at this hour, state police have reopened part of route 130 following a two car crash in madison heights. thank you for joining us on 13 news midday. this is what the scene looked like around 9:45 this morning. police say the driver of this blue jeep crossed over the center line and hit a car going in the opposite direction. both lanes were temporary closed as police cleared the scenes. the driver was cited for reckless driving while two other people in the other car treated for minor injuries. the uber driver accused in a deadly shooting spree in michigan set to face a judge today. investigators will not say what set him off. we are hearing from the passengers he picked up in between hits. latest. >> reporter: six people dead. two others injured.

so far, no motive. according to police, the mayhem in michigan started shortly before 6:00 saturday evening in the residential complex. a woman was shot several times. she survived. about four hours later, the car dealership parking lot, father and son shot and killed. minutes later, outside the cracker barrel restaurant, five people shot, four died including retired teacher mary jo nigh. jason dalton taken into custody without incident. police are looking for reports. this man who asked to remain anonymous said he was one of dalton's customers during the rampage.>> i joked with him and said, you are not the shooter are you? he said, no. tired.

id law in federal court. the lawyers for the state democratic party will argue the law is unconstitutional. democrats filed a lawsuit last year challenging the 2013 law requiring voters to show photo identification at the polls. they claim it illegally depresses minority voting. more than 30 states have some sort of voter id requirement and lawsuits pending in several states. virginia lawmakers considering a bill that would penalize people who falsely claim to have service dogs. the bill hopes to restore the credibility to service animals. other states like maine, arizona, hawaii, and york, are considering similar bills. some lawmakers want to weed out the fakers by giving people with disabilities the option of obtaining a state issued card. the battle between the fbi and apple has taken a turn. the fbi says they believe the san bernardino shooters phone has critical clothes, but apple has yet to budge. >> reporter: a new plea and iphone battle hitting security against privacy.

the fbi director writes, we don't want to break anyone's encryption or set a master key loose on the land; i hope topol people take the time to understand that. director james comey defends his agencies demand the apple help them open the iphone belonging to syed farook, the shooter in san bernardino who along with his wife killed 14 people. the fbi said his phone may have critical additional clues in the investigation including whether others were involved. we cannot look for survivors in the eye, nor ourselves in the mirror if we don't follow this lead writes comey and a new blog post. apple is also working to rally public opinion taking to the airways. >> there's no limit to what the government could require apple to do if it succeeds this way. >> reporter: attorney ted olson, a former senior justice department official his wife

the suit is the most recent of a 2005 federal law designed to protect on makers from liability when their guns are used in crimes. the passage of the protection of law an crimes, nearly every such suit against gunmakers has been dismissed. we have all seen those videos. now, officials are making bold moves to regulate the popular hoverboards including a possible recall.

warning about hoverboards. their one of the hottest gifts, but officials are now saying no hoverboard is certified as safe. they are talking a possible recall. abc has what you need to know. >> reporter: ,the hottest gift be headed toward extinction? this morning, major retailers responded to the consumer product safety commission stunning announcement that no hoverboard is certified as safe and they are out there in droves. at one point, ebay said it was selling a hoverboard every 12 seconds. we also those videos, dozens of injuries from coast-to-coast. and those fires. they say 52 hoverboard fires in over 24 states totaling some $2 million in damages.this home burned to the ground after a hoverboard went up in flames. some blaming those lithium ion

still, no firm proof. >> is irresponsible for a company to continue to sell hoverboards that they know do not comply with the standards. >> reporter: the cpsc telling retailers hoverboards on the market could be subject to recall and consumer should ask already sold. if the boards are not certified as safetoys "r" us taking hoverboards off their website. amazon offering full refunds. overstock stopping all sales. and mega bus full of passengers goes up in flames and then explodes on a highway. >> it was really scary. >> mona: the bus was headed from chicago to minneapolis. the driver pulled over on the side of the road and just minutes after the 40 people on board got off the bus caught fire. panicked passengers watching as their belongings went up in flames.

cloudy and cool the forecast you can count on from abc 13 weather experts. good afternoon. just about 12:15. it has been a cloudy day. a live view of our tower cam. we have seen a little fog out there. pinpoint doppler radar is quiet. i'm not seeing any shower activity. they see a little light drizzle. only 20 percent chance. the story is a cloud cover and cool temperatures. 46 still in lynchburg.

44 in blacksburg. 48 in martinsville. 50 in danville. temperatures warm up a couple more degrees with a wedge of high pressure. cloudy and cool. wind goes clockwise around the high. that is where the wind is out of the northeast at about 5 to 10 miles per hour. you can see the southeast unsettled weather. we had the cold front stalled to our south. a low pressure system will ride along the front. we will see unsettled weather into tuesday in the form of rain. heavy rain arriving wednesday. it means you will need the umbrella and the rain gear through thursday morning. timing everything out on futurecast. we may see light, spotty showers later this evening. the rain will increase as we head throughout the overnight. you may see a few raindrops on your windshield heading home this evening. we will see a lot of rain as you're heading to work and children heading to school tomorrow.

see pockets of heavy rain. we're going to get a break in the action tomorrow afternoon. the clouds will hang tough, but the rain will move out.we will see spotty showers and then soggy through wednesday afternoon. timing this out on futurecast. thunderstorms developing later in the day. temperatures upper 40s, low 50s. all of this will fall as rain. we will have to watch for some of those stronger storms heading into wednesday afternoon. how much rain fall are we talking about? 1 to re-inches. the latest model calling for 1.77 inches in lynchburg. close to 3 inches in martinsville. two in danville. over two in roanoke. the ground is saturated, so we will have to watch for flooding concerns, especially heading into wednesday.

you can see a moderate risk and parts of the gulf coast. a slight risk there. as we head into wednesday, parts of our viewing area, danville, south boston, pittsylvania, halifax, we could see a slight risk. high temperatures this afternoon upper 40s, lower 50s. a couple degrees warmer than where we are right now. seasonably cool with clouds and drizzle. overnight tonight, temperatures dropping into the upper 30s, near 40.widespread rain will develop you will need the umbrella and you have to stay tuned for any severe threats. temperatures in the 40s and 50s. we will dry out thursday. for your weekend, as we look ahead friday, saturday, sunday, mostly sunny. dry and cool. mona, over to you. this mid day, a nightmare hoax has a lot of parents paying attention. a connecticut mom says a photo announcing her sons birth was stolen and was plastered online with a fake story. lindsay janis explains.

the joy the date your first child is born, a moment you will cherish forever. this morning, the very same photo creating a living nightmare for mother karina bennett. >> something i don't believe it times that really happened to me. >> reporter: the photo originally posted was an article on the milford mirror in january 2015 about bennett's son being the first baby born in the new year at the milford hospital in connecticut. the same photo resurfacing wednesday with the very different story. the headline reading, detroit woman gives earth to her 14th child from 14 different fathers on world news daily. the story went viral. bennett was tagged by a former coworker. >> i thought it was a joke. i laughed about it. >> reporter: the article tying bennett and her family's image to the fabricated story of a

as the day wore on and the story spread, he began to take an emotional toll on bennett. >> i started getting more and facebook. people are starting to make comments calling it ugly, fat. those are the comments that started to hurt me a lot. down. i was seeing comments from 30,000 people. >> reporter: according to experts, all photos published are at risk. how do you protect yourself? mark your page as private or watermark your photos. >> if it was him watermarked and copyrighted, people can grab the photo i do what they want. unfortunately, the law has not caught up with technology. new developments in the domestic assault investigation involving nfl quarterback johnny manzella. dallas police are saying they have surveillance video that may help the case. hotel surveillance video
