puddles on the roads. but these gusty winds which today were fairly quiet will be a lot stronger during the day tomorrow. and the combination of intense rain and wind has left a lot of neighborhoods soaked and caused this tree to fall in south charlotte. meteorologist john ahrens is there live with the problems this could cause over night tonight and especially tomorrow. >> reporter: the big concern we have is how waterlogged the trees are. they're trying to clean this one up from earlier today. they got the woodchipper out now. they have to step aside to continue to clean this up. before that i was able to walk around. the trees were so waterlogged. the ground is soaked. and that was from just two inches of rain. tomorrow we add the wind speeds. they could be 50 to 60 miles per hour. earlier today, there was a family inside, three kids, they said it felt like an earthquake ..

now to our other big story tonight, fall out over the vote to expand charlotte's nondiscrimination ordinance to members of the lgbt community. the governor and lawmakers are preparing to fight it. just in the last hour, eyewitness news anchor brittney johnson spoke one on one with governor pat mccrory about what the intervention could involve. she joins us now live from raleigh. >> reporter: the governor told me he can not believe we're discussing this issue today. he's disappointed that the city decided to pass this ordinance despite this warning and as he promised, he said lawmakers working on legislation to reverse the city's decision. after this ordinance failed last night, city leaders voted 7-4 to make it against the law for businesses and taxis to discriminate against gay, lesbian and trans gender people. trans gender people can use the bathroom they choose.

heard from lawmakers, including leaders from mecklenburg county who are ready to reverse the ordinance. they believe charlotte leaders are over stepping boundaries and developing legislation to stop other cities from trying to pass similar laws. >> i think this is city government over reach. and believe me, i've stepped in in the past when i think there's federal government over reach on regulations. state government over reach. and now i'm doing it regarding city government over reach. especially on a privacy matter that impacts all of us. >> reporter: lawmakers told me they have four options including striking the law completely or putting it before the voters in a referendum. now we're going to break down the implications of putting this issue before the voters on eyewitness news at 6:00 and we'll tell you why the governor says he's against going that far. live in raleigh, brittney johnson, channel 9 eyewitness news. the expanded policy does not actually take effect until april.

joe bruno found out that cms and businesses are all ready looking into what those changes mean for them. he continues our team coverage tonight. >> reporter: less than 24 hours after charlotte city council passed a controversial anti discrimination ordinance, major jennifer roberts spoke to the people it directly effects, business owners. >> i think charlotte looks very bright today. >> reporter: the law bans businesses from discriminating against someone based on sexual orientation or gender identity, hundreds packed charlotte city council chambers to voice support or opposition to the bill. it was approved 7-4. >> i think anything that makes charlotte have a welcome -- >> many are troubled about the part that allows you to use the restroom of the gender you identify with. people opposed to the law say

to target children. if businesses don't comply and someone files a complaint, a committee will review it. the penalty is up to a 500- dollar fine and 30 days in jail after three prior convictions. but charlotte city leaders say other cities with similar ordinances don't see a rise in sexual crimes and trespassing indecent exposure laws are still in effect. a spokesperson says they're still reviewing the ordinance. but some parents we spoke with say they're uneasy about the new law. but leaders say it's not about bathrooms, it's about equal rights. and today charlotte looks inclusive. in uptown charlotte, joe bruno, channel 9 eyewitness news. now this is one of our top stories on wsoctv.com and on facebook. you can share this story or comment and read all of our past coverage there. president obama says it's time to close a chapter of our history as he announced plans

center at guantanamo bay. the plan comes seven years after the president made a vow to permanently shut down that prison. he said it drains military resources and it doesn't help in the united states fight against terrorism. >> it's counter productive to the fight against terrorists because they use it as propaganda in their efforts to recruit. >> the plan involves transferring the bulk of remaining de naanees to other countries. the others would be moved to cities in the u.s. one could be the navel brig in south carolina. the fight to keep suspected terrorists out of the state. troopers say the logging truck driver was distracted in the seconds before his truck flipped and killed another driver. darrell bane crossed the center line coming out of a curve yesterday. he over corrected and hit a pickup truck head-on. that driver, robert jones died.

the gazette that they do not believe that bane was texting and driving. but they say he was not paying attention. new at 5:00, a york woman is facing charges accused of showing nude graphic photos and a porn website to two children. detectives say ashley griffin went to see one of the boys at his grandmother's house to tega cay where she showed the photos. she faces display of obscene materials, probation violation, and other charges. new information about somebody shot a suspected intruder in hickory, police arrested brian eckert after he was shot twice. he felt his life was threatened when eckert smashed his way through a rear sliding glass door. police are investigating and they'll forward their findings to the da once all that is done. authorities say a tip led them to a gun at a high school campus in union county.

a 17-year-old and a 16-year-old sitting in a car in piedmont high school's parking lot yesterday. the deputy said he smelled marijuana and found a handgun in the car. both teens were arrested. neither of them go to piedmont high school. new tonight, channel 9 learned that more than 27,000 people timed out a community survey about charlotte mecklenburg's controversial school assignment plan. eyewitness news reporter elsa gillis is live in uptown where the school board plans to move forward with a proposal tonight. elsa? >> reporter: we still don't know if cms got a representative sample of the community with the survey. that's something i'm going to ask board members tonight as they continue the student assignment conversation. tonight the board voting on goals that will guide any student assignment plan they create. they include reduce the number of schools with high concentrations of poor and high needs children, provide school assignment options to students not mealing performance

expected to have steam rolled the other republican presidential candidates in the nevada caucus. trump has dominated the poles there. it's left a fierce battle for second between marco rubio and ted cruz. cruz ousted his national spokesman this week after he put out a video falsely portraying rubio. on the democratic side, voters in columbia south carolina can ask hillary clinton and bernie sanders questions tonight. cnn is hosting a debate at u.n.c at 8:00. a town hall style meetings. sanders will take the stage first. he's ramped up attacks on clinton's credibility since her win in nevada this weekend. with all eyes on this squall line to the southwest, pushing towards us, we're going to look at the damage all ready done and i'll have a future cast to show you what to expect as the line rolls through. drug activity in charlotte mecklenburg schools. problems so bad students are demanding answers. >> this happens so often. >> i dug through three years of records, how your child's school stacks up against others.

puppy is breaking just within the past hour, police just arrested two young teenagers for shooting this six week old puppy 18 times with a bb gun. and then throwing a knife at the dog. investigators say that these arrests are all thanks to tips that have been pouring in from the community. new tonight, eyewitness news reporter angela hong went to the animal hospital where that puppy is recovering tonight. in this six week old

fighter. so far. >> the ebenezer animal hospital named him brody. they say it's a strong name for a strong puppy. >> there's a whole bunch of bb gunshot wounds and amazingly body. >> from his head to tail he's covered in wounds. police say sunday night a maintenance man at these apartments found the puppy bloody and injured. the man saw 15 to 20 kids earlier. >> kids that start out doing this, hurting animals sometimes go on to more violent things. >> reporter: that's why they want to find the kids responsible. >> they need some guidance and help. >> reporter: the doctors here say that the bbs are actually still inside of brody. you can see them on an x-ray. there's 18 of them. they missed major organs. he's too young to go through surgery but all ready people from as far as washington are offering to give him a good home.

dalton stopped in about once a month and bought a tactical jacket hours before the shooting. police say he shot eight people at three different locations, friends say that they're in shock. >> he was very quiet and reserved. not afraid to speak his mind but not out to cause trouble. >> dalton is cooperating but he won't say anything about a possible motive. outside, gloomy sums up the day. steve is tracking more rain headed our way. >> at least it's not raining like it was last night. nothing like that going on in and around the charlotte area. but boy it's cool and raw. mid to upper 40s. 47 if charlotte. university city, harrisburg, matthews, mint hill, out toward waxhaw, gastonia, not a big range in temperatures. even up in the mountains we're around 40 degrees. this wedge of cool moist air

maybe a sprinkle or two through the evening. but not much. temperatures in the upper 40s. the interesting thing about temperatures. we'll get caught in this whirlpool of warm moist air that's from that batch of storms. watch what happens on our future cast with temperatures over night tonight. normally of course as the night goes on our temperatures go down. warmer air will push in. that sets the stage for showers and storms tomorrow. by the time you get up tomorrow morning, temperatures will rise into the 50s. close to 60 the highway 9 corridor. still in the 40s along i-40. statesville and hickory. low 40s across the high country. quite a line of showers and storms to the west. for more on some of the damage that's done, let's head to christine rapp. >> this system that will move our way tomorrow is causing a west in areas to the south. this waterspout occurred north of new orleans earlier this afternoon. it also had to deal with not just tornadoes but strong winds and heavy rain. there's a couple other images

here this afternoon. we are expecting these storms to continue to march to the east. they've been dealing with eight tornado reports alone in eastern louisiana here this afternoon. and as we talk right now, there's still four separate tornado warnings going on right now for louisiana and mississippi. so as these storms continue to move off to the east, we'll continue to bring you the latest images into the news room throughout the rest of our news cast, steve. here's a look at the timing as the storms come rolling in, the morning drive will start out with scattered showers. the main event is moving through the mountains by 8:00 or 9:00 tomorrow morning. by 10:00 a.m., you see a broken line of storms in and around the charlotte area. john talked about this earlier. you're not going to need these powerful storms to produce damaging winds. any one of these heavier showers could produce damaging winds tomorrow. far and away, winds will be the greatest threat. in a situation like this, i can't rule out an isolated tornado. the good news is, this thing is

it's going to haul to the east. by lunch time, it's along the highway 52 corridor. and it's gone during the afternoon. and it's one and done. one line of showers and storms. after that, better weather. here's your temperatures tomorrow, upper 50s at 9:00 a.m. the peek of the event between 10:00 and noon in the charlotte area. off to the east it goes, sunshine back in the afternoon. neighborhood forecast from mooresville, roughly the same time line, late mornings what we're looking at for the peek of the event, showers, gusty thunderstorms, drying out in the afternoon, look how warm it is. well in the 60s. same story in albemarle. warmer weather as we work through wednesday night and thursday, more sunshine for the charlotte area. but how about this, snow showers up across the high country and after tomorrow, we are done with the rain chances right through the weekend. welcome news. five-day forecast, near 70 tomorrow in the charlotte area. a big cool down back back to

a mooresville community is rallying around a beloved family tonight after a fire destroyed their home and killed investigators say a heat lamp was to blame. it was on the porch at the home on wiggins road. eyewitness news reporter ken lemon went there and saw the damage firsthand. >> reporter: this was a blow to the gut. they've lived here for 32 years. it was difficult seeing the house like this. but they say because of the out

friends, they now see a ray of hope. >> you can see what basically what we lost. mark beaver pointed to the white blocks on the refrigerator where he and his wife kept photos. >> things that we lost, we can't get those back. >> reporter: they were burned in the fire that troyed the couple's home. a relative took this picture of what looks like a ball of flames tearing through the house. it started from a heating lamp on the porch, five cats and three dogs died in the fire. rescuers tried in vain to revive one of the cats. he said people came out of nowhere to help the family dig through the ashes and rescues irreplaceable pieces of their lives. >> they come up acting like we've been friends for life. mark helped change a woman's tire last year.

right behind it is this massive system that's causing major damage across the deep south right now. this is livingston parish louisiana where families are dealing with hopes literally ripped apart. i'm allison latos. >> and i'm scott wickersham. steve udelson is tracking the storms. >> it's wasting no time. the leading edge of the heavy storms, about 500 miles to the south and west. in and around the charlotte area, you saw from the tower cam, misty, cloudy, a couple showers detected on live early warning doppler 9. pushing up the i-85 corridor like last night. we'll see rain moving through hov.
