if you are hitting the interstates from -- china grove southbound to concord, from 152 to nc 73 average speed is 66 miles per hour. that will take about 11 minutes. john? i'm in the breaking news center following two stories. first overnight we have learned new details about a deadly double shooting at a hickory mcdonald's. this is the man, eric yount behind bars. he will face a judge today. he is charged with murder and attempted murder. police say just before 6:00 last night he shot mcdonald's managers in the restaurant parking lot on highway 321. one died at the seen. watts is in critical condition. witnesses tell us he was driving when the gunman started firing shots near the play area. >> my chest was hurting. i pulled over here. it's a crazy world that we live in. >> police believe the shooting

we are working to find out the relationship between the victims and suspect. in caldwell county a man is in custody accused in a stabbing that left a mother and her child with serious injuries. overnight we learned it may have stemmed from a domestic incident. this is the vote that dave faherty sent us along fairway acres drive. investigators say the suspect stabbed a woman inside of her home. they say a toddler was injured and airlifted to the hospital. investigators say they were checking a younger child at the scene for possible injuries. throughout the morning on daybreak, channel 9 will push for more information about both of these breaking news stories. we will bring you new developments as we get them on air and online at wsoctv.com. a company connected to the

for bankruptcy. joe bruno is live on i-77 in corn knee use to explain the situation. >> reporter: the governor ordered a review of the contract. the order comes after a company that build an austin, texas, toll road declared bankruptcy. that company falls under sentra, the same company that overseas the mobility partners. head of the ncdot is flying to texas monday to meet with that state's transportation leader to talk about legal and financial options with i-77's contract. on tuesday, i uncovered how much money the i-77 mobility partners are expected to make from tolls. $5.1million in 2018 and when the highway opens $24.6 million in 2019.

77 will end up in a similar situation to what is happening in central texas, renewing the call for ncdot to get out of the call. >> we should cancel the contract now. we shouldn't be doing business with a company that has a track record of failure. >> reporter: dot secretary says the governor has directed us to immediately review every available option both legal and financial to reassess the i-77 mobility partners business model and current contract. they said, quote, the current contract protects taxpayers from financial losses. this isn't the first central highway to go bankrupt. a similar project being run in indiana went bank result in september of 2014. joe bruno, channel 9 eyewitness news. >> count on channel 9 to keep digging for impacts this could have on knowles charlotte.

they expect to charge a driver that caused a crash. police have not identified the 18-year-old driver. he was speeding when he lost control and crashed into the woods. 15-year-old evan chay died in the back seat. she was one of three students in the car. >> when you needed somebody, you went to him. when you were upset you go to him. >> the two other students in the car were seriously injured. police expect to charge the driver when they are released from the hospital. the family of a hit and run suspect hired an attorney after this video was seen showing a officer punching him repeatedly. >> angela hong is live outside of headquarters. the mother wants to see the body cam video. >> john, that's right. malcolm elliott's mother does not condone her son's behavior

saw in the video. we first showed you this cell phone video tuesday. it shows seven officers trying to arrest elliott after a hit and run crash. one officer hits him with closed fists several times while he is on the ground. channel 9 is the only station hospital yesterday. he didn't say much to us but his family has hired a lawyer. his mother wants to see the body camera footage. it's not available to the public because it's part of the investigation. >> it didn't take that many police officers to apprehend my son because my son is tall and he is very small, very skinny. >> rodney moore is looking into drafting a wall that would require more transparency when it comes to police body cameras. we reached out to city leaders and cmpd. they are not commenting until the internal investigation is complete. in the next 30 minutes, hear

bring hundreds of residents and jobs to the catawba river area. they want 150 condos, 150 apartments and hotel and office space on cherry road. construction could start this year. new this morning, north carolina state environmental regulators will hold a public hearing on an asphalt plant. we told you the county planning director revoked the permit for the plan on highway 421. last month the adjustment board overturned the decision. people that want to speak have to register. it begins at 6:00 on west king street in boone. new information in the search of malaysia flight 370 that disappeared two years ago. officials say they found a piece of the wreckage from a boeing 777 likely belonging to flight 370. an aviation source told cnn

an armed robbery in the charlotte. a live look at the scenes. crews just got there 7-eleven. you can see it's an active scene. likely interviewing the clerk inside. here is what we know at this point. police tell us four people went in there before 4:00 this morning. ago. two people went in the store and they robbed the clerk at gunpoint. the good news here, no one was hurt. officers say the suspects then drove around the corner. while they sat there, a police dog tracked them down. police say one of the suspects is 15 years old. we are getting video of the suspects in custody right now. we are working to get that turned around for you in the next half hour. but apparently they have caught their suspects and they are still investigating. this morning we are pushing police for the names of two

shooting at a south end shopping center. >> a witness said it was a chaotic scene on south boulevard. it happened near a popular bar in the shopping center. a bartender said he knew something wasn't right when he saw what appeared to be a group of men in a bar waiting for a man that walked in. the bartender said minutes later he heard gunshots coming from the parking lot. >> after like the fourth or fifth shot and the kids were running across the parking lot. >> from chopper 9 sky zoom you can see markings throughout the parking lot. police told us two suspects are in custody but would not release names or charges. the man accused in a deadly shooting in north charlotte more than a year ago is scheduled for a plea hearing. police arrested johnny young. they say he shot and killed a man on julia avenue and injured a woman. today marks 25 years since the incident that prompted the los angeles riots.

recorded video of police beating rodney king in l.a. king lead officers on a high- speed chase after a dui traffic stop. then they stopped him and he lurched at one of the officers. a taser didn't stop him and officers beat him with a baton. the officers were acquitted and that set off the riots. we are learning details about video that shows a baltimore police officer slapping a teen. take a look. you can see the officer slap him three times then kick him as he walks away. the baltimore sun reports the officers were responding tuesday to a report of two intruders at this school. there is dispute about whether the teen is a student. his friend is the one that recorded the video. city schools say this is a criminal investigation.

encouraging voters to say yes to a bond mess stir. if approved the college would get over $7 million. the school would use 3 million to renovate campus buildings and another on the fire training facility. the schools cabarrus county facilities would get three million dollars. piles of rubble remain as some north carolina residents try to rebuild after an ef-3 tornado rolled through. they are working to save any memories possible. >> i came home and look at this. they are great people. >> nearly 100 volunteers showed up to help yesterday as residents have a long way to go in the cleanup process. it's quiet here but cool. weather and traffic every ten minutes. here is keith monday. >> 30 in the con cords.

the mountains and high clouds spill in it will likely cap the drop in temperatures. it may not go down much more from where it is now but cold enough. 30s by 9:00. sunshine mixed with the thin clouds early in the day. clouds will thicken up quickly into the afternoon. 40s by midday. we are dry. by 4:00 light rain will work in from the west. highs at 51. we might 54 yesterday afternoon. we will start to fall a little further down the scale today as the rain chance builds in. we will be dry to start out. if you are aware from home all day long, take the umbrellas with you. rain chances build in with clouds thickening up by 3:00. still dry but 5:00, 6:00 light showers. by 8:00 most of us have rain and the mountains, you have the snow to deal with. that will be with you for a good chunk of the night as we

you may get a few flakes around taylorville working to the predawn hours of the morning. light rain in charlotte. that shifts out about time for the morning drive. you may wake up with wet roads. by 8:00 the sun is working back in. the mountain snow is beginning to wrap up. i don't see any big threats with this coming through. low risk for any heavy rainfall. quarter inch, maybe half inch in a spot or two. little to no chance of lightning. low end risk for winds. severe weather threat kept down. in the mountains, another 1 to 3-inch snowfall. we dry things out quickly for friday. sunshine returns. the weekends looks spectacular with the temperatures back in the low 60s by sunday. i will touch more on this in the next half hour. more significant warm up likely coming the middle of next week. temperatures go up to the mid- 50s tomorrow.

new inside into what officers think might have lead to a deadly officer shooting christmas eve. prosecutors said the man, an off duty cmp officer shot and killed may have brought a gun to the mall to avenge a shooting that paralyzed his brother. this is video from christmas eve when thomas ferguson shot and killed a man after investigators say westbrook fired in the mall. westbrook was preparing to shoot at someone from a rival street gang.

ten berry, the suspect involved in this shooting on the brookshire freeway last move. that paralyzed westbrook's brother and left another man seriously injured. it was revealed during the bond hearing yesterday. he is charged with two counts of attempted first-degree murder and still in jail this morning. people are able to access criminal records across north carolina thanks to a new modernized search system. the upgrade began in november and running in all 100 counties including mecklenburg. it offers a quicker search and costs about $1.2 million to complete. the iredell sheriff's office closed down part of the crime lab because it costs too much money to keep the chemical analysis portion open. now the sheriff says they will let a private lab handle blood analysis and testing. south carolina lawmakers

73 to jump on 85 alternate route. south from 29 dale earnhardt boulevard back to 85 to get around that are which should be wrapping up. on the other end of 85 from gastonia, we are checking conditions in gastonia near new hope road from 321. a quiet road. cleveland county in towards kings mountain and making the way to here, too early for slowdowns as well. channel 9 is following stories for your day ahead. >> in a few hours voters across north carolina will cast ballots for the presidential primary. joe bruno is live in cornelius. voters have to show an i.d. when they cast a ballot. >> yeah. voters in north carolina have to show a driver's license or a government issued i.d. if they want to vote. if you don't have one of those you are not completely out of luck. we spoke to the state board of

without an i.d. can vote with a provisional ballot or absentee. early voting starts to march 12. same day registration is allowed during the early voting period. unaffiliated can vote in either primary. you can vote in the presidential race, u.s. senate and state legislature but not senate races. there will be a primary in june due to the new congressional districts. >> after this election, we will start a new campaign. we will focus on the next primary out there. so, let's not lose sight of march 15th. >> reporter: also on the ballot, two billion dollars bond referendum if approved would deliver money across the state. the primary actually voting is on march 15th.

joe bruno, channel 9 eyewitness news. the four remaining republicans running for president will be in the first debate since donald trump had a big win in super tuesday. he won seven states despite criticism in his party. ted cruz took three states and marco rubio took one. ben carson will not participate in the debate seeing no political path forward. we will speak about his political future tomorrow. former candidate lindsey graham says trump is not a real republican and doesn't trust him. he dropped out of the presidential race in december. >> we need the party to come together and see if we can find an alternative to mr. trump, a more reliable republican. >> today former republican candidate mitt romney plans to hold a high profile speech in which he is expected to criticize trump.

air and on the news page at wsoctv channel 9. channel 9 went to a federal prosecutor about whether this video of a cmp officer is an example of excessive force. police and city leaders are tight lipped about the investigation. angela hong is live outside of headquarters to explain what the expert told us. >> john, former fbi agent and federal prosecutor clinton williams says the video is controversial but it's too difficult to tell if it's an example of excessive force. in the video you can see seven police officers surrounding malcolm elliott trying to arrest him for a hit and run. one officer repeatedly punches elliott with closed fists and they must conduct interviews with the officers that were around and witnesses to see what was going on as the

williams -- williams says the body camera footage will be important. >> police officers are trained to defend themselves. if a police officer is getting punched then for them to fight back is okay. if somebody is being restrained and they are restrained, there is no need to come to blows with them. >> channel 9 asked to see the video but it can't be made public yet because it's a part of the investigation. they have not released the name of the officer in the video. in the next 30 minutes, hear what malcolm elliott's family has to say about what they saw in the video and what they will do about it. angela hong, channel 9 eyewitness news. new this morning, a south carolina bill could require children to ride in child safety seats and stay in the back seat a lot longer. the statehouse of representatives subcommittee heard the bill yesterday.

in rear facing car seats until they are two years old instead of one under the current law right now. they would have to use forward facing child seats or booster seats until they are 8 instead of 6. the biggest change, children have to ride in the back seat until they are 13 instead of 6 currently. a columbia pediatrician told the house subcommittee remaining in the rear seat reduces the risk of serious injury by 70%. state representative walt mccloud said it's crazy to have someone sit in the back seat until they are 13 but two years later be able to get a driver's permit. governor halley wants a statewide evaluation on how local government impacts businesses. she says this will point out best practices and opportunities for improvement.

today a crisis team at a lancaster elementary school to help children cope with the loss of a classmate. >> an 8-year-old was riding his bike when he collided with a car. officials say he was not wearing a helmet and taken to cmc but died yesterday morning. he was a second grader at harrisburg, elementary. >> any time you get news like this, you hope it's not coming in your backyard. >> the boy's mother said she spoke to the driver who is not facing charges right now. she said the driver is having a difficult time dealing with this crash. cmpd hopes a photo will help identify a woman found dead nearly five years ago. detectives worked with anniversary throw polo give artist to create this sketch who was found in march of 2011. she is possibly white or hispanic between the ages of 20 and 30.

shoes and shirt when her body was found. police say they are still investigating this case. the department of justice is promising lawmakers they will be allowed to review policies to see if the irs is tracking cell phones. lawmakers pressed for answers about why they are using stingray technology. the systems work like cell phone towers collecting data on every cell phone user within a certain radius. we told you in october lawmakers wanted answers about the technology and are growing frustrated they aren't getting them. >> the irs owns them. we don't know what they are used for. to my knowledge they have not released public policy governing how they have been used. >> only two chairmen of the house oversight committee will be allowed to review their policies and with many restrictions. the pentagon is look for hackers to break into the military network in hopes of testing vulnerabilities.

that have to go through a thorough background check. the pentagon's most sensitive networks will not be part of the program which kicks off next month. a north carolina county is using a private company to survey landslides in the area after the state cut the funding in 2011. jackson county officials hired a company to survey that county this month. over the next year it will look like landslides from areas and map the findings out. one of the consultants says landslides cause thousands of dollars in damage in north carolina every year. weather ant traffic every ten minutes. a lot of folks at or below freezing. >> a little shock. temperatures near freezing for everybody around charlotte. the cold north flow of wind holding us to 50s in the afternoon. now the culmination of the cold this morning.

weeks. i am in the breaking news center this morning monitoring the latest developments in an armed robbery we told you about 30 minutes ago. several police officers on the scene at this 7-eleven at sharon amity in southeast charlotte. police are wrapping up the investigation. i want to show you new video that we got of the officers taking the suspects into custody. one has a gray hoodie, one a black hoodie and one in a t- shirt. police arrested four suspects. one of them is 15.

blushed the faces of all the suspects. police say two people robbed the 7-eleven at gunpoint around 4:00. two others were waiting in a car. no one was hurt. after the robbery, officers say the suspects just took off around the corner. while they were there a police dog tracked them down from the crime scene. we will bring you names as soon as we get those. a 16-year-old from long view confronted an intruder that broke in the house in the middle of the day. his quick action helped them catch the suspect. cody lane said the suspect broke in through a window. he grabbed a bat to defend himself. he said he was just trying to hide. he wasn't taking any chances and told la fever to leave through the window he came in. >> i couldn't let him be here. >> his father arrived home for the lunch break as la fever ran

he chased him town helping arrest la fever. mecklenburg county health officials want people to stay away from parts of little sugar creek saying it's contaminated. it is between east 36th street in a trib tower at east 27th street had high levels of pce and tce. the county is investigating what caused it. weather and traffic every 10 minutes here is keith monday in severe weather center 9. where we are starting out chilly. >> chilly all day. we will have limited sunshine. the clouds take over quickly. we won't warm up any more, probably a few degrees cooler. mountains are in the mid-20s. here is the timeline of temperatures. we warm to the mid-40s to upper 40s by midday. that is a few degrees behind pace of yesterday. mountains in the 30s all day long. we try to shoot for 51 or 52 at best.

here is the inner loop, outer loop getting thick as well. no big issues here. good news. coming from the west side from gaston on 85, 19 minute mark on 321. i'm in the breaking news center following two stories. hickory officers charged this man for a murder in a busy mcdonald's parking lot. they caught eric yount about 30 miles away three hours after last night's shooting. police say yount shot richelle lail and cod by watts who workers say -- cod by watts who are workers. officers believe this is part of a domestic argument. a witness said it happened near the mcdonald's play area. >> it makes me want to hold my kids tight. you never know what will happen.
