to rgdeclare a national ecy here, which basically would allow the opportunity to reopen the government r.ht aw i guess my question is, what dvice is he getting? why hasn't hee this yet? the fact he's sort of waiting to declare a national emergency, doesn't that undercut the argument that there is, in fact,

a national emergency, if he's still thinking about it? right.tly if this were a true national emergency, he could have declared it immediately,ul and have declared it immediately. the problem is, the white house, the lawyers have into this, trying to figure out what their legal options are, and preparing for a legal challenge in the courts. it's not conclusive thar, that president would be able to do this. he's hesitant. we're hearing from key republican lawmakers on capitol hill who are s ing, holdon. don't do this. this would be a mistake. try to negotiate some sort of solution first. >> just following up on that point, the president's pushing back against t aracterizati characteri. said the republican party hasn't ever been more unified behindything. we know his base is. we've seen the establishment peel away a tiny bit. phil, is there any indication that his base would abandon him if the pain gets t tough in some of these red states? >> it is unclear, kristen, if the base would abandon him, but the problem is the republican

party is more than just trump's base. there ke some republican lawmakers, including lisa murkowski, the senator from alaska, cory gardner,yi , that's enough, let's get the government open. there are cracks. let's see if trump can keep more cracks from opening into next week. >> we've seen remarkable weeks, and this was another one. can you pull back the curtain? give us a sense of what it is like inside the west wing, inside the president's thinking, as best you can understand it right now. >> we hear about the west wing eing chaotic so often, but it is at thismoment. there does not seem to be a strategy for this shutdown. they decidedo enter the shutdown without a clear plan of how to get out from it. we're now three weeks, almost four weeks into it and, again, meere is no plan for how to reopen this gove and secure the funding for the border wall that the president has promised his supporters around the country. >> well, these 800,000 workers
