now joining us exclusively is the owner mr. ry west. good morning to you. >> good morning. >> before we get into the nitty-gritty here, i just have to ask you, as somebody who has been in the horse racing business for a long, long time what it felt likhi to t you had won the derby and then to have it taken away. how is that moment for you? >> it was literally like the old tv show the thrill of victory t and agony of defeat, all within a io22-minute perof time. it was winning it was the most euphoric thing i have ever had in our lives and disappointment when they took the horse down to for the first timen history. i couldn't -- we were stunned, shocked and in tot and complete disbelief. it had never been done before. >> as it stands this morning, are you planning to appear o file legal action?

where are you on that issue? >> we are going to file an appeal today with the state racing commission. we right after the race i had the trainer cl the stew wards and very nicely ask them if they would be willing to visit with us after the races were over. we said we'll say here until 11:00, 12:00 at night whatever you want. they said absolutely not. we won't be showing the films until thursday. so we didn't really have any alternative legally other than to be, the appeal has to be filed within8 hours. so we'll be filing that today. d> gary, craig melvin here. as i understan it, the racing commission, they're in kentucky. the language is important. dey say the findings of fact andermination shall be final and shall not be subject to appeal. it doesn't sound like they're going to allow an appeal. wh is going to be the basis there? >> well, it's obviously you can't appeal it to the stew wards who made the decision.
