>> well, typically, in a sexual assault or sexual case, it is a heidsa/she said case, which can be difficult por arosecutor to prove. however, guys, particular situation, based upon the fact they're at a minimum for one of the victims with a video of an alleged sex act between r. kelly and one of thei ims, it lends itself to being corroborating evidence for the prosecution. that's exactly what as a prosecutor. you usually don't get that. you just get their testimony as them against that of the departmet, defendf he even testifies in court. the existence of at least one video. avenatti said perhaps there is another video that can help cook coun county d.a. prosecute the cases. >> isas hearing t morning that there were videos before. this one, essentially, y clearly see his face? michael avenatti tweeted a graphic picture yesterday, zoomed in on r. kelly's face. is that the difference, ou especially ifave more

videos? >> yeah. it's kind of disturbing, ll shei that that's the standard we're judging the success of a case, is thef quality a video of a sex act with minors with r. kelly. in 2008, when he went to trial, he rolled the dice before a jury of his peers and he was acquitted. there is a suggestion the vteo wasn't tgood. the fact the victim in the case refused to testify obviously hurt the prosecution's case. fromndhat we understa, we here. have the situation victims.four the date range was between is the 1998nd 2010. the rages were between 13 to 16 years of age. we have the felony counts against r. kelly. >> this follows the docu-series. this is where several of thesea womenhey were sexually abused by r. kelly. he, for his part, says theyire all here. what's striking is after that docu-series, the prosecuto in chicago came forward and said, we need you to come to us and

tell your stories. could theefense try to use that as part of their strategy in pushing back? >>yes. in fact, we already know the defense for r. kelly is already doing that. when he did the presser last ight after r. kelly turned himself into thpolice, he basically went on the attack. he took the gloves off and said, they're all lying. he ao noted t existence of the docu-series, stating they're all looking for a, quote, gravy train. well, that is, you know, the playbook, quintessential bo pl defense in a criminal sexual abuse defense case. you go after the credibility of the victims. you try to suggest to the jury at large that the victims are lying because they want personal dp gain, either fame or fortune. you use that to your advantage. if i were the criminal defense attorney for r. kelly, i wouldn't be talking so much because i haven't seen the evidence. the criminal defense attorney has said, he hasn' seen the video that directly allegedly implicates r. kelly. becausof that, i would maybe keep my mouth shut for now. oes all penalties if it

the way here? >> three to seven years, each probation.sibly you can get consecutive sentencing. he could be looking at up to 70 years in prison if convicted, if he goes to trial. >> thank you. let's turn to the severe weather threat facing tens of millions of people today. >> dylan is here with the very latest on that. a lot of people getting hit today. >> good morning. yes, a lot of people have been getting hit for quite some time. large portion of the country could see flash flooding, more snow, even the possibility of tornadoes today. it was a surprise snowfall out west, of allha places, t caught a lot of residents off guard. >> reporter: a wicked storm leaving its mark on the west coast. sin city looking more like a winter wonderland. some parts of las vegas saw up to an inch of snow. schools closed as residents had e first measurable snowfall in more than a decades. snowplows hit the road in san diego. highways around los angeles were forced to close. the unusual wintry weather left

risk under these flash flood watches. this is going to be an area that not only do we have to worry about the torrential downpours leading to flooding, but we also have a severe threat as we go through the day, especially in this darkest red here. that includes tupelo, mississippi, also southwestern tennessee. damaging winds and tornadoes are a possibility with this storm system. as we go through the day, we are going to see these storms fire up through the afternoon, through this evening. this will move across the east coast as we go into tonightnd saturday. this will produce some really heavy rain up and down the east coast bef exiting as we go into late in the afternoon on sunday. extreme northern new england could end up with more snow out of this one. again, the flooding rain will be our b concern because the ground is saturated, and we could easily see more flash ooding. rivers and streams overflowing, washing out some of the roads, too. we could see another 3 to 4 ,inches of rainfa especially across tennessee and northern mississippi. peter and sheinelle? >> dylan, thank you. counsel robert mueller releases his final report on the russia investigation to the attorney general. a senior justice department official telling nbc news it will not be given to the justice department while theld presiden a high-stakes summit with north korea's leader. this as president trumpays he's ready to veto any legislation that tries to stop his national emergencycovered f pennsylvania avenue this morning. we start with geoff bennett, our white house correspondent on the north lawn. good morning. reporter: peter, good morning. the waiting game continues. a justice department official says special counsel robert mueller's reportex is nocted to be delivered to the attorney general as early as next week, as was widely reported. house democrats though are demanding thathenever the report does drop on the ag's desk, he must make it public. judgment day delayed, as a senior justice department official tells nbc news, special

now, the victims in all of this, some as young as 24 years old, came from china. many of them thought that they were coming to thees united st for legitimate jobs, paying in some cases, up to $20,000. they landed in new york, then und themselves in florida, speaking only chinese. they found no way out. sort of a surreal scene here last night at the massage parlor, as people in the community came out, finding out where this was located, lining up and taking pictures, selfies. just a really unusual kind of scene in the wake of the seriona re of what happened here. >> quite the spectacle. could kraft face rep remands from the nfl? >> reporter: it is not the solicitation charge that's dramatic, it is a second dree
