citing virginia case law - finch noted the - quote - "difficulty in seating the jury".. and the fact that a large percentage of jurors had knowledge or connections to the case beforehand weighed heavily in his decision that white receive a fair trial. after the ruling.. prosecutor mike fleenor asked for a bench trial. white and her attorneys agreed. prosecutors expect to bring in some 20 witnesses to testify at today's trial which begins at 9 this morning. stick with abc 13 for updates on this case. 3 3 3 mona tight new this morning... danville police are investigating a robbery that happened at the golden coral on holt garrison parkway.. they say they responed to a call last night that the business's parking lot. there they found two pittsylvania county residents said that a man pointed a gun at them and demanded money and then ran away. police are looking for the suspect. 3 3 3 bundle up today as we're waking up to morning lows in the teens with wind chill values in the teens and single digits to near zero. thursday will be sunny and breezy with continued cold temperatures. highs will only reach near 30

controversial bill to cut off funding for planned parenthood programs on aids and domestic violence, has passed...kasich says he will sign it. lz abc n, w.3 3 pattie box in richmond.. the house has approved 3 bills that would allow more concealed-weapon permit holders to legally carry guns in the state. the approval came despite heavy criticsm from a national gun control group. the legislation would expand the number of concealed handgun permit reciprocity agreements virginia has with other states. that would allow more out-of-state permit holders to legally carry guns in virginia. it would also prohibit people subject to protective orders from carrying firearms.. and require police presence at gun shows for voluntary backgroud checks. 3 mona the james river association says.. it's going to legally challenge a state permit allowing millions of gallons of coal ash wastewater into the river. the southern environmental law

they will move forward with a court appeal of a permit issued last month by the state water control board. dominion virginia power is seeking to discharge 350- million gallons of wastewater into the james.. from the bremo power station in fluvanna county. dominion is discharging the water as it works to close coal ash impoundments at power plants. 3 pattie tight the national institute of allergy and infectious diseases and the cdc say they're doing everything they can to keep people informed about the zika virus. yesterday's hearing on capitol hill came as researchers in brazil say the mosquito-borne virus may be linked to eye abnormalities in babies. the world health organization declared a public health emergency over the virus. the declaration came amid increased reports of birth defects and a serious neurological condition that could be linked to the virus. and accurate data."pattie tight the w-h-o estimates as many as three to four million people across the americas will be infected with the virus over the next year. 3 3 mona tight the zika virus is one the latest emerging mosquito borne threats. we've seen west nile and chikungunya... now zika. researchers at virginia tech have long studied flaviviruses -- that's the family of viruses the zika virus belongs to they look at how the virus can get past the mosquito's immune system and the human immune system. the flavivirus family also includes other important pathogens, such as west nile virus and yellow fever. now virginia tech reports they will begin work on the zika virus. reserachers say the development of a vaccine is paramount to resolving the current public health crisis. however, they are also exploring new strategies for vector control -- such as spraying. 3 pattie he's only 7, and has a lengthy battle with

just a few weeks since the diagnosis-- and seven year old milan has already had two surgeries. mona doctors discovered a golf-ball sized tumor on his brain in january. his mother says they're thankful they discovered it in time. katie brooke reports. 3 a normal afternoon in january for malaka payne quickly became horrifying. she says her son fell asleep in the car and wouldn't wake up. (:04)malaka payne, milan's mom, "he was very disoriented, very spaced out." once she got him up and into the house he fell and she knew something was very wrong. (:03)malaka payne, milan's mom, "we left immediately and went to the er." 12 days in the hospital and an mri showed a tumor on milan's brain. two surgeries later.. doctors drained a lot of fluid. (:05)malaka payne, milan's mom, "i was so scared the whole time cause they told me what could happen." the next step for the 7 year old.. a month of radiation and four months of chemotherapy. malaka payne graduated in august from sylvan mellou

she's now a stylist in forest, but had to take a break since her son got sick. keena wood, admissions director, "she's done a great job here supporting our organization and going out and representing our school very well and we want to supportther in her time of need." so they're hosting a cut-a-thon. 5 dollar hair cuts with all proceeds going to malaka and milan. 3 a sad day for our area.... allen huddleston, the last of the bedford boys, passed away yesterday.mona huddelston was 97. marissa parra spoke with one of his best friends. 3 robert key says allen huddleston was like a brother. robert key, allen huddleston's best friend: "he was just a good friend and a good man. he they'd been friends since 1946 -- meeting through the military.robert key, allen huddleston's best friend: "i went with a brother into bedford to join up with company a. and that's when we would meet allen huddleston at company a." he says allen was an avid photographer. best friend: "he had his own photo shop down on west main."3 allen ended up going to serve in world war ii. but -- allen suffered a broken ankle that kept him from the beaches of normandy on d-day. robert key, allen huddleston's best friend: "he said well, if i hadn't broke my ankle two weeks before d-day, i would probably lost my life on the

danville has some tips - like-- shut off your lights when you don't need them. turn down the thermostat by a degree or two. and don't run the dishwasher or do laundry between 7 and 10 am, the highest usage hours. 3 mona tight this morning a shocking new development about a reported armed robbery on a community college campus. danville police say..that a danville community college student's report that he had been a victim of an armed robbery.. was fake. they have now charged 18-year-old jov hall with filing a false police report. police say hall reported the robbery took place on south main street and kemper road. hall was arrested.. but is now out on bond. 3 pattie two former employees of the bedford country club are under investigation for allegedly embezzling money. now we are getting a look at the search warrants concerning the investigation.mona according to these search warrants, michael thompson worked at the bedford country club as a golf professional.. and his live-in girlfriend, michelle clark, was a club attendant who was responsible for working the snack bar, the pro shop, and guest services. documents

the day-to-day finances of the club... and that there were several inconsistencies...like club membership dues not applied to members' accounts, cash withdrawn from the club's debit card, and little or no cash deposited in snack bar records.pattie investigators also reported that thompson was charged with reporting income and expenses to the bookkeeper for club records.mona the board of directors president, sam hodges would not tell us how much money is missing but says the club is "doing well" and that they are "moving on." the case is still under investigation. 3 pattie tight a man convicted of sexual assault three years ago will now serve a reduced sentence. the commonwealth attorney's office in bedford county says howard witcher will now serve six-months in prison after a witness recanted their testimony. witcher was originally sentenced to two years behind bars in 20-14. he was found guilty of indecent liberties with a minor and sexual battery after police say he sexually assaulted a 12-year-old girl in 20-12. witcher will still have to register as a sex offender.

stunning medical error. a new mom says.. she thought her newborn was being taken for a routine check up.. but instead was taken into surgery. when they brought the baby back.. the parents say.. they learned there was a terrible mistake. a doctor had performed a surgical procedure meant for a different child. sot jennifer melton / motherat that point i began to cry hysterically. // essentially they took our child who was 100 percent healthy // and just took him out of the nursery and cut his mouth. mona medical records show it was a "frenectomy" .. where they cut underneath the tongue so it moves better for children having trouble nursing. in a statement, the hospital says it can't comment on the case due to privacy laws. the family's lawyer says.. the doctor did apologize.. but that the hospital still billed them for the procedure. 3 3 pattie box today area students will get involved donating blood. lynchburg city schools has partnered with the american red cross. right now this is for students at e.c. glass high school and heritage. the idea is to give students the

next generation of entrepreneurs. students at george washington high school are creating a company.. and must convince their classmates to buy their product. it's part of a virtual enterprise class, so it's all make treating it as if it's the real thing- everything from coming up with the business plan, to shooting a commercial. it's practice for their future careers.
