court. he talked with the woman who recorded that video. path, what did she tell you? >> reporter: she has a lot to say, jim, but, first, let's talk about the victim here. he's a howard grad, a finance major. he works in a startup here in our city. saturday he wanted to see his mom. he decided to take metro. he goes down into the u street station and -- and let's go to the videotape. the metro cop tased him and then tased him again. they say the man was trying to be a peace-maker when it happened. the 29-year-old man cuffed and charged wit assaultn a police officer, charged with obstruction of justice, charged with resisting arrest and jailed for two days. according to his attorney, the charges all dropped today. hear now from his mom who was at

by the suspect. she took the witness today, and as you mentionedki the shoc things that she said, she said the good samaritan was not a hero and that he never should have intervened. it's been almost a year since a good samaritan died after trying to help a woman who was being attacked along south george mason drive in arlington.r fo the first time today, we'g hearinfrom the woman who says the attacker, michael ash, was her boyfriend and that he's not fully to blame, even admitting at least once to the court thato neighdidn't rape her. the woman went on to testify that the two of them were arguing on the nightct of oer 18th, 2018. nash was yelling at her and at moments l he started beating her and taking off her clothes before touching her sexually. on the witness stand the girlfriend said she was screaming. that when patricio salazar, a good samaritan, tried to help

r and salazar ease head was beat into the ground by nash and in a shocking admission nash's girlfriend says he doesn't seea s as a hero and that he should never have intervened. the court also heard from bradley flood. he's the man who came running to the scene after hearing a woman scream. flood testified that he tried helpintu salazar by ing him on to her back and minutes later salaza stopped breathing. the defense tried pointing out that it's possible salazar died from a punctured lung, something that happened when flood turned him over. the defense attorneys also questioned the suspect's girlfriend about posts she made on facebook hours after the crime comi to nash's defense by saying he has a mental illness and that demons were harassing him. and nash showed no emotion inou c today. his family seated just behind him. we asked them for a commentut they declined. back to you. >> meagan fitzgerald live for us

i-66 in virginia and michael carter jng. died after hit an x-lite on maryland's eastern shore. maryland, virginia, and 14 other states are now the process of replacing x-lite. back in tennessee steve sorts through these thousands of pages he's collected through public records requests and online research. the tennessee department of transportation says t x-lite functioned properly in haniyeh's cra, something this father doesn't accept based on what he'se discoverd. he's particularly bothered by e-mails he found that showed the federal highway administration was aware of concerns about the x-lite before his daughterdied. >> i have federal highway talking aboutrd extrary x-lite images. >> reporter: you're looking at those extraordinary images and we obtained them through the freedom of information act and they show six different crash scenes in missouri where x-lites

vere hit. >> reporter: i ha them meeting twice in may of 2016 and june of 2016 and discussing these concerns. >> just a few months after those meetings, federal highway sent this email to one of its field offices, flagging potential problems. >> it says have caltranz check with missouri d.o.t. before they use x-lite. they knew this was an issue. >> reporter: e-mails from transportation offic detail concerns about the guardrail. >> here's an email from the georgia d.o.t. they said we have so issues with performance. >> reporter: in this email the rhode island d.o.t. describes, u ote, quality concerns, and this one from arizona menons constructability challenges, but steve says the mosttroubling discovery he's made isn't in all of these papers on its kitchen table, it's out here on the road. >> they have increase it had by about 50%. >> he believes t x-lite

guardrail that lines our highways today are nothe same product that passed crash tests durdevelopments. >> what we had was the head was thicker. we have this part here is not a. wid these are longer and more narrow. this bolt has been three different sizes. >> reporter: so how did steve discover the differences? he sply compared his measurements to specifications provided by the manufacturer in this crash test report. he says he's found dozens of changes. >> and they were having performance issues, and i they just -- and installation issues and multiple issues all the way down, so we've basically changed irtually every part on the system. >> kind of on the fly. >> on the fly. >> we were just let's try this, can try that, maybe w make it a little better. >> reporter: we asked the maker of the x-lite lindsey transportation solutions about the changes and whether they have run new crash tests they didn't answer our questions and declined an on-camera

inerview citing steve's wrongful death lawsuit, but they did send us a statement reading highway al administration has examined and re-examined the x-lite and its in-service performance and has gathered input from state departments of transportation across the country. the federal highway evaluations the x-lites have performed consistency with other terminals and highways. >> reporter: there's limited information about how specific guardrails perform in crashes. they depend on states for that kind of data, and up until a f years ago most weren't even collecting it. the only hard numbers that the federal highway has to go on is from a pilot proam that it launched in 2015 which looked at about00 crashes involving several different types of

guardrails. back at the family home steve says he'll continue to fight until every state removes the x-lites that are on the road. >> for some reap i feel like this is my responsibility tosee it through. >> reporter: melissa say she will continue to support her husband's mission, and she thinks their daughter hannah would be so proud. >> i would like to think that he's pleased and very proud of her dead. >> reporter: and steve is goingi to keep p states to remove these guardrailsecause the decision is ultimately theirs. as far as changes to the x-lite, the manufacturer was allowed to make modificationsrior to 2015, but, again, since company is notom cmenting on the changes tt steve has found, we don't know exactly when they t made or why.

we saw and the humidity has been a big factor. earlier today, i mean, right now it's 97. the heat index around fredericksburg. earlier it was 101 in fredericksburg. 92 degrees is what i saw for the high temperature and high heat index in and around the d.c. area. you'll notice the rain-cooled air back down to 74 in culpepper. heat and humidity will be big factors over the next couple of days, guys. look at this heat. 91 tomorrow and 93 on wednesday and 94 on thursday and 96 degrees on friday. i think the hottest of those thursday and friday will have a heat index of around 100 d and that heat remains. we've not seen much in the way of asoheat wave far this season and it looks like this will be an extended heat wave kend. on through the we 16 on saturday and 95 on sunday. hot and humid with an isolated chance of storms most of the next couple of days of the plenty of sunshine with that heat and then we see another chance and potential heat wave next week as well into tuesday and wednesday so one thing we've not seen a whole lot of has been the heat.

going nto the district? something the agency is studying. here's the main reason they are studying this. the current tunnel between rosslyn and d.c. can onlyle hand a set number of trains per hour and with the blue, orange and silver lines all trying to cram through the tunnel, it's known as the worst traffic choke point along the metro system. take a look at this map of a potential new route for the blue line. a second line allows the route to split off and have stops in places like georgetown, west end, thomas circle, even station.ay to union india booker walking across the key bridge from georgetown to rosslyn. she would love to have a new georgetown metro station. >> that would be perfect as well, yes. there should be a stop there, definitely. and the study will take about two yers and make n mistake. a new tunnel could cost billions but ulme say it wobe better than the current setup. >> of course i'm upset, you know. it's not easy for me.
