distance, you can see part of the home's roof that blew into it. i just received this photo of jb and naomi newton. they were sleeping when a man driving a truck crossed the center line on east stagecoach trail. he lost control and ran into the house and a propane tank. the home exploded. firefighters got the newtons out of the house. family members tell me they died in the hospital this morning. it's a very tight knit community. all morning we've seen people coming to the house to grieve. the mayor lives across the street from the newtons. there have been three crashes at their house in the past year. the most recent one, a driver lost control and struck naomi newton's car. she asked for help from the state but was told there isn't anything that can be done. >> i truly, truly hate that this has happened. but i hope that the state will see that this is a problem.

learned the driver of the truck's name is thomas pruitt of king's mountain. he was driving in a company truck for martin's electric. ken lemon went to the company to talk to a worker but was locked out of the building. he has nonlife-threatening injuries. joe bruno channel 9 eyewitness news. breaking in south charlotte. a major road just reopened after a serious crash. we have video just into the news room from randolph road. witnesses tell us a semi-truck was crossing five lanes of traffic near construction at sharon amity when that driver crashed into a cadillac. the driver of the cadillac was rushed to the hospital. we have a crew investigating that construction area right now and asked about the potential dangers on this very busy road. we'll have more answers today on eyewitness news at 5:00. following more breaking

past hour, police took an armed man into custody after a stand off. it happened in a community off scott drive. this is near the state line. they were called to a home near the end of the road for a report of a man threatening suicide. police kept our cameras way back while they tried to talk to them. the stand off ended without injuries. in salisbury, firefighters are investigating what caused this fire at a burger king. this is on jake alexander boulevard at lincolnton road. we break you breaking updates this morning. firefighters had to call in extra crews to get this under control. you can see how much damage it caused. no one was hurt. one lane of jake alexander will stay closed until about 4:00 this afternoon. we have breaking developments today in the past 45 minutes. police released the name of the man charged in a deadly hit and

lewis fernando perez rivera faces dwi, felony dead by vehicle and felony hit and run charges. angela hong is live. >> reporter: in the last hourings we learned from cmpd that perez rivera actually called 911 himself to say that his car has been stolen. his van was actually found a quarter mile away from the scene of the accident here. the crash here on central avenue. now the car was found on green apartments. front end damage. channel 9 was the first to report and show you the suspect's car. police found it next to a building where he lived. the crash happened around 2:30 this morning. police say the victim, a man was walking along or on central avenue when he was hit by the car. his body ended up in the

perez rivera left the scene. the victim was pronounced dead. >> if i wasn't involved in the accident, if i saw a person laying there, i'd stop and see what i could do. >> reporter: he came to cmpd headquarters willingly and they charged him with dwi and felony hit and run and felony death by vehicle. and right now we're asking more details from police. we found out they're still searching for the victim's family this afternoon. we'll have a lot more on this story later on tonight at 5:30. in east charlotte, angela hong, channel 9 eyewitness news. >> channel 9 has calls into the education. so far we know a meeting this morning dealt with a confidential personnel matter. we asked if it relates to the

charges. she's the president of a company that employed a sales executive from lenovo that had district. tomorrow three men are set to face a judge accused of firing up to 50 shots in the middle of uptown charlotte while the city tournament. so you remember.

had a ak 47 nd a handgun. the shootings weren't random but police aren't saying more than that. they hit a van on caldwell street. some bullets hit a red car. and we're told two women were in the car. neither of them were hit. other bullets hit the building and shattered the glass in front of the building that houses a hyatt hotel. i spoke with a, concierge who was on duty there. >> something like that just doesn't -- i just -- i hit the floor real fast. >> reporter: he told me he spoke with a young man who claimed he was probably the

oil prices are up too. but global stocks are also coming down. we'll keep an eye on that for you throughout the day. just in the past few hours a virginia man faced a judge accused of killing a rookie police officer on her first day on the job. ronald hamilton is in jail without bond this day. on friday he killed officer ashley. she was a marine core reservist and interned in 2011. >> she shared with us that she felt like she still wanted to do this job. she couldn't get it out of her blood. >> hamilton killed his wife and shot two other officers. they're expected to recover. prosecutors said they'll likely seek the death penalty in this case. kannapolis police are working with the district attorney to decide whether or not to file charges after a road rage incident. police released the names of

robert andrews shot ryan baret on orphanage road yesterday. baret is in critical condition. police need to conduct more interviews before deciding on possible charges. a heads up for drivers in iredell county today. part of a mooresville road the closed. crews shut down statesville avenue between east center street and carpenter avenue. they're working on a water line. it's expected to reopen sometime tomorrow. so many voters will take to

of the highest points in the mountain. >> they were not bouldering or doing anything technical. they were scrambling around on the rocks trying to get photographs. >> the man was air lifted to the hospital with serious injuries. new at noon, people using the women infants and children program will soon have an easier time buying groceries. the agriculture department will require states to transition from paper vouchers to electronic cards. it's the same type of ebt cards that food stamp recipients use. half the nation's infants benefit from wicc. lots of sunshine. temperatures warming up. keith monday is here with more on that. >> it's warmer than it was throughout the day yesterday. we started with warm temps this morning. that gave us a good base to start with. it's beautiful. lots of sunshine. a few fair weather clouds through the afternoon. we have a weak cold front pushing through today. hardly noticeable. except for tonight when we cool back down.

and the last couple weeks, warmer temperatures are bringing up more of the tree pollen getting into the high category. the cedar, the elm, oak trees the culprit so far. allergy season has begun. and we have a long time to go before we can say this is winding down. we're headed into the season of the yellow cake of pollen everywhere. temperatures, look at this. mid to upper 60s for everybody east of the mountains. we're approaching 70 degrees. cloud cover in the mountains is long gone. now still very windy in the high country. gusting over 40 miles per hour. winds gust between 20 to 25 for the afternoon. sustained winds between 10 and 15. these ease this afternoon. once we cool down tonight, or when the wind eases up, things cool down into this evening. the evening outlook, just beautiful. get the grills fired up here. it looks fantastic.

low 60s by 8:00. we fall back in the low to mid 50s by 11:00. 40 over night tonight. crystal clear sky our way tonight and through tomorrow morning. mid to late tomorrow, clouds roll in. a couple light showers in the afternoon mainly west. by tomorrow evening, expecting a good line of thunderstorms coming into the mountains here. not quite severe levels but heavy rain and brief gusty winds. passing through charlotte between 8:00 and 10:00 tomorrow evening. likely after the commute tomorrow which is good timing. it bodes well for the lack of severe weather risk. by wednesday, it's long gone, but it sets the stage for cooler temperatures for the rest of the week. the five-day forecast, the weekend always in view, rumbles of thunder tomorrow evening clear out quickly into wednesday, we cool things back down, low 50s here by thursday, another rain chance building up. that should now move out early

president obama awarded a navy seal with the nation's highest military honor. edward brewers jr. is the first living active duty member of the navy to receive that award in four decades. eyewitness news reporter jacqueline fell explains the chief's brave actions in a life saving hostage rescue. >> reporter: navy seal edward byers was part of a team that rescued an american doctor kidnapped by the taliban. >> the mission that night was a hostage rescue mission. to us, that's a no fail mission. our objective, our goal is to bring back an american hostage alive. >> the president awarded byers the honor at a ceremony this morning at the white house.

unit that killed osama binladen. the rescue took place in 2012. the american doctor was held hostage for four days. he was the second seal to burst into the taliban hide out to free the doctor. the first seal inside was killed. today's ceremony, a bit uncomfortable for byers who typically operates in the shadows, not the national spotlight. >> it's defined by a deep sense of humility. he doesn't seek the spotlight. he shuns it. he's the consummate professional. >> he's the first to receive the metal of honor since the vietnam war. in washington, jacqueline fell, channel 9 eyewitness news. byers also served as a core man with the second marine division at camp lejeune before he went to the navy seal training camp. banks are fighting back
